The Supreme Court (SC) on September 3 ordered the Government to release Khadga Prasad Bishwakarma, spokesperson for Netra Bikram Chand-led Communist Party of Nepal (CPN) objecting to the repeated arrest of Bishwakarma, reports The Himalayan Times.Police had arrested Bishwakarma for the first time on August 7 on charges of seeking donation illegally. However, in response to a habeas corpus petition filed on behalf of Bishwakarma, the SC had termed his detention illegal and ordered the Government on August 17 to release him from custody. He was rearrested the same day on the charge of arson and organised crime. He was arrested for the third time on August 23.

Government has failed to formulate even a single law essential for the implement of the newly-introduced fundamental rights even as the constitutional deadline for enacting such laws ends on September 19, reports Republica on September 4.Altogether 15 bills related to the implementation of the fundamental rights as envisioned by the present constitution, have either been just tabled in parliament or have just been forwarded to the various parliamentary committees so far. Most of the parliamentary committees have not held even a single meeting to discuss such bills, as these committees have yet to elect their heads.Only the legislative committee of the upper house has been holding discussions on the bills relating to fundamental rights.

Netra Bikram Chand-led Communist Party of Nepal (CPN) Spokesperson Khadga Bahadur Bishwakarma was released on bail after he was presented at District Court Bhojpur on September 5, reports The Himalayan Times.The court’s Information Officer Maniram Pokhrel said that Bishwakarma was presented at the court in cases related to improvise explosive devices, arson and murder.However, he was released later after posting NR 60,000 in bail after a single bench of judge Harishchandra Ingnam gave an order to this effect. The court sought NR 25,000 bail for his involvement in exploding a device at Tyamkemayu Rural Municipality on November 14 last year. Likewise, NR 25,000 and NR 10,000 were sought for exploding explosive devices at Shadananda Municipality and Salpasilichho Rural Municipality during an election publicity gathering of the communist alliance last year.

During a meeting with a delegation led by Deputy Chair of Afghanistan High Peace Council Habiba Sarabi, Vice-President Nanda Bahadur Pun said Nepal’s peace process is exemplary, reports The Himalayan Times on September 11. “The countries in conflict can learn a lot from Nepal’s peace process. I am very pleased to learn about the beginning of peace process in Afghanistan. A lot of things can be learnt from Nepal. Both sides should seek a meeting point. Peace process can advance only when the conflicting parties ascertain a meeting point. There can be no meeting point if conflicting parties stick to their stances. You can learn something from Nepal, we are ready to extend our support, if needed,” Pun told the Afghan delegation wishing for the success of the peace process in Afghanistan.

The RJP-N has sent circulars to all its District Committees to stage demonstrations and organise protest rallies against Constitution Day on September 19 and stage a black out from 7pm to 7:15 pm among other protest programmes on the same day. The letter signed by RJP-N Presidium coordinator Mahanta Thakur has been kept a secret. “The new constitution was forcefully promulgated on September 19 even though we had been expressing dissatisfaction from the street. The government did not hear our grievances and opened fire on protesters. That is why we will protest in any form on the Constitution Day,” RJP-N spokesperson Krishna Singh said.

Less than five months to the end of the extended tenure of the two transitional justice bodies, little or no progress has been made in investigating the war-era cases of human rights violation as the Government continues to delay the release of funds necessary for the process, reports Kathmandu Post on September 18. The Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) have received no money for investigation despite their persistent lobbying for the funds since the beginning of the current fiscal year. The two commissions were formed in February 2015 with a two-year mandate to probe the cases of human rights violation during the decade-long Maoist insurgency, and to recommend action against the perpetrators. With their failure to accomplish the task, their terms have been extended twice, the latest one pushing it to mid-February 2019. This means both the TRC and the CIEDP have around five months to investigate 63,000 and 3,000 cases registered to them respectively. Out of the total NR130 million required for the CIEDP, the Government has released NR 40 million for staff salary, and NR 30 million to pay the experts and contract officials. But officials say there is no money for travel, which is critical to the investigation of thousands of cases. The situation at the TRC is worse. The commission needed NR 117 million for the current fiscal year, which includes salary, travel costs, and a stipend for employees, as well as allowances for the victims who need to travel to the TRC offices to record statements. The Government released NR 37.70 million from the state coffers in mid-July, while agreeing to transfer NR 80 million granted by Germany to the Peace Fund.

Police said four motorcycle-borne gunmen shot dead Khursid Ansari, chairman of a local school management committee, at the town centre before fleeing to India. As the gunmen were fleeing to India, they also shot Police Constable Shiva Poudel who had tried to stop them at Ghuksi Bazaar. The injured constable was taken to Dharan for treatment. Besides chairing the management committee of Rohiyan National Public School, Ansari was also the vice-chairman of Dawat-e-Islam, a Muslim social organisation, and a member of Nepal Communist Party (NCP). Friends and family members suspect that there is a powerful force behind Ansari’s death, the one that did not like his growing influence in the community. The Sunsari chapter of NCP condemned Ansari’s killing and demanded the authorities concerned to arrest the culprits and provide a suitable compensation to his family.

Khurshid Alam was working as a Principal of Raiyan National School and was shot dead by unidentified bike-borne gunmen. Alam was on the ‘radar’ of Indian Intelligence agencies as he was suspected to be involved in the 1993 Mumbai attack. Members of the group say there has been a broad understanding that the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) cannot complete their tasks without the parities’ commitment. Bhagi Ram Chaudhary, chairman of the Conflict Victims Common Platform, an umbrella body of victims’ organisations, told that there was a unanimous call for an alternative strategy. “Victims have lost faith in the TJ bodies and even in the political parties. Annoyed by and impatient at the delays by the transitional justice bodies and the federal Government in finalising the reparation policy, conflict victims have started reaching out to the local Governments for priority while formulating the local policy—one of the many reparation measures, reports Kathmandu Post on September 30. Leaders of the Conflict Victims Common Platform (CVCP), an umbrella body of 13 organisations advocating justice of war-era victims, have started dialogue with the chief and other members of local Governments for recognition of the victims. CVCP President Bhagiram Chaudhari has consulted with eight local governments in Bardiya district, one of the districts with the highest number of enforced disappearances during the Maoist insurgency. With the powerful local Governments in place, the conflict victims want their role in the reparation programme. “We have consulted with different local governments and they have agreed to take initiatives for reparation. This would be a step forward in consoling the victims who have been completely ignored by the federal government,” Chaudhari told.

Without naming, he hinted at CK Raut, who has been campaigning for Free Madhes. Thapa’s statement comes in response to increasing concerns including from ruling party leaders over a rise of forces making secessionist remarks. Claiming that the government curbed violence in the last six months, Home Minister Thapa said the administration was committed to maintaining law and order. “Secessionists attempting to create instability in the country won’t be spared,” Thapa told the reporters at Biratnagar Airport on Sunday. Fresh activities of Raut including his “offensive” remarks raised eyebrows in the public. The Raut-led Alliance for Independent Madhes (AIM) organised protest programmes in different parts of the Tarai on September 19 when the country observed the Constitution Day. Even senior leaders of the ruling Nepal Communist party (NCP) have started raising serious concerns against such activities and the government’s inaction.
