General Officer Commanding (GOC) Dagger Division, Major General Bipin Rawat, on February 1 said that militants are desperate to infiltrate into Kashmir but the Army along the Line of Control (LoC) is vigilant to thwart their designs, reports Daily Excelsior. While addressing a gathering at Nambla in Haji Peer sector of Uri, the GOC said that the success of countering infiltration depends upon the cooperation from the civilian population of the Uri, which was living near the LoC. In order to win the support of the local population, the Army is organizing a recruitment rally in Uri to absorb local youth in Army.

Sessions Judge Poonch Kishore Kumar on February 1 awarded life term to a man and his son for hiding a militant in his house who had shot dead a civilian and one Security Force personnel during searches in Mendhar area of Poonch District in Jammu and Kashmir, reports Daily Excelsior. The judge awarded life imprisonment to Mohd Rafiq (Govt teacher) and his son Rayees Hayat, residents of village Keneti Banola in Mendhar tehsil (revenue unit). The judge observed that the accused persons beyond any doubt had hidden the militant at their house and during searches huge quantity of arms and ammunition was recovered from the almirah. It indicated that he used to help terrorists. The accused persons were convicted for the commission of offence under Section 302 RPC read with Sections 120-B and 307 RPC and sentenced to undergo life imprisonment and fine of 25,000 and 10 years rigorous imprisonment for the commission of offence under Section 307 RPC.

The Daily Excelsior reports that State Government on January 2 finally decided to take Legislature route for making amendments in Public Safety Act (PSA). The Government would be introducing a bill on the PSA reforms in upcoming budget session of the Legislature beginning February 23. According to sources, the Government wanted to reform the PSA under which a number of Kashmiri youth, mostly stone pelters, had to be detained during 2010 and 2011 summer unrest. Further, State Government wanted to reform the PSA as it was finding it difficult to get Armed Forces Special Powers Act (AFSPA) withdrawn partially from four districts of the State in view of strong objections raised by the Army and endorsed by the Defence Ministry.

Security Forces (SFs) trapped three militants belonging to Lashkar-e-Toiba (LeT) by cordoning off the village after a brief encounter, 8 kilometres from Pulwama town on February 3. Superintendent of Police Pulwama, Amit Kumar, in this regard said that the operation was put on hold, as it is a built up area and was dark. Chief of Army Staff, General V K Singh visited the Northern Command headquarters and reviewed the Jammu and Kashmir security situation at Udhampur on February 9, reports Daily Excelsior. Accompanied by the Director General Military Operations (DGMO) Lieutenant General A K Choudhary and Air Marshal D C Kumaria, AOC-in-C Western Air Command, the Army Chief arrived at the Technical Airport, Jammu from Delhi in a special aircraft this morning. The General then reviewed the overall security situation prevailing in the Jammu, Ladakh and Kashmir regions. The Army Commander, Northern Command, Lieutenant General Parnaik briefed the COAS about the general situation in Poonch, Rajouri, Doda, Kashmir valley and Ladakh region. He was also apprised of the anti-insurgency operations being carried out in the northern theatre, by other field commanders present in the meeting.

For the first time the Union Government approved a grant of INR 499 crore for upgradation of weaponry to track down militants and criminals, modernization of Police training centres and Police stations etc and lit up all Police buildings round the clock including the border Police posts in Jammu and Kashmir (J&K), according to Daily Excelsior. The Ministry of Home Affairs (MHA) has approved INR 461 crore while the Ministry of New and Renewable Energy has sanctioned a grant of INR 37.93 crore for Jammu and Kashmir Police (JKP), Additional DG (Police Headquarters) Dr Shesh Pal Vaid stated on February 17. The grants for upgradation of Police infrastructure and modernization were aimed at gradual takeover of police as the security of sensitive installations including in militancy prone areas from para-military forces. Dr Vaid further said the Union Government has sanctioned 280 crore for upgradation of all seven Police training centres including Sher-i-Kashmir Police Academy (SKPA), Udhampur. Six other Police Training Centres (PTCs) included Kathua (Kathua District), Talwara (Reasi District), Sheeri (Baramulla District), Manigam (Anantnag District), Lethpora (Pulwama District) and Vijaypur (Jammu District). Out of 280 crore upgradation grants for SKPA and PTCs, the Government of India has already sanctioned 30 crore in the first phase. Rest of the amount would also be released shortly in the phases to ensure that the upgradation was completed shortly.

A local court in Jammu on February 24 charged Jammu and Kashmir Liberation Front (JKLF) chief Yasin Malik under the Prevention of Terrorism Act (POTA) for allegedly raising funds to strengthen militancy in the State, reports Times of India. Additional sessions judge (Jammu) Sanjay Parihar charged Malik with raising funds to strengthen "armed activity" in the State and "to strike terror among people''. Malik pleaded not guilty to the charges. Malik was charged with allegedly deputing two people - Mushtaq Ahmad Dar and Shameema - to collect USD 100,000 from Kathmandu (Nepal) in 2002. The money was recovered from them after they were arrested later that year. Though POTA was repealed in 2003, cases registered under it prior to that can still be pursued.

Chief Minister Omar Abdullah announcing, in August 2011, amnesty to persons involved in 1300 cases during the course of 2010 summer unrest, the Jammu and Kashmir Government is yet to implement the decision. “The cases of 1524 persons involved in 228 cases are being examined and the orders for the withdrawal of cases falling within the ambit of amnesty scheme are likely to be issued in near future,” said the state home department’s report. “We could not implement the offer as we are still reviewing over 200 cases affecting 1,500 boys. The relief is expected by December," said law minister Ali Muhammad Sagar. According to the state home department, the amnesty will apply to first time offenders involved in stone pelting and not in heinous crimes like arson and damage to property. DNA adds that the Jammu and Kashmir Government had decided to withdraw cases against 3,000 miscreants allegedly involved in different crimes other than arson and destruction of public property. Official figures reveal that the Jammu and Kashmir Police has recommended withdrawal of 402 cases registered against stone-pelters in different Police Stations across Kashmir valley. Official figures reveal around 1,300 cases were registered against the stone throwers in the 16 months starting June 2010 of which less than 100 pertained to arson.

State Home Department in response to an RTI application said the Centre has not accorded sanction for prosecution under AFSPA in any of the cases referred to it by the Jammu and Kashmir Government, reports Indian Express. “No sanction for prosecution has been intimated by Ministry of Home Affairs and Ministry of Defence to the State Government from 1990-2011 under the (Jammu and Kashmir) Armed Forces Special Powers Act,” the State Home Department said. The Centre's sanction is mandatory for prosecution of members of armed forces posted in Jammu and Kashmir under Section 7 of the AFSPA, which was promulgated in 1991 at the time of eruption of militancy.

The Jammu and Kashmir Government de-inducted three Central Reserve Police Force (CRPF) battalions and removed 39 Central Paramilitary Forces (CPMFs) bunkers from Srinagar, reports DNA. “The foot prints of security forces are being reduced. As many as three CRPF battalions have been de-linked, 39 security bunkers removed in Srinagar city and 52 buildings vacated from forces occupation,” Chief Minister Omar Abdullah said on February 29. The Government has also identified 15 more bunkers to be removed from Srinagar as situation continues to improve on the ground. “The improvement in law and order during the last three years is visible on ground. Though attempts were made during last year to disrupt the peace, credit goes to people who denied the vested interests to opportunity,” Omar said. Figures released by the Chief Minister said militancy related incidents in 2009 were recorded at 385 in which 71 civilian, 13 Police personnel and 52 Security Forces (SFs) were killed. In 2010, militancy related incidents plummeted to 268 in which 47 civilian, 15 Police personnel and 49 SFs were killed. “During the year 2011 the militancy related incidents were 192, civilian killed were 30, Police personnel killed were 13 and Security Forces killed were 18,” said Omar. Talking about Armed Forces Special Powers Act (AFSPA) he said, “Our efforts for gradual revocation of AFSPA from some parts of the state where militancy has died down and the army has no role to play will continue as it possesses logical reason. I would continue to work for it.”
