Army’s Northern Command chief said in Akhnoor on January 15 that cross-border infiltration in Jammu and Kashmir has been on a decline since 2004, but approximately 600 to 800 militants are active in the State. "About 600 to 800 militants are active in Jammu and Kashmir as per the assessment of various security agencies," General Officer Commanding in Chief (GOC-in-C), Northern Command, Lt Gen P. C. Bhardwaj, told reporters. He also said militants and their leadership are under severe pressure due to the neutralization of their top cadres. Due to this cumulative effect, 335 militants have been killed in joint operations during 2008, he added. Referring to cross-border infiltration, General Bhardwaj said, "Infiltration is on decline since 2004 due to multi-tier deployment of security we have taken along LoC.”

Police arrested Muzaffar Ahmad Dar, the ‘chief operations commander’ of Hizb-ul-Mujahideen (HM) outfit, from a locality near Kashmir University in the Hazratbal area of capital Srinagar. “J&K Police has achieved a major success in its drive in anti-terrorist operations with the arrest of Hizbul Mujahideen chief operations commander Muzaffar Ahmad Dar from Sadrabal area of the city near Kashmir University,” the Inspector General of Police (Kashmir), B. Srinivas, told reporters at a press conference. Srinivas said Dar, who was operating under various aliases like Gaznavi, Mohammad Ali and 'One Nine', was arrested around 3.30 p.m. A resident of Chichlora in the Pattan area of Baramulla District, 38 year-old Dar joined the HM in the early 1990's. Srinivas said "Over the years, he has masterminded several terrorist activities including the blast at Narbal in July 2008 in which security forces suffered losses. He had been actively involved in financing the terrorist activities of Hizb.”

According to Times of India, a "brief statement'' on "activities and achievements'' of the Ministry of Defence released on February 17 mentioned that the Army killed 330 terrorists and arrested 172 others in Jammu and Kashmir in 2008, while it neutralised 717 United Liberation Front of Asom (ULFA) militants in Assam. Moreover, relentless operations by the Army and Assam Rifles in Manipur led to 209 militants of various outfits being killed, and another 863 being arrested, during the year. The statement also mentioned that the Army's counter-insurgency operations in Jammu and Kashmir successfully targeted the terrorist leadership, killing 60 middle-level leaders during 2008.

Pillar, said there is an undeniable link between the banned outfit Lashkar-e-Toiba (LeT) and the Pakistan Government, which saw it as a useful tool to keep insurgency brewing in Jammu and Kashmir, Indian Express reported. "Lashkar-e-Toiba, or LeT, is an Islamist Pakistani group that has gotten, certainly in the past and there's a question about how much it still has in the present cooperation and sponsorship from elements of the Pakistani Government itself", Pillar said. "The Government saw it as a useful tool, particularly with regard to confronting the Indians in Kashmir and keeping an insurgency in Kashmir brewing", he added. "The official sponsorship is no longer there. The remaining question is to what degree there may be individuals or elements, particularly in the Pakistani military, that may have some continued relationship with the group," Pillar added.

The Lashkar camp had 17 members, including seven Pakistanis and three Kashmiris. Yasin, Fayaz, Shakeer alias Rahim and Fayiz who were killed in encounters with the Police in Kashmir and Abdul Jabbar, who had escaped the scene, constituted the militants’ team sent from Kerala to Kashmir. "The Malayalis joined the camp in the second week of September. Shakeer alias Rahim was their leader. He could speak Urdu," said Fiaz Ahammed. Shabbir Ahammed Tali told the Police that 180 more youngsters were waiting in Kerala after the preliminary training to join the Jihad. "One Ustad had indoctrinated them," said Tali.

Chidambaram said on March 18 that Security Forces and candidates contesting the forthcoming Parliament elections in the State will have to be on a high alert notwithstanding that level of violence and infiltration has considerably decreased in the State. Talking to reporters in Jammu after his brief visit to the State during which he reviewed the situation at the Unified Command Headquarters meeting at the Chief Minister’s residence, Chidambaram observed that things have improved in the State during last two years. "Level of violence has gone down. Infiltration is at lowest. Security forces have gained an upper hand (over the militants)", the Home Minister said after attending the Unified Command Headquarters meeting. On his maiden visit to the State after taking over the charge of Home Ministry from Shivraj Patil, Chidambaram said: "we will have to be on high alert from now onwards especially the period between April 16 to May 13 during which five phase election for six Lok Sabha seats will be conducted." The Home Minister, however, didn’t refer to the quarters of threat to the candidates and other soft targets during the Lok Sabha elections.

The gun battle between infiltrators and Army in the forests of Kupwara District entered its fourth day on March 23 as Security Forces (SFs) shot dead five more militants while four soldiers also died, taking the death toll in the ongoing operation to 19, Daily Excelsior reported. "A total of 11 militants have been killed in the operation so far which began in the early hours of Friday in Chowkibal area near the Line of Control (LoC) in Kupwara district," a Defence spokesman said in capital Srinagar. He said while two militants were killed in early morning firefight, three more were shot dead in the afternoon. Four soldiers were also killed in the exchange of fire between the two sides. "Five militants and four soldiers were killed in today's gun fight alone," he added. The spokesman also said the operation was still going on and full details would be made available only after the last of the militants in the area has been neutralized.

Giving details of the operation, he said contact was initially established at three places - two in general area Drangyari in Shamsabari ridge of Chowkibal and another in Haphruda forest. "The operation is still in progress as searches are being conducted in the area. Although majority of the terrorists have been killed, the remnants, if any, will also be eliminated," he said adding the number of infiltrating militants as per the intelligence input was close to the number killed in the operation. He said there was no exchange of fire in the area since the evening of March 25 and only combing operation was going on. The cache of arms and ammunition recovered from the site of operation included 23 AK 47 rifles, 17 grenades, three UBGLs, 10 radio sets of various makes, two GPS equipments, water bottles, maps, snow gear, ice axes, rations, jihadi literature, medicine and some Indian currency. The officer refuted claims by the LeT that 30 soldiers were killed in the gun battle that lasted over five days. He said "We have lost eight of our soldiers. The rest of the information is not true." Brigadier Singh also said infiltration at this time of the year was expected as the snow starts melting along the LoC. An estimated 6.18 lakh voters exercised their franchise (45.3 per cent) in the Udhampur-Doda Lok Sabha seat which went to polls in the second phase on April 23. The voter turnout was low by about four per cent as compared to the Jammu-Poonch Parliamentary constituency where polling was held in the first phase on April 16. Voting was held in three Districts of Doda belt including Ramban, Doda and Kishtwar and parts of Reasi segment under tight security arrangements following reports of fresh infiltration. An almost equal number of votes were polled in Udhampur-Doda seat as compared to the 2004 Lok Sabha election. As against 6.18 lakh people exercising their right to franchise on April 23 out of a total of 13.62 lakh electorate, 6.08 lakh votes were cast in the 2004 elections out of a 13.04 lakh electorate. Kathua District with a highest number of 4.04 lakh electorate also accounted for the highest voter turnout of 53.02 per cent while the lowest voting percentage of 33.2 was recorded in Ramban District. Voting in all six districts, which formed part of Udhampur-Doda Lok Sabha constituency, passed off peacefully with no militancy-related or major poll violence incident reported from anywhere. Addressing a joint press conference, the Chief Electoral Officer B. R. Sharma, Inspector General of Police (Jammu), K. The Army chief General Deepak Kapoor said in New Delhi on April 28 there was information about more militants preparing to infiltrate into India and that his force has "refined" the pattern of deployment to foil these attempts. "As far as Jammu and Kashmir is concerned, infiltration has increased in March because of the elections being held there and to disrupt the electoral process in the State," he told reporters. "The figure upto March 31 says that 54 terrorists have come into Jammu and Kashmir," Gen Kapoor added. Sources said the infiltration in March 2009 was the highest for the corresponding month in the past seven years. The infiltration has increased both in terms of quantity and quality, considering the weapons brought by terrorists, the sources said. "It cannot happen without the conscious decision of the establishment in Pakistan," they added.

Chidambaram, who took part in the meeting of the Unified Headquarters chaired by Chief Minister Omar Abdullah, said the Central Government would prefer to see the paramilitary forces like CRPF in a secondary role to the JKP. The meeting, which was attended by top security and intelligence officials of the Central and State agencies, also discussed the issue of reorganisation and reorientation of Central paramilitary forces, especially the CRPF, in the State. Some of the participants reportedly favoured a gradual handing over of duties like guarding vital installations and protecting VIPs to the JKP. An official spokesman said Chidambaram asked the Controlling Officers of CRPF and State Police to sit together to work out a strategy for gradual substitution of CRPF by J&K Police in the essential duties that should ordinarily be performed by the Police. Advocating a step by step approach, he said "we would like to take small, baby steps one by one and no great leap in Kashmir."

"Taking advantage of the cease-fire agreement and the situation prevailing along the borders, Pakistan has been strengthening its defence infrastructure especially in the Jammu and Kashmir. After Mumbai terror strike, the pace of work has been increased along the IB. Some works initiated were highly objectionable and BSF [Border Security Force] raised the points during flag meetings," Special Director General (DG) of the BSF, U. K. Bansal, told media-persons at the sidelines of the passing- out parade at local training centre in Udhampur on July 14. The DG disclosed that BSF at various levels have raised objections and even took up the matter with their Pakistani counterparts but on ground, they have not responded to the commitment made during flag meetings. "We want these objectionable structures to be removed," the DG maintained. Responding to another question, the DG said there has been a decline in the infiltration along the IB in Jammu sector due to fencing and increased vigil all along the borders but the terrorist infrastructure and training camps were still intact on the Pakistani side. "There is hardly any decline in terrorists training activities. The training camps, as per inputs available from that side are still existing. Chidambaram on July 22 said that the terror threat to India had not diminished and the Government would remain alert against the menace with the epicenter of terrorism lying on India’s border. “… Let there be no illusion. The terror threat to the country has not diminished. During the last six months, a significant number of potential terrorists, including Madani, have been arrested. Our objectives are three-fold. Raise the level of preparedness, meet any terror threat directed against India; respond swiftly and decisively to any terror threat or any terror attack and we have to remain on guard against terror and cannot lower our guard,” Chidambaram said. While, replying to the debate in the Parliament on the demands for grants for the Union Ministry of Home Affairs for 2009-10, he said: “… terror is a global phenomenon but that do not give any solace to India because one of the epicentres of terror is the country on our border.” He also said that there was no question of withdrawing the Army from Jammu and Kashmir and they would continue to guard the border, prevent infiltration of terrorists and indulge in counter-insurgency operations. On the presence of paramilitary Forces in the State, the Minister said that additional forces sent there for the Amaranth Yatra duty would be withdrawn and redeployed after August 7 when the pilgrimage season ended. The other regular paramilitary forces would continue to assist the State Police in fighting terrorists, guard important installations/personalities and take part in counter-insurgency operations until the Jammu and Kashmir Police recruited more personnel, trained and deployed them for duties. Then the responsibilities now done by the paramilitary forces would be transferred to the Police over a period of time. Though militant activities had declined in the State, “agitational politics” such as indulging in agitations, violence and disrupting normal life even for a smallest incident was on the rise. This affected all people of the State. The Government would not allow efforts to “demean or demoralise” the security forces. “We must have faith in our Army and Security Forces. Just because there are one or two black sheep in the forces, let us not demean them,” Chidambaram said, referring to agitations launched against the paramilitary forces and for their withdrawal. The Government would review the demand for withdrawal of the Armed Forces Special Powers Act at an appropriate time, he added.

The Central Reserve Police Force (CRPF) has started withdrawing from Jammu and Kashmir to reportedly fight the Maoist insurgents elsewhere in the country, according to Daily News and Analysis. Initially, five battalions - three from Jammu and two from Kashmir - will be withdrawn in the next couple of weeks. They will be replaced by an Indian Reserve Police (IRP) battalion and CRPF troops in other parts of the State. The IRP battalion from Haryana has reportedly already arrived in Jammu. The battalion - 1100 personnel - is undergoing pre-induction training at the Police Training School in Kathua. "Since events such as Amarnath Yatra and Independence Day have passed off peacefully, a few CRPF battalions are being withdrawn from Jammu and Kashmir and sent to Maoist-affected states," CRPF Public Relations Officer Prabakhar Tripathi said.

On withdrawal of the 39 Mountain Division from Rajouri and Poonch border Districts to its base in Palampur in Himachal Pradesh (HP), General Officer Commanding (GOC), 9 Corps, Lt Gen G. M. Nair, said, "This Division is being shifted. Some of its units have already reached its base in HP." 39 Mountain Division was shifted to Rajouri and Poonch districts to assist joint security grid in conducting counter-insurgency operations and undertake counter infiltration measures in 1994. "It takes nearly six months to shift the entire Division," he said, adding the process is on. He also said Pakistan is building fortifications along the border and more than 50 militants are waiting to infiltrate into Jammu sector from Pakistan occupied Kashmir (PoK). "They (Pakistan) have dug up bunkers and ditches and set up a few observation towers along Jammu and Kashmir and Punjab borders," Lt Gen Nair said. Militants on September 1 carried out twin strikes on Security Forces in the capital Srinagar within 500 metres of the State Legislative Assembly, which is in session, killing two Central Reserve Police Force (CRPF) troopers and injuring 26 others, Daily Excelsior reported. Militants armed with silencer-fitted pistols shot at two CRPF personnel from point blank range just outside the UCO Bank at Budshah Chowk, killing constables Rajesh Shekhar and Mulkranjan Rampa of the 28th Battalion. Minutes later, on the other side of Budshah Bridge, militants lobbed a hand grenade on CRPF troopers at Batamaloo, resulting in injuries to 26 persons, including four CRPF soldiers and two Policemen. Official sources said CRPF and Policemen seemed to be the target of the militant attack but many civilians were hit by the splinters as the area is usually crowded. The Deputy Inspector General of Police (Central Kashmir), Hemant Kumar Lohia, said Police has reasons to believe that the latest attacks and on August 1 were the handiwork of the same module of militants. "We have more or less identified the module of militants since taking up investigations in the cases of attacks. We have identified the call signs and codes of the members of these modules and now we have to fix a face to these," Lohia told reporters at a press conference. He said Police has been able to get some mugshots of the latest incidents from closed-circuit cameras installed in the city and identified a suspect who might be involved. "We will enlarge the shots and identify the person by verifying the registration details of the motorcycle he is riding," he added. He said two modules of up to nine members each are active in Srinagar and the Police have been tracking them. He said, "They are keeping the numbers low and the members are mostly from Hizbul Mujahideen and Lashkar-e-Toiba and Jaish-e-Mohammad. They keep lesser numbers in loop which helps them evade detection for a longer time." Asked if the militants were carrying out fresh recruitments within the Valley, the officer said it is a fact that it was happening. "If there were no recruitments by militants, there would be no militancy…. But it is not at the large scale as suggested," he said when asked to comment on reports that militants have managed to recruit 200 to 300 fresh youth.

"There is a political problem in Kashmir and it has to be solved. Prime Minister has made the policy of the Government clear on many occasions. We are not afraid of dialogue… we are not shying away from the talks. There will be a dialogue with every section of opinion on Kashmir problem," Chidambaram said in his address to the All India Editors' Conference. The Home Minister said instead of holding dialogue under the media glare, the process this time will be quiet dialogue and quiet diplomacy for finding a political solution to the Kashmir problem. "The dialogue cannot take place in the glare of the media. There will be no dialogue then … it becomes a show. The dialogue will be held quietly - one-on-one, two people to two people. Let me assure you that it will be quiet diplomacy until we find a political solution. Once the broader contours (of a solution) are arrived at, it will be made public," Chidambaram said. He said the Centre will hold talks with mainstream political parties like National Conference, People's Democratic Party, Congress and other smaller parties. Without naming any separatist outfit, he added that the dialogue process will also include other groups which are not organized and are referred to as extremists. However, the Home Minister declined to answer a question as to whether a formal invitation will be extended to the groups like the All Parties Hurriyat Conference (APHC). On the alleged non-implementation of reports submitted by the working groups formed after Round Table Conference convened by Prime Minister Manmohan Singh in 2005, the Home Minister said "these reports are being absorbed in our Kashmir plan. It is not right that these are being ignored." On the security situation in the State, he said there has been a marked improvement. The number of violent incidents in the first nine months of 2009 was 395, which is the lowest during the corresponding period in the last eight to nine years. He also said the Government's approach to violence in Jammu and Kashmir is of zero tolerance. "There is no place for violence in Jammu and Kashmir. There will be political differences and even voices for secession … we accept that and it is a reality. But whatever the cause, there is no place for violence. There are other ways of airing grievances and mobilizing support for your views through peaceful means," he added. Chidambaram said the main problem in Jammu and Kashmir is posed by the infiltration from Pakistan and PoK where authorities were desperate to push in militants to this side.

On the eve of the first anniversary of November 26, 2008 (also known as 26/11) Mumbai attack, the Union Ministry of Home Affairs (MHA) said that terrorists backed by various external agencies had expanded their focus beyond the Kashmir Valley with the objective of creating communal tension and hitting the country's economic growth, reports Times of India. Underlining the threats which exist despite various security measures taken post-Mumbai terror attacks, the MHA said, "The challenge that we face today is from terrorist organisations that are not only equipped with latest technologies and have immense access to funds, but are having active backing of various external agencies." The MHA also said, "It is important that we are totally committed to a comprehensive approach to tackling terrorism and put in sustained intensive efforts to end this menace." However, among measures taken to strengthen security and intelligence infrastructure in the past year, the MHA listed functioning of the Multi-Agency Centre (MAC) within the Intelligence Bureau for effective intelligence sharing, setting up of four regional hubs of National Security Guard (NSG) at Hyderabad, Kolkata, Mumbai and Chennai, move to set up 20 counter-insurgency and anti-terrorism schools across the country, constitution of National Investigation Agency (NIA) and strengthening of coastal security among other things. The MHA also said that due to close coordination among intelligence and security agencies of the Centre and States, a number of sleeper cells were broken up, key Lashkar-e-Toiba (LeT) operatives arrested, terrorist incidents averted and a large number of cases resolved. There were 573 cases of apprehension of infiltration reported in 2006 and 535 in 2007 along the LoC in Jammu and Kashmir, the data said. The Minister said that Government has increased the budget for road construction and fencing on the India-Pakistan border by nearly 300 per cent. "Along Indo-Pakistan border, the Government has approved revision of cost estimates in fencing, floodlighting, roads and Border Outposts works from the earlier sanctioned Rs 380 crore to Rs 1,201 crore," he said. The Union Government on December 2 announced the withdrawal of a "significant" number of battalions of Central forces from Jammu and Kashmir in a significant confidence-building measure following the initiative for holding a "quiet" dialogue with separatist groups, Daily Excelsior reported. The Union Home Minister P. Chidambaram informed the Rajya Sabha (Upper House of Parliament) that the decision had been taken in view of the improvement of law and order situation in the State. On the situation in Jammu and Kashmir, Chidambaram said violence in the State has been the lowest in 2009 and the Centre is willing to take "what appears to be a risky step of withdrawing a significant number of battalions of security forces" and hand over law and order to the Jammu and Kashmir Police. He also said the process has already been initiated but refused to quantify the personnel being withdrawn. The announcement would be a major confidence-building measure offered by the Union Government which has initiated a "quiet" dialogue with the separatist groups. Earlier in the day, Chidambaram told the Upper House of Parliament that Kashmiri groups have responded positively to the Centre’s initiative of "quiet talks" and hoped a solution will emerge. He asserted that talks with India and Pakistan for resolution of Kashmir issue will go ahead. Chief Minister Omar Abdullah is reported to have described the attack as a well-thought out attempt to derail the peace process. "It is the most unfortunate incident and a well thought out attempt to derail the peace process and deny people of the State a peaceful atmosphere they have a right to," Omar said. Describing Qureshi as a pro-dialogue individual and among the most reasonable separatist leaders, Omar said he was one of the separatist leaders who wanted to find a solution to the Kashmir problem at the negotiating table. The Chief Minister said Qureshi was offered security on various occasions but he turned it down. A member of the decision-making Executive Committee of the Hurriyat Conference, Qureshi had played a key role in facilitating talks between the Hizb-ul-Mujahideen (HM) and the Government in 2000 following a cease-fire in July that year. Antony ruled out revocation of the Armed Forces Special Powers Act (AFSPA) from areas where the armed forces were deployed for counterinsurgency operations. “Already the Army, by its own initiative, has withdrawn two divisions from Jammu and Kashmir. Last year, it withdrew one division. This year also it withdrew another division. So whenever we feel the situation is improving, we are willing to further reduce the visibility and presence of the armed forces,” he said after delivering the keynote address at a seminar on internal security. On the AFSPA, he reiterated the stand taken by the Army chiefs in the past that the armed forces needed special powers whenever they were deployed on counter-insurgency duties. But, he expressed the Government’s willingness to discuss changes in these powers. “Without special powers, the Army cannot operate … But at the same time we can have a detailed discussion about making some modification here and there,” he added.

Indian Express reports that the year 2009 has witnessed a phenomenal drop of 25 per cent in militancy-related incidents in Jammu and Kashmir. “This year, we have achieved a milestone. It is for the first time in 20 years that less than 500 violent incidents took place in the State,” Jammu and Kashmir’s Director General of Police (DGP) Khuldeep Khoda said. The highest number of militancy-related incidents in Jammu and Kashmir took place in 1995 when the Police recorded a total of 5,946 cases across the State. Khoda said that during 2008, militancy-related violence came down by 35 per cent as compared to 2007, while in 2009, the violence dropped further by 25 per cent. “Over the past 20 years, the morale and confidence level of the Jammu and Kashmir Police has been built painstakingly and its professional skills have helped in restoration of peace and normalcy in the State. With these efforts, the graph of violence is rapidly coming down year after year,” Khoda said. For the second consecutive year in 2009, civilian casualties have been remained under-hundred mark. In 2008, 89 civilians were killed. “This year around 70 civilians were killed which is the lowest in the past 20 years,” Khoda said. The highest number of civilian casualties – 1413 - was witnessed in 1996. Khoda said that the Security Forces (SFs) causalities were also the lowest this year in the past two decades of violence. In 2008, 75 SFs were killed, while as in 2007, the causality figure was 110. This year, the lowest number of human rights violation cases was registered as compared to the previous years. “It is for the first time that no custodial death related to militancy was recorded this year,” the DGP Khoda said. The DGP said the Jammu and Kashmir Police, along with other Security Forces, succeeded in eliminating more than 50 self-styled militant commanders of different outfits during various anti-militancy operations.
