Chief Election Commissioner (CEC) Bhoj Raj Pokhrel said a number of "technical processes" were yet to be completed and that the time left was too inadequate to complete necessary preparations before the CA polls could be held. Pokhrel also urged the Government to give at least 110 days to the commission before announcing the polls date. "A number of election-related laws are yet to be formulated and enacted. The Government should give at least 110 days to the commission to hold the CA polls after formulating all election-related laws," said Pokhrel.

Chief of the United Nations Mission in Nepal (UNMIN) Ian Martin has said that the peace process with the Maoists is firmly on track despite the postponement of constituent assembly elections planned for mid-June. Briefing the Security Council on May 4 he said, “Fundamentally I'm optimistic, because it was the people of Nepal who took their future in their hands in a very dramatic way in the people's movement of a year ago.” He further said, "Their determination and demand that Nepal must not slip into armed conflict is very strong." Martin expressed hope that the Nepalis, with the assistance of UNMIN, would be able to improve security conditions for the elections and work for the full inclusion of marginalised ethic groups.

According to Daily Star, the Election Commission (EC) intends to finish preparing the voter list with photographs in eight months and assesses that the number of voters will not exceed 75 million, about 20 millions less than the number on the last electoral roll. Unidentified sources close to the EC said that by increasing the number of teams that will register voters in phases by being stationary at voter registration camps across the country, the EC believes it will be possible to complete the task by March or April 2008 if the eligible people show just enough enthusiasm for visiting the camps to register their names. Election Commissioner Sahul Hossain told reporters on May 15, "Of course, less time than calculated earlier will be required to complete the task as the number of teams has been increased. Besides, we have decided to prepare the voter list by setting up camps only to save time. We now hope the list will be prepared much before the expiration of the 18-month timeframe."

But the Election Commission recently decided to increase the number of voters' registration teams from 8,000 to 12,000 to do the task within eight months.

Humayun Kabir, secretary to the EC Secretariat, told a weekly press briefing on May 17, "It's not possible to complete the task in less than 18 months. The six-month time frame is mere notional." The Election Commission (EC) on June 17 drafted a new proposal to curtail the absolute power of political parties' parliamentary boards to nominate party candidates for parliamentary election. Using this power, the major political parties, especially the Bangladesh Nationalist Party and Awami League, reportedly made huge amounts of money by selling party nominations to businessmen and black money holders during the previous parliamentary elections, while the dedicated leaders were ignored in many cases. According to the new proposal, two or more candidates will now be selected through a secret ballot by the grass roots workers of the registered parties, one of whom would be selected as the final candidate by the party's central parliamentary board. The new proposal as well as the proposed conditions for a political party to get registration with the EC will be finalised upon consultation with the major political parties after the embargo on indoor politics is lifted.

Therefore, be ready for another revolution,” he said, adding, “The government has not laid the foundation for the CA polls. Failing this, the Maoists will start their revolution from September 18. A declaration to this effect was made by the Chief Advisor Fakhruddin Ahmed during his address to the nation. He said, “The government will lift the restrictions on indoor politics tomorrow to create an environment conducive to talks with political parties.” The declaration, however, has put some restrictions on the political parties with regard to the ongoing reforms programme. According to a gazette notification issued by the Home Ministry, a political party may hold meetings of its forums to discuss only its organisational reforms and the Election Commission's (EC) proposal for electoral reforms. The meetings will have to be held at its central office, hotels, restaurants, auditoriums, and residences of its members located in the capital with an advance notice to the Dhaka Metropolitan Police. The meeting will be attended by a maximum of 50 leaders at a time. Prior permission from the Home Ministry is required if more than 50 persons attend the meetings. Violation of restrictions attracts a punishment of two years to five years imprisonment and fines. The Chief Adviser further said that the government will arrange for the general elections ahead of the previously set December 2008 deadline after completion of the electoral roll with voters' photos. He said, “Immediately after preparation of voters' list with photos, the government will extend all-out cooperation to the EC in holding the polls at the quickest.”

Secretary to the Election Commission Kunwar Irshad said on September 16 that the poll panel has amended Presidential election rules, so that Article 63 of the Constitution that has a clause to bar Government servants from participating in elections unless they have been retired for at least two years, no longer applies to the President. Irshad said the rule of Article 63 (K) stating that "if he (the candidate) has been in the service of Pakistan or of any statutory body or any body which is owned or controlled by the Government or in which the Government has a controlling share or interest, unless a period of two years has elapsed since he ceased to be in such service" has been amended to exempt Musharraf who continued as Chief of Army. The Supreme Court on September 28 cleared the way for President Pervez Musharraf to contest the October 6 presidential election while remaining Army chief, by dismissing as "non-maintainable" all petitions challenging his eligibility, according to The Hindu. The 6-3 majority verdict of the nine-judge Bench did not, however, touch upon the substance of the petitions. Nor did the Bench make any observation on the recent changes to the election rules made by the Election Commissioner, favouring President Musharraf. The verdict said the petitions, which pleaded for the court’s intervention as an issue of public importance relating to fundamental rights was involved, could not be maintained on these grounds. Among the three dissenting judges was Rana Bhagwandas, who headed the Bench. The Opposition parties and the legal community denounced the verdict, and called into question the independence of the judiciary. Government spokesmen said justice and the rule of law had prevailed. Attorney-General Malik Qayyum denied that there was any government pressure on the Bench and reiterated that President Musharraf would step down as Army chief after his election.

However, a formal notification of his success was not issued as validation of his candidature is yet to be decided by the Supreme Court. Musharraf bagged 98 per cent (671) of the total votes polled (684), and overall he got 57 per cent out of total 1,170 votes of parliament and four provincial assemblies. According to the unofficial count, 257 senators and Member of National Assemblies (MNAs) polled votes in the 100-member Senate and the 342-member National Assembly. Musharraf secured 252 and Justice (retd) Wajihuddin Ahmed bagged two votes while three votes were declared invalid as announced by Chief Election Commissioner Justice (retd) Qazi Mohammad Farooq. In the 371-member Punjab Assembly, 257 members polled their votes out of which 253 voted for Musharraf. Ahmed got three votes while one vote was declared invalid. In Sindh, 104 votes were cast out of a total 168. Musharraf secured 102 votes and two votes were polled for Ahmed. In the 124-member North West Frontier Province (NWFP) Assembly, 34 votes were polled and 31 members cast their votes for Musharraf. One member voted for Ahmed and two votes were declared invalid. In the 65-member Balochistan Assembly, all the 33 votes were cast in Musharraf's favour.

The scrutiny of the papers will take place from November 27 to December 3, appeals against acceptance or otherwise of the nomination papers may be filed by December 7 and decisions on such appeals will be taken by December 14. The nomination papers can be withdrawn by December 15 and the final list of candidates will be published on December 16. Talking to the media after arriving in Lahore from Medina at 6.25pm (PST), he said all decisions regarding participation in elections would be made on the All Parties Democratic Movement (APDM)’s platform. He said the APDM would participate in the elections if General Pervez Musharraf withdrew the emergency declaration he issued on November 3 and released opposition members who had been jailed. “Everything that was done must be reversed and drawn back completely… You must have a level playing field for fair elections,” he said. He said the Pakistan Muslim League-Nawaz (PML-N) would never welcome ‘turncoats’, adding that he wanted to unite the PML and the PML-N. He said he had made no deal with President Musharraf. “I haven’t met any Pakistani government functionary over the last eight years, although there were a lot of overtures from the Pakistani side to meet me and to talk to me,” he claimed. On Gen. Musharraf, the former Prime Minister stated that “He is not a legitimate president of the country. I do not accept that, not at all.” He added that there was “no question” to him ever agreeing to a power-sharing deal with Gen Musharraf as president and himself as prime minister. Speaking at a programme organised by the Nepal National Intellectuals’ Association in Chitwan, he said, “The revamping of the state army and formation of a national army after the PLA’s integration and progressive restructuring of the state on racial, ethnic, gender and regional bases are mentioned in all agreements and understandings, including the 12-point pact reached with the parties,” adding that, “It will be a regressive step if the polls were to be held without integrating the PLA into the national army or restructuring the state.” Prachanda also said that all the past agreements have now become meaningless and that it is necessary to move ahead by forging a new understanding. “All the past agreements have been repeatedly flouted and now they have lost their meaning. So we have to forge a new understanding while still keeping the seven-party unity intact” he said.
