The ongoing probe into the 2013 killing of 27 Congressmen by Communist Party of India-Maoist (CPI-Maoist) at Jiram Ghati in Bastar District seems to have made a significant headway with the Police identifying the owner of the SIM card allegedly used by Maoists to track the movement of the Congress convoy in the area before targeting it, reports The Asian Age on January 9. “The cyber cell of the Chhattisgarh Police has identified the owner of the SIM card used by Naxals during Jiram Ghati attack. He is a local forester. The calls made from a cell phone at the ambush site on the fateful day have been traced to the SIM. The call details recovered from the SIM have revealed involvement of some other people in the incident. Calls made to the SIM had been tipping-off the movement of the Congress convoy in the area, second by second,” a senior Police officer has said. “The forester along with two other local people has been detained for interrogation. We are confident of a major breakthrough in the case after their interrogation,” the Police officer said. All the three suspects would soon be handed over to National Investigation Agency (NIA) which is also probing the case.

A local court in Hyderabad on January 21 sent Salman Mohiuddin, who was arrested for allegedly trying to leave the country to join the Middle-East terror group, Islamic State of Iraq and Syria (ISIS) to 10-day Police custody, reports First Post. Cyberabad Police, in its petition, had earlier sought 15-day custody of Salman and told the court that it needed to further probe his alleged ISIS links. The 32-year-old United States (US)-returned engineering graduate was arrested on January 16 at the International Airport in Hyderabad when he was on way to Dubai. The Police said the Hyderabad resident was planning to go to Syria via Turkey. Further, he intended to undergo training in Syria and return to indulge in anti-national activities in the country, they claimed.

The Supreme Court on February 6 ordered immediate release of Sangram Mohanty, son of Jana Adhikar Manch convenor Dandapani Mohanty and member of Odisha Jan Morcha (OJM), reports The Times of India. He was in jail since December 5, 2012, for his alleged links with the Communist Party of India (CPI-Maoist). The court of Additional District Judge (ADJ) in Koraput District on February 16, acquitted Nachika Linga, leader of Chasi Mulia Adivasi Sangh (CMAS), of charges framed against him by the Police on May 15, 2011, reports Odisha Sun Times. It may be mentioned that the Narayanpatna Police, during the anti-Maoist operation, had seized a huge cache of arms and explosives from Kanchanpadu village on May 15, 2011 and registered cases against 35 persons, including Nachika on treason charges and the Arms Act. Terming the cases registered against the accused as baseless, Nachika’s counsel Manoranjan Routray had moved the court. After hearing the petition of the counsel, ADJ Pradip Kumar Mohanta acquitted Nachika of the charges.

The State Government made the submission when petitions by Jaison C. Cooper of Fort Kochi and advocate Thushar Nirmal Sarathi of Palakkad seeking bail in a case registered against them under the provisions of the Unlawful Activities (Prevention) Act for their alleged links with Maoists came up for hearing. While opposing the bail petitions, Director General of Prosecution (DGP) T. Asaf Ali submitted that the government was more concerned about the safety of the public. If the petitioners were released on bail, the public would be in danger. He submitted that the petitioners were active members of the CPI-Maoist.

The Kerala High Court on March 3 dismissed the bail pleas of Thushar Nirmal Sarathy and Jaison C Cooper, who allegedly belong to a Communist Party of India-Maoist (CPI-Maoist) front organisation and were behind the attack on NHAI office in Kochi, reports The Times of India. Turning down the bail pleas, justice B Kemal Pashad held that the contents of the case diary prima facie reveal their complicity and the matter requires thorough and continued investigation. Considering the seriousness of the allegation and the present stage of investigation, it is premature to grant bails now, the court said.

The Kerala High Court on March 17 granted bail to Thushar Nirmal Sarathy and Jaison C Cooper, who allegedly belong to a Communist Party of India-Maoist (CPI-Maoist) front organization, reports The Times of India. Sarathy and Cooper, who were arrested after the attack on National Highway Authority of India’s (NHAI) Kochi office, were later released from Kakkanad District jail on March 17. A division bench comprising justices KT Sankaran and Babu Mathew P Joseph granted conditional bails after prosecution informed that their continued detention is not warranted. Though they had sought bails earlier, a single bench of the court had declined their request after the prosecution had opposed the pleas saying that investigation was at an early stage. The CPI-Maoist is offering money, liquor and ganja to tribals to do favours for them, reports The New Indian Express on March 18. Maoists are shedding their ideologies to woo the tribals living in the forests of Kerala, if reports are to be believed.

All the activists were allegedly working for the Communist Party of India-Maoist (CPI-Maoist) in Nadia District in south-central Bengal and had been languishing in various jails for nearly 10 years. They were charged under the Arms Act of 1959 and various sections of the IPC. However, none of the charges was established and thus all the activists were acquitted by the (Addl.) District and Sessions Judge, Rupanjana Chakravarty. Ajit Chakravarty, Pradeep Chatterjee, Lata Murmu, Gupi Das, Haidar Ali Chowdhury, Paresh Tirkey and Mongal Mondal were released.

Since Roopesh, Shyna and three others were sent to the custody of Tamil Nadu Q Branch for 10 days, the arrest could not be recorded. The officials of ISIT said that they would be approaching court for getting Roopesh and Shyna in custody once Q Branch hands them back to judicial custody. The ISIT will also approach various courts where cases against the couple were registered, for issuing production warrant. Four cases are being probed by ISIT involving the couple in the state. The first case was registered at Perumbavoor Police Station for arranging hideout for Maoist Central Committee member Mala Raja Reddy and wife Beecha Sugna alias Sangeetha.

Earlier, on April 30 the Court had found 13 persons guilty of various charges including terrorism and criminal conspiracy in the cases related to the chopping of the palm of T J Joseph, a professor with the Newman College in Thodupuzha in Idukki District by the activists of radical outfit Popular Front of India (PFI). Those awarded 10-year rigorous imprisonment were found guilty under various sections of Unlawful Activities [Prevention] Act (UAPA), along with different sections of the Indian Penal Code (IPC) and Explosive Substances Act. The rest three were convicted for offences under IPC. The court also imposed a fine of INR 8 lakh on the 13 convicts which will be given to the victim, professor T J Joseph. There are 54 accused persons in the case, of which 37 were charge-sheeted by the NIA. As many as 31 persons have undergone trial, and six accused are absconding The incident happened on July 4, 2010, when Prof T J Joseph was returning home with his family after attending the Sunday Mass. A six-member gang pulled him out of his car and chopped off his palm for authoring a question paper that allegedly had material insulting the Prophet.

The Jharkhand High Court on May 22 asked the Cental Government to extend necessary assistance, both financial and human resources to the State for the development of the 21 Communist Party of India-Maoist (CPI-Maoist)-affected Districts, reports The Times of India. A division bench comprising Chief Justice Virendra Singh and Justice PP Bhatt delivered the order in connection with the kidnapping of 35 children by Maoists in Gumla District in which the Chief Justice in his motion, treated news published in a vernacular daily on April 22 as Public Interest litigation (PIL) and notices were issued to the Central and State officials. In his affidavit, Jharkhand Director General of Police (DGP) DK Pandey submitted that 21 anti-Maoist operations spread over 98 days have been conducted in Gumla District to free the kidnapped children during which five children were rescued. Identifying Lohardaga, Gumla and Latehar as Maoist hotbeds, Pandey said the State was looking at Central assistance in terms of finance and human resources to set up seven camps in the area to facilitate development. The DGP submitted that though he had written to the Union Home Secretary in this connection on March 31, 2015, the latter was yet to respond. Advocate General Binod Poddar apprised the Court that the Centre has released INR 184.19 crore in 2013-14 and INR 340 crore for 2014-15 under the Integrated Action Plan (IAP) for 17 LWE- affected districts.

Muhamed Mustaque while delivering a judgement said that State pay a compensation of INR 10000 and INR 10,000 as cost to the petitioner Shyam Balakrishnan from Wayanad District in the case. In his judgment Justice A. Muhamed Mustaque further held that in this case, “the facts will clearly indicate that the petitioner was arrested as a suspected Maoist. At the relevant time, the police had no clue about the offence committed by the petitioner. The only reason on which the petitioner was arrested was that he was a suspected Maoist. No doubt, the police, on realising the mistake, released the petitioner without registering a case.” The judgment pointed out that in this case “police violated the liberty of the petitioner by taking him into custody without satisfying that the petitioner was involved in any cognisable offence punishable under law.”The Court further said “if the Maoist organisation is a proscribed organisation under the law, activities of the Maoist organisation can be interfered. If the individual or organisation abhors and resorts to physical violence, the law agency can prevent or take action against the individual or organisation.” ‘‘The police version that the petitioner was rescued from the agitated mob cannot be believed. The General Diary and other action on the part of the police in searching the house of the petitioner will clearly indicate that the petitioner was taken into custody as a suspected Maoist,” the judgment said.

A division bench comprising Chief Justice Ashok Bhushan and Justice A M Shaffique was considering an appeal filed by the State Government against the order. The single bench's ruling, on a petition filed by Shyam Balakrishnan of Wayanad, had also said that being a Maoist is not a crime and detaining a person for questioning will amount to illegal detention if the legal formalities of an arrest are not followed. The appeal filed by the government through senior government pleader C S Manilal says that being Maoist is a crime and the single bench's ruling is illegal. It demands that the order should be set aside. As an interim relief, it had sought a stay on further proceedings based on the judgment.

The Additional District Judge (ADJ) Court of Berhampur on July 17 quashed imposition of Unlawful Activities (Prevention) Act, 1967, (UAPA) on arrested Odisha Maobadi Party (OMP) ‘chief’ leader Sabyasachi Panda and Dandapani Mohanty by the prosecution, reports The Hindu. Dipak Patnaik, counsel of Sabyasachi and Dandapani, said the Court quashed imposition of the UAPA as the prosecution had not adhered to basic norms needed for its imposition. “As per section 45 (2) of the UAP Act, no court should take cognizance under this Act without having a valid sanction from the Central government. The initial charge sheet filed by prosecution did not include any sanction order from the government for imposition of this Act. Moreover, the sanction order had to come from a reviewing officer of secretary rank of Central government as it a Central Act. But on a later date prosecution had filed a sanction order for UAP Act from the State government, which was not authorised for it,” Patnaik added.

Communist Party of India-Maoist (CPI-Maoist) ideologue Kobad Ghandy, accused of propagating the activities of the party in Delhi, was granted interim bail by a Court on September 29, reports India Today. Additional Sessions Judge (ASJ) Reetesh Singh granted interim bail to Ghandy, who is facing charges dealing with cheating, forgery and impersonation under the Indian Penal Code (IPC) and under provisions of Unlawful Activities (Prevention) Act (UAPA). The Court said that 65-year-old Ghandy, who is in custody in this case since September 2009, was suffering from various ailments and his condition has "visibly deteriorated" during the period of trial. "In these facts and circumstances, I admit accused Kobad Ghandy to interim bail for a period of three months on his furnishing a personal bond in the sum of Rs 1 lakh and two sureties of the like amount," the Court said.

The Maharashtra Anti-Terrorism Squad (ATS) on October 14 filed a chargesheet against senior CPI Communist Party of India-Maoist (CPI-Maoist) member Kannamballi Muralidharan alias Ajith at a special court, reports punemirror.in. The investigation has so far revealed that the accused was using different names by forging documents and had been in contact with several youths attached to the Maoist movement, especially in Thane, Mumbai and some parts of Pune. Assistant commissioner of police (ATS-Pune unit) Bhanupratap Barge, who has been probing the case, said, "After getting the state government's sanction under the Unlawful Activities (Prevention) Act (UAPA), we submitted the chargesheet on Wednesday. The chargesheet runs into 600 pages, with all the details of the investigation." Muralidharan (62) was arrested from his hideout at Talegaon Dabhade on May 9 this year. Since then, he has been lodged at the Yerwada Central Jail.

Naidu, heading the one-man panel to probe into the 2008-Kandhamal riots, has indicated the role of the Communist Party of India-Maoist (CPI-Maoist) in the murder of Vishwa Hindu Parishad (VHP) leader Swami Laxmananda Saraswati, reports The Hindu. “The circumstantial evidences as well as the situations that led to the murder and the post-murder developments have clearly indicated the role of Maoists,” Justice Naidu said after submission of his report to the State Government.
