The Madras High Court (HC) granted interim bail to five Communist Party of India-Maoist (CPI-Maoist) cadres, top Maoist leader Roopesh, head of Western Ghats Zonal Committee (WGZC) of CPI-Maoist, and four others, including his wife Shyna, who were arrested near Karumathampatti in Coimbatore in May 4, 2015, by the Q branch Police with a condition to appear before the Investigating Officer every day for a month, reports The Hindu on January 22. On September 29, 2015, the Principal Sessions Court, Coimbatore, dismissed the bail petitions moved by all the five detainees. Assailing the order, the Maoists approached the High Court. Admitting the pleas, Justice C.T. Selvam on January 20, granted interim bail to all the five Maoists and directed them to appear before the investigating officer every day for a month and thereafter whenever summoned by the investigating agency.

A suspected Communist Party of India-Maoist (CPI-Maoist), Ranjith, was produced before the Judicial Magistrate Court in Dindigul District of Tamil Nadu on February 1, reports The Hindu. Judicial Magistrate C.B. Vedagiri adjourned the case till February 15. Police claimed that the accused was in Kodaikanal with Naveen Prasad, who was gunned down in an encounter with the Police, and was engaged in weapon training. The Police had brought Ranjith from Tiruchi prison.

The Communist Party of India-Maoist (CPI-Maoist) cadres killed a Dangoria Kondh (tribal) youth identified as Shyamo Kadraka (22) of Nirgundi village under Kalyansinghpur Police limits in Rayagada District after trial in a kangaroo court on January 4, reports The Times of India. Maoists killed Shyamo suspecting him to be a ‘police informer’. His body was found hanging from a tree, on the outskirts of the village. Villagers retrieved the body and cremated it. Shyamo had been warned of dire consequence by Maoists in December, 2015.

The Supreme Court (SC) on April 4, granted bail to Delhi University (DU) Professor G.N. Saibaba, in jail over suspicion of having links with the Communist Party of India-Maoist (CPI-Maoist), while pulling up the Maharashtra government for being “extremely unfair” to an ailing man, reports The Hindu. A Bench of Justices J.S. Khehar and C. Nagappan said there was no point in keeping Saibaba, who is a wheelchair-user, in Nagpur Jail indefinitely. “You are extremely unfair to him (Saibaba) considering his medical condition. There is no point keeping him in jail if the material witnesses have already been examined,” Justice Khehar observed when the State counsel pressed for extending the custody. In February, the apex court had agreed to consider the Professor’s bail plea on April 4, 2016, after the Maharashtra government completed the examination of eight material witnesses in the case. The apex court had ordered day-to-day trial to start from March 4.

The Odisha Maobadi Party (OMP) 'chief', Sabyasachi Panda appeared before the District & Sessions Judge Court in Phulbani District on April 5, in connection with three cases filed under Daringibadi Police Station limits, reports New Indian Express. OMP is a splinter group of the Communist Party of India-Maoist (CPI-Maoist). All the three cases were registered in 2011 when Panda was active in Daringibadi area. In one of the three cases, it was alleged that Maoists, under the leadership of Panda, attacked Security Forces (SFs) during a combing operation in Daringibadi in 2011. After appearance of the Maoist leader in the District Court, the cases were transferred to Additional District Judge Court, Phulbani for trial and the next hearing was fixed on April 29.

A Lohardaga court on April 12, awarded life imprisonment to five Maoists for killing 11 SF personnel in a 2011 ambush in Senha block in Lohardaga District, reports The Times of India. In the series of 300 landmine blasts, 58 jawans (troopers) were also injured. ‘Sub-zonal commander’ Pooran Ganjhu, ‘area commander’ Akshay Kherwar and cadres Sudhwa Asur, Sunna Kherwar and Vishnu Asur were brought in the court of Additional District Judge Anil Kumar amid tight security. Additional public prosecutor A K Pandey said the Maoists have been given rigorous imprisonment. A fine of INR 10,000 has been imposed on each of the convicts.

Security Force (SF) personnel have confirmed the arrest of a top Communist Party of IndiaMaoist (CPIMaoist) ‘commander’, identified as Mansaram Hembram alias Bikas, in West Medinipur District of West Bengal, reports The Business Standard on May 12. Bikas was produced before a judicial magistrate court in West Medinipur District which sent him to Police custody for 12 days on May 11. A woman Communist Party of India-Maoist (CPI-Maoist) cadre and another person were on May 24 sentenced to life imprisonment by a district court for the abduction of the then District Collector R. Vineel Krishna five years ago, reports indiatoday.intoday.in. Additional District and Sessions Judge Bamashankar Mishra convicted Tapan Sha and M Divya alias Shanti and awarded life term for the abduction of the IAS officer on February 16, 2011. While Sha was a former government employee and had worked as a Gram Rozgar Sevak, Divya was a Maoist. The court, however, acquitted another accused Ghasiram Pangi due to lack of evidence.

A Delhi court on June 10 acquitted Maoist ideologue, Kobad Ghandy (68), of terror charges but held him guilty of cheating and forgery, reports The Hindu. However, the Additional Sessions Judge Reetesh Singh sentenced the Maoist leader for the period of imprisonment he had already undergone during the trial. “Kobad Ghandy is in custody since September 20, 2009, which is almost six years and six months. I therefore impose upon him a term of imprisonment already undergone by him and fine of Rs.10,000. Dindigul Police had taken her under custody for two days to investigate her involvement in arms training in Kodaikanal in 2008 along with Naveen Prasad, who was killed in an encounter during search operation near Moolayar at Vadakaunji on April 19, 2008. The remand was granted by Chief Judicial Magistrate (CJM), Gautam Buddha Nagar on the application moved by ATS on October 17," a senior Police official said. The Maoists, who were taken in remand included Ranjit Paswan, Krishan Kumar, Pawan Kumar Jha and Ashish Saraswat, he said. Averting a major Maoist attack in the national capital and its neighbourhood, the UP-ATS had on October 16 arrested a gang of rebels arresting 10 of them, including a self-styled ‘area commander’, and recovering a huge cache of arms and ammunition. AP Police, which filed a reply in the High Court, in response to a Public Interest Litigation (PIL) submitted by Civil Liberties Committee, said that the incident of firing took place outside of the territory of AP, in Odisha. In the reply, Visakhapatnam Rural District Superintendent of Police (SP) Rahul Dev Sharma said that on October 24, they got information about the presence of Maoists in the AOB (Andhra-Odisha Border) and Police parties of Odisha and AP reached the forest area of 'Ramagurah'. "On seeing the police parties, the Maoists, who were armed with latest automatic weapons, opened fire on the police parties resulting in injuries to two Greyhound Commandos, and one of them died. Despite the police calling upon the Maoists to surrender, they did not pay heed to the warning and continued firing, constraining the police parties to retaliate by counter-firing in self-defence," the SP said. As a result of this firing incident, some Maoists died and some more escaped. The incident was reported at Chitrakonda Police Station of Malkangiri District and a case was registered, which is under investigation by the Odisha Police. On ascertaining from the Chitrakonda Police, it was revealed that they found 24 bodies at the scene of offence (13 men and 11 women), the SP added. Civil rights activists had earlier moved the high court and filed a PIL seeking a thorough judicial probe into the incident. Advocate V Raghunath, on behalf of Civil Liberties Committee, had filed the litigation and demanded registration of murder cases against the AP Police. Seeking dismissal of the petition, Sharma said in the reply, "Police have not violated the law and the incident of firing has taken place in Odisha and is being investigated into. The writ petition seems to have been filed by twisting the facts of a legitimate joint-combing exercise and the counter-firing in self-defence." The court posted the matter for further hearing to November 8.

Sources said a joint team of Central Reserve Police Force (CRPF) and District Police personnel rounded up the four during a search operation launched following a tip-off on movement of suspected rebels in forests along the bank of Karo river in Tapkara area. After a hot chase, the security men arrested Prasanna Gudia, Ruben Gudia, Manoj Gudia and Susrihit Bodra from the village, some 40 kilometres from Khunti District headquarters. A gun, cartridges, mobile phones and PLFI literature were found on them. Another rebel Sanjeevan Topno alias Disco, however, gave the Police the slip in the darkness of the night. "The police have intensified search to nab Sanjeevan," Khunti SP Anish Gupta said. He added the four had revealed some information about the outfit and the Police were verifying their claims.

The Jehanabad District Court, on November 15, pronounced capital punishment to 10 of the 16 accused in the 1999 carnage in Senari village of Jehanabad District, in which 34 people were killed by the erstwhile Maoist Communist Centre (MCC), presently merged with the Communist Party of India-Maoist (CPI-Maoist), reports The Pioneer. A total 38 people had been accused in the case, of which 16 were convicted. The 16 accused were charged with killing 34 people in Sensari village on the night of March 18, 1999. It is to be noted that, special court in April 2010 handed out capital punishment to 16 accused and life imprisonment to 10 but the High Court in October 2013, acquitted all the convicts. It is worthwhile to mention that it was the Senari massacre which provoked the Ranveer Sena to take retaliatory action at Bathe in Arwal in which the landlords reportedly killed 62 persons, mostly Dalits, on December 1, 2000.

A local court dismissed a petition seeking re-post-mortem on the bodies of two Communist party of India-Maoist (CPI-Maoist) in Malappuram District on December 5, reports Business Standard. District and Sessions Judge S S Vasan in Manjeri D rejected the plea in this regard by Sreedharan, brother of slain Maoist leader Kuppuswamy Devaraj and some human rights activists, public prosecutor P Suresh said. The court observed that the autopsy was conducted by experts in Kozhikode Medical College Hospital and there was no need for a re-post-mortem. It also directed the hospital to hand over the bodies to relatives of the deceased. The Police can take further action if the relatives refuse to receive the bodies, he said. The court on November 29 had directed Police to preserve the bodies of the two Maoists until it pronounces its verdict on December 5, on a PIL by Sreedharan and some human rights activists. The petitioners had claimed the duo were gunned down in a "fake" encounter which was rejected by police saying they were killed in retaliatory firing, after the Maoists fired at them. KuppuswamyDevaraj, a Central Committee member of the outlawed outfit, and Ajitha were killed in an alleged encounter in the Nilambur Forests in the district on November 24 during search operations by a 60-member elite team of the Thunderbolt Force, based on a tip-off that some Maoists were camping in the area.
