On June 1, major political parties intensified inter-party talks with a fresh commitment to prepare first draft of the new constitution by mid-July, reports myrepublica.com on June 2. Senior leaders from Nepali Congress (NC), Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), Unified Communist Party of Nepal-Maoist (UCPN-M) and United Democratic Madhesi Front (UDMF) have said deliberations over forming a national unity government would be held only after resolving the unsettled issues of the new constitution. However, NC Vice-president Ram Chandra Poudel said disputes related to state restructuring could be settled in stages if all the contentious issues are not settled at one once. Poudel further claimed that major political parties are inching closer to a consensus on the number of provinces. The next meeting of the major four parties is scheduled for June 2 (today).

A section of CPN-UML leaders, including party chairman KP Sharma Oli, are strongly pressing for replacing the Koirala-led government, whereas other leaders, including the party’s Deputy General Secretary Ghanshyam Bhusal, are mounting pressure on the party leadership to change the government only after promulgating the new statute. The leaders, including Bhusal, say if the government with two-third majority fails to promulgate statute and new power equation emerges, the constitution writing will be further complicated. “It would be better to form a new government only after promulgating the new constitution. Otherwise, the government might be replaced but constitution will not be promulgated,” Bhusal said.

Meanwhile, the four major political forces are seen positive on settling the names of the federal provinces and delineation of their borders by means of a commission comprising of experts, reports ekantipur.com. The meeting of the top leaders of the NC, the CPN-UML, the UCPN-M and the United Democratic Madhesi Front (UDMF) held at the Prime Minister's residence on June 2, discussed on constitution writing, disaster management and formation of a national consensus government. According to the leaders, the meeting strived to settle the past disputes and the discussions were heading towards the positive direction. The top leaders of the four parties are scheduled to next meet at 5 pm June 3 (today) in their bid to forging consensus within June 4 on topics as constitution writing, disaster management and formation of a national unity government.

The ruling Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) said that they would accept Maoist proposal of a mixed model electoral system—60 percent direct and 40 percent proportional—provided they reach consensus on federalism, reports ekantipur.com. During a four-party meeting at Prime Minister Sushil Koirala’s residence in Baluwatar on June 2, the Unified Communist Party of Nepal-Maoist (UCPN-M) proposed to elect 40 percent representatives through the proportional system and the rest under the first-past-the-post. NC and CPN-UML leaders said they would accept the proposal provided that the Maoist party reaches an understanding on federalism--the most disputed issue of the constitution. The ruling parties had previously proposed to go for the direct electoral system in their joint-proposal tabled at the Political Dialogue and Consensus Committee of the Constituent Assembly.

The deal signed by Prime Minister Sushil Koirala, CPN-UML Chairman KP Oli, UCPN-M Chairman Pushpa Kamal Dahal and MJF-L Chairman Bijaya Kumar Gachhadar states that the country shall be federated into eight provinces on the basis of economic viability and identity. Two key components of federal states—names and delineation—remain unsettled, though. The writ was filed only after a single bench of justice Cholendra Shumsher JBR issued an order to register the agreement reached among the four parties, SC Joint Spokesperson Baburam Dahal said. "Of the 16-point agreement reached among the Nepali Congress (NC), Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), Unified Communist Party of Nepal-Maoist (UCPN-M) and Madhesi Janadhikar Forum-Loktantrik (MJF-L) on June 8, point no 1, 2, 3, 5 and 13 are against the constitution," it is stated in the writ.

Receiving a memorandum submitted by the Nepal Federation of Indigenous Nationalities (NEFIN) at his residence in Lazimpat in Kathmandu on June 17, Chairman Dahal said his party had to be flexible on some issues for consensus but the party had not given up the issues it had been raising in the past and urged the delegation to take the deal positively. He further said the party has not retracted from its main agendas and some of the issues it has been voicing, adding that a few of the issues are not addressed by the 16-point-deal and these would be settled while naming and demarcating the federal states.

Talking to journalists in Gorkha at his home-District Gorkha on June 18, Bhattarai said the new constitution would be announced within the current Nepali month of Ashad (mid July). “There may be a delay of one or two day. But if no incident beyond our control takes place, the new constitution will be promulgated by the end of Ashad,” Bhattarai said, who arrived in Gorkha to meet the victims of recent earthquakes. He said the constitution drafting committee would table the first draft of the constitution by June 28.

Meanwhile, taking strong exception to the apex court’s interim order, four major political forces, Nepali Congress (NC), Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), Unified Communist Party of Nepal-Maoist (UCPN-M) and Madhesi Janadhikar Forum-Loktantrik (MJF-L) have termed the move as an act of intervention in the jurisdiction of the sovereign CA elected to promulgate the new constitution, reports ekantipur.com. The four parties said that the order would not affect the set statute-drafting process. An emergency meeting of the ruling and opposition parties held at Prime Minister Sushil Koirala’s official residence in Baluwatar immediately after the court’s ruling on June 19 said the order was against the spirit of the Interim Constitution-2007 and the principles of the separation of powers. They said that the order had infringed on the jurisdictions of the Assembly. “The CA is an independent and capable institution. It is indisputable that its decision on constitution-drafting will be final. A meeting of the four major political parties -- Nepali Congress (NC), CPN-UML, UCPN-M and United Democratic Madhesi Front (UDMF) -- held at Baluwatar, Kathmandu, on June 28, decided to keep the same ratio in the electoral system as agreed earlier for the federal assembly. The four parties have agreed to ensure 33 percent women in both provincial and federal assemblies. The Constitution Drafting Committee (CDC) on June 28, endorsed the preliminary draft of the new constitution, which will be tabled in the Constituent Assembly (CA) on June 29 (today) for deliberation among the CA members, reports Ekantipur.com. Though the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and the Unified Communist Party of Nepal-Maoist (UCPN-M) and some fringe parties voiced some reservations over some of the provisions, they fully backed the passage of the preliminary draft, in a step towards promulgation of the new constitution. The CDC has completed its tasks within the time-frame provided by the CA. CDC Chairman Krishna Prasad Sitaula will table the draft at the CA meeting, proposing to initiate deliberations on it.

On June 29, major opposition Unified Communist Party of Nepal-Maoist (UCPN-M) warned of not signing the first draft of the constitution citing that the draft contained provisions against the spirit of 16-point agreement, reports Ekantipur.com. UCPN-M expressed its dissatisfaction saying that the Constitution Drafting Committee (CDC) Chairman Krishna Prasad Sitaula added some words which is against the 16-point understanding reached among the political parties on June 8. UCPN-M Standing Committee member Agni Prasad Sapkota said the citizenship provision contained additional word against what was agreed upon in the 16-point pact. He also mentioned that the problem aroused after a word ‘district’ was added along with centre, provinces and local administrative entities in the draft.
