Roy of Calcutta High Court on January 18 directed the joint Security Forces to find out if armed camps existed in the Junglemahal - the forest areas of West Midnapore, Purulia and Bankura Districts - and neutralise them. It also asked the State Government to pay compensation to the victims of the January 7 Netai village massacre but refused to order a Central Bureau of Investigation (CBI) probe into the massacre incident. A Communist Party of India-Maoist (CPI-Maoist) squad leader, identified as Kalicharan alias Kaliram Soren active in Binpur area, was arrested by the Police from Jhatira village in Jhargram in West Midnapore District in the night of January 23. “Kaliram was presented before the Jhargram court in the afternoon of January 24 and the court has remanded him in Police custody for 14 days”, Additional Superintendent of Police (ASP) (operation) Mukesh Kumar said. 'Kaliram, a landmine expert and knows all the dos and don'ts in making landmines and was involved all the landmine blasts that were triggered by the ultra-Left rebels in Binpur area. He was also accused in several cases and three arrest warrants were pending against him,' ASP Kumar added.

The Chhattisgarh High Court on February 10 dismissed an application of rights activist and paediatrician Binayak Sen seeking bail and suspension of life term awarded to him, reports The Hindu. But the court will continue to hear his appeal against the life sentence handed down by a Raipur Additional District and Sessions Court. The court also dismissed a similar application of co-accused Kolkata businessman Pijush Guha. On December 24, 2010, the Raipur court had convicted Binayak Sen, Guha, and alleged Communist Party of India-Maoist (CPI-Maoist) ideologue Narayan Sanyal of conspiring to commit sedition and sentenced them to life imprisonment.

Acquitting a suspected 'mere member' of the banned United Liberation Front of Assam (ULFA), a Bench comprising Justices Markandey Katju and Gyan Sudha Misra noticed section 10 of Unlawful Activities (Prevention) Act, which provides punishment of upto two years jail term to members of banned outfits and said a statutory provision could not override a citizen's fundamental rights.

Justice C.R. Das, of the Odisha High Court has granted conditional bail to four Maoist cadres, identified as Roza Mandangi, Gokul Kuldipia, A.Iswari and Kendula Sirisha alias Padma, whose release had been demanded by the Maoists for the release of Malkangiri District Collector R Vineel Krishna from their captivity, reports Orissadiary.com. The Judge has granted bail against deposit of INR 20,000. Roza and Gokul will report to the Investigating Officer (IO) in every 15 days. Further, with the condition that they cannot go outside of the District without the permission from the Police. The court also directed the Odisha Police to hand over Iswari and Padma to Andhra Pradesh Police within two days. The two were asked not to enter the State until summoned by the SDJM’s court in Jeypore, Koraput District. In addition, Maoist leader Ganti Prasadam, who is currently lodged in the Koraput District jail, is likely to be out on bail, with his lawyer trying to get people who would stand surety for him, reports Indian Express.

Srinivas was asked to be released by the Maoists in exchange in the abduction case of Krishna and Majhi. According to his lawyer, Srinivas who was arrested in 2007 from Bariguda forest in Kalimela area of the District had been tried in six cases since then and he was acquitted in all six cases, including three murder charges. "First Srinivas was tried in four cases in which he was acquitted. But the Police again implicated him in two more cases in which he was acquitted," his counsel said. Prior to his arrest Srinivas was carrying a cash prize of INR 1.2 million in Andhra Pradesh.

The ruling - issued by Justices B. Sudershan Reddy and S.S. Nijjar on the writ petition filed by social anthropologist Professor Nandini Sundar and others - strongly indicted Chhattisgarh for violating constitutional principles in arming youth who had passed only the fifth standard and conferring on them the powers of police. The Bench said: “The State of Chhattisgarh shall forthwith make every effort to recall all firearms issued to any of the SPOs, whether current or former, along with any and all accoutrements and accessories issued to use such firearms. The word firearm as used shall include any and all forms of guns, rifles, launchers, etc, of whatever calibre.” The court also directed the Centre and the State to provide appropriate security forthwith, and undertake such measures “as are necessary and within bounds of constitutional permissibility, to protect the lives of those who had been employed as SPOs previously, or who had been given any initial orders of selection or appointment, from any and all forces, including but not limited to Maoists/Naxalites.”

Outlook India reports on July 7 that trade union leader and alleged Communist Party of India-Maoist (CPI-Maoist) leader Gopal Mishra (43) and his wife Anu have been ordered to be put on trial by a Delhi court under the country's anti-terror law. Additional Sessions Judge Santosh Snehi Mann ordered framing of charges against Mishra and his wife Anu for allegedly having links with the Maoists and committing various offences under the Unlawful Activities (Prevention) Act, saying the documents recovered from them "lay emphasis" on capturing political power through armed rebellion. "The magazines, books and booklets recovered from the residential premises of the accused persons in bulk, besides promoting ideology of (CPI-Maoist), lay emphasis on capture of political power in the country by armed rebellion.... Text of the books speaks in strong words about bringing political and social change in the country through violence and by spreading hatred against the democratically elected government," the court said. Mishra was arrested by Special Cell of the City Police on April 26, 2010 from Shahdara in East Delhi and was found carrying various documents and a CD containing material related to CPI-Maoist. Anu was arrested a day later. The prosecution claimed that during interrogation, Gopal revealed that he is an active member and city organiser for Delhi region of the Maoists and his task is to motivate people to join the outfit.

"The court order may not be applicable for the state. The method of recruitment and engagement of SPOs in Orissa is totally different from Chhattisgarh," Chief Secretary B. K. Patnaik said on July 28. SPOs appointed in tribal-dominated districts in Orissa did not directly confront Maoists and would be taken as regular constables after completion of a three-year tenure, he said. The youths appointed as SPOs in tribal areas received an opportunity to remain in mainstream instead of joining the Maoist brigade, he said. As many as 4,500 youths have so far been appointed as SPOs in the State and the Government was not averse to recruit more, a home department official said.

The arrested duo have been identified as Naxal militia ‘commander’ Chamru Naitam and his aide Mansaram Naorte from village Bhatamnar village in Dhanora tehsil (revenue unit). They were allegedly involved in hijacking a tanker carrying chemicals while it was passing through dense forest area in Dhanora tehsil on March 10, 2010. By the time the tanker was recovered during combing operations conducted later, the chemical from the vehicle was already removed by the Naxals. A week back, six suspected rebels were arrested from village Munjalgondi which led to the arrest of Naitam and Naorte recently. A Communist Party of India-Maoist (CPI-Maoist) cadre, identified as Tuna Pradhan, was arrested and forwarded to court by the personnel of G. Udaygiri Police Station in Kandhamal District on August 11. He is a resident of Sakdai village in the limits of the Police Station. Interrogation revealed that he was trained in arms use by Maoists in 2009. The arrested Maoist was involved in bomb making, recruitment of gullible youths and provision of logistics to the Maoists, claimed Police.

The Times of India reports that the Supreme Court on November 18 lifted its July 5 ban on central funding of anti-naxal [Left-Wing Extremism] and anti-insurgency operations through Special Police Officers (SPOs) in all states except Chhattisgarh. On July 5, a bench of Justices B Sudershan Reddy, since retired, and S S Nijjar had clamped a complete ban on central funding, which accounted for a major chunk of the budget for anti-naxalite and anti-insurgency operations in many states on a petition filed by Nandini Sundar alleging illegal recruitment of tribal youth as SPOs in Chhattisgarh and large-scale illegalities committed by them. On an application moved by the Ministry Of Home Affairs (MHA), a bench of Justices Altamas Kabir and S S Nijjar clarified that the July 5 judgment would operate only in Chhattisgarh. During the arguments on Nandini Sundar's petition, the Raman Singh government had clarified that SPOs, whose salary budget is borne mainly by the central government (80%), were not peculiar to Chhattisgarh. If there were 6,500 SPOs in Chhattisgarh, their number in Jharkhand was 6,400, Bihar 6,353, Orissa 4,480, Andhra Pradesh 2,130 and Maharashtra 1,500, it had said.

Cases convicting Sagar were filed in connection with encounter at Burugulakottala in Nallamala forest on March 24, 2003 and claymore mine-blast at Veerabhadra Swamy on June 1, 2003. Four years ago, Police had arrested Sagar and lodged him in Ongole central jail December 7, 2007.

Jharkhand High Court on December 15 acquitted the death sentence of four alleged Communist Party of India-Maoist (CPI-Maoist) cadres for opening fire on spectators of football match in Giridih on October 2007 in which former Chief Minister Babulal Marandi’s son and 18 others were killed, reports Business Standard. A division bench of justices R K Merathia and P P Bhatt heard the appeals filed by the accused and gave them the “benefit of doubt”, citing “lack of evidence” on the part of the prosecution to confirm the death sentence awarded by Giridih sessions judge on June 22. The bench observed that the prosecution had failed to bring about a strong case against the accused.
