On October 2, Police arrested four cadres of the Unified Communist Party of Nepal-Maoist (UCPN-M) from Jhumka in Sunsari District alleging them of being involved in extortion from one Suman Thapa, who was bringing four tractors loaded with timber and firewood, which he had bought from the District Forest Office, to his Jhumka-based sawmill, reports inseconline.org. The arrestees are identified as Rajan Kiranti, Dinesh Chaudhary, Khagendra Bhattarai and Bidhya Dahal. Suman Thapa said that the inebriated UCPN-M cadres obstructed the tractors and demanded NPR 100,000 as “donation”. He alleged that the Maoists had assaulted the drivers and workers when the latter refused to pay the amount. The accused Maoist cadres, however, reportedly claimed that they had stopped the vehicles carrying timber to check whether they were brought illegally.

The UCPN-M) on October 11 said it wants to sign an agreement to conclude the peace process before Prime Minister (PM) Baburam Bhattarai leaves for India on an official visit on October 21, reports Kantipuronline. The 45-day deadline committed by the PM for concluding the peace process expired on October 11. "We have now reached an understanding that the peace process should be immediately concluded. Though we are yet to find a meeting point on contentious issues, we are optimistic that there will be a decision before the prime minister's visit to India," said Maoist Politburo member Janardan Sharma. Nepali Congress leader and Special Committee member Ram Sharan Mahat said his party has found a sense of seriousness and urgency in the Maoists, but that progress in the process will depend on their intent to implement the commitments. “We are cautiously optimistic because they have not brought in any formal flexible proposal on the contentious issues so far,” Mahat said.

Minister for Land Reform Prabhu Sah, who is accused of plotting the murder of Hindu Youth Association president Kashiram Tiwari in Birgunj 15 months ago, has been cleared of all charges by the District Attorney's Office on October 12, reports Nepal News. The District Attorney didn't file a case against Minsiter Sah against whom an arrest warrant was issued for plotting the murder of Tiwari. The Parsa District Police Office had issued arrest warrant against Sah, but he has vehemently denied to have received the warrant and has dismissed the murder charge. The decision of ODA not to file any case against Sah comes a day after Unified Communist Party of Nepal-Maoist (UCPN-M) cadres continued the shutdown strike in Rautahat District to protest the arrest warrant against him. Sah, a Maoist politburo member, was elected to the Constituent Assembly from Rautahat-3.

According to Kantipuronline, the opposition parties—Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML)—who had agreed to harmonise their positions on the integration of Maoist combatants, have gone a step further by preparing a ‘flexible’ joint proposal that they say should be acceptable to the Unified Communist Party of Nepal-Maoist (UCPN-M). The proposal will be presented to the UCPN-M in a meeting scheduled with Prime Minister Baburam Bhattarai on October 18 (today). “We are proposing a deal which the Maoists simply cannot refuse,” said an NC leader suggesting that an agreement was almost a done deal. “Our proposal is in line with what the Maoists have already agreed to in talks post-Dashain.”

According to Kantipuronline, the major political parties have settled the contentious issues regarding integration and rehabilitation of PLA combatants except rank determination. Leaders say series of informal talks among the parties are producing positive results and they are preparing to hold a formal meeting to formalise it. Unified Communist Party of Nepal-Maoist (UCPN-M), Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) are scheduled to meet on October 19 (today) to discuss the contentious issues of army integration. "We are close to a deal," said Maoist leader Janardan Sharma. Meanwhile, the main opposition parties- NC and CPN-UML - continued to obstruct the meeting of the parliament, demanding resignation of Defence Minister Sarat Singh Bhandari. The opposition parties have been obstructing the House demanding his resignation for publicly making controversial remarks on the possible disintegration of the country if 22 districts of Terai decide to secede. Speaking at the Reporters Club on September 26, Defence Minister Bhandari had warned that the 22 Terai Districts could disintegrate if the demands of Madheshis are not taken into consideration, saying that no one will save the nation if the Terai Districts decide to secede.

CPN-UML senior leader KP Sharma Oli accused the UCPN-M of misusing the caliber of its combatants by keeping them at bay in the various cantonments, Kantipuronline reports. He slammed the Government of including the tainted elements in the name of combatants. “It will be just sufficient to look at the names and the photos of the ministers to know those elements included in the Government,” Oli said. He also said the Maoist have increased the salary of the combatants by NR 1005, instead of focusing on their integration, due to the greed for money. “Simply integration is not enough, management of combatants in security bodies is vital,” he added.

Kantipuronline reports that the three major parties have reportedly struck consensus on integrating of former PLA combatants by forming a new directorate with a non-combat mandate as proposed by the Nepal Army. Leaders, who attended October 20 talks said the parties have 'almost settled' their differences on numbers, modality and rehabilitation package, but are yet to find a meeting point on rank determination and norms of integration. "We have agreed to accept the directorate with the mandates proposed by the Nepal Army. We had an agreement that the combatants will get the responsibilities similar to that of a regular Army and can undertake other responsibilities prescribed by the state," Unified Communist Party of Nepal-Maoist (UCPN-M) Special Committee member and Finance Minister Barsha Man Pun said. He said his party is mindful of the Army's sensitivity and does not intend to erode the professionalism of the national army in pushing ahead with the integration process. A Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), leader who attending the three-party talks, confirmed that the major parties had resolved the differences on the mandate of the directorate that would integrate the former combatants. "The Maoist Chairman himself had consented to the mandates when the proposal was prepared by the Army, but he later backtracked following pressures from hardliners within his party," the leader said. Nepali Congress leader Krishna Sitaula said, "We felt that the Maoists are yet to complete discussions within their party," adding, "If there is consensus, there will not be a partial deal but a package agreement on all the contentious issues." The Mohan Baidya faction of the Maoist party is demanding that the directorate be given a complete military mandate and the same role as that of Army soldiers. The Army plans not to provide peacekeeping role and access to weapons to the newly integrated combatants.

General Secretary of the Unified Communist Party of Nepal-Maoist (UCPN-M) Ram Bahadur Thapa on October 21 said there should be a serious review of the Government’s performance as it is not working in satisfactorily, according to Nepal News. He also said that Islami Sangh Nepal’s leader Faizan Ahmad’s murder in a broad daylight near Police offices and the presence of controversial ministers (who were recently relieved of their duty) in the Government were the evidences to prove that the Government is not working in a satisfactory way. “Though he (Prime Minister Baburam Bhattarai) was determined to work for peace and constitution and to deliver relief to the people, such incidents have demonstrated Government’s weaknesses,” added Thapa. Thapa represents cadres close to the hardliner faction of the party led by vice chairman Mohan Baidya. Faizan, general secretary of Islami Sangh Nepal, was shot dead by unidentified assailants on September 26, 2011.

Nepali Congress (NC) President Sushil Koirala accused Maoists of posing hindrance in the peace process through the issues of integration of the combatants, returning the seized property and the paramilitary structure of the Young Communist League (YCL). “You claim to be loyal and flexible. But there is violence and crime growing even in the hometown of Bhattarai. How are you loyal,” questioned Koirala. Koirala said that Maoists have not abided by the past pacts although they claim to be the most loyal party. He said that they should be able to implement their agreements before calling themselves loyal. “There were 8-point, 12 point and Comprehensive Peace Agreement along the peace process. However, they have not been followed. You just claim to be loyal. You need to work so that people can trust you,” said Koirala. Stating that Maoist Chairman Pushpa Kamal Dahal aka Prachanda and Prime Minister seem serious about the peace process, Koirala said that the seriousness should now be put into action. “Now you should endorse your commitments through the party and show in both the national and international arena that there really is something happening in the peace process,” Koirala remarked.

UCPN-M leader loyal to Mohan Baidya, Secretary C P Gajurel claimed that the purported agreement between the major three parties regarding the integration of Maoist combatants was wrong. He refuted the reports that there was tacit understanding between the major parties on the peace process and the agreement would be signed after the arrival of prime minister from New Delhi (India). “The alleged endorsement of the proposal to incorporate 40 percent combatants and 60 percent security men from government security agencies in the directorate for integration was completely wrong,” said Gajurel, adding, “Our party has not backed from its stand of 50 percent from each side.” The major parties had reportedly struck consensus on integrating former Maoist combatants by forming a new directorate with a non-combatant mandate as proposed by the Nepal Army.

NC President Sushil Koirala on October 22 said that UCPN-M was responsible for hindering the peace process due to its reluctance in implementing the past agreements. He said no other than Maoist should be hold responsible for delaying the peace process, adding, “Looking back at the discussions and consensus since four years, peace process has not got momentum due to the Maoist.” He accused the Maoist of being the barrier on the issues of returning the seized properties, para-military structure of Young Communist League (YCL), and integration of its combatants. “Why don’t they abide their government’s decision of returning the seized properties, Why are they so reluctant to submit the weapons to their own government,” Koirala questioned. “This situation is created by the differences in their saying and their acts,” he added.

The Unified Communist Party of Nepal-Maoist (UCPN-M) chairman Pushpa Kamal Dahal aka Prachanda on October 23 urged his deputy, vice chairman Mohan Baidya to come up with a clear position about the ongoing peace and constitution-writing processes, according to Kantipuronline. Dahal said that time has come for the hardliners to clear their stance on the peace process as political parties are close to forging a peace deal. After holding discussions with Baidya, about resolving the deepening intra-party rift, Dahal said there was no alternative with the party to accomplishing the peace process and drafting the constitution compromising with the Nepali Congress (NC) and the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML). “Baidyaji himself is not against the party's line of peace and constitution writing but he is under pressure from other leaders,” said politburo member Haribol Gajurel, close to Dahal. Leaders say some Baidya supporters are trying to split the party. Dahal is also preparing to hold talks with other leaders from the Baidya camp, including General Secretary Ram Bahadur Thapa and Secretary C P Gajurel. Notably, Thapa claimed that Dahal has links with India’s external intelligence agency, Research and Analysis Wing (R&AW) and accused him of coming to terms on the number of combatants to be integrated in the Nepal Army under the directive of the RAW. He also objected to the signing of the Bilateral Investment Promotion and Protection Agreement (BIPPA) with the Government of India on October 21. He accused Prime Minister Baburam Bhattarai of going against people’s wish, party’s decision and political consensus by signing the BIPPA.

Nepal Police on October 27 said that the cause of an attack on the Unified Communist Party of Nepal-Maoist (UCPN-M) lawmaker and trade union leader Salikram Jamarkattel on August 27 was the internal dispute of the Maoist party, reports Nepal News. After the investigation, the Police concluded that there was "political reason" behind the attack. Organising a press conference in Kathmandu, Central Investigation Bureau (CIB) of the Nepal Police revealed that Maoist combatants attacked him following an order from former secretary of All Nepal Trade Union Federation-Revolutionary Tara Nidhi Panta aka Ramesh Panta. Senior Superintendent of Police Kamal Singh Bam said the investigation found Panta to have plotted the attack and Rajan Kharel 'Dhiraj' assisted him'. Combatants from the third division of the Maoist cantonment Indra Bahadur Shahi had attacked Jamarkattel with an iron rod and disqualified combatants Sudip Karki 'Nabin' and Kamal Budhathoki had assisted him. Likewise, combatabts Ram Pudasaini had planned the timing of the attack. Police have arrested the four while main accused Panta and his assistant Kharel are still at large.

The 'decisive meeting' between top leaders of three major parties – UCPN-M, Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) - held at a resort in Budhanilkantha, Kathmandu,on October 31 to find a common ground on the controversial issues seen in constitution drafting and peace processes has ended inconclusively.
