A Dantewada District court has granted bail to the Essar general manager, who is one of the accused in the alleged payouts of the protection money by the multinational to the Communist Party of India-Maoist (CPI-Maoist) in Chhattisgarh, reports The Economic Times. Observing that the case of the accused DVCS Verma is different from that of the other accused, the district and sessions court judge A K Beck granted him bail saying the Police have failed to produce enough evidence against him even three months after his arrest, defence counsel K K Dubey told reporters on January 4. The court ordered Verma's release on two bonds of INR 200,000 each, he said.

A special Central Bureau of Investigation (CBI) court in Lucknow sentenced a State Bank of India (SBI) official and two others to six years rigorous imprisonment in a Fake Indian Currency Notes (FICNs) recovery case, the investigation agency said on January 18, reports CNN-IBN. Sudhakar Tripathi, the then Cashier of SBI at Domariaganj and two persons, Abid Ali and Ram Shankar Singh, were sentenced to six years Rigorous Imprisonment and a fine of INR 500,000 was imposed on each of them in connection with the recovery of FICNs from their possession, an unnamed CBI spokesperson said. "Further, the genuine currency to the tune of Rs 17.19 lakh [INR 1.71 million] which was recovered from the residence of Sudhakar Tripathi was ordered to be confiscated in favour of the State," he said. The agency had seized FICNs with a face value of INR 500,000 from the possession of Abid Ali while INR 5,000 worth FICN were recovered from Tripathi and Singh, the official said. CBI had filed a chargesheet against all the three accused on October 21, 2008. "The trial Court found the accused guilty and convicted them. One of the accused Ram Shankar Singh has also been earlier sentenced to four years Rigorous Imprisonment with a fine of Rs 5,000 on October 24, 2011 in another FICN case investigated by CBI," he added.

The Supreme Court (SC) on January 27 suspended the Andhra Pradesh High Court (HC) order granting bail to Communist Party of India-Maoist (CPI-Maoist) leader Kobad Ghandy, accused of being involved in the August 15, 2005 bomb attack that killed the then assembly deputy speaker Narsi Reddy and 10 others, reports The Times of India. A bench of Justice B S Chauhan and Justice K S Radhakrishnan also issued notice to Kobad Ghandy alias Aravindhu alias Kamal on a petition by the Andhra Pradesh (AP) Government that challenged the August 10, 2011 HC order granting him bail. The SC's stay came after the AP Government furnished evidence against him and his alleged involvement in 20 other cases.

Second Judicial Magistrate First Class (JMFC) court, through a judgment delivered on February 29, absolved six youth, who had been arrested by Policemen of Doddapet Police Station in Shimoga District in 2009, on charges of being involved with the Communist Party of India-Maoist (CPI-Maoist) activities. Anita, Jagannath, Devendrappa, Asha, Gangamma, and Mallesh, had been arrested on the allegation of being suspected Maoists, and getting involved with illegal activities. Because of the Maoist tag, they were lodged in Mysore jail. Judge of the court, Arjun Malloor, who heard the case, held that the prosecution had failed to prove the charges levelled against the youth. He ordered release of all the accused, observing that there are no evidences against them. It is said that Anita and Jagannath will be released immediately, as other cases filed against them have also been decided in their favour. The other four will continue to face some other cases. Therefore, their release will be dependent on the outcome of these cases.

Kolkata Police approached a Court in Kolkata on March 13 to frame charges against Sadanala Ramakrishna alias RK, the head of the Central Technical Committee of the Communist Party of India–Maoist (CPI-Maoist), and four other members of the outfit, arrested on March 1, under the Unlawful Activities Prevention Act (UAPA). While Chief Minister Mamata Banerjee had earlier opposed the UAPA being implemented by the previous Left Front Government, the decision by her Government to book the five accused under the UAPA has invited widespread criticism from various human rights organisations. A Delhi court on March 28 put on trial Communist Party of India-Maoist (CPI-Maoist) politburo member Kobad Ghandy for alleged cheating, forgery and impersonation while discharging him on charges under stringent anti-terror law, reports The Statesman. Paving the way for the trial, additional sessions judge Pawan Kumar Jain framed charges against 65-year-old Ghandy under various provisions of the IPC relating to cheating, forgery and impersonation in the case in which he is accused of trying to set up a base for CPI-Maoist. The court, however, discharged Ghandy of the charges under the Unlawful Activities (Prevention) Act due to improper sanction from the authorities. “In my opinion, case is made out against Gandhy under the provisions of Unlawful Activities (Prevention) Act but I am discharging (of the charges under UAP Act) him for want of proper sanction,” the judge said.

Two days after Communist Party of India-Maoist (CPI-Maoist) leader Kobad Ghandy was absolved of the terror charges under the Unlawful Activities Prevention Act (UAPA) for want of proper sanction, the special cell of Delhi Police have made a fresh plea to a Delhi court on March 30 with a renewed sanction of his prosecution under the anti-terror law, reported The Times of India. The charge sheet will come up for consideration on March 31 (today). A court in Delhi on April 30 took cognisance of the charge sheet filed against Communist Party of India-Maoist (CPI-Maoist) Politburo member Kobad Ghandy by Delhi Police indicting him of offences under the Unlawful Activities (Prevention) Act (UAPA), reports The Hindu. Ghandy was discharged of UAPA charges by a Sessions court on March 28 owing to a defective prosecution sanction obtained by Delhi Police. Following this, the Delhi Police filed a fresh charge sheet before Chief Metropolitan Magistrate Vinod Yadav. On April 30, Yadav took cognisance of the charge sheet for offences punishable under Sections 20 and 38 (membership of terrorist organisation and furthering its activities) of the UAPA. With this, Ghandy's case will again be put up for arguments on charge in a Sessions court. Ghandy has been accused of trying to set up a base for the CPI-Maoist in Delhi.

Angelina Sontakke, Sushma Ramteke, Nandini Bhagat, Jyothi Chorghe, Anuradha Sonule, Siddharth Bhosale and Dhawale Dangle had all filed a bail saying that there is no case in connection with them and evidence is fabricated. However, special public prosecutor Rohini Salian told the court that a compact disc recovered from them is a clinching evidence against them. In its objections, the State Police has appealed to the court not to grant him bail stating that incriminating documents, newspaper cuttings and pro-Maoist literatures were found in his possession. The State also said that the accused student had provided shelter and food to several Maoists at his home. The State also submitted that he had participated in a training camp organised by them in the Western Ghats. Objecting grant of bail to Vittala, the State also raised apprehension that if released, he might again join the Maoist movement. Communist Party of India-Maoist (CPI-Maoist) leader Kobad Ghandy was charged with membership of a terrorist organisation under the Unlawful Activities (Prevention) Act (UAPA) on July 16, reports The Hindu. He pleaded not guilty and sought trial which will now begin on September 4. Additional Sessions Judge Pawan Kumar Jain had on March 28 said that UAPA Sections 20 and 38 relating to membership of a terror organisation were made out against Ghandy. However, he refused to frame charges on these counts pointing out that the prosecution sanction that was taken was defective. The court ruled that the police had violated Section 45(2) of the UAPA by not submitting the charge sheet to an independent authority constituted by the Central or State Government, which after vetting the documents was to recommend the sanctioning authority (Lieutenant-Governor) to grant sanction for prosecution. Jain had on that occasion discharged Kobad Ghandy for the offences punishable under Section 10/13/18/20/38 of UAPA pointing out that no case was made out against the accused qua these sections. The Delhi Police on March 30 filed a supplementary charge sheet with fresh prosecution sanction following which arguments on charge were taken up again. The defence did not contest the charges of cheating, impersonation and forgery under the Indian Penal Code that were framed on March 28.

The Supreme Court (SC) on July 27, refused to interfere with the Andhra Pradesh High Court order granting bail to the alleged top Communist Party of India-Maoist (CPI-Maoist) leader Kobad Ghandy in a 2005 case of murder of nine persons including a senior Congress leader, reported IBN Live. "Our order will be meaningless. The entire exercise will end in futile," said a bench of Justice B S Chauhan and Justice Swatanter Kumar, pointing out that Ghandy's status will remain same as he is in Tihar Jail for the cases registered in the Capital against him. The bench said Andhra Pradesh government's plea against the High Court's order could be heard later if Ghandy is granted bail in cases registered by the Delhi Police. "We will keep your appeal pending," the bench told senior advocate Mahabir Singh, who, appearing for the Andhra Pradesh Government, sought cancellation of bail to Ghandy. The apex court had on January 27 stayed the Andhra Pradesh High Court order, which had granted bail to Ghandy, accused of killing the erstwhile Deputy Assembly Speaker Narsi Reddy and eight others on August 15, 2005. While staying the bail order, the apex court had issued notices to Ghandy who is at present lodged in Delhi's Tihar Jail. The alleged Maoist leader, who has been in jail since 2009 after his arrest, is facing trial in around 20 criminal and terror cases in different parts of the country. Congress leader Chittem Narsi Reddy and eight others were killed by Maoists in Narayanpet in Mahbubnagar District on August 15, 2005. The High Court had granted bail to Ghandy on August 10, 2011. The State Government had claimed Ghandy had confessed to his role in a statement made after his arrest in Delhi in 2009.

Subhasish Roy, counsel for the Maoists said that under the West Bengal Correctional Services Act, 1992, these prisoners were entitled to the status of political prisoner. All the accused pleaded not guilty before the MCOCA court. The court charged the accused under the provisions of MCOCA and Arms Act, in addition to provisions of the Indian Penal Code (IPC). The court rejected the prosecution's plea to defer framing of charges till the Maharashtra Anti Terrorist Squad (ATS) filed a charge sheet against one of the prime handlers of the November 26, 2008 (26/11) Mumbai (Maharashtra) attacks and arrested Lashkar-e-Toiba (LeT) operative Abu Jundal alias Zabiuddin Ansari. The trial in the arms haul case was stayed by the apex court after one of the accused challenged the constitutional validity of certain provisions of the MCOCA. The apex court had, in May 2009, lifted the stay and the trial was to commence in June 2010. As per the prosecution's case, in May 2006, the ATS booked 21 persons for carrying a large amount of explosives and arms. The ATS claimed to have seized 43 kg of RDX, 50 hand grenades, 16 AK-47 rifles and over 3,000 live bullets from Chandaud in Aurangabad.

The National Investigation Agency (NIA) filed a charge sheet against five Communist Party of India-Maoist (CPI-Maoist) leaders in a special NIA court in Kolkata on August 23, accusing them of manufacturing local weapons illegally to "intensify the war against the country", reports PTI. The five Maoists, including 'central technical committee' member Sadula Ramakrishna alias Sadanala Ramakrishna, Dipak Kumar Pargania, Sukumar Mondal, Sambhu Charan and Bapi Mudi were arrested in a joint operation by the elite anti-Naxal [Left Wing Extremism (LWE)] force Greyhounds of Andhra Pradesh and the Special Task force (STF) of Kolkata Police in March. The charge sheet also names five Maoist leaders, who are all on the run, as part of the conspiracy, adds The Times of India. Prabhakar Suryadeora, Arun Parera, Anjela Sontakke, Anuradha Sonule, Mayuri Bhagat, Jyoti Chorghe, Bhimrao Bhowate, Sushma Ramteke and Siddhartha Bhosale are accused of murder, attempt to murder, damage to public property and arson in connection with various incidents in the District. Eight other witnesses were also examined in the case relating to the murder of Piniti Suresh at Basnaput under Bandhugaon Police Station limits of Koraput District on September 7, 2009. The Police said this after reviewing the call details of Bittu, who was produced in the court on September 25. The court extended his Police remand by two days. The Police said they had to recover the explosives and weapons from his possession. The Police claimed that the investigation found that Bittu used to lure the youth by giving them money that was transacted into his bank accounts from foreign countries and used to distract them. Bittu has been facing the trial for allegedly threatening the witnesses of the Shingar Cinema bomb blast case [Ludhiana, October, 2007]. According to Police Commissioner Ishwar Singh, another woman witness has contacted the police and filed a complaint against Bittu, alleging that he threatened her to change her statement.

Emphasising on validation of rights of tribals and forest-dwellers over the forest lands, the Supreme Court has said that Naxalism [Left Wing Extremism (LWE)] was a result of an oversight of constitutional provisions relating to administration of schedule areas and tribes of the country, Indian Express reports on October 3. “Nobody looks at Schedules V and VI of the Constitution and the result is Naxalism. Urbanites are ruling the nation. Even several union of India counsel are oblivious of these provisions under the Constitution,” said a Bench led by Justice A K Patnaik. The Bench made a reference to Schedules V and VI as they contain various provisions relating to administration and control of scheduled areas and scheduled tribes in several parts of the country. The court made the observations during a recent hearing on fresh guidelines over tiger reserves.

Superintendent of Police (SP) Amol Venukant Homkar said that Maoists gunned down Sharma near the gate of Bimal Sagar Maharaj temple at Parasnath Hills because he had sacked a married woman labourer indulging in an illicit relationship. The woman, Sanjhali Devi alias Churki, wife of one Sirka Majhi of Jobhitola Taratand area under Nimiyaghat Police Station, used to work as a cleaner at an organisation headed by victim Sharma. The ailing rebel leader, who is in his mid-70s, was granted bail by the court of Justice SC Mishra. Police said though Roy was facing trial in various cases of violence, arson and murder in Jharkhand, West Bengal and Odisha, the state did not oppose his bail plea on humanitarian ground. There are 18 cases pending against him but he is very sick and recently underwent a surgery for cancer. Roy was arrested from Midnapore in West Bengal in May 21, 2005. However, R Roy would be out of jail only after he gets bail in another case, he added. Earlier, Roy's kin had met Union Home Minister Sushil Kumar Shinde around a fortnight ago, seeking amnesty on his behalf on account of his terminal illness and old age. Though Roy is charged with sedition, Shinde took a humanitarian view of the request and forwarded the matter to the Jharkhand government, suggesting that Roy be given relief from incarceration in what are probably his "last days".

According to Police, a shoot-out took place between the Police and the Maoists in the forest between Pidmili and Piddur on July 4, 2010 when the Special Anti-Naxal [Left Wing Extremism (LWE)] Squad and a team Commando Battalion for Resolute Action (CoBRA) troopers were conducting a combing operation. Miccha was arrested during the encounter and charged with attempt to murder and offences under Indian Arms Act. The court sentenced him, and also imposed a fine of INR 500 on him.

Anti-Naxal [Left Wing Extremism (LWE)] cell and C-60 squad arrested a top Communist Party of India-Maoist (CPI-Maoist) cadre, identified as Sanjay alias Bandu Bawne (34), in a joint operation on December 9, from his residence in Bhatala village under Shegaon Police Station in Warora tehsil (revenue unit) in Chandrapur District, reports The Times of India. Bawne, a top Maoist cadre of Chandrapur area committee of CPI-Maoist and was wanted for more than one Maoist-related offence. Bawne was wanted for participating in antinational activities with Deshbhakti Yuva Manch, the front organization of urban Naxal outfit that was busted in January 2008. He also was accused of putting up provocative Naxal pamphlets in Bramhapuri in 2011. He was produced before the court, which granted him Police Custody Remand (PCR) till December 17 on December 10.

West Midnapore Additional District and Sessions Judge Partha Pratim Das said trial of the 20 accused would commence in February, 2013. They were charged under various sections of the IPC including murder, the Unlawful Activities Prevention Act and the Railways Act. The 20 against whom charges were framed included the prime accused Joydeb Mahato, Asit Mahato and Bapi Mahato -all belonging to the Communist Party of India-Maoist (CPI-Maoist)-backed People's Committee against Police Atrocities (PCPA). No charges were framed by the special court against one of the arrested accused as he is a minor. Another two are still absconding.

The National Investigation Agency (NIA) on December 29, filed a supplementary chargesheet against four Communist Party of India-Maoist (CPI-Maoist) cadres in Kolkata (West Bengal) for trying to manufacture rockets, launchers, rocket-propelled grenades and 51 mm mortars, according to Hindustan Times. The probe had revealed that the naxal’s secret weapon programme was running under the direct guidance of top naxal leader Muppala Laxmana Rao alias Ganapathi. The first chargesheet was filed against Sadula Ramakrishna, Dipak Kumar, Sukumar Mondal, Sambu Charana and Bapi Mudi. Now the agency has filed a supplementary chargesheet against Asimkumar Harnath Bhattacharya among others. They have been charged with running the Maharashtra unit of the Central Technical Committee of the CPI-Maoist that used to receive regular instructions from Ramakrishna.
