A Delhi court on April 1 declared three Jaish-e-Mohammed (JeM) terrorists Masood Azhar, Ghazi Baba and Tariq Ahmed, all Pakistanis, as ‘proclaimed offenders’ in the December 13, 2001 terrorist attack on Parliament. The court also directed the Delhi Police to seek assistance of the Interpol after the prosecution submitted that all steps were taken to trace the three accused in the case. The prosecution had moved an application in the court requesting it to declare the three as proclaimed offenders. The prosecution also informed the court that all efforts were made to trace the immovable and movable properties of the three persons but without any success. The police have charged the three accused with having masterminded the December 13 terrorist attack in which five Pakistani terrorists attempted to attack the Parliament House. All the five were killed in an encounter and four of their associates arrested and booked under the Prevention of Terrorism Ordinance (POTO).

It replaces the Prevention of Terrorism Ordinance (POTO) first promulgated in October 2001 and re-promulgated in December 2001.

The Supreme Court on April 2 upheld the death penalty awarded to a Khalistani terrorist Devender Pal Singh under the erstwhile Terrorist and Disruptive Activities (Prevention) Act (TADA) on the basis of a confessional statement to the police which he had later retracted. Singh was an accused in the 1993 car bomb attack, which targeted the then Youth Congress President M S Bitta. Nine persons were killed in that incident. The Court held that death penalty was “the most appropriate sentence” for Singh. He confessed “voluntarily” and his retraction was an “afterthought”, added the court.

A Delhi court on April 8 closed a 11-year old case filed under the Terrorist and Disruptive Activities (Prevention) Act, TADA, against the Akali Dal (Mann) leader and Member of Parliament Simranjit Singh Mann, saying the prosecution was not interested in his trial. The court observed, "The case is closed against Mann because this court feels that the prosecution is not interested in arresting him and sending him to face trial in the court". The court said despite warrants issued against Mann and another Akali leader Talib Singh Sandhu 11 years ago, the same had not been executed and these persons were ‘roaming freely’. A TADA case against Mann was filed in 1991 for alleged activities of sedition and delivering inflammatory speech at a Gurudwara in the capital where he had spoken about formation of Khalistan.

The visiting US Assistant Secretary of State (South Asia) Christina Rocca on April 9 discussed Maoist insurgency in Nepal with the Joint Secretary (North) in the Ministry of External Affairs in New Delhi. Media reports pointed out that India and the US had been holding extensive consultations on the Maoist insurgency in Nepal. From the US point of view, the insurgency in Nepal falls within the ambit of its global campaign against terrorism. Earlier, in March, a US team from its Pacific Command had visited Nepal to take stock of its military requirements.

A student from Myanmar, who was one of the two hijackers of a Thai Airways passenger aircraft in 1990, was arrested by the West Bengal police in Delhi on April 10. The accused, a supporter of the pro-democracy leader in Myanmar Aung Sang Suu Kyi had hijacked the plane and diverted it to the N S C Bose International Airport in Kolkata. The two students released all the passengers after a few hours of negotiations and surrendered to the Indian authorities at the airport. They had been granted bail by the court in Kolkata after a few months of the incident. Police sources said that the accused is being brought to Kolkata for further interrogation.

The Central Bureau of Investigation (CBI), on April 11 sought help of the United States and its investigating agency, Federal Bureau of Investigation (FBI) in the extradition of 20 wanted criminals and terrorists from Pakistan. The request was conveyed to the visiting US Assistant Secretary of State for South Asia Christina Rocca by CBI Director, P C Sharma at a meeting in New Delhi, official sources said. Reports said that Sharma also pointed out to Rocca that as terrorism was acknowledged as an international problem, the US should help India and its agencies in getting the 20 criminals and terrorists from Pakistan. During the meeting, Sharma also reportedly emphasised that the CBI had given a lot of information to the FBI in the IC-814 hijacking case and expressed hope that the FBI would also share information with them as they had also registered a case and were carrying on their own investigation into the case.

A Delhi court on April 18 discharged four out of six terrorists of the Jammu-Kashmir Islamic Front (JKIF) chargesheeted by the city police for allegedly waging war against the Government of India. The court acquitted the four for want of sanction from the Union government to prosecute them for waging war against the government of India as also for lack of evidence. However, the court framed charges against two other JKIF terrorists Feroze Ahmad Mir and Mohammad Sayed Tantrik alias Yusuf under section 121 (Waging or attempting to wage war or abetting waging of war against government of India), section 121-A (conspiracy to commit offences punishable by section 121) and section 120-B (criminal conspiracy) of the Indian Penal Code (IPC). The police had arrested Feroze Ahmad Mir and Tantrik on June 20, 2001 from a guest house in Delhi and seized Rs 15 lakh from them. Later rests of the accused were arrested on the basis of their statements.

India and China on April 23 held the first meeting of the dialogue mechanism on counter-terrorism in Delhi with both sides sharing their national experience on dealing with the problem. A Ministry of External Affairs spokesperson told the media that the two sides exchanged views on international counter-terrorism situation, including developments in the region. Cooperation at the United Nations and possibilities of enhancing bilateral cooperation were also discussed by the two sides. The next round of the dialogue will be held in Beijing in early 2003.

A Delhi court on April 27 sentenced three Pakistani terrorists of the Harkat-ul-Ansar (HuA) to death in the case of abducting four foreign nationals in 1994, in which Omar Sheikh, a leader of the Jaish-e-Mohammed (JeM) was the main accused. The court awarded the death sentence to Nazir Khan, Abdul Rahim and Naser Mahmood Sadozi and gave life sentence to Mahmood, Mohammed Sayeed and Narul Amil A total of 11 persons were accused in the case registered under various sections of the Indian Penal Code, the Terrorist and Disruptive Activities (Prevention) Act (TADA) and the Arms Act.
