Terming Transitional Justice (TJ) an “internal matter,” Nepal Government has said that it remains committed to addressing the remaining components of transitional justice in the best interest of the country and people, reports My Republica on February 2. In a briefing to the Kathmandu-based diplomatic community on the Government’s major policies, priorities and diplomatic engagements here on February 1, Minister for Foreign Affairs Pradeep Gyawali said that the peace process in Nepal had been “fundamentally concluded” — something the international community, mainly the major Western countries and the United Nations (UN), say remains “incomplete.” The briefing comes a week after major Western countries and the UN urged the Government to clarify to the public its plans for taking the TJ process forward in 2019. “While we have noticed concerns expressed in certain quarters for the expeditious conclusion of this process, we believe that this internal matter can be resolved with our commitment and efforts,” said Minister Gyawali. Those issuing the joint statement to urge the Government to clarify its plans to resolve TJ cases included Australia, Germany, the European Union, Finland, France, Norway, Switzerland, the United Kingdom, the USA and the UN. Earlier, Nepal Government spokesperson Gokul Banskota had said that foreigners did not need to remind the Government to resolve the issues of TJ.

Nepali Congress (NC), the main opposition party, is staging protests across the country on February 4 (today), against the recently-endorsed National Medical Education Bill by the Government, in various parts of the country including the capital, reports My Republica. Taking strong objection to the National Medical Education Bill by force amid its protest in the parliament, the NC has argued that the bill failed to honor the agreements reached in the past with senior orthopaedic surgeon Dr Govinda KC who ended his 16th fast-unto-death last week. The NC leaders and cadres are holding protest in all district headquarter. The NC has denounced the Government move to endorse the Bill with force, undermining the voice of main opposition party in the parliament.

The opposition party Nepali Congress (NC), on February 4, organised a nationwide protest against the Government’s ‘authoritarian’ move of forcibly getting the National Medical Education Bill endorsed from the Parliament as well as its failure to maintain law and order and control corruption, reports The Himalayan Times. The NC also raised the issue of a meeting of the Constitutional Council convened in the absence of leader of the Opposition Sher Bahadur Deuba. The meeting convened on January 20 had recommended chairpersons for the five constitutional commissions. The party took out rallies across all 77 Districts, where participants chanted slogans such as ‘stop authoritarian style’, ‘follow parliamentary norms’, ‘control murder and violence’, ‘deliver justice to Nirmala Panta’, ‘control skyrocketing prices’, and ‘roll back exorbitant tax hikes’, among others.

Police arrested 22 leaders of the Nepal Students’ Union (NSU), the student wing of the main opposition Nepali Congress (NC), from Kathmandu on the charge of obstructing various roads in Kathmandu and Pokhara on February 5, reports My Republica. The NSU leaders were obstructing the roads demanding the release of NSU leaders Parasuram Basnet, Difan Bhujel and Binaya Paudel who were arrested on February 2, for allegedly setting a government vehicle on fire in Pokhara. The trio was accused of setting the vehicle on fire amidst a nationwide campaign of the student organization to stop the misuse of Government vehicles during public holidays. Police informed that NSU Chairman Nain Singh Mahar, Vice-president Nabin Rai, foreign relations advisor Dambar Sunar, central committee member Prem Shahi and nine other leaders of NSU were arrested for obstructing the road at Baneshwar. Similarly, five other leaders were arrested from Ratna Rajya Laxmi Campus. Police also arrested four NSU leaders in Pokhara for obstructing a road demanding the release of the three arrested leaders.

Civil society members have urged the Government to protect complaints and testimonies collected from victims and families of those who were killed or disappeared during the Maoist insurgency, reports My Republica on February 7. Issuing a joint statement on February 6, hours before the parliament debated a new bill to extend the terms of the Truth and Reconciliation Commission (TRC) and the Commission for Enforced Disappeared Persons (CIEDP) for the third time, civil society members called on the stakeholders concerned to hand over complaints, evidences and documents gathered from victims of atrocities to the National Human Rights Commission (NHRC) so as to ensure the privacy of victims and their families. The human rights groups and civil society members have taken a strong exception to the plan saying it could infringe on privacy of the victims. In their complaints, several hundred victims have identified their perpetrators. So far, the CIEDP has conducted detailed investigations into 2,100 cases, while TRC has gone through 3,000 of the 61,000 registered complaints.

The House of Representatives on February 6, endorsed the bill to amend the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act 2014, reports The Himalayan Times. Minister of Law, Justice and Parliamentary Affairs Bhanu Bhakta Dhakal presented the bill in the House for endorsement. The National Assembly has already passed the amendment. The bill extends the tenure of members of two Transitional Justice (TJ) commissions till April 13 and the tenure of the commissions by one year with provisions to extend the tenure by another one year. The extended tenure of the two commissions formed in February 2015 is expiring on February 9. The bill also has provisions that separate the tenure of the commission members from the tenure of the commissions. The new provision means if the tenure of the commission members expires or all the posts of members remain vacant, the commissions will still remain intact and the Government can make new appointments through a Cabinet decision. As per the existing act, members shall continue to hold their posts till the tenure of the commissions, and the commissions will be scrapped in the event the posts remain vacant. However, the new provision now allows the Government to restructure the two commissions — Truth and Reconciliation Commission (TRC) and Commission of Investigation of Enforced Disappeared Persons (CIEDP) — after April 13. Conflict victims have also been demanding that the commissions be restructured.

President Bidya Devi Bhandari, on February 8, authenticated the amendment bill on Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) Act-2071', reports My Republica. The President's Office in a press statement said, the president authenticated the amendment bill in line with the Article 113 (2) of the constitution. With the approval of the bill, the terms of TRC and the CIEDP have been extended for a year. Earlier, the House of Representatives (HoR) and the National Assembly (NA) had endorsed the bill, extending the terms of the two commissions for a year at first and for a further year if needed. The commissions were formed to investigate conflict-era cases.

International Commission of Jurists (ICJ), Amnesty International (AI) and TRIAL International on February 11, called on the Nepal Government to commit to a transparent and consultative Transitional Justice (TJ) process that complied with international law and the judgments of the Supreme Court, reports The Himalayan Times.The Government has extended mandates of the two TJ mechanisms — Truth and Reconciliation Commission (TRC) and Commission on the Investigation of Enforced Disappearance of Persons (CIEDP) — for an additional year and their members till April 13.“A further one-year extension will be meaningless if measures are not taken to secure the independence and impartiality of the commissions,” said Frederick Rawski, ICJ Asia Pacific director, in a press statement. “This can only be achieved through a transparent selection process driven by a genuine will to combat impunity — not just for conflict victims, but for future generations.”The three organisations reiterated their view that the process had till date failed to deliver justice, truth or reparation for victims of crimes under international law and gross human rights violations or establish laws and institutional safeguards to ensure that such crimes are never repeated.

The victims of the decade-long Maoist conflict have said the Government and political parties should immediately begin the process of appointing new members to avoid any possible vacuum in the commissions, as within two months’ time, the tenure of members of two transitional justice (TJ) mechanisms will expire, reports The Himalayan Times on February 15. Through an amendment to the Transitional Justice Act, the Government has extended the tenure of members of the two commissions till April 13, and tenure of the commissions by one year, with provisions for another one-year extension.As per the act, a five-member recommendation committee headed by former Supreme Court chief justice will recommend members of the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP). The recommendation will then be approved by the Cabinet. Even if the Government wants to continue the existing members, which is against the victims’ demand for restructuring the commissions, the act needs to be amended again.Against this backdrop, the victims said it was already late for the formation of the recommendation committee, and any further delay would raise the chances of the commissions existing without members after April 13. Moreover, the victims have demanded their meaningful participation in the process of selecting new TRC, CIEDP commissioners. The international community has also been pressing the government to appoint competent members in the two mechanisms in a transparent manner.

Factions of Nepal Student Union (NSU), a student wing of the Nepali Congress (NC), clashed at the party headquarters on February 24, prompting the Police to charge batons and leaving around 16 persons injured, reports The Himalayan Times. The two groups of students — one close to the NC faction led by President Sher Bahadur Deuba and the other close to Krishna Prasad Sitaula — had reached the party headquarters to pressure the leadership not to delay formation an ad hoc committee of the NSU after the dissolution of its central committee.The clash erupted after student leaders led by Kundan Kafle (close to Sitaula camp) tore banners displayed by students led by Rishikesh Jung Shah (close to Deuba camp), who were organising a silent demonstration, according to Shah. As soon the situation turned violent as students started exchanging bricks and stones, and the Police then had to charge batons. At least 16 persons sustained injuries in the incident, including around four journalists.

A family member of Singh Prasad Gurung, who was killed in a blast outside Lalitpur-based Ncell office on February 22, wants the Government to act against the Netra Bikram Chand-led Communist Party of Nepal (CPN), which has owned up to the blast, reports The Himalayan Times on February 26. “My brother was killed for no fault of his. Unless the government reins in the Chand-led outfit, many more innocent people could lose their lives in such terrorist acts,” said the victim’s elder brother Shyam Prasad Gurung.Criminal lawyer Lav Kumar Mainali said CPN was spreading terror mainly because its cadres and leaders enjoyed political protection.“Home Minister Ram Bahadur Thapa’s admission that Chand-led faction was treated leniently in the past shows that the outfit enjoyed political protection,” Mainali added.Asked if the Government was preparing to declare CPN a terrorist organisation, Home Ministry Spokesperson Ram Krishna Subedi said there were enough laws to deal with acts of terror committed by the Chand-led outfit.

Secretary at the Prime Minister’s Office Ramesh Dhakal, who has been consulting conflict victims on transitional issues, said chances of the Government registering a new bill to amend the Truth and Reconciliation Act (TRA) was slim in the ongoing session of the Parliament, reports The Himalayan Times on March 1. “It’s not merely a legal issue but also a political issue that requires consensus at the political level and I think the political leaders are yet reach consensus,” he said. Dhakal added his office needed to hold more consultations with the conflict victims on transitional justice issues. Rights activists have, however, criticised the Government for its failure to amend the Transitional Justice (TJ) Act. The Government recently extended the term of two transitional bodies — Truth and Reconciliation Commission (TRC) and Commission of Inquiry on Enforced Disappeared Persons (CIEDP) — for one more year, but it did not extend the tenure of their office bearers whose term will expire on April 13.
