The United States State Department, on October 5, redesignated 25 outfits as Foreign Terrorist Organisations (FTO), dropping two outfits, the Japanese Red Army and the Tupac Amaru from the original list of 27 outfits named in the year 2000. Names of the Jaish-e-Mohammad (JeM) and the Lashkar-e-Toiba (LeT) do not figure in the list and the only Kashmir-related outfit on the list is the Harkat-ul-Mujahideen (HuM). However, media reports said the two outfits may be named in a separate White House executive order aimed at putting a financial clampdown on terrorism. The order is expected to be issued in a few days’ time.

According to media reports, a new Islamic terrorist outfit called the Islamic Security Force of India (ISFI) has started operating in various Muslim-dominated areas of Assam. This outfit was created in Mumbai last year (2000) with the active support of the Al-Qaeda headed by Osama bin Laden. Official reports indicate that the ISFI has started recruiting Muslim youths in lower Assam districts. Official sources further revealed that the self-styled secretary of the terrorist outfit, Mustafa Mustaqil, has urged the Muslim community in Assam to unite for jehad against the atrocities perpetrated by the National Democratic Front of Bodoland (NDFB) and the Bodo Liberation Tiger (BLT). While the ISFI has so far been confined to the Bodoland Autonomous Council (BAC) areas, it is trying to expand its network to the Char areas of Assam. The ISFI has close links with Hizbul Mujahideen, Laskar-e-Toiba and Jammu and Kashmir Liberation Front (JKLF), reports said. The ISFI also has links with Al-Umar, a terrorist outfit operating from Pakistan-controlled Kashmir (PcK), from which it has received financial assistance as well as arms and ammunition. Intelligence became aware of the existence of the ISFI in Assam through evidence discovered in certain documents distributed by the outfit in remote areas of Darrang district, which were recovered by security forces, reports added.

A Delhi court, on October 16, rejected the bail application of the two terrorists facing trial in the Red Fort shootout case in which terrorists of the Lashkar-e-Toiba (LeT) had stormed the Red Fort and killed two army personnel and a civilian on December 22, 2000. The court observed that the accused did not qualify for being released, as the allegations against them were very serious in nature. Earlier, on August 29, 2001, the court had rejected the bail applications of two other accused on the same ground. The accused terrorists have been charge-sheeted under various sections of the Indian Penal Code (IPC), the Arms Act and the Explosive Substances Act.

Delhi police have filed a charge sheet against two more terrorists in the Red Fort shootout case in which two terrorists of the Lashkar-e-Toiba (LeT) had stormed the historical monument and killed two Army personnel and a civilian on December 22, 2000. In an additional charge sheet filed before the court, the Special Cell of the Delhi police named Farooq Ahmad Quasid and Nazir Ahmad Quasid, currently lodged in Jammu jail in connection with some other case, as accused. With this, the total number of those charge sheeted in the case has gone up to 10. They have been accused of murder, attempt to murder, criminal conspiracy and waging war against the country.

Two civilians were also killed and two security force personnel were injured in the encounter. Some arms and ammunition were also recovered from the site of the encounter. Media reports have indicated that this was the 18th fidayeen attack in Jammu and Kashmir in the year 2000 but the first time that terrorists have struck on an IAF base. News sources also indicated that Lashkar’s Lahore-based spokesperson, Abu Osama, had claimed responsibility for the fidayeen attack. Senior Air Force officials while observing that the terrorists had been stopped at the first security perimetre, also added that no damage was done to the air base housing sensitive installations.

In a statement issued to a news network in Jammu and Kashmir, the LeT said the attack was carried out at the CRPF camp by two of its fidayeens (suicide squad). A CRPF personnel was killed in the attack. Earlier, investigators had suspected that a local resident may be involved as also the possibility of personal enmity being the motive behind the attack.

Announcing the promulgation of the ordinance, Union Home Secretary Kamal Pande said, "The recent attack on the USA emphasises the urgency to undertake immediate special measures". He added that though POTO had built in safeguards to make it more humane for the innocent, it was a legal salvo against terrorism and terrorist outfits. He said, " The existing criminal justice system was not designed to deal with the types of heinous crimes that have appeared in the country in the last 50 years. Separate definition of terrorist acts, special provisions relating to financing of terrorism, use of explosives and weapons of mass destruction, substances of chemical and biological warfare and operations of terrorists organisations were not there or were ineffective.'' While the maximum punishment under POTO would be death, it has the provision of five-year imprisonment as the minimum punishment. Besides, he added, any person having connection with the proscribed organisations could face an imprisonment of 10 year with fine.
