A Special Tribunal constituted under the Criminal Law (Amendment) Act on January 3 upheld a 1998 Tamil Nadu Government order banning the Al-Umma, a terrorist outfit responsible for the serial blasts in Coimbatore, southern India, killing approximately 60 persons on February 14, 1998. The Tribunal held that there was sufficient evidence on record to show that Al-Umma was encouraging and promoting hatred between Hindus and Muslims. The Tribunal also noted that Al- Umma leader Basha had admitted that four persons of his outfit were charge-sheeted.

Nearly 100 persons accused of the 1993 serial bomb blasts in Mumbai pleaded for security cover before the designated Terrorist and Disruptive Activities (Prevention) Act (TADA) Court in Mumbai on February 12. Their request came in the wake of recent killing of co-accused, Hanif Kadawala on February 8. There were reports that the underworld Mafia, Chhota Rajan had vowed to kill all the serial blast accused who had secured bail. The Court, however, expressed its helplessness in the matter saying it could not consider such plea.

The Jamaat-e-Islami (JeI) filed a writ petition in the Lahore High Court, on February 15, challenging the proposed curbs on Jehad fund-raising by the terrorist outfits. It has also sought a Lahore High Court direction for the removal of Interior Minister Moinuddin Haider for violating "constitutional provisions". A writ petition moved by the JeI deputy chief Liaqat Baloch said that the Pakistan Constitution guarantees freedom to profess religion and to manage religious institutions by its Article 20. The petition also declares that according to the Constitution, Islam is to be the State religion of Pakistan. The petitioner, citing several other provisions of the Constitution, said that the Quran and Sunnah oblige Muslims to wage Jehad.

The Lahore High Court directed the Interior Ministry on February 20 to submit a report on a writ petition filed by Jamaat-e-Islami Deputy Chief Liaquat Baloch challenging curbs on terrorist outfits. Justice Karamat Nazir Bhandari, who heard the petition, however, declined to pass an interim order to suspend the operation of the restrictions on Jehad fund raising by the terrorist groups. The Judge also observed that since there was no law or notification prohibiting the collection of donations, the terrorist outfits were free to make collections. The petitioner has contented that according to Article 20 of the Constitution of Pakistan, anyone was free to pass their lives according to their religion. He also added that the concept of Jehad was "deep-rooted in Islam and those propagating it could not be banned".

The warrant was issued after the Court rejected an application filed on behalf of the JKLF (Yasin) chief, seeking exemption from personal appearance. In two separate chargesheets, the police had named Pakistani national and a LeT terrorist Ashfaq, his Indian wife Rahmana, Babar Mohsin Bhagwala, Devender Singh, Shahanshah Alam and Rajiv Kumar Malhotra as accused under various sections of the IPC, Arms Act and Explosive Substances Act. Asfaq and his wife were arrested on December 26, 2000. The remaining four accused were arrested on January 4, 2001 for allegedly helping the LeT terrorists. The move follows framing of charges on April 28 against Abdul Latif alias Patel, Bhupalmar Damai alias Yusuf Nepali and Dilip Kumar Bhujel, who had helped the five accused and their two accomplices. The charges include murder, attempt to murder, wrongful confinement, kidnapping, grievous injury, criminal intimidation and criminal conspiracy along with offences under various sections of anti-hijacking law of 1982 and Arms Act. In addition, the Central Bureau of Investigation (CBI) has also reportedly secured a ‘red corner’ notice against the five hijackers-- Ibrahim Athar, Sunny Ahmed Qazi, Zahoor Ibrahim, Shahid Akhter Sayed and Shakir -- and their two accomplices, Yusuf Azhar and Abdul Rauf, from the Interpol. He submitted to the court that while the five Russian pilots, released in July 2000, and he were convicted and then sentenced to life on identical charges, ''The Russians are now free men and I am in jail because I am a British national. It is racial discrimination''. The court observed that it was still in the dark whether the five Russian pilots were released after being granted mercy or pardon or remittance. The court observed that the matter would become clear after the Union Law Ministry files its affidavit by October 5. Bleach and five other pilots were arrested after a plane dropped a huge cache of arms in Purulia district, West Bengal, on December 17, 1995. The Central Bureau of Investigation (CBI) investigated into the case and filed charge sheets against Bleach and five Russians. The Russians were, however, released from jail on July 22, 2000 through a Presidential Order.

A Karachi court on October 27 acquitted two central leaders of the Muttahida Qaumi Movement – Altaf (MQM-A) in two different cases. The court exonerated them and two other activists of the MQM - A from charges of rioting, arson and violent activities as the prosecution failed to prove the allegations. The first case was registered on May 1, 1994 by the New Karachi police for setting ablaze a bus. The second case was registered by the same police on May 5, 1994 for setting a National Saving Centre in New Karachi on fire.

Taking cognizance of an application filed in a matter related to the problem of law and order situation in Delhi, the Court said that the respondents should file their replies by December 14. The Court also held that no awareness campaign had been launched by the government to educate the people about the measures initiated in case a person has contacted diseases spread through Anthrax spores or any other form of bio-terrorism.

In a supplementary chargesheet filed before metropolitan magistrate, the special cell of Delhi police named Atharuddin alias Abdullah as the eleventh accused in the case. Police sources added that after the December 22 incident, Abdullah went to Jammu and Kashmir where he took part in an attack on a special operation group camp in January 2001. Thereafter, the accused reportedly went to Lucknow from where he fled to Jeddah, the chargesheet stated.
