The Supreme Court on January 28 ordered the release of Ahmed Omar Saeed Sheikh, the main convicted of beheading United States journalist Daniel Pearl, reports Daily Times. Ahmed Omar Saeed Sheikh, who was the main suspect in the 2002 kidnapping and murder of Wall Street Journal Reporter Pearl, was released by a bench of three judges. “By a majority of two to one, they have acquitted all the accused persons and ordered their release,” Provincial Advocate General Salman Talibuddin said. “The court has come out to say that there is no offence that he has committed in this case,” Mahmood Sheikh, who represented Sheikh, said. He added that the court had ordered that three others, who had been sentenced to life in prison for their part in Pearl’s kidnapping and death, also be freed. A Sindh High court (SHC) division bench on April 2, 2020, had commuted the death sentence of Ahmed Omar Saeed Sheikh to seven years and acquitted three others who were serving life terms. The Sindh Government had swiftly challenged the April 2 order in the Supreme Court. The Sindh Government had also immediately detained the four men under Section 3 (1) of West Pakistan Maintenance of Public Order (MPO) Ordinance, 1960. “The decision is a complete travesty of justice and the release of these killers puts in danger journalists everywhere and the people of Pakistan,” the Pearl family said in a statement released by their lawyer.

The Supreme Court (SC) on April 26 refused to issue stay order in the case filed by Communist Party of Nepal-Unified Marxist–Leninist (CPN-UML) leader Madhav Kumar Nepal and three other leaders of his faction of the CPN-UML against KP Sharma Oli's action, reports The Himalayan Times. Bhim Bahadur Rawal, Ghanashyam Bhusal and Surendra Prasad Pandey had challenged party Chair and Prime Minister KP Sharma Oli's punitive actions against their factional activities. Nepal, Rawal, Bhusal, and Pandey, who face the risk of being removed from the House of Representatives for their alleged anti-party activities, had filed a writ petition at the apex court seeking annulment of punitive action taken against initiated by Oli. The petitioners had urged the court to prevent Oli from taking any action against them as per the Political Party Act, including his decision to remove them from the party as that could consequently lead to their removal from the House of Representatives. A single bench of Justice Prakash Kumar Dhungana issued a show cause notice to PM Oli and other defendants, but refused to issue an interim order saying that just because these leaders were asked by the party chair to furnish explanation, that did not present a basis for the court to issue an interim order. The court said that issues such as whether the explanation letter issued by the party chair was in conformity with the rules, and whether the party chair could take action against them should be settled in the final hearing as per Section 28 and 32 of the Political Party Act and overall principles of political parties. SC's refusal to issue interim order in the case means party Chair and PM Oli has no hurdle, at least for now, in taking further punitive actions against the rival faction. The court has listed the case for priority hearing saying there is urgency to settle the case soon.

The Lahore high court on November 6 set aside a trial court's conviction and acquitted six senior leaders of Jamaat-ud-Dawah (JuD) in a terror financing case, reports The Times of India. The Lahore Anti-Terrorism Court (ATC) in April this year had handed nine-year imprisonment each to JuD senior leaders – Prof. Malik Zafar Iqbal, Yahya Mujahid (JuD spokesperson), Nasarullah, Samiullah and Umar Bahadur - and six months' jail term to Hafiz Abdul Rehman Makki (brother-in-law of Saeed) after an FIR was registered by the Counter Terrorism Department (CTD) of the Punjab Police. The trial court had found these leaders guilty of terror financing. They had been collecting funds and unlawfully financing the proscribed organisation Lashkar-e-Taiba (LeT). It had also ordered the confiscation of assets made from funds collected through terrorism financing. “On Saturday LHC's division bench comprising Chief Justice Muhammad Ameer Bhatti and Justice Tariq Saleem Sheikh set aside the trial court's decision in the CTD's FIR 18 of 2020 against the six JuD leaders after the prosecution failed to prove the charge against the appellants beyond reasonable doubt,” a court official said. The official said the division bench allowed the petition of the JuD leaders, observing “the statement of the ‘star prosecution witness' is not reliable as there is no corroboratory evidence.”

The Supreme Court on November 10 grilled Prime Minister (PM) Imran Khan over the Government's inaction against those responsible for the Peshawar Army Public School (APS) attack in 2014 and the ongoing talks with the Tehreek-i-Taliban Pakistan (TTP), reports Dawn. A three-judge bench — headed by Chief Justice of Pakistan (CJP) Gulzar Ahmed, and comprising Justice Qazi Mohammad Amin Ahmed and Justice Ijazul Ahsan — summoned the PM in connection with the case around 10am. He arrived at the court roughly two hours later, just before noon. During the hearing, Justice Amin reminded the PM that Pakistan is not a small country. "We have the sixth largest army in the world," he said. With regards to media reports regarding negotiations with the TTP, Justice Amin questioned whether "we are bringing them [TTP] back to the negotiating table instead of taking action against them?" "Are we going to surrender once again?" Justice Amin asked the premier. As the three-member bench continued to grill the premier, at one point the latter asked for a chance to speak, given that he had been summoned for the hearing. But the judges continued to fire questions at him. CJP Gulzar said, "You are in power. The government is also yours. What did you do? You brought those guilty to the negotiating table." "The satisfaction of the parents [who lost their children in the APS attack] is necessary," said Justice Ahsan addressing the PM. The Supreme Court directed the Government to submit its report within two weeks, but Attorney General Khalid Jawed Khan requested the court to grant additional time. Accepting the plea, the court granted four weeks to the Government. The court inquired from Prime Minister Imran what action had been taken in the case. Chief Justice Gulzar then picked up the Constitution book and said it guaranteed security to every citizen.

The three-member tribunal, led by Justice Mohamad Shahinur Islam, announced the schedule on completion of the case summing up arguments from both the prosecution and the defence lawyers. Placing her rebuttal after the defence lawyers’ case summing up arguments, prosecutor Rezia Sultana Chamon demanded capital punishment for Khalek and other accused in the case Khan Rokunuzzaman (64), claiming that they could prove all six charges against the duo beyond doubt. She argued that the witnesses identified the accused as offenders and the duo, being active members of Islami Chhatra Sangha, the then student wing of JeI, joined Razakar force during the Liberation War. On March 5, 2018, the tribunal charged four suspects — Khalek, Rokunuzzanan, M Abdullah-Al-Baki and Zahirul Islam, for killing six people, torturing 14 people and raping two women in Satkhira. Khalek was in the dock while Rokunuzzanan was facing the trial in absentia. The tribunal dropped the names of Baki and Zahirul from the trial process as they died.

The Supreme Court (SC) on November 23 upheld the death penalty of Salauddin Salehin, a dreaded militant from the banned Jama'atul Mujahideen Bangladesh (JMB), who was convicted in the killing of Goni Gomez of Jamalpur in 2004, reports Dhaka Tribune. In 2004, Goni Gomez, owner of a pharmacy, was killed by the JMB militants for converting to Christianity from Islam. In 2006, Dhaka Speedy Trial Tribunal sentenced Salehin and Rakib to death in the case and later the High Court (HC) upheld the sentence rejecting their appeal. Rejected by the HC, the two appealed the death sentence before the SC. The court did not consider the appeal of Rakib, another death-row convict in the case, as he was killed in a gunfight with police in 2015. Salehin has been a fugitive since 2015 when JMB militants abducted him from a prison van, carrying him to Mymensingh jail after a gun attack in Trishal upazila.

On November 24, the European Union (EU) General Court dismissed an application brought by the European Political Subdivision of the Liberation Tigers of Tamil Eelam (LTTE) to annul the 2019 and 2020 acts maintaining the inclusion of the LTTE on the EU’s terrorist sanctions list, reports Colombo Page. The Court said the Council could rely on the decision by the UK Home Secretary in 2001 to list the LTTE because the Government was a ‘competent authority’ for these purposes and the EU had a duty to review whether the 2001 assessment still justified the listing in 2019. The Court found that the EU had sufficiently justified the listing in 2019 – 2020 and rejected the argument that the LTTE could not be classified as a ‘terrorist organization’ for the purposes of Article 1(3) of Common Position 2001/931.

The Islamabad High Court (IHC) Chief Justice Athar Minallah remarked on November 1 said that the responsibility of missing persons falls on the Prime Minister (PM) and members of the Federal Cabinet, reports Dawn. Justice Minallah made the remarks while hearing a petition filed by Rana Mehmood Ikram, father of journalist Mudassar Mehmood, who had reportedly gone missing on August 19, 2018. Human Rights Minister Shireen Mazari and Interior Secretary Yousuf Naseem Khokhar appeared for today's hearing. Additional attorney general Qasim Wadud and deputy attorney general Syed Tayyab Shah were also present in the courtroom. Advocate Usman Warraich appeared on behalf of the missing journalist's father. However, Advocate Imaan Mazari was not present as she was unwell. During today's hearing, Justice Minallah told the minister that she had been summoned because the state was not "visible" in tackling the issue of enforced disappearances. "A person going missing is a crime against humanity. The prime minister and members of the cabinet are there to serve the people of the country. The state's response towards recovering missing persons is pathetic," he remarked.

The high court in England on December 9 rejected an appeal by Indian authorities seeking permission to appeal against a magistrates’ court order turning down the extradition on human rights grounds of Kuldeep Singh alias Keepa Sidhu (44), wanted in India as an alleged senior member of the banned terrorist organisation Khalistan Zindabad Force (KZF), reports Hindustan Times. Singh, is charged with conspiring with others to commit terror activities in Punjab dating back to 2015-16, including a plot to assassinate then chief minister Parkash Singh Badal and deputy chief minister Sukhbir Singh Badal. Singh is also accused of recruiting youths in Punjab to the banned KZF organisation by offering them money and organising a meeting of separatists in a gurdwara. District judge Gareth Branston, presiding over the extradition case at Westminster Magistrates’ Court here, ruled in January that as the offences carry maximum sentences and “no possibility of a review of such a life sentence with a view to its commutation, remission, termination or conditional release”, it would be contrary to Article 3 of the European Convention of Human Rights. Singh, who entered the UK illegally in 2005, was on immigration bail when he was arrested at Loughborough Immigration Reporting Centre in eastern England in October 2019.

Three persons were arrested for allegedly preaching in favour of Khalistan at a place near Banur area in Patiala District of Punjab, reports The Economic Times on December 31. Senior Superintendent of Police (SSP), Harcharan Singh Bhullar said two persons, identified as Jagmeet Singh and Ravinder Singh, were visiting various religious and public places and distributing some registration forms to people to vote for a referendum to form Khalistan. The pro-Khalistan material was being provided by Jagmeet Singh's mother Jasveer Kaur and she was also arrested, adding that a large quantity of pro-Khalistan material was recovered from the possession of the accused. Notably, the US-based Sikhs for Justice (SFJ), a pro-Khalistan group, had pushed for a referendum as part of its separatist agenda. SSP, Bhullar said initial interrogation of the accused revealed that the kingpin of the gang was Jasveer Kaur and her husband Kuldeep Singh who works as a superintendent at Punjab Roadways. The SSP said Jasveer Kaur's brother-in-law Manjit Singh was the ‘area commander’ of the terrorist organisation Babbar Khalsa International (BKI), Sukhdev Babbar Group. Jasveer Kaur, Jagmeet Singh and Ravinder Singh were produced in a court which sent them to six-day Police custody.
