The Hindu reports that charge sheet has been filed against the 62 accused in connection with the July 26, 2008 Ahmedabad serial bomb blasts in which 57 people were killed by a special court on January 11. Among the 95 accused, 33 are still absconding (of whom, three are dead). The remaining 62 are in jail and were present in court. The 62 accused belong to 11 different States and were arrested at different times and from different places. Charges include hatching a conspiracy, waging war against the State, murder, attempt to murder, organising training camps for training terror activities, encouraging youths to join terror camps, and others. However, the charge sheet named Abu Bashar, Qyamuddin, Abdul Razeek and Zahid Sheikh as the main conspirators and masterminds of the blasts. The charge sheet mentioned that the conspirators had stolen a few cars from Mumbai, which were then laden with explosives and placed at strategic points in Ahmedabad, including the trauma centre of the Government civil hospital to cause greater damage. The explosives, however, were purchased in Ahmedabad. In other incidents, old bicycles fitted with bombs were used.

A joint Police team of the Punjab and Delhi Police neutralised a module of the Babbar Khalsa International (BKI), an outfit backed by Pakistan's Inter-Services Intelligence (ISI), by arresting three militants from Punjab and Delhi, reports Times of India. Two suspected BKI militants, identified as Daljit Kumar alias Deepak of Baltana from Mohali District and Purshotam Singh alias Bunty from Rajoura in Patiala District, were arrested at the Zirakpur-Patiala road near Zirakpur in an operation conducted by the Mohali Police and the Special Cell of Delhi Police in the night of March 18. The third militant of the outfit, identified as Karwinder Singh, a native of Ropar, was arrested in Delhi on March 19. The arrests indicate that BKI is being pressured, just like Indian Mujahideen (IM) terrorists hosted by Pakistan, by its ISI handlers to revive terrorist activities. Senior Superintendent of Police, Mohali, Gurpreet Singh Bhullar said that two France-based terrorists identified as Purshotam Singh of Matheri and Goldy of Ghel, both from Ambala District, were funding the terrorists activities. INR 100000 recovered from the two militants was sent by them. Police also recovered a .455 bore revolver with three cartridges from the two militants. Purshottam Singh, a proclaimed offender, is reportedly one of the accused involved in the assassination of former Punjab Chief Minister Beant Singh, but could not be arrested. He had also tried to eliminate former Haryana Chief Minister Bhajan Lal before Benat Singh's assassination. Preliminary interrogation of the accused revealed that they were planning to carry out blasts in the region to create terror, the cops said, adding that more revelations are expected in the coming days. A case against them was registered at the Zirakpur Police Station and they were produced in the Derabassi court from where they were sent to Police remand till March 21.

The British Supreme Court has ruled that being a cadre of the Liberation Tigers of Tamil Eelam (LTTE), which has been designated as a terrorist organisation by the British Government can seek asylum in UK, reports Daily Mirror quoting London Telegraph. This ruling was made in the case of “R” who joined the LTTE in 1992, at the age of 10. “R” occupied various positions until, at the age of 18. He was ‘appointed’ to lead a mobile unit transporting members of the intelligence division through the jungles to Colombo. He also acted as chief security guard to the leader of the intelligence division and second in command of the combat unit of the intelligence division. In October 2006, he was sent under cover to Colombo to await further instructions but two months later he discovered that the Sri Lankan Government was aware of his presence in the capital. Then he fled to Britain and claimed asylum on the basis that if he returned to Sri Lanka he would face mistreatment due to his race and LTTE membership. The application was refused, saying there were grounds for considering that he had committed war crimes.

An Australian court has released three persons, who were charged with sending funds to the Liberation Tigers of Tamil Eelam (LTTE) after pleading guilty to their charges, reports Colombo Page. Three Tamil persons, Aruran Vinayagamoorthy, Sivarajah Yathavan, and Arumugum Rajeevan, pleaded guilty to providing over USD 1 million to the LTTE outfit between 2002 and 2005. They were arrested in 2007 by the Australian Federal Police following a two-year investigation. The trio was earlier charged with the terrorism but the Australian prosecutors in 2009 withdrew all terrorism charges against the three LTTE supporters. The men pleaded guilty in December 2009 to a lesser charge of providing funds to a terrorist organization. Although LTTE is not banned in Australia, under the charter of the United Nations Act, Australian federal law makes it a criminal offence to funds to a terrorist organization banned either by the UN or by the Australian Government. However, Vinayagamoorthy also pleaded guilty to providing electronic equipment, including radio transmitters, used in bomb attacks in Sri Lanka. Justice Paul Coghlan of Victorian Supreme Court on March 31 accepted the guilty pleas and sentenced Vinayagamoorthy to two years in jail but released him on a good behaviour bond for four years. Justice Coghlan sentenced Yathavan and Rajeevan to one year in jail and released on a good behaviour bond for three years.

Pakistan on April 25 handed over to India six dossiers on its own investigation into the Mumbai attacks, with a request that India hand over Ajmal Kasab and an Indian national, Fahim Ansari, so that their testimonies could be recorded in Pakistan, reports Daily Times. Top Foreign Office officials handed over the dossiers to the Indian Deputy High Commissioner. “We have sought India’s help that he (Ajmal Kasab) should be handed over to us so that the trial here can go forward,” Foreign Office spokesman Abdul Basit said. Islamabad is holding seven suspects linked to the November 26 to 29 attacks on India’s financial capital, including alleged mastermind of the operation, Zakiur Rehman Lakhvi, and Lashkar-e-Toiba (LeT) operative Zarar Shah. An anti-terrorism court in Rawalpindi indicted the seven persons on the eve of the first anniversary of the attack. Since the indictment, officials have implied that the seven suspects’ trial cannot proceed unless Kasab, who was convicted in Mumbai in March 2010 after a year-long trial, is handed over as a witness. When asked how India could extradite Kasab and Ansari to Pakistan, Basit replied, “It is not extradition per se. It is a legal requirement since the court has asked that Kasab be produced before it.” Interior Minister Rehman Malik has also said that Kasab is required to appear in Rawalpindi.

27 among 675 accused of the 44 Rifle Battalion of the Bangladesh Rifle (BDR) were in particular focus as they were hauled before the (Bangladesh Rifles) BDR Special Court-5 on April 27 in civil dress. The rest were handcuffed and in uniform in the dock at the Darbar Hall of Bangladesh Rifles headquarters in Pilkhana where the bloody mutiny broke out on February 25, 2009. This was the first incident of producing the accused in fetters before the BDR court set up to hold trial for mutiny charges. Of the 27, sepoy (soldier) Salim Reza drew special attention as he played a leading role during the carnage. Everyone's focus was trained on Salim on the first day of the trial on April 26 when the complainant and prosecutor of the case narrated his leading role. Further, on the basis of a video footage of BDR mutiny at Pilkhana, Criminal Investigation Department (CID) investigators confirmed another BDR sepoy's involvement and he was brought to CID headquarters from Thakurgaon on April 27. A special sessions court in Mumbai on May 3 pronounced Mohammad Ajmal Amir Kasab, the lone surviving Lashkar-e-Toiba (LeT) militant of the November 26, 2008 Mumbai terror attacks (also known as 26/11), guilty of waging war against India, after a 271-day trial, reports The Hindu. The 1,522-page judgment convicted Kasab of conspiring to wage war, along with nine other terrorists and 20 co-conspirators in Pakistan, and of murder and abetment to murder, among other offences. Among the 20 wanted accused indicted by the court are LeT Chief Muhammad Hafeez Saeed and other operatives Zaki-Ur-Rehman Lakhvi, Zarar Shah and Abu Hamza. The arguments for the quantum of sentence will begin on April 4 (today). Special sessions judge M.L. Tahaliyani at the Arthur Road jail court in Mumbai acquitted the other two accused, Indians, Fahim Ansari and Sabahuddin Ahmed, of “all the charges framed against them.” The two had been accused of making and conveying maps of target locations in Mumbai. The court said: “The preparations made for the attacks by Kasab and nine other attackers, and the co-conspirators, the training imparted to the gunmen, the arms and ammunition involved and the quantity of cartridges reached proved beyond reasonable doubt that this was not a simple case of murder but an offence punishable under Section 121 of the Indian Penal Code [IPC].”

Appearing in the British Columbia Supreme Court in Vancouver on May 11, Toronto-based Prapaharan Thambithurai admitted raising money for the LTTE in 2008. Vancouver is the major city of British Columbia - the western-most province of Canada - with a huge concentration of the South Asian community. The 46-year-old Sri Lankan Tamil, who came to Canada as a refugee in 1988, was arrested in 2008 for illegally raising funds for the LTTE. The LTTE was banned along with many other terror outfits by Canada in 2006 after the new Conservative Government took over. He was arrested while seeking donations for the World Tamil Movement for relief work in Sri Lanka. But Canadian intelligence agencies found that the body was a front organization for the banned LTTE. Pleading guilty, the Sri Lankan Tamil admitted that half of the money raised for humanitarian aid went to the LTTE.

The special court which conducted the trial of November 26, 2008 Mumbai terrorist attacks (also known as 26/11) has criticised personnel of Azad Maidan Police Station, saying they acted in a "cowardly" manner and "ran away" instead of stopping the militants, reports Times of India. Instead of coming to the aid of Additional Commissioner Sadanand Date, who engaged the terrorists in a gunfight on the terrace of Cama Hospital and got grievously injured in the process, the officers from the Police station possibly "ran away", Judge M. L. Tahaliyani said in the judgement, a copy of which was made available to PTI on May 24. In addition, the 26/11 special court has come down heavily on the prosecution and investigating agency for submitting "doubtful" and "fragile" evidence against accused Faheem Ansari and Sabauddin Ahmed that led to their acquittal in the terrorist attacks case. "The evidence of the only prosecution witness is doubtful and unreliable. The investigating agency has failed to provide quality evidence against the duo (Faheem and Sabauddin)," the 1600-page judgement, said.

The trial in the July 2006 serial train bomb blast case is scheduled to restart in a special court on May 24 (today), reports Times of India. Seven RDX bombs kept in first class coaches of Mumbai’s suburban trains exploded on July 11, 2006. The Anti Terrorist Squad said that the conspiracy was hatched in Pakistan and at least five of the 13 arrested persons had gone to that country for terror training. The Police also said Pakistan-based militant outfit Lashkar-e-Toiba (LeT) had used the banned organisation, Students Islamic Movement of India (SIMI), to engineer the blasts. The trial started in a special court in December 2007. However, matters could not progress as the accused had challenged the application of certain provisions of law. The legal dispute was finally settled by the Supreme Court in April 2010 before the trial court in Mumbai could hear the case again. The process involved a delay of more than two years. In 2007, Saeed Ahmed, son of serial bombing accused Sohail Shaikh Shabbir Masiullah arrested for the 2006 Malegaon blast, and Zameer Rehman, accused in the Aurangabad arms haul case, had filed petition in the Bombay high court challenging the constitutional validity of Maharashtra Control of Organised Crime Act (MCOCA). When the High Court upheld the decision to slap MCOCA, the accused moved the Supreme Court in 2008 and it stayed their trials.

The bench comprising Justice Nasirul Mulk, Justice Jawwad S Khawaja and Justice Rahmat Hussain Jafferi dismissed the petitions against the Lahore High Court verdict that ended Hafiz Saeed’s house arrest. The bench observed that keeping a person in detention on mere concerns of threat was not justified. It observed that the Punjab Government had admitted to lacking sufficient evidence against Saeed and his involvement in any illegal activities after his house arrest ended. Justice Khawaja said, “If there is any material against him then its ok, but if he doesn’t create any law and order situation then the UN resolutions don’t provide grounds to detain him.” AK Dogar, lawyer for Hafiz Saeed, said his client was a peaceful citizen and the JD was a welfare organisation. “The prosecution has failed to prove its case,” he added.

A Pakistani college student, Adnan Babar Mirza (33), living in Texas was convicted on May 28 of conspiring to help the Taliban and fight US troops, report Daily Times. A federal jury convicted Adnan Babar Mirza of two conspiracy counts and seven firearms violations after a three-day trial held in Houston. He faces up to five years in prison on each conspiracy count and 10 years on the weapons counts when he is sentenced on September 10, 2009. Mirza, who remains in federal custody, was one of four men arrested in 2006 for alleged participation in paramilitary training exercises at campsites around the Houston area so they could engage in a “holy war”. Mirza’s attorney, David Adler, told jurors that Mirza went on camping trips but denied they involved paramilitary training exercises. Prosecutor Jim McAlister told jurors that the activities of Mirza and the other three men came to authorities’ attention after another of their friends, James Coates, decided, “things were getting out of hand” and became an FBI informant. Mirza claimed Coates was the one who was militant and promoted violence. An undercover officer taped conversations with Mirza and the other men in which they allegedly talked about ambushing US soldiers and triggering a bomb with a cell phone, according to court documents. FBI Special Agent John McKinley, the prosecution’s first witness, told jurors that Mirza can be heard on the taped conversations talking about sending money to support Taliban families. Prosecutors have said Mirza collected about $900 for Taliban fighters and their families. Prosecutors also said Mirza, who was attending Houston Community College, was in the country illegally because he violated his student visa by working. The three other men who were arrested have pleaded guilty or been convicted. Kobie Diallo Williams, a US citizen, was sentenced four and a half years in prison for conspiring to join the Taliban and fight against US forces. Syed Maaz Shah, a former Pakistani engineering student at the University of Texas at Dallas, was sentenced in 2007 to six and a half years in prison on federal firearms charges. Shiraz Syed Qazi, also a Pakistani student and Mirza’s cousin, received a 10-month prison sentence in 2007 on a firearms charge.

Times of India reports that a team of Indian investigators has arrived in Chicago, USA and is preparing to interrogate Headley in connection with the November 26, 2008 Mumbai attacks. Three days after the team arrived in the US to question Headley, there was no confirmation from US authorities as to when and what kind of access would be granted to the team. An FBI Chicago spokesperson said that the federal agency would not comment or provide any information on the Headley interrogation. US Attorney's office spokesperson in Chicago Randall Samborn said he "does not have any comment on anything related to David Headley whatsoever". The 49-year old Pakistani-American has been held at the downtown Metropolitan Correctional Center. Headley had pleaded guilty to conspiring in the 26/11 Mumbai attacks but struck a deal with US authorities in a plea bargain that saved him from the death penalty and extradition to India. The plea agreement had however said Headley would cooperate with foreign authorities and can be interviewed by them only on US soil.
