The Supreme Court, on January 9, extended till February 17 its interim order placing social activist Gautam Navlakha, accused of having links to Communist Party of India-Maoist (CPI-Maoist) and Pakistan's spy agency Inter-Services Intelligence (ISI), under house arrest, reports The Pioneer. The top court had on November 18 ordered that Navlakha be placed under house arrest "without fail" within 24 hours and ordered some additional security measures to be put in place at the building where the activist will be kept under house arrest. Alleging that Navlakha's medical report issued by the Jaslok Hospital was "vitiated", the National Investigation Agency (NIA) had said proper treatment was given to him whenever required and his condition was manageable within the premises of Taloja central jail. The case relates to alleged inflammatory speeches made at the Elgar Parishad conclave held in Pune on December 31, 2017, which the Police claim triggered violence the next day near the Koregaon-Bhima war memorial on the outskirts of the western Maharashtra city.

The National Investigation Agency (NIA) filed a charge sheet before the NIA Special Court, Ranchi, Jharkhand on January 20, against two accused, identified as Tarun Kumar and Pradyuman Sharma, in a case related to funding to the banned Communist Party of India-Maoist (CPI-Maoist), reports The Pioneer. The case relates to a conspiracy hatched by the members of CPI-Maoist for its revival in the Magadh Zone and to raise funds for the organization. The case was suo-moto registered by the NIA on December 30, 2021.

The Calcutta High Court (HC), on February 28, granted bail to 11 Communist Party of India-Maoist (CPI-Maoist) cadres, accused in the 2010 Jnaneswari Express accident, in which as many as 148 persons were killed and 180 were injured, reports daijiworld.com. The 11 accused were granted bail after spending almost over a decade since their arrests while the investigation of the Central Bureau of Investigation (CBI) in the matter is yet to be concluded. The 11 accused who were granted bail on Tuesday were Khagen Mahato, Bholanath Mahato, Jaladhar Mahato, Ram Mudi, Manik Mahato, Amiyo Mahato, Jaideb Mahato, Mohonto Mahato, Lakksmikanto Roy, Sunil Mahato, and Manoj Mahato. The Jnaneswari Express derailed in 2010 near Jhargram in West Midnapore District of West Bengal, following which 148 persons were killed and 180 were injured.

A court in Bihar's Gaya, on March 2, sentenced a Communist Party of India-Maoist (CPI-Maoist) ‘area commander’, who had led the February 12, 1992 Bara massacre where 35 persons were killed, to life imprisonment, reports daijiworld.com. Gaya's District and Sessions Judge Gaya Manoj Kumar Tiwari pronounced the quantum of punishment for Kirani Yadav, the ‘area commander’ of the erstwhile Maoist Communist Centre (MCC). "Kirani Yadav, on February 12, 1992 had slit the throats of 12 persons with his own hands. He has been lodged in Gaya central jail since 2007. The quantum of punishment was announced through video conferencing on Thursday," Special Public Prosecutor Pramod Kumar said. MCC along with and the Communist Party of India (Marxist-Leninist) People's War (also known as the People's War Group or PWG) merged to form the CPI-Maoist on September 21, 2004.

A special court refused to drop charges under Maharashtra Control of Organised Crime Act (MCOCA) against three accused in a case where 15 security personnel and a civilian were killed in 2019 at Gadchiroli in an attack by the cadres of the Communist Party of India-Maoist (CPI-Maoist), reports The Free Press Journal on March 9. The court observed that prima facie there is ample material to show that the applicants – Parasram Tulavi, Somsay Madavi and Kisan Hidami – are members of the CPI-Maoist and have participated in the conspiracy and terrorist act. The court stated that it is not the requirement of law that previous chargesheets be filed against them and that the prosecution has shown their nexus with the organisation. The court also noted that the National Investigation Agency's (NIA) prosecutor has produced a list of 65 cases registered against members of the organisation. It said there is ample material that the applicants are its members and that the allegations against them are specific.

The special team of the Special Task Force (STF) arrested a Communist Party of India-Maoist (CPI-Maoist) cadre, identified as Ratu Koda, during a raid in Chowkia village under the Laxmipur Police Station area in Jamui District of Bihar on March 23, reports livehindustan.com. In a second raid on March 23, Maoist cadre Doman Koda was arrested from Simra Tari under Kajra Police Station in Lakhisarai District. Half a dozen cases are registered against both the Maoists, and their involvement has also been found in many Naxalite [Left Wing Extremism, LWE] activities. Cases have been registered against both of them under the Unlawful Activities Prevention Act (UAPA) and other serious sections. STF was looking for these two for a long time.

Communist Party of India-Maoist (CPI-Maoist) leader Sabyasachi Panda, who has been in judicial custody since July 2014, was acquitted by the district judge court in Nayagarh District in connection with an attack on the District Reserve Police in 2008, reports The Times of India on March 28. As many as 134 cases were registered against Panda at different Police Stations in Ganjam, Gajapati, Kandhamal, Rayagada and Nayagarh Districts. He has been acquitted in at least 57 cases but is unlikely to come out on bail in the next few years, a Police officer said. The Maoist leader, facing a series of cases, was awarded life sentence by the first additional district and sessions court in Berhampur on May 18, 2019, on charges of waging a war against the nation.

The High Court of Kerala rejected the petitions filed by two persons hailing from Andhra Pradesh, who were arrested under the Unlawful Activities Prevention Act (UAPA) for their alleged links with the Communist Party of India-Maoist (CPI-Maoist), reports indialegallive.com on April 14. Noting that the offences alleged against them were of a grave and serious nature, the Division Bench of Justice Alexander Thomas and Justice C.S. Sudha denied bail to the accused. The High Court, while taking in view the material which showed the alleged involvement of accused number 5 & 6 in the activities of CPI-Maoist, ruled that they cannot be granted bail. It further noted that if granted bail, there was a serious likelihood of the accused either remaining absconding or fleeing away from the long arm of the law, since the terrorist organisation had presence in different States. The National Investigation Agency (NIA) had registered a First Information Report (FIR) against the accused for offences punishable under Sections 18, 18A, 18B, 20, 38 & 39 of the UAPA and Section 120B of the Indian Penal Code (IPC).

A bench of top court Justices M R Shah and C T Ravikumar directed the Chief Justice of the Bombay High Court to place G N Saibaba’s appeal and that of other accused not before the same bench which had discharged them and the case be heard by another bench. It said that question of law, including sanction under the Unlawful Activities Prevention Act (UAPA), is to remain open for adjudication by the High Court. The National Investigation Agency (NIA) Special Court, Guwahati, Assam, on April 26 convicted five accused to eight years imprisonment in the 2011 People's Liberation Army (PLA)-Communist Party of India-Maoist (CPI-Maoist) nexus case related to a criminal conspiracy to threaten the unity, integrity, security and sovereignty of India, reports The Pioneer. Three of the convicted accused belonged to the PLA and two to the CPI-Maoist. The NIA had registered a suo moto case on July 1, 2011 on inputs that the PLA, had hatched a conspiracy to destabilize the country with the support of CPI-Maoist. “The CPI (Maoist) leaders had agreed to recognize and support the separatist activities of PLA for the creation of the northeastern state of Manipur, as a separate nation. The PLA leadership, on its part, decided to support the continuing war of CPI (Maoist) for overthrowing constitutionally elected Government of India,” the NIA said in a statement. Investigations revealed that PLA had established a liaison office in Kolkata, where a meeting was held between PLA/Revolutionary Peoples Front (RPF) and CPI-Maoist leaders. Modalities were worked out at the meeting for taking unified action for waging a war against the Union of India, the agency said. Investigations also revealed that PLA had provided logistic support to Maoist cadres and both groups were regularly communicating and exchanging emails. The accused persons had travelled to different places within and outside India, and created fake IDs and bank accounts under pseudonymous identities, it further said.

The NIA on May 29 said it had filed a supplementary chargesheet against two accused in a case related to a Naxal [Left Wing Extremism, LWE] attack on former Member of Legislative Assembly (MLA) Gurcharan Nayak in which two Police personnel were killed in Jharkhand in January 2022, reports The Tribune. In the second chargesheet in the case filed in a special court in Ranchi on May 27, the NIA has named two armed cadres of the Communist Party of India-Maoist (CPI-Maoist) — 25-year-old Tivari Bankira alias Shaka and 20-year-old Sadan Korah alias Sajan. The agency said the duo, hailing from Jharkhand’s West Singhbhum district, had been charged under various Sections of the Indian Panel Code (IPC) and the Unlawful Activities Prevention Act (UAPA). While Korah has been in custody since February 13, 2022, Bankira was arrested on November 30, the NIA said.

The charge sheet has been filed under various sections of the Indian Penal Code (IPC) and the Unlawful Activities Prevention Act (UAPA) against Vinay Yadav alias Kamal alias Murad alias Guru ji, Naval Ji alias Naval Bhuiyan alias Arjun Bhuiyan and Jilebiya Yadav alias Vinay, all residents of Bihar, a NIA spokesperson said. The latest charge sheet comes just days after the NIA conducted widespread searches in Jharkhand and Bihar in connection with the case which was originally registered by Bihar Police on November 3, 2018, following the brutal murder of Naresh Singh Bhokta, who was abducted on November 2, 2018 and taken to a ‘jan adalat or kangaroo court’ where the top leadership of the CPI-Maoist issued instructions to their cadres to kill him after declaring him as a ‘police informer’. His body was found near Badhai Bigha village in the Madanpur Police Station area the same day. Nine accused have so far been arrested in the case, the investigation of which was taken over by the NIA on June 24, 2022. The agency had filed a supplementary charge sheet on February 25 against one of the accused.

On June 28, the National Investigation Agency (NIA) filed its first supplementary chargesheet at a NIA Special Court in Ranchi, Jharkhand, against 22-year-old Abhinav alias Gaurav Kumar alias Bittu from Aurangabad District in Bihar in the Communist Party of India (CPI-Maoist) terror financing case for the revival of the outfit’s Magadh Zone of Bihar, reports NIA. NIA investigations revealed that Abhinav, a cadre of the CPI (Maoist), was arrested on January 3 and was part of the conspiracy to raise funds for the organisation. He was also found to have motivated ex-cadres of the CPI (Maoist) for the revival of the CPI (Maoist) in Magadh Zone and worked as a conduit between the outfit’s operatives and other stakeholders in Magadh Zone in Jharkhand and Bihar. The National Investigation Agency (NIA) registered a case against Krishna Hansda alias Saurabh Da, a ‘regional commander’ of the Communist Party of India (CPI-Maoist), to probe an alleged conspiracy to extort ‘levy’ (extortion money) from businessmen and contractors in Jharkhand for organising violent activities, reports Hindustan Times on July 11. The Maoists often collect ‘levy’ from contractors and businessmen engaged in developmental projects in Jharkhand, and invest the money in dubious shell companies to purchase arms and other logistics for operations against Security Forces (SFs). Hansda was arrested by Jharkhand Police on January 16 from Lucio Forest area in Dumri village in Giridih District, when he was travelling with an associate to allegedly collect ‘levy’. According to a first information report (FIR) filed by NIA on June 30, “a credible input was received by Jharkhand Police that a Naxal [Left Wing Extremism, LWE] cadre of proscribed terrorist organisation CPI (Maoist) - Krishna Hansda alias Saurabh Da, regional commander of CPI (Maoist), along with his squad, had gathered in Lucio Forest area of Dumri police station, Giridih, to collect levy and carry out an untoward incident”. The agency said that Hansda was arrested while his associate managed to escape. A US-made pistol, six live rounds of 7.65 mm, INR 200,000 cash and Naxal literature were recovered from the Maoist, the agency added.

The Calcutta High Court of West Bengal on July 11 granted conditional bail to Chhatradhar Mahto, former leader of the Communist Party of India-Maoist (CPI-Maoist)-backed People's Committee Against Police Atrocities (PCAPA), in a case registered by the National Investigation Agency (NIA), reports jagran.com. The court, however, directed Mahto not to enter Purba (East) Medinipur, Paschim (West) Medinipur, Jhargram, Bankura, and Purulia districts, once Maoist strongholds. A division bench of Justice Debangsu Basak and Justice Mohd. Shabbar Rashidi directed that Mahto be released on bail after furnishing a surety of INR 50,000 and two sureties of like amount. The bench also directed that Mahto shall appear before the trial court on every date of hearing until further orders and shall not in any way intimidate the witnesses or tamper with the evidence. Mahto has also been directed to appear before the Chief Investigating Officer of the NIA once a week until further orders. Mahto was arrested by the NIA on March 28, 2021, in connection with three cases from 2009, two of which were from Lalgarh and the third from Jhargram Police Station.

BG Krishnamurthy alias Bhaskar (35), accused No.3, of Chikkamagaluru District, Hosagadde Prabha alias Nethra (24), accused No.6, of Shivamogga District and Savithri alias Usha (18), accused No.10, of Chikkamagaluru District, who are now in rehabilitation centre and judicial custody, are discharged from the offences. Judge Gangadhara CM said there is no grave suspicion about their involvement in any unlawful activity and therefore, this court cannot frame a charge against them for the offence under the provisions of the Indian Penal Code (IPC) and Unlawful Activities Prevention Act (UAPA). The court observed that except for the voluntary statement of Ramesh, accused No.1, the investigation officer has not collected any evidence to show that a meeting was held at Malappuram. Reportedly, the three accused were booked for allegedly attending a meeting at Malappuram in Kerala in May 2016 to plan to carry out Naxal activities in western ghats and to conspire to attack Policemen in September later in the same year.

The accused have been slapped with charges under various sections of the Indian Penal Code (IPC), the Arms Act, and the Unlawful Activities Prevention Act (UAPA) in the charge sheet which was filed on October 13. In a statement issued by NIA on October 14, it said that the investigation unveiled a sinister plot by a group of Maoist cadres, led by senior figures including Sanju, Laxman Nag, Dashri Kawasi, Dubasi Shankar, Jalamuri Srinu Babu, Vijayalaxmi, Ramesh Kunjami, and others, who conspired to execute this violent act. An NIA spokesperson said that the agency filed a charge sheet against the two, both residents of Bihar, in the Maoist arms seizure case. The case involves the seizure of two AK-47 rifles, five magazines, and 460 rounds of 7.62×39 mm live ammunition. These items were discovered buried in a forested area near Bariakala village in the West Champaran District of Bihar. The case was initially registered on May 4 this year under sections 25(1-b) a, 26, 35 of the Arms Act, and sections 16, 17, 20, 21, 22, 23, 38, 39, and 40 of the Unlawful Activities (Prevention) Act, 1967, at Laukaria Police Station in Bihar’s Bagha. This initial registration of the case took place in Bihar. On June 23, the NIA assumed jurisdiction over the case and re-registered it in Delhi.

A special National Investigation Agency (NIA) court in Patna, on December 1, convicted three Communist Party of India-Maoist (CPI-Maoist) cadres, identified as Udit Narayan Singh alias Tulsi alias Tufan, Akhilesh Singh alias Manoj Singh, and Arjun ji alias Mani Yadav, in a case related to the seizure of arms and ammunition in the Aurangabad area of Bihar more than a decade ago, reports latestly.com. The quantum of punishment against the trio will be pronounced by the court on December 4. A spokesperson for the NIA said the special court found them guilty of being in possession of prohibited and non-prohibited arms and ammunition, as well as chemicals for making Improvised Explosive Devices (IEDs) and bombs for their use in terror attacks by the banned CPI-Maoist in 2012. The Aurangabad Police had initially registered the case on March 26, 2012, a day after raids were conducted in the houses of the three based on information that some Maoist cadres had assembled in Aurangabad to execute terrorist activities.

The National Investigation Agency (NIA) charged eight people on December 1 with supplying deadly explosives, drones, and other equipment to the Communist Party of India-Maoist (CPI-Maoist) for attacking Security Forces (SFs) in the Naxal [Left Wing Extremism, LWE]-infested areas of the country, reports the Deccan Herald. All eight accused are in custody following their arrest under sections 120(B), 143, 147, 148 R/w 149 IPC, section 8 (1) of the TSPS Act, section 5 of the ES Act, and sections 10, 13, 18, and 20 of the Unlawful Activities Prevention Act (UAPA) of 1967. While three of them, working as couriers for the CPI-Maoist outfit, were arrested while on their way to supply explosives, drones, and a lathe machine, the others were arrested subsequently. The NIA investigations have revealed that the explosive material recovered from the possession of the three arrested originally, namely Punem Nageswar Rao, Devanuri Mallikarjun Rao, and Vollepogula Umashankar, was supplied to them by accused Jannu Koti, Arepalli Srikanth, Tallapalli Arogyam, and Bontha Mahender. The latter four had procured the stuff from Sonaboina Kumaraswamy, who held a license for dealing in explosives. The cache that the three accused were carrying at the time of their arrest was intended for use in the manufacturing of country-made arms to be deployed against the SFs in the country’s Naxal-affected areas, as per the NIA investigations. The case was initially registered at Cherla Police Station in Bhadradri Kothagudem District of Telangana on June 5 and taken over by the NIA on August 3, the spokesperson said.

On December 4, a National Investigation Agency (NIA) special court in Patna sentenced three Communist Party of India-Maoist (CPI-Maoist) cadres to rigorous imprisonment for 10 to 12 years after convicting them in a 2012 arms and ammunition seizure case, reports The Week. Udit Narayan Singh and Akhilesh Singh have each been sentenced to 12 years of rigorous imprisonment with a Rs 5,000 fine. Arjun Ji has been sentenced to 10 years of rigorous imprisonment and has been fined Rs 5,000, a NIA spokesperson said. The official said that all three will be liable for an additional three months of simple imprisonment in case of default in payment of the fine. The trio were charged by the NIA under various sections of the Unlawful Activities Prevention Act (UAPA), the Arms Act, and the Explosive Substances Act. The Aurangabad town police initially registered the case on March 26, 2012, a day after raids were conducted at the houses of the three accused. The raids followed secret inputs that some active cadres of the CPI-Maoist had assembled in Aurangabad to execute a terror plot, the spokesperson said.
