The Supreme Court (SC) on April 2 said that the conflict-era cases can be tried under existing laws, reports Republica. The court´s decision has come at a time when both the Maoist parties - Unified Communist Party of Nepal-Maoist (UCPN-M) and Communist Party Nepal-Maoist (CPN-Maoist) - have been continuously exerting pressure on the political leadership not to take up insurgency-era cases until the Truth and Reconciliation Commission (TRC) and the Commission on Disappearance are formed. The former rebels are for settling all the war-time cases solely through the two commissions and not under existing justice system.

Unified Communist Party of Nepal-Maoist (UCPN-M) Chairman Pushpa Kamal Dahal while addressing the inaugural session of the 19th national conference of the party’s student wing All Nepal National Independent Students Union-Revolutionary (ANNISU-R) in Kathmandu on April 4 warned of serious consequences if the Supreme Court fails to respect the past agreements, including the Comprehensive Peace Accord, reports The Himalayan Times. “The country will plunge into a serious conflict if the court tries to act as a superpower,” said the former rebel leader. The Supreme Court had, on April 2, paved the way for prosecuting war-era cases under the regular justice system.

Unified Communist Party of Nepal-Maoist (UCPN-M) leaders on April 6 met Prime Minister Sushil Koirala in Kathmandu and expressed concern about the ‘unilateral decision’ to reform the Bills on Truth and Reconciliation Commission (TRC) and Commission on Disappearances and called for downsizing negative list for granting amnesty, reports The Himalayan Times. Former UCPN-M general secretary Bahadur Bogati said that the Government had taken a negative approach and claimed that establishing truth should be the main objective of the commissions. The guilty should seek apology and the victims should forgive them so as to develop harmony in the society. “If we try to punish each other and go for vengeance, society will again plunge into serious conflict,” he warned.

Leaders of ruling coalition partners Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) on April 7 stressed on the need to form the Truth and Reconciliation Commission (TRC), which doesn’t grant general amnesty to perpetrators of human rights violation or initiate any kind of reconciliation attempts with them without the consent of victims (or the family of the victims), reports Nepal News. CPN-UML leader Pradip Gyawali opined that the to-be-formed TRC should respect the rights of the victims on whether to pardon or reconcile with the victimizers. Similarly, NC leader Ramesh Lekhak said that the transitional justice mechanism as well as the TRC should be formed in a manner that will provide justice to the victims as per the tenet and spirit of the Comprehensive Peace Accord and the Supreme Court decision.

Republica on April 8 reports that according to Unified Communist Party of Nepal-Maoist (UCPN-M) leaders as a result of its humiliating defeat in the CA polls, active members of UCPN-M are likely to decrease significantly during its upcoming general convention. Party leaders said the members of the party are likely to decrease by almost one-fourth compared to its seventh general convention held in Hetauda in 2013. The party said members are likely to decrease as several of its members have joined Mohan Baidya-led Communist Party Nepal-Maoist (CPN-Maoist) while the others have not renewed memberships.

Nepali Congress (NC), Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and Unified Communist Party of Nepal-Maoist (UCPN-M) at a meeting held at the Prime Minister´s official residence in Kathmandu on April 13 reached an understanding to stand united in Parliament to endorse the bill on Truth and Reconciliation Commission (TRC) and the Commission on Enforced Disappearance (CED), reports Republica. The leaders said they took the decision as the bill was finalized as per the political understanding reached among the three parties. The Government subsequently registered the bill at Parliament secretariat last week and lawmakers are to deliberate on the proposed laws in the House meetings scheduled for later this week.

A day after a District attorney’s office filed case against 13 cadres for a 2004 murder, the Unified Communist Party of Nepal-Maoist (UCPN-M) on April 14 boycotted a scheduled three-party meeting in protest and warned of further protests, reports The Hindu. The meeting between the Nepali Congress (NC), the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and the UCPN-M was scheduled at the Prime Minister’s official residence in Kathmandu. The Maoist leaders came to the venue and after expressing their protest and warning, left the place. The Maoist leaders also threatened not to show up in any meeting with political parties unless the cases were withdrawn.

After conducting a hearing for two days, District Judge Binod Mohan Acharya delivered the order in the case. As per the court order, Bhimsen Poudel and Chhanilal Poudel have been decreed a bail amount of NPR 27,000 and NPR 20,000, respectively, as the pre-condition for their release from the judicial custody. Among the 13 Maoist cadres alleged of involvement in the Adhikari murder case, 11 are absconding. The court has issued arrest warrant against them.

During the debate, Prakash Jwala of Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) said the bill has not made it mandatory to get consent of the concerned victims before the commission granting amnesty to a perpetrator and demanded that the provision be amended by making the victim’s consent compulsory for pardoning the perpetrator concerned. Agni Sapkota of the Unified Communist Party of Nepal-Maoist (UCPN-M) lauded the bill as historic and urged those who opposed it to accept the political changes that took place in recent years. Even lawmakers from the same party expressed differing opinions about the bill. Senior Nepali Congress (NC) leader Kul Bahadur Gurung fiercely criticized the bill saying that it was faulty in its overall spirit while Ramesh Lekhak of the same party argued that the proposed law wasn’t flawed as projected by a section of society.

While those loyal to Baburam Bhattarai are holding their function at Dharahari Village Development Committees (VDC), and the supporters of Dahal are organising a parallel conclave at Gedahiguthi VDC of the District. The organizers of both the conclaves have claimed their event to be the official one. "We should rise above individual interest in the party," said lawmaker Ashok Jaiswal, loyal to Prachanda, accusing the Bhattarai faction of derailing the party's main agenda.
