Peshawar High Court (PHC) Chief Justice Dost Mohammad Khan on June 4 observed that in the present security situation and after the passage of 18th Amendment, law and order was provincial subject and the Act dealing with the Frontier Constabulary was apparently now a dead law, reports Dawn. Heading a two-member bench the PHC Chief Justice observed that now it was up to the Attorney General (AG) for Pakistan to come and assist the court on what grounds the Frontier Constabulary could be deployed in rest of the country apart from Khyber Pakhtunkhwa. The bench observed that times had changed now as there were important cases related to the federation before the superior courts and now there should be an AG for each of the provinces. The Chief Justice recalled that despite issuance of notices in several cases the AG did not turn up as there were important cases before the apex court. The bench observed when the British Government had set up Frontier Constabulary Act 1915 and declared its headquarters in Peshawar which clearly manifested their intention that the force was meant for the areas between Khyber Pakhtunkhwa and Federally Administered Tribal Areas (FATA). The PHC Chief Justice observed that in present security situation and after 18th Amendment maintenance of law and order was exclusive domain of Provincial Government, therefore the Frontier Constabulary Act appeared to be a dead law.

He implored the Government and the Chief Justice to take notice of missing party workers. He claimed that Lyari town of Karachi is no longer in control of Pakistan People’s Party (PPP), but has become the hub of criminals. He asked the Sindh Government to stop supporting Peoples’ Aman Committee (PAC) which he claimed was responsible for the killing of MQM party workers. BNP-M leaders these days are visiting different Districts to ask the party’s workers and sympathisers whether it’s elected members in the assemblies should remain part of the system or quit their seats. The copy of resolution indicates that drone attacks conducted earlier by the American Central Intelligence Agency (CIA) and now by the Pentagon through direct missiles fired on Pakistani territory are a violation of Pakistan’s sovereignty. The resolution stated that the NA seeks to remind the Government of its obligations on the drones issue in view of the April 2013 judgement of the Peshawar High Court on a writ petition in which the court decided, inter alia: “Under the Constitution of Pakistan, 1973 particularly Article 199 thereof put this court under tremendous obligation to safeguard & protect the life & property of the citizen of Pakistan and any person for the time being in Pakistan, being fundamental rights.” The resolution said that the United State (US) drone attacks violate the Geneva Conventions (1949). It notes that drones do not even provide the suspects a chance to surrender and any person having characteristics of a militant are targeted by signature strikes, without confirming the identity of the suspect.

"Pakistan held a sham trial that put Dr (Shakeel) Afridi away for 33 years. He has been tortured and has already spent over two years of his life in prison. Dr Afridi is a hero and we shouldn't be sending tax payer dollars to his jail keepers," Congressman Dana Rohrabacher said. "There is no doubt whose side Pakistan's leaders are on; their actions could not speak louder. Pakistan actively funds and directs terrorist organisations who murder American soldiers and civilians in Afghanistan and India. All Americans owe Dr Afridi a debt of gratitude; it is time we honour that," he said. Rohrabacher is also offering an amendment that would ensure Pakistan is not using its military or any funds or equipment provided by the United States to persecute minority groups for their legitimate and nonviolent political and religious beliefs, including the Balochi, Sindhi, and Hazara ethnic groups and minority religious groups, including Christian, Hindu, and Ahmadiyya Muslim. The allocation for the three defence services amounted to 15.7% of the federal budget of PKR 3.99 trillion for fiscal 2013-14, according to official budget documents presented in Parliament. The army got the lion's share of the outlay with PKR 301.54 billion. The air force was allocated PKR 131.18 billion while the navy got PKR 62.80 billion. The documents further showed that the Government had allocated PKR 2,300 million for the defence production division in the public sector development programme for 2013-14. Of this, PKR 2,246.30 million has been allocated for installing a ship lift, transfer system and associated machinery and equipment to provide docking and repair facilities for surface ships, submarines and commercial vessels at Karachi port.

He said on the Prime Minister’s instructions, the Special Assistant to the Prime Minister had summoned the US charge D’affairs to convey a strong message that the drone strikes violate Pakistan’s sovereignty, international law, UN Charter and the norms of inter-state relations. Protesting at the high level shows the importance the government attaches to this matter, he added. The farmhouse, at Chak Shahzad, a village in Islamabad (Federal capital), had earlier been declared a sub-jail. Baloch leader Nawab Akbar Bugti was killed in a cave Aug 26, 2006 during a military crackdown ordered by Musharraf who was president and army chief at the time. "We are still in a state of shock at the martyrdom of our deputy chief and there is no change in our decision of not talking to the government," TTP spokesman Ihsanullah Ihsan said."We had offered dialogue and wanted to talk to everyone, but the political government has no power and the powerful establishment has never shown seriousness for a peace dialogue," Ihsan said on phone from an undisclosed location. The TTP withdrew its offer of dialogue with the new Pakistan Muslim League-Nawaz (PML-N) Government a day after Ihsan confirmed on May 30 that Rehman was killed with six other militants in a US drone strike in North Waziristan Agency (FATA). Pakistan is working on a new policy to stop the United State (US) drone strikes, which are a contravention of the country's sovereignty and counter-productive for the campaign against terrorism, advisor to Prime Minister on foreign affairs and national security, Sartaj Aziz said on June 18, reports The Times of India. A new policy is being evolved to stop drone attacks and Pakistan is hopeful that it will succeed in ending the campaign by the spy planes, added Sartaj Aziz. Pakistan has already conveyed its 'serious concerns' over drone strikes to the US and it will continue to raise the issue at all forums, he said. Pakistan has adopted a clear policy on drone strikes' which are 'counter-productive' in countering terrorism and a contravention of the country's sovereignty and integrity, he said. Giving details of drone strikes within Pakistani territory, Aziz said 115 attacks were carried out in 2010, 62 in 2011 and 45 in 2012. 13 attacks have been carried out so far this year, he said. One drone attack was carried out after the current government assumed office. "Instead of pursuing a policy of threat' we need to resolve this issue through talks," said Aziz.

According to the statement, the state forces are carrying out a lengthy military offensive in Kalat District for the past many days. Several areas, including Kabu, Isplinji and Mangochar, have been attacked by the forces and Baloch residents are being targeted indiscriminately. Dozens of the houses of Baloch civilians have been attacked, looted and destroyed. Every kind of medical and food access has been denied to the residents by the forces since the start of the offensive on June 1. Casualties are also feared as the areas remain under tight siege and continuous assaults of the forces. The Government welcomed on June 21 the prospects of talks between the United States and Afghan Taliban and expressed the hope that the initiative would lead to peace and stability in the region, reports Dawn. “The Nawaz Sharif government firmly believes that dialogue and reconciliation are the only way forward in bringing permanent peace to the region,” Interior Minister Chaudhry Nisar Ali Khan said during a meeting with US Ambassador Richard Olson at the Interior Ministry. “It is a matter of satisfaction that Pakistan is able to play a role in this process (Taliban-US breakthrough),” a spokesman for the interior ministry quoted Chaudhry Nisar as having said. Chaudhry Nisar called for stability of the region after the withdrawal of US troops from Afghanistan in 2014 and handing over of security to Afghan forces. Olson thanked Pakistan for its positive role in the forthcoming talks and assured that all stakeholders would be taken into confidence before reaching any conclusion. The meeting discussed issues of mutual interest and the coming Doha talks between the Taliban and the US.

According to the Citizens Police Liaison Committee (CPLC), abduction-for-ransom ‘industry’ is booming in Karachi as this industry has generated huge money at the cost of life and peace in metropolis, Daily Times reported on June 23. The data available to the sources in CPLC says that within few months, from January to June 2013, about 74 such cases have been registered. In year 2012, there were 132 such cases registered at various Police Stations of the city. SSP Anti Violent Crime Cell (AVCC) Niaz Ahmed Khoso said that 66 of the total 74 abducting cases were resolved, while Police is trying hard to recover the remaining eight victims still in the custody of abductors. However, sources said most of these cases were settled after paying ransom money to the captors. The trend of abducting for ransom is the easiest way to make money. Abductors demand money for the release of abductees, where majority of people are willing to pay ransom for the release of their loved ones. Sources privy to the matter said that areas including Super Highway, Northern Bypass, Gulshan-e-Iqbal, Defence, Gulistan-e-Jauhar, Shah Latif Town, Gadap Town and Bin Qasim Town are most hit by this menace. CPLC revealed that majority of the affected families declined to register the case and also restrained Police from interference for recovery of victims. They pointed out that there are two kinds of abducting gangs operating in the city. The major groups are operating from interior Sindh, where such sort of group has been operating for long, whereas, the recently emerging groups hold affiliation with different terrorist organisations.

FIA’s Deputy Director Khalid Rasool appeared before ATC-I Special Judge Chaudhry Habibur Rehman and presented the charge sheet against Musharraf and listed him as the main accused in the light of a statement recorded by US journalist Mark Siegel. The court directed Musharraf to appear before it on July 2 and adjourned the hearing till the date. The charge sheet also contained the statements of four witnesses, including that of the US journalist as well as Benazir Bhutto’s own statement, in which she had said that Musharraf and three others be held responsible if she was assassinated. Commenting on the offer to resume peace talks with the newly elected Pakistani government led by Pakistan Muslim League-Nawaz (PML-N), the spokesman said the TTP is closely monitoring the policies and activities of the Pakistan Tehreek-e-Insaf (PTI) in Khyber Pakhtunkhwa and PML-N in the Centre. He also said that the TTP supports peace negotiations between the US and the Afghan Taliban, a week after the Afghan insurgent leaders opened a political office in Qatar. Ehsanullah Ehsan said that the organisation had vowed allegiance to Mullah Omar and that any decision taken by the Afghan Taliban chief would be accepted. "We accept all decisions taken by Afghan Taliban as we are their part,” he claimed. In a separate interview with Dawn, Ehsan said that situation in Afghanistan and Pakistan are totally different from each other and administratively, the US-Taliban talks would not affect the situation of TTP in Pakistan. TTP sources said hundreds of militants comprising Lashkar-i-Toiba (LeT), Ansarul Islam (AI), 'Mohmand force' and other local militias (Lashkars) were part of a joint attack on Pakistani Taliban positions in Afghanistan. Earlier, reports had said that the Afghan Taliban were also backing the attacking groups but later the TTP requested Afghan Taliban ‘chief’ Mullah Omar to intervene and as a result the clash was averted. Rival groups have now initiated another attack of which the Afghan Taliban are not a part, said TTP ‘commander’. Mukarram Khurasani, ‘spokesman’ for the TTP's Mohmand chapter ‘chief’ Omar Khalid, told Dawn that hundreds of militants had attacked the TTP positions in Shongrai and the bordering village of Jarobi Darra. Khurasani also accused LeT ‘commander’ Haji Abdul Rahim of leading the attackers. The Shah Khalid group is also supporting the attack. Disappointed over Pakistan's slow pace of trial in 26/11 terror attack case, a top American Congressman Ed Royce, chairman of the powerful House Foreign Relations Committee has demanded that the seven suspects, including Lashkar-e-Toiba (LeT) operational commander Zakiur Rehman Lakhvi, be handed over to the International Criminal Court (ICC), on June 27, reports The Times of India. "There are seven individuals that need to be brought to justice (for their role in the 26/ 11 attack case)," said Congressman. "If Pakistan cannot try them, turn them over to ICC for crimes against humanity, for what they did in their collusion, in their culpability for what happened," he said. The seven Pakistani suspects have been charged with planning, financing and executing the attacks that killed 166 people in Mumbai in November 2008. A Rawalpindi-based Anti Terrorism Court (ATC) had been handling the case since 2009 though the judge has been changed five times. Addressing a select group of Indian-Americans at a Congressional reception at the Capitol Hill organized by the American India Public Affairs Committee, Royce said both India and the United States are facing challenges from terrorism. Royce said some $100 million has been traced going from the Gulf States to Pakistan's 600 Deobandi schools; which, according to him, are factories of radicalism. "Ethnic cleansing is going out in Pakistan today those who are speaking against it," he said, alleging that the population of Hindus in Pakistan has now dropped to 1.5%, against 25% at the time of independence.

According to a Police, the militants were Khalilullah of Mirkhel, Swat and Khawaja Mohammad of Kalwal, Mansehra and aged between 20 and 26 years as shown by their computerised national identity cards seized after the encounter. The encounter began after militants shot down constable Shaukat of special police force in Rahimabad on June 26-evening. Shaukat accompanied by two policemen had stopped militants to prove identity. After the killing, the militants barged into the house of daily wager Gul Yar and took positions there. There followed exchange of fire between them and Police. The encounter left the house completely destroyed and a Policeman injured. In a news release issued here, Police said they had seized two pistols, four chargers, 50 cartridges, a hand grenade, a knife and two cell phones carried by militants.

According to a report sent to IGP Sindh Shahid Baloch, it was mentioned that during the aforementioned period, overall 24,385 accused were arrested including 2,213 proclaimed offenders, 15,138 absconders, 73 abductors, 66 terrorists and 5,699 dacoits. In these actions 524 gangs were busted. Sindh Police, in these raids, recovered 1458-kg explosives, three rockets/ rocket launchers, 204 hand grenades, 55 bombs, five suicide jackets, 4403 pistols/ revolvers, 139 rifles, 194 SMG/ AK-47, six MP-5, two LMGs, one anti-aircraft gun, two G-3 rifles and 415 shotguns/ repeaters. The Karachi police, during the same period, arrested 9548 accused including 4694 absconders, 473 proclaimed offenders, 23 kidnappers, 65 terrorists and 4403 dacoits/ criminals. The city police busted 46 gangs in action against criminals. Two LMGs, two G-3 rifles, six MP-Fives, 111 shotguns/ repeaters, 80 rifles, 3068 pistols/ revolvers, four suicide jackets, 203 hand grenades, 51 bombs, two rocket launchers and 1458-kg explosives were recovered in these raids. In 2013, till June, around 273 persons were abducted from various parts of the Karachi (Karachi District), the provincial capital of Sindh and their bodies were later found dumped in gunny bags, on June 30, reports Daily Times. The recovered bodies carried marks of severe torture before they were being shot, tortured to such extent that many of them are still lying unidentified in morgues. As many as 92 bodies were recovered from Lyari and its adjoining areas including Baghdadi, Chakiwara, Eidgah, Pak Colony, Kharadar, Old Golimar, Garden and Kalri. The remaining bodies were recovered from other areas including Malir, Gulshan-e-Iqbal, Nazimabad, Rizvia, Landhi, Khokhrapar, Shah Faisal Colony and Orangi.

Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan on June 30 called for formulation of a policy by the Prime Minister Nawaz Sharif in consultation with the Chief of Army Staff (COAS) General Ashfaq Parvez Kayani and PTI to deal with terrorism in Khyber Pakhtunkhwa, reports Daily Times. Addressing a convention of the party, Imran Khan said there are different forms of terrorism in Federally Administered Tribal Areas (FATA), Khyber Pakhtunkhwa, Karachi and Balochistan, which will have to be dealt with through different means. He said he has written a letter to the Prime Minister for the formulation of a national policy in consultation with political and military leadership to deal with terrorism. He said terrorism could not be overcome in Khyber Pakhtunkhwa unless the prime minister, the chief of army staff and the Khyber Pakhtunkhwa Government sit together and arrive at a consensus formula. They will have to hold dialogue with Tehreek-e-Taliban Pakistan (TTP) at political level, he added.
