A court in Dantewada District on January 7 ordered acquittal of 10 accused in the Tadmetla massacre of 76 Security Force personnel, 75 of them from the Central Reserve Police Force (CRPF), on April 6, 2010, reports The Times of India. Additional sessions judge Anita Deharia acquitted the 10 accused on the ground that the prosecution had failed to provide substantial evidence of their involvement in the case. Sympathy for Communist Party of India-Maoist (CPI-Maoist) philosophy with a likelihood to indulge in various violent activities is not sufficient ground to conclude that the accused are presently active members of the Maoist organisation, the Bombay High Court held while granting bail to four youths held from Pune in Maharashtra allegedly for their Maoist links, reports The Indian Express. High Court judge Abhay Thipse passed the order on January 31 stating that "suspects could be sympathisers of Maoist philosophy but none can be said to be active members of banned CPI (Maoist)". The suspects include Siddhartha Bhosale of Kondhwa, an economics student at Fergusson College, Deepak Dhengale, a poet-singer of Pune-based cultural group Kabir Kala Manch (KKM), and two girls, Mayuri of Nagpur and Anuradha Sonule of Chandrapur.

Court of District Judge II of Bokaro, Satya Prakash Sinha, on February 22, sentenced four Maoists, who were under trial since 2008, to 10 years of rigorous imprisonment, reports The Telegraph. Pradeep Jain, Dasho Manjhi, Jitu Singh alias Jitendra and Kundan Singh were held in August 2008, by Bokaro Police and convicted by the same court three days ago. All four were arrested on August 2007 during a raid from a secret hideout during the tenure of then SP Priya Dubey.

The Supreme Court (SC) stayed a Calcutta High Court judgment directing West Bengal to treat arrested members of the Communist Party of India-Marxist-Leninist (CPI-ML) as “political prisoners” by declaring the outfit a “political movement,” reports The Hindu. A Bench of Justices, Aftab Alam and Ranjana Desai, was acting on the State Government’s appeal challenging the rationale of the August 8, 2012 High Court verdict. The High Court had declared CPI-ML Spokesman Gour Nararayan Chakraborty, who was facing charges under the Unlawful Activities (Prevention) Act, a “political prisoner” under the West Bengal Correctional Services Act, 1992. Six other Maoists facing similar charges — V. Venketeswara Reddy, Sambhu Soren, Sagan Murmu, Chatradhar Mahato, Sukanti Baskey and Prasun Chatterjee — had also secured similar privileges from the High Court. The State asked whether an active member of a declared terrorist organisation could claim to be a political prisoner. “The judgment has wrongly held that even terrorist activities would amount to a political movement and therefore participants in such terrorist acts would be political prisoners.”

A Dantewada District Court, on April 9, acquitted all the 13 accused due to lack of evidence in a Maoist attack case in 2010 in which 33 people including security personnel were killed when Naxals [Left-Wing Extremists (LWEs)] allegedly blew up a bus in Sukma District of Chhattisgarh, reports Zee News. Defence lawyer Bichen Pondi said "The prosecution failed to provide substantial evidence that could have led to their conviction." Three months ago, the Dantewada District Court had acquitted all 10 arrested, due to lack of evidence, in connection with the 2010 Tadmetla attack case, in which 76 security personnel were killed in Dantewada District.

The Chhattisgarh Government, on May 19, ordered a judicial inquiry into May 17 night’s encounter between Security Forces (SFs) and suspected Maoists near Edasmeta village in Bijapur District, in which seven villagers, some suspected to be Jan Militia member, and one Maoist were killed. A Commission headed by Justice VK Agrawal, which is probing the encounter with Maoists at Sarkeguda in Bijapur District on June 28-29, 2012, will conduct the probe. The decision was taken at a meeting chaired by Chief Minister Raman Singh. The government also announced compensation of INR 5 lakh each to the kin of the dead.

Police sources said Darbha Police has registered FIR against CPI-Maoist Dandakaranya Special Zonal Committee (DSZC) secretary Ramanna alias Ravulu Sriniwas, South Bastar regional committee Secretary Ganesh Uike alias Paka Hanumanthu and others. Names of other Naxalite leaders Vinod, Dewa and many other rebels from Darbha division figured in the FIR. Bandopant and his brother Narendra were accused of supplying arms to LWEs with five others, including a Government doctor in Gadchiroli District. While four people were arrested, Bandopant, Narendra and the doctor, Ravindra Karpe, are still absconding. Bandopant approached the Nagpur bench of the HC seeking anticipatory bail on the ground that he was innocent and had never indulged in criminal conspiracy to provide explosives and ammunition to LWEs.

Acting on petitions filed by social anthropologist Nandini Sundar, Ram Guha, Swami Agnivesh, Kartam Joga and others, the Court on July 5, 2011 gave a series of directions to the Central and Chhattisgarh Governments and sought a compliance report. Both of them were picked up from the Deori bus-stand in Gondia District while they were "heading to Naxal-stronghold Abujmadh to meet a central committee (CC) member", according to the Police. The two were produced before a Gadchiroli court which remanded them to police custody for 13 days. Sources in Gadchiroli Police said they learnt about Rahi's mission from Hem Mishra, a former Jawaharlal Nehru University (JNU) student who was arrested on August 22 from near Morewada village in Aheri, south Gadchiroli. The court also extended the remand of Mishra for another 13 days. Rahi, who was one of the main campaigners during the Tehri dam protest in the '80s and '90s, attended school and college in Mumbai and then moved on to complete his engineering degree from Benaras Hindu University in Uttar Pradesh. His daughter Sikha assisted actor Aamir Khan in Hindi movie Taare Zameen Par.

The Supreme Court (SC) on September 9 sought responses from the Centre and nine States on a Public Interest Litigation (PIL) alleging that the Integrated Action Plan (IAP) to wrest control of Naxal [Left Wing Extremist (LWE)]-affected areas and undertake development there has not been implemented properly, reports The Times of India. A bench of Chief Justice P Sathasivam and Ranjana P Desai issued notices to Andhra Pradesh, Bihar, Chhattisgarh, Jharkhand, Madhya Pradesh, Maharashtra, Odisha, Uttar Pradesh and West Bengal on the PIL by Kishore Samrite. The petitioner said though the Centre had decided to extend IAP for four more years with annual allocation of INR 10 billion, it was facing implementation hurdles because of internal differences between various ministries in the Union Government. According to the fresh proposal, each of the 82 IAP Districts would be given INR 50 million annually for the purpose and the remaining INR 5.9 billion would be distributed among the Districts on the basis of their population and area.

In a six-page statement, the Maoists’ Koel Sankh Zone Spokesperson Sudhir condemned the three ex-Maoist leaders. The Union Ministry of Home Affairs (MHA) has told the Supreme Court that Communist Party of India-Maoist (CPI-Maoist) ideologues and sympathisers are more dangerous than the armed cadres of the CPI-Maoist as they were making all efforts to keep the Naxal [Left-Wing Extremist (LWE) movement alive, reports The Hindu on November 16. “The ideologues and supporters of the CPI (Maoist) in cities and towns have undertaken a concerted and systematic propaganda against the state to project it in a poor light and also malign it through disinformation… In fact, it is these ideologues who have kept the Maoist movement alive and are in many ways more dangerous than the cadres of the People’s Liberation Guerrilla Army,” the MHA said in an affidavit in the apex court. The Centre’s affidavit is in response to a Supreme Court notice on a PIL plea seeking directions to the Centre and nine Naxal-affected States to formulate a policy on the Maoist issue.
