The interlocutors on Jammu and Kashmir (J&K) on November 2 submitted their report to Union Home Minister P Chidambaram after their maiden visit to the State, with their leader Dileep Padgaonkar saying he is "hopeful" of a solution of the issue but did not have a "magic formula", according to Daily Excelsior. The three-member group briefed Chidambaram about its visit to J&K and presented its report which included recommendations. "This was our first visit to the State. We gave our set of recommendations," Padgaonkar said but refused to divulge details about the contents of the report. The interlocutors undertook their six-day visit to the State from October 23.

As part of its outreach in Jammu and Kashmir, the Ministry of Home Affairs (MHA) has finalized the surrender policy for those who have crossed over to Pakistan-occupied Kashmir (PoK) and now want to return even though the initiative will not offer an unqualified general amnesty, according to Times of India. If there are cases of a serious nature against militants wanting to surrender, they will be prosecuted while cases of crossing into PoK will be reviewed separately. The policy has been sent to Jammu and Kashmir Government in September and is likely to come up for discussion in the next State cabinet meeting, said a senior State Government official. The policy will be implemented after it is passed in the Jammu and Kashmir Assembly.

The activists of Jammu and Kashmir NGO Forum, a conglomerate of several NGOs, were demonstrating against loss of INR 270 billion, which has affected all sections of the society as a result of four months continuous strikes. Commenting on opposition to the withdrawal of AFSPA, the Chief Minister said, "No right-thinking person can turn around and tell you that AFSPA should be revoked in one shot. It is not possible at a point where you still have militant encounters and things like that going on. The overnight revocation of the AFSPA from the entire State is not possible. He, however, said there are areas where the Army has "virtually no presence and virtually no role to play". "It is in those areas that we are contemplating withdrawing the Disturbed Areas Act which will then automatically mean that the AFSPA does not apply there," the Chief Minister said. Omar also said the State Government has started moving back the forces and the recent dismantling of 16 bunkers in Srinagar was a first step. "We hope to continue until we reach a level where the visible presence is greatly reduced," he said.

Troops noticed heavily armed group of militants near the Line of Control (LoC) in Tangdhar sector in the morning and challenged them, official sources said. The militants opened heavy and indiscriminate firing towards the troop’s positions, which was retaliated, triggering off an encounter. Two militants were killed in the exchange of firing that was going on till last reports came in. Although group affiliation and identity of the slain militants could not be ascertained immediately, they were believed to be foreigners and affiliated to Lashkar-e-Toiba (LeT). There has been an increase in infiltration bids along the LoC since September 2010 and more than 65 militants have been killed in over two dozen bids made over past two and half months alone.

Release of a total of 12 PSA detenues for a period of three months was ordered by the Unified Command. Release of Shabir Shah from Kot Bhalwal jail was also delayed as he had declined to meet the conditions on the ground that he had never asked for the release and was not a stone pelter. Later, the Government had waived off conditions for his release on parole for one month due to sickness of his mother. Sources said the Government could review PSA cases of some more detenues shortly. Further, Director General of Police Kuldeep Khoda said the cases of 50 to 60 separatists and stone pelters will be reviewed from time to time depending upon the situation.

Two Central Reserve Police Force (CRPF) personnel, identified as head constables Balram Teja and Om Prakash, were killed by the militants in an attack in the Pattan town of Baramulla District on November 10, reports Daily Excelsior. The militants struck in Pattan market at around 11.45am (IST) as the CRPF personnel were on a patrol duty, official sources said. They said the pistol (fitted with silencers)-borne militants shot at two CRPF personnel from close range and targeted their heads. While one of the troopers died on the spot, the other succumbed to injuries later. The deceased paramilitary troopers have been. The militants also decamped with the service rifles of both the deceased personnel, the sources added. A CRPF spokesman, however, said the weapons were recovered later. "The CRPF jawans exercised utmost restraint while dealing with the situation as the market was crowded and any retaliation could have lead to civilian killings," the spokesman said, adding that inflicting collateral damage at the hands of the Security Forces seemed to be the primary aim of the militants.

The DGP said, "At least 500 terrorists of various terror outfits including 300 in Kashmir Valley and roughly 200 are still active in Jammu", adding that the number of active militants is coming down due to sustained anti-terrorist operations by joint teams of SFs. He said all the agencies involved in the security grid are having perfect synergy and information is leading to successful anti-insurgency operations carried out in State. Security Forces (SFs) launched a search operation in Chanakhan locality of Sopore town following information about presence of militants in the area, official sources said. As the search party reached the target house, the hiding militant opened indiscriminate firing on them, resulting in injuries to one Policeman, who later succumbed to injuries. The SFs returned the firing leading to fierce gun battle that lasted nearly eight hours and ended with the killing of the militant. They said the house belonging to one Altaf Ahmad Najar, where the militant was hiding, was blasted by the SFs, resulting in damage to the building. Some arms and ammunition were recovered from debris of the house. The identity and the group affiliation of the slain militant could not been ascertained, the sources said.

On November 15, Pakistan's envoy Amjad Sial told the General Assembly debating the annual report of the UNSC that the absence of the J&K issue was "inadvertent". However, while welcoming the UNSC report, Indian diplomats said the issue has not been part of any UNSC report since 2006. In 2005, then UN secretary general Kofi Annan declared that the "plebiscite" issue could not be enforced or self-implemented. It was after Annan's remarks, made in the context of resumption of India-Pakistan dialogue in 2005, that the UNSC dropped reference to the dispute. In the past five years, there has been no such mention. The India-Pakistan issue has not been debated in the UNSC since 1965.

Police said 17 year old Junaid Akram Malik son of Reyaz-ul-Hassan Malik, a resident of Sangram Bhatta in Kishtwar District, presently putting up at Bhatindi in Jammu joined Hizb-ul-Mujahideen (HM) in the Dachan area of Marwah forests. Azhar Ali Bhat, 28, son of Ghulam Mohammad Bhat, a resident of village Kijaie in Asthan Payeen area of Kishtwar District, who had taken Junaid to Dachan forests for his recruitment and training, was arrested by the Police in Kishtwar on November 16. Police said Azhar was associated with Amir Kamal alias Akram, a ‘B’ category militant of HM, who was active in the Dachan area of Marwah for past quite sometime. It was on the directions of Amir Kamal that Azhar had recruited Junaid into the militancy after visiting his house twice in Jammu. Junaid was picked up from Kishtwar bus stand and handed over to HM operative Irshad Ahmed, son of Ghulam Mustafa Akhoon, a resident of Lidri in Dachan. Akhoon has also been arrested by the Police. After taking Junaid to Dachan, Irshad handed him over to ‘Chacha’ a known trainer of HM. Chacha later introduced Junaid to Amir Kamal alias Akram. Irshad Ahmed is a Rehbar-e-Taleem (ReT, Teaching Guide) teacher at primary school in Lidri.

Although sources said four civilians were injured in the clashes between the Police and the protestors, a Police spokesman said only one civilian sustained injury in the incident. The clashes took place at several places in Srinagar, Baramulla and Pulwama Districts shortly after Friday prayers, the sources said. Some protesters attempted to disrupt peace at Muran Chowk and Rajpora Chowk in Pulwama District town by resorting to heavy stone pelting, the sources said, adding SFs used minimum force and chased them away. A protestor received injury in the process. Similar incidents were reported from Baramulla District and Sopore town. One protestor was injured in the Police action. One pistol, one grenade, one radio set, one mobile telephone, one torch and a bag full of dry fruit were recovered from the possession of the slain OGW. Official sources said Qasim Din had also led a Police team in the encounter in which Shaffi was killed while Bashir Gujjar had escaped. Meanwhile, people in Nagnigarh and surrounding areas held a demonstration in the morning of November 21 to protest the killing as they described the OGW as a civilian. Sources said Habib Gujjar along with his two associates forced his entry into the house of Qasim Din and held his brother Noor Din as hostage. Habib wanted to take Noor Din with him. However, Noor Din’s 55 year old mother Gujra Begum came to the rescue of her son and grappled with the militants. Sources said Habib Gujjar opened firing on Gujra Begum and killed her on spot. He also tried to kill Noor Din but he survived. Qasim Din’s wife and two children sustained minor injuries. Later, Habib Gujjar along with his two associates escaped from the incident site. Official sources said Inqullabi after executing his mission in New Delhi wanted to flee to Nepal or Bangladesh via Gorakhpur in Uttar Pradesh or West Bengal respectively on way to Pakistan as he had completed more than 10 years of militancy in Jammu and Kashmir. Reports further indicate that not only Shehnaz but also her parents — Bashir Bakerwal and Qasim Jan had later also joined the militancy on being lured by Inqullabi. Qasim Jan was arrested by Shopian Police along with a HM militant early this year while transporting arms and INR 4.4 lakh worth hawala money for the militants, Shehnaz and Bashir Bakerwal alias Nissar were arrested by Rajouri Police on November 15. Army and Police on November 25 killed three Pakistani militants of Lashkar-e-Toiba (LeT) after a three day long operation at Marha in upper reaches of Sailan in Surankote tehsil (revenue unit) of Poonch District, reported Daily Excelsior. Official sources said all three militants were killed after daylong heavy exchange of firing with troops. The militants were being searched since evening of November 23 when first contact with them was established at Marha in which a Special Police Officer (SPO) was injured. However, the militants had managed to escape then. A contact with the militants was established in Sailan forests in the morning of November 25. The militants lobbed grenades and opened firing on the Security Force (SF) personnel, who retaliated. Later, the militants entered a dhok which was blasted by the SF personnel in which all three militants were killed. The encounter ended late in the afternoon with the recovery of dead bodies of all three militants. An Army soldier and a civilian identified as Subba, a resident of Marha, were injured in the firing. Also, four Army soldiers were wounded when a tree fell on them with the impact of a rocket launcher fired by the troops towards the dhok where the militants had been hiding. Recoveries made from the slain militant’s possession included three AK rifles with four magazines, one pistol, one Under Barrel Grenade Launcher (UBGL), one Thoraya satellite telephone, three mobile telephones, 98 used cartridges, two pistol magazines, three bags and a set of documents.

"The repair work on the tracks and railway stations, which bore the brunt of violent protestors during the recent unrest, will commence from tomorrow and we are expecting to resume the operations within a week," an official of the Northern Railway told Daily Excelsior. The rail service, connecting North and South Kashmir, was suspended on July 31 after unruly protestors attacked the trains, damaged tracks and ransacked railway stations at several places in the Valley. Over 130 non-Kashmiri staff also fled in the wake of the unrest. Prime Minister Manmohan Singh inaugurated the Valley's first rail service between Anantnag to Budgam District on October 11, 2008. The second phase of the train between Budgam to Baramulla was flagged off on February 14, 2009 followed by the third phase between Anantnag to Qazigund on October 28, 2009. Barring an IED blast by suspected militants on the track in Pulwama District on April 2, 2010, the service was a big success before worsening of the law and order situation in the Valley on June 11.

On the basis of information provided by Baloch, the SFs neutralized the hideout in Waripora falling under the jurisdiction of Pattan Police Station and recovered two solar rockets, four explosive rods, four Improvised Explosive Device (IED) circuits, five kilograms of explosive powder, six IED detonators, one pistol along with magazine and six. One AK magazine, 121 rounds of AK ammunition, satellite phone with two batteries, one radio set, one binocular, one anti tank mine, four IED pipes, two IED fuse and one Chitra uniform were also seized. The State Government on November 25 ordered withdrawal of nearly 1000 Central Reserve Police Force (CRPF) personnel from Srinagar town besides removal of 10 more bunkers as part of its peace initiative to make life easy for the people of the State, reported Daily Excelsior. Chief Minister Omar Abdullah cleared the proposal after assessing the law and order situation in the Valley, official sources said. According to the sources, 10 more bunkers will be removed from Srinagar city raising the number of bunkers removed to 26 since October 5. A plan had been worked out by the local Police with the CRPF in consultations with the security agencies for withdrawal of one battalion of the CRPF (1000 personnel) from the city. Earlier, as per the decision of the unified headquarters, 16 bunkers were to be removed. The CRPF has been assisting the State Police in maintenance of law and order in Srinagar and other towns and its personnel are manning the bunkers dotting the city. The Centre had also requested the State Government to review the deployment of Security Forces in Kashmir valley with particular reference to de-scaling the number of bunkers and check-points in Srinagar and other towns, and to review the notification of areas as ‘disturbed areas’.

"The training camps of LeT and other outfits were still active in Pakistan and its occupied Kashmir, despite a crackdown launched by the authorities there," Mohammad Saleem Rehmani alias Abu Saad, a resident of Nawab Sahib area of Sindh in Pakistan, told reporters. "About 250 to 300 militants were with me during the Daura-e-Khas (advanced course). We were being trained in handling weapons and launching attacks on security forces in Kashmir," the militant, who was part of an eight-member infiltrating column and managed their entry through Lolab sector of Kupwara District, said. Rehmani claimed that the permanent training camps were sealed by Pakistani authorities after 26/11. However, he added that various make shift camps have come up in the forests to facilitate the training of the recruits. He admitted that Pakistani Army was helping the militants to infiltrate into Jammu and Kashmir. "There are four to five launching pads active in 'Azad Kashmir' where 45 to 50 militants are always ready to infiltrate. When they are given green signal by the Army, they cross over," he said. Expressing his ignorance about involvement of Pakistani Army in training militants, he said, "I have not come across any Army officer during my training at several camps in Pakistan and PoK." "There is a concrete evidence that the recent agitation was planned," Sahai said, adding, Police have found evidence that Lashkar-e-Toiba (LeT) militants planned the unrest and were in league with the separatist politicians. "As our investigations are making headway, we find that increasingly there is a very well-planned operation on part of the Lashkar to carry out incidents of stone-pelting and arson," he said. Sahai said Ghulam Mohammad Tantray, the tehsil (revenue unit) president of Tehreek-e-Hurriyat (TeH) in Sopore town, had stayed with LeT ‘commander’ Furqan and was also maintaining contact through telephone with him. "There are the direct evidences to show how militant organisations and the so-called separatist leaders, who are leading a so-called peaceful agitation are very deeply linked," he added. The IGP said the recent upsurge in militant activity after the decline in the stone-pelting incidents was another link to prove that the unrest was planned. "Stone pelting has subsided and suddenly there is an upsurge in militant activity. There are arrests of Pakistani militants, there have been killings, this cannot be an innocent balance that once the stone pelting increases the militant violence decreases," he said. Sahai also claimed that during the interrogation of a stone-pelter in Sopore it was revealed that militants are hiding in a house in Sopore. "When the house was raided, we make some recoveries which included uniforms with badges of (different) ranks. We conclude that militants were planning to operate in uniform and these are the likely signs of fidayeen (suicide) attacks," he said. He said Police has busted a module of boys, recruited by a LeT operative from Batamaloo locality of Srinagar, who were involved in hurling grenades. Talking about training camps in Pakistan Sahai added, "The militant groups including Lashkar are openly motivating youth to train them for attacks on security forces in Kashmir. The militant has revealed that most of the camps and motivation centres, which were claimed to have been closed by Pakistan government, are still functional." Sahai said the militants were put through three courses before being selected for carrying out suicide attacks. "The first phase is Daura-e-Aam (ordinary training) followed by Daura-e-Khas. The best out of the second stage are selected for Daura-e-Lashkar (Lashkar or Army training) to carry out suicide attacks," he said adding it indicated the kind of training received by Rehmani before being sent here.

All three militants, identified as Mohammad Junaid, Mohammad Arif and Tahir, were part of Inqullabi’s team, which had been assisting him in moving from one part to another within the State and had also arranged his temporary stay in New Delhi, Police sources said. One of the arrestee was a TATA Sumo operator, who had dropped Chechi to Jammu from Shopian on November 7. The militants from the Central Asian region, identified only by their code names of Umar and Usman, were spotted from a photograph recovered by Police during a recent anti-militancy operation in Sopore in Baramulla District. The photograph shows the alleged Chechen militants armed to teeth with latest assault rifles and other ammunition. The sources said the duo has been active in Sopore for several months now and the Security Forces have launched special operations to track them down. The foreign militants are believed to have sneaked into the Valley in late spring or early summer during one of the many dozen infiltration bids launched by the militants from across the Line of Control (LoC), they said. The sources said more than 60 militants, mostly foreigners, are active in Sopore. Meanwhile, Inspector General of Police (Kashmir) Shiv Murari Sahai confirmed the recovery of the photograph. "However, the contents of the photograph need to be authenticated with regard to the location where it was taken and the nationality of those pictured in it," Sahai said.

Two Hizb-ul-Mujahideen (HM) militants were killed by the Security Forces (SFs) in a 16-hour-long encounter in a deep natural cave at Kalamul forests on the outskirts of village Budi in the Gandoh area of Doda District on November 28, reported Daily Excelsior. The slain militants were identified as Tauseef Ahmed and Imtiyaz Ahmed. While Tauseef was an ‘A’ category militant, Imtiyaz belonged to ‘B’ category. The duo had joined militancy in 2008 and was involved in a series of subversive activities. The slain militants were operating with Ghulam Nabi ‘Gama’, a ‘district commander’ of the outfit under the overall command of HM supreme in Doda-Kishtwar, Shah Din Khandey. Gama is the only hardcore militant now left in Gandoh along with his two body-guards. A Light Machine Gun (LMG), looted from a Police post along with other weapons from Chilyas Police post on September 9, 2006, was also recovered from the possession of slain militants along with one pistol, magazines and rounds of both the weapons, a mobile telephone which they had damaged before being killed and currency notes which they had torn inside the hideout. Police said the LMG had been looted by the HM militants along with three Self Loading Rifles (SLRs), one AK and one Insas rifles from the Police post on September 9, 2006.

Doda Police have initiated a process to attach the property of about 100 militants of Lashkar-e-Toiba (LeT) and Hizb-ul-Mujahideen (HM), who were involved in a series of subversive activities in Doda District, including killings, but were presently operating from Pakistan or Pakistan occupied Kashmir (PoK), Daily Excelsior reports. Proceedings to attach property of two ‘commanders’ —one each of LeT and HM — were set into motion on November 30 after Police got proclamation against the militants issued under Section 87 of the Criminal Procedure Code from the court. The militants against whom the process to attach property has been initiated, included Mohammad Amin alias Khubeb son of Dawood Bhat, a resident of (r/o) Kathwa, Thathri, a LeT ‘commander’, who has been operating as 'Launching Officer’ in PoK with the name of Gazi and Abdul Rashid son of Arsala Khandey r/o Khanpura in Thathri, who is reportedly based in a Muzaffarabad camp of HM in PoK. The militants have property in the form of houses, shops, and costlier goods etc. in Thathri and other places in Doda. The cases are being prepared to get proclamation against many other militants issued from the court to attach their property and send a stern message to the militants and their commanders that they could face action in the First Information Reports (FIRs) registered against them despite fleeing to Pakistan or PoK, official sources said. To avoid from getting their property attached, the militants would have to return and surrender. The State Government has already announced a Rehabilitation Policy for the militants under which they could return to the State from PoK.

Police on November 30 said that the three militants killed in the gun battle at a market place in Srinagar on November 29 were cadres of the Jaish-e-Mohammad (JeM) outfit and were also involved in the recent killing of two Central Reserve Police Force (CRPF) personnel in Baramulla District, according to Daily Excelsior. "The slain militants were working as a Jaish module which was headed by Waseem Raja Guru and the rented accommodation of Arshid Bashir was used as a hideout. The module was also involved in the killing of two CRPF men in Pattan area of Baramulla district on November 10," Director General of Police (DGP) Kuldeep Khoda told reporters. He revealed the identity of the slain militants as Waseem Raja Guru and Arshid Bashir, both residents of Sopore, and Zahoor Ahmad Hajam of Bandipora. Stating that the infiltration of militants from across the border continued across the State, Khoda said around 100 militants had managed to sneak into this side, even as more than 200 militants, including some top ‘commanders’ have been killed in 2010. About the number of active militants in the State, he said 400 to 450 militants were still at large which has forced their handlers across the Line of Control (LoC) to change strategy from time to time to carry out their designs. The DGP reiterated that there was a clear nexus between militancy and street protests in the Valley, which has come to the fore during investigations into the summer unrest. "More than 3000 persons were arrested in connection with fuelling or taking part in the street protests and stone-pelting incidents. Most of them have been bailed out or their detention has been quashed," he said adding "at present, we have 124 persons detained under Public Safety Act (PSA), 12 in judicial custody and 29 in police custody."

The three interlocutors appointed by the Centre for Jammu and Kashmir have suggested a number of administrative and Confidence Building Measures (CBMs) which have been forwarded to the State Government for necessary action, Union Home Minister P Chidambaram said on November 30, reports Daily Excelsior. Addressing a press conference, Chidambaram said the panel of three interlocutors — Dileep Padgaonkar, M M Ansari and Radha Kumar — have submitted their first report after visiting the State and talking to all shades of opinion. "The report suggests a number of administrative and confidence building measures. We have looked into them. We are in the process of urging the Jammu and Kashmir Government to look into them and implement as many as possible," he said when asked about the report of the interlocutors. The Home Minister said the first report of the interlocutors only suggested administrative and confidence building measures and has not dealt with any political issue. The interlocutors were appointed by the Centre on October 13 to hold a sustained dialogue with all sections of people in Jammu and Kashmir.
