Conflicting views in the Unified Communist Party of Nepal-Maoist (UCPN-M) about resuming formal talks with the ruling parties have placed party Chairman Pushpa Kamal Dahal aka Prachanda in a tight spot, reports Kantipur Online on March 2 (today). Senior leader Baburam Bhattarai says the party should not sit for talks until the ruling coalition agrees to scrap the ongoing majority process in the CA and return the disputed issues of constitution writing to the Political Dialogue and Consensus Committee that he leads. Vice-chairman Narayan Kaji Shrestha is of the view that the preconditions will make negotiations difficult and should be ready for talks if the Prime Minister expresses his commitment to write a new constitution on the basis of consensus.

Threatening to walk out of the Government if the Nepali Congress (NC) is not ready to push the ongoing majority process of constitution writing, the ruling Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) on March 2 decided to mount pressure on the largest party to proceed with the Constituent Assembly (CA) process, reports Republica. CPN-UML Secretary Pradeep Gyawali said “They could say that the CA process should be halted until their general convention is over. In such a situation, the CA process will be further delayed.” The move comes at a time when formal dialogue between the ruling and opposition is yet to start even as the latter completed its first phase of protests on February 28.

Ruling parties Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) during a meeting in Kathmandu on March 3 decided to urge Constituent Assembly (CA) Chairman Subas Nembang to resume the stalled CA process, reports Kantipur Online. Both the parties also asked the Unified Communist Party of Nepal-Maoist (UCPN-M)-led alliance to sit for talks without further delay. On February 13, the CA meeting was postponed indefinitely for the sake of bringing the opposition parties on board. Despite Prime Minister Sushil Koirala’s repeated calls, the opposition parties have refused to come to the negotiating table. Leaders attending the meeting, however, said they would continue their efforts to hold a dialogue with the agitating parties in order to build consensus on the key disputes. Meanwhile, UCPN-M Chairman Pushpa Kamal Dahal aka Prachanda said that it would be difficult to forge consensus on disputed issues in constitution making if the opposition alliance is forced to launch second phase of protests, reports Republica on March 4. Dahal said “The ruling parties have to express commitment that the new statute would respect the spirit of Comprehensive Peace Agreement (CPA). Second, they have to say they will bring new statute through consensus and not through voting in CA.” Stating that they are planning second phase of protests, Dahal said they wish to see the ruling parties create environment favourable for talks before March 6.

Unified Communist Party of Nepal-Maoist (UCPN-M) Chairman Pushpa Kamal Dahal aka Prachanda met Prime Minister (PM) Sushil Koirala on March 5 and urged him to prepare ground for formal talks between the ruling and the opposition parties, reports The Himalayan Times. According to Dahal’s Personal Secretary Chudamani Khadka, Dahal told PM that the opposition parties could sit for talks if he could ensure that there would be consensus among the forces that jointly steered the popular movement of 2006. The PM urged Dahal to sit for formal talks soon. According to Khadka, Dahal said his meeting with the PM positively contributed to the environment for formal talks.

On March 9, the Unified Communist Party of Nepal-Maoist (UCPN-M) objected to a recent verdict of the Supreme Court (SC) that prohibits the Commissions of Inquiry on Truth and Reconciliation (TRC), and Enforced Disappearances from looking into cases sub judice in court, reports ekantipur.com. UCPN-M said that all war-era cases should be handed over to the newly formed commissions. The SC, on February 27, had given a verdict that cases sub judice in court cannot be dealt by the TRC as they fall under the purview of the court. Organising a press conference, Prabhu Sah, head of the party’s legal department, said that the Maoists would take up this issue with the ruling parties in cross-party negotiations. He said that the order should be corrected. He argued that Parliament can correct the SC verdict if there is the need for it.

Prime Minister (PM) Sushil Koirala has said that an environment conducive for drafting the constitution through consensus is being created, reports ekantipur.com. PM Koirala urged the UCPN-M led opposition alliance to take this opportunity and lend support for drafting the new constitution. PM Koirala, who held discussions with UCPN-M Chairman Pushpa Kamal Dahal aka Prachanda on March 8, has been continuing parleys with other leaders as well. In a press statement issued on March 9, PM appealed to all the parties to strengthen their belief that the consensus would be possible through discussions. “I request Dahal ji [UCPN (M) Chairman] along with other leaders of the opposition alliance to contribute to this positive political environment,” said PM Koirala, “I also urge leaders to keep their faith in ‘talks’ to forge consensus.”

describing the current lapse of protests as “temporary ceasefire”, UCPN-M leader Baburam Bhattarai has said consensus among the political parties on the disputed issues of the new constitution would be hard to build in the near future, reports ekantipur.com. Bhattarai said both Nepali Congress and CPN-UML had not been taking concrete measures to make cross-party talks meaningful. In a meeting with select journalists at his residence in Sanepa on March 10, Bhattarai charged that the ruling parties were not responding to their repeated calls for dialogue and consensus. Bhattarai also said the alliance would announce new protest programmes if there is no consensus by mid-March, adding that street agitation would never shut the door for dialogue. In a separate development, the Communist Party of Nepal-Maoist (CPN-Maoist)’s plan to revive the 33-party alliance for another round of protest has suffered a setback after several parties withdrew their support in favour of the UCPN-M led opposition bloc, reports ekantipur.com. Several fringe parties previously associated with the alliance, spearheaded by the Mohan Baidya -led CPN-Maoist, have joined the bloc under the leadership of UCPN-M, while many other parties have shown reluctance to launch another round of protest, citing obscure position of CPN-Maoist regarding the CA. Parties, including Social Democratic Party Nepal and Limbuwan Rastriya Rajya Parishad, have refused to be the part of the alliance led by CPN-Maoist. “Not many parties are willing to join the alliance and those who are still in think that it would be better to launch a united protest by joining forces with UCPN (Maoist),” said a CPN-Maoist central committee member on March 10.

In a strongly-worded speech over the lack of progress in the constitution writing, Nembang told the top leaders during a meeting in Singha Durbar, Kathmandu on March 18, that he would resume the majority course if there is no consensus within March 25. A joint meeting held at the Communist Party of Nepal-Maoist (CPN-Maoist) office in Buddhanagar on March 22, announced the alliance concluding that the ruling parties had breached the Comprehensive Peace Accord (CPA) and the Interim Constitution by “not following the statute and the CPA in their true spirit”. The SC, on February 26, had given a verdict that cases sub judice in court cannot be dealt with by the commissions as they fall under the purview of the judiciary. The meeting also decided to go ahead with a nation-wide agitation programme to pressurize the government to implement the peace pacts. The parties are scheduled to organise a broad interaction on March 28 and stage a nationwide demonstration on April 6.

But the opposition front has decided to boycott the Constituent Assembly (CA) meeting summoned for April 6 unless the ruling parties commit to consensus-based constitution. A meeting of the opposition alliance decided to withdraw its agitation programmes such as picketing government offices, blockade of entry points and obstruction of tax collection and focus on general strike of April 7-9. During the meeting, UCPN-M Chairman Pushpa Kamal Dahal aka Prachanda put forth the proposal to call off all of its agitation programmes slated prior to April 6 and focus on the general strike. However, Madhesh-centric parties strongly criticised Dahal’s proposal saying that such tactic would weaken the agitation.
