India, on October 1, welcomed UN Security Council resolution No. 1373, passed on September 28, on combating international terrorism as a positive step and hoped that the resolve of the international community will now be translated into concrete action through its effective implementation and regular monitoring by the Council. An Indian External Affairs Ministry spokesperson, while speaking to the media in New Delhi, said the resolution indicated the global nature of international terrorism and the need for comprehensive international cooperation in combating it. The spokesperson added that India would continue to press for the early finalisation of the Comprehensive Convention on International terrorism mooted by it.

Union Home Minister LK Advani warned that the possibility of terrorists having access to weapons of mass destruction could no longer be ignored. Addressing a conference of State chief secretaries and police chiefs in New Delhi on October 5, he said, this possibility, therefore, called for very high degree of preparedness in managing internal security of the country, including expertise in disaster management. The Minister laid stress on greater cooperation and coordination between law enforcing agencies of the Union government and the States, and said a law to deal effectively with terrorism was required. Cabinet Secretary T R Prasad reportedly told the meeting that there was a proposal to form a National Disaster Management Agency (NDMA). It could be modeled after the Federal Emergency Management Agency (FEMA) in the US to handle the rescue operations like the aftermath of the September 11 terrorist attacks in the United States. Briefing the media on the conference, Union Home Secretary Kamal Pande said, " Almost all States were in agreement over a need for a law against terrorism and for creating the Central Law Enforcement Agency. Some states like West Bengal, however, wanted their turf (of law and order) not to be meddled with." He said several such crucial issues would again be discussed at the conference of Chief Minister to be held in November 2001. The conference recommended a minimum action plan to all States and Union Territories. These included: setting up a State disaster management agency with sub-units in all district headquarters and with Civil Defence and Home Guards in its ambit; drawing up lists of vulnerable targets including buildings, installations, monuments and important persons; training and equipping at least a company of State Armed Police for search and rescue work in all disasters; procuring search and rescue equipment like earth movers and cutters, as also sniffer dogs; strengthening fire and mobile medical facilities; revamping communication network.

A city court in Delhi, on October 6, rejected the bail plea of three arrested activists of the Students Islamic Movement of India (SIMI). The court said, " There is sufficient evidence on record to show that SIMI and its activists have been promoting ill-will against other religions by publishing the magazine 'Islamic movement' and through the audio and video tapes which have now been seized by the police." The SIMI activists were arrested on charges of raising provocative slogans in protest against the ban on the organisation on September 27. The court had asked the prosecution to substantiate the allegations by producing the audio and video evidence about their unlawful activities.

According to official sources, Delhi police has charge-sheeted six terrorists of the Jammu Kashmir Islamic Front (JKIF) for allegedly waging war against the Union government. Feroze Ahmad Mir, Mohammad Sayed Tantrik alias Yusuf, Mohammad Manzoor Mir, Mohammad Lateef Hajaam, Abdul Rashid Gojri and Inderjit Singh Bali have been charged under section 121 (Waging or attempting to wage war or abetting waging of war against government of India), section 121-A (conspiracy to commit offences punishable by section 121) and section 120-B (criminal conspiracy) while the rest four accused have been charged only under section 120-B of the Indian Penal Code (IPC). Police had arrested Feroze Ahmad Mir and Tantrik on June 20, 2001 from a guesthouse in the walled city area of the capital and seized Rs 15 lakh from them. Later, the other accused had been arrested.

External Affairs Minister Jaswant Singh, addressing a press conference in New Delhi on October 11, ruled out India playing a larger or more direct role in the current US-led campaign in Afghanistan or providing forces for it, saying it was neither necessary nor on the cards. He also ruled out India contemplating granting the US the right to establish permanent bases as were being reported. However, the Minister said neutralisation of terrorist bases in Afghanistan was of direct interest and benefit to India as terrorists of the Al Qaeda’s network were operating in Jammu and Kashmir. He also indicated India’s desire to play a role in the future dispensation of Afghanistan. Saying that India would like to have a process-based rather than personality-based structure, he added it was necessary to ensure that Afghanistan did not once again become a centre that radiated terrorism. While extending support for a broad-based multi-ethnic government, Singh rejected the suggestion that a moderate Taliban leadership could be part of it, saying the term was an oxymoron. The Minister said India will continue to exercise restraint on the issue of hot pursuit but feels this is not the right time for either a visit to Pakistan or resumption of dialogue. He said, for a dialogue to resume, it was necessary that the weapon of terrorism be discarded. Welcoming the recent OIC communique condemning terrorism, he expressed optimism that the current campaign against terrorism would be taken to its logical conclusion.

External Affairs Minster Jaswant Singh, while speaking in New Delhi after a meeting of the Cabinet Committee on Security (CCS), said, " I disagree with the assessment. We have disagreed with earlier also to this type of thesis being put up by the West. Rather than Kashmir, it was Afghanistan which is the flashpoint". According to official sources, the Defence Research and Development Organisation (DRDO), the National Institute for Communicable Diseases (NICD) and the Union Ministry of Home Affairs have started a programme to train doctors and formulate procedures to deal with possible attacks by terrorists using biological and chemical agents. DRDO Chief Controller RV Swami told the media that some sort of a ‘quick response team’ was already in place in Delhi to counter terrorist strikes using biological or chemical agents. The DRDO scientists visited leading hospitals in the national capital over the past week to brief doctors on coping with possible attacks, reports said. The DRDO has also developed a wide range of equipment, including suits, to protect people from the effects of nuclear-biological-chemical (NBC) strikes, and decontamination gear for the armed forces.

A Delhi court, on October 16, rejected the bail application of the two terrorists facing trial in the Red Fort shootout case in which terrorists of the Lashkar-e-Toiba (LeT) had stormed the Red Fort and killed two army personnel and a civilian on December 22, 2000. The court observed that the accused did not qualify for being released, as the allegations against them were very serious in nature. Earlier, on August 29, 2001, the court had rejected the bail applications of two other accused on the same ground. The accused terrorists have been charge-sheeted under various sections of the Indian Penal Code (IPC), the Arms Act and the Explosive Substances Act.

Addressing a joint press conference with Indian Minster of External Affairs Jaswant Singh, in New Delhi, on October 17, visiting US Secretary of State Colin Powell said his country’s war against terror included terrorism targeted against India. He said, "We deplore terrorism wherever it exists, whether on September 11 or on October 1 in Srinagar." He reiterated the US position that both the countries stood shoulder to shoulder fighting terrorism and ‘that includes the terrorism that has been inflicted on India’. The Secretary of State, however, skirted the issue of Pakistan’s role in terrorism in Jammu and Kashmir. Asked whether Pakistan should be included in the global coalition against terrorism, he said Pakistan had recognised the nature the Taliban government and was working with the US to fight the Al Qaeda. He also clarified that he had not said in Islamabad, on October 16, that Kahsmir was ‘the’ central issue between India and Pakistan, but ‘a’ central issue. He said the Kashmir issue must be resolved between India and Pakistan, but the US would be willing to help facilitate the talks. He also announced that Prime Minister Atal Behari Vajpayee had accepted an invitation from President George Bush to visit Washington on November 9. At the press conference, Jaswant Singh said India has assured the US of full cooperation in its action against Afghanistan. He said, India has also demanded that the US’ war against terrorism go beyond Afghanistan and address Pakistan-sponsored terrorism in Kashmir. The Minister admitted that there were differences on the Kashmir issue between India and the US and added, "We can disagree without being disagreeable." Separately, the Secretary of State and India’s Union Home Minister L K Advani signed a treaty on legal assistance in criminal matters. Official sources said the pact would enhance the ability of the two countries to pursue the common objective of law enforcement by putting in place a regularised channel for obtaining law enforcement from each other. The treaty would also improve the implementation of the bilateral extradition treaty signed between the two countries earlier in July 1999.

Delhi police have filed a charge sheet against two more terrorists in the Red Fort shootout case in which two terrorists of the Lashkar-e-Toiba (LeT) had stormed the historical monument and killed two Army personnel and a civilian on December 22, 2000. In an additional charge sheet filed before the court, the Special Cell of the Delhi police named Farooq Ahmad Quasid and Nazir Ahmad Quasid, currently lodged in Jammu jail in connection with some other case, as accused. With this, the total number of those charge sheeted in the case has gone up to 10. They have been accused of murder, attempt to murder, criminal conspiracy and waging war against the country.

It has increased cross-border firing along the Line of Control (LoC) and the International Border, apparently to provoke Indian troops, he said. He further said, the September 11 terrorist attack in the US and the subsequent developments in the world have had no impact on Pakistan’s activity vis-à-vis Kashmir.
