The Supreme Court (SC) on January 14 upheld the death sentence of former Jatiya Party (JP) leader Syed Mohammad Qaisar, for his involvement in crimes against humanity and war crimes -- including killing and rape - during the 1971 Liberation War, reports The Daily Star. The International Crimes Tribunal-2 (ICT-2) on December 23, 2014, awarded death penalty to Qaisar for committing crimes against humanity in 1971 war. Later, Qaisar filed an appeal with the Appellate Division seeking acquittal of the charges in which he has been convicted and sentenced.

Anti-Terrorism Court (ATC) in Rawalpindi on January 17 has sentenced 86 members of Tehreek-e-Labbaik Pakistan (TLP), including TLP chief Khadim Hussain Rizvi's brother Ameer Hussain Rizvi and nephew Mohammad Ali, to 55-year prison terms each for taking part in violent rallies in 2018 over the acquittal of a Christian woman in a blasphemy case, reports Daily Times. The trial had lasted for over a year. Additionally, the court ordered the convicts to collectively submit Rs 12,925,000 and directed authorities to seize their moveable and immoveable assets. The court was hearing a case registered in the Pindighep Police Station against TLP workers who held violent protests and clashed with the Police over the arrest of party chief Khadim Hussain Rizvi in 2018. Pir Ejaz Ashrafi, a senior leader of TLP, said the sentences will be appealed. “Justice has not been done,” Ashrafi said. “We will challenge the verdicts,” he added.

The duo Ejaz Khan and his brother Iliyas were arrested on December 12, 2019 on the charges of being alleged SIMI members following serial train blasts in Mumbai City. The two men have been absconding since 2006. Taking cognizance in the matter, the court stated that being an absconder for a long time itself cannot be a ground to reject bail.

The National Investigation Agency (NIA) would again take the voice samples of the nine militants of Khalistan Zindabad Force (KZF) for their involvement in the smuggling of arms using drones on the International Border (IB) with Pakistan, reports The Tribune on January 31. As per the report, barring Gurdev Singh, all the militants appeared in an NIA court in Mohali District on January 30. Three KZF militants – Balbir Singh alias Binda, Harbhajan Singh and Romandeep Singh were arrested by the NIA on a production warrant. The NIA had also registered cases against Akashdeep Singh, Balwant Singh, Shukhdeep Singh, Mann Singh, Sajanpreet Singh, Gurdev Singh and Malkit Singh. The case was earlier being investigated by the State Special Operation Cell, Amritsar. At that time, four militants including Balbir Singh, Harbhajan Singh, and Balwant Singh, were arrested along with the arms and other material near Chola Sahib on September 22, 2019. Later, the case was handed over to the NIA.

The Special Court of National Investigating Agency (NIA) on February 12, issued non-bailable warrants against chief of Khalistan Zindabad Force (KZF) – Ranjeet Singh Neeta, a resident of Jammu District, now based in Pakistan, and his accomplice Gurmeet Singh alias Bagga, who hails from Hoshiarpur District, currently based in Germany, in an arms-dropping case in Punjab, reports The Tribune. As per the report, the duo is wanted for dropping arms and ammunition and Fake Indian Currency Notes (FICN) in September 2019 at Chola Sahib in Punjab via unmanned aerial vehicles (UAVs) or drones that originated from Pakistan. The spokesperson of NIA said, "During investigation, role of Neeta, Pakistan based chief of KZF, a proscribed terrorist organisation and Singh, a key operative of KZF based in Hamburg, Germany has been found in the conspiracy of trafficking of illegal arms, ammunition, explosives, communication devices and FICNs into India to further terrorist activities."

He was slapped with a prison sentence of five-and-a-half years and a fine of PKR 15,000 in each case. The sentences of both cases will run concurrently. The court also granted him the benefit of Section 382-B of the Code of Criminal Procedure (reduction of period of sentence of imprisonment). Malik Zafar Iqbal, the secretary of Al-Anfaal Trust, has also been convicted in the same cases and has been awarded similar punishment. They were convicted under the Anti-Terrorism Act Section 11-F (2) — pertaining to membership, support and meetings relating to a proscribed organisation — and 11-N (punishment under Sections 11-H to 11-K). Section 11H relates to fundraising for the purpose of terrorism, 11-I is about the use and possession of money or other property for terrorism, 11-J relates to funding arrangements which result in money being made available for terrorism, while 11-K relates to money laundering. The court directed authorities to keep Saeed under custody until further orders. The verdict was announced by ATC judge Arshad Hussain Bhatta. Saeed was also present in the courtroom while the judge read out the sentence.

The other accused are Syed Naveed Mushtaq Shah alias Naveed Baba, Irfan Safi Mir, Rafi Ahmed Rather, and Syed Irfan Ahmad alias Irfan, all the residents of Shopian. The National Investigation Agency (NIA) has procured five days of custody of Telangana Vidyarthi Vedika (TVV) president, Bandari Maddileti to interrogate him in connection with a case of his association with frontal organisations of Communist Party of India-Maoist (CPI-Maoist), reports The Times of India on March 11. As per the report, the VI metropolitan sessions judge Court of Nampally city in Hyderabad District of Telangana granted the custody of Maddileti to NIA. The defence counsel V. Raghunath said, “the court has specified certain conditions while granting the custody. NIA officials will take Maddileti into custody on March 11.” NIA had moved a petition in the court a few days ago seeking custody of Maddileti. In December 2019, NIA re-registered a case based on a FIR booked by Hyderabad Police against activists of TVV. The death-row convicts are Jahangir Hossain alias Rajib Gandhi, Alamgir Hossain, Ramjan Ali (arrested on February 26, 2016 from Panchagarh) and Rajibul Islam Molla. Among the death-row convict, Rajibul Islam is absconding. Suspected Islamic State (IS) operative, Areeb Majeed who was arrested in November 2014 for having travelled to Iraq and then Syria to join the global terrorist outfit granted bail by a special National Investigation Agency (NIA) court on March 17, reports The Hindu. Majeed along with Fahad Shaikh, Shaheem Tanki and Aman Tandel had left India for Iraq under the guise of pilgrimage in May 2014 and joined the IS. All of them later went to Syria, where the other three are believed to have been killed, while Majeed came back to India via Turkey in November 2014. Earlier, he had moved a bail plea before the Bombay High Court after it was rejected by the special NIA court. The NIA in its chargesheet against Majeed who had been in NIA custody since last five years had claimed that the suspect had participated in several attacks perpetrated by IS, and had sustained bullet injuries on two occasions, and was seriously injured in a bombing following which he had decided to return to India.

The operatives were identified as Ravinderpal Singh alias Ravi, Jagdev Singh alias Sonu - both residents of Moga and Fatehgarh Sahib District of Punjab respectively and Harcharan Singh, a resident of Delhi. However, the Court discharged another accused Nishan Singh alias Punia, as the NIA failed to file challan against him. Sindh Government on April 3, invoked the maintenance of public order to keep in jail British-born alQaeda leader Ahmed Omar Saeed Sheikh after a court overturned his death sentence in the abduction and murder of United States (US) journalist Daniel Pearl in Karachi in 2002, reports The Times of India. Three of his accomplices, who were acquitted on April 2, will also remain in prison. Sheikh was sentenced to death in 2002 for masterminding Pearl’s murder. The other three were sentenced to life. On April 2, a two-judge Sindh High Court bench had found Sheikh guilty of the lesser charge of kidnapping and commuted his death sentence to seven years in prison. According to the law, Sheikh was eligible to walk free as he had already served 18 years in prison on the death row. The Sindh Government acted swiftly to invoke the order which allows it to keep the four convicts behind bars for three months. According to a notification issued by the Sindh Home Ministry, the release of Sheikh and his three associates could jeopardise the law and order situation in the province, thus, necessitating their continued detention.

Hemayet Uddin Khan, Assistant Public Prosecutor of the Chief Metropolitan Magistrate's Court of Dhaka, told, "Majed returned to the country on March 15 or 16 from Kolkata. He claimed that he had been hiding there for about 23 years." A CTTC high official, requesting anonymity, said during primary interrogation, Majed, the self-declared killer of Bangabandhu, told them that after returning home, he stayed in different houses, but had communications with his family. Majed was present at Dhanmondi Road-32 on August 15, 1975, when Bangabandhu and most of his family members were assassinated. After the killing of Bangabandhu, Majed performed his duties at the Bangabhaban and some other places as per the instructions of late Ziaur Rahman. The late President Ziaur Rahman's Government awarded the killers in many ways. Majed went into hiding after the Awami League Government came to power in 1997.

A five-member bench of justices Deepak Kumar Karki, Meera Khadka, Bishwambhar Shreshta, Ishwar Prasad Khatiwada and Ananda Mohan Bhattarai refused to reopen the case. The full bench finally closed the door for reviewing the apex court verdict which was issued some two years ago following intense hearings on a case filed against the Government by Suman Adhikari. A Karachi Anti-Terrorism Court (ATC) on May 18 sentenced two men, said to be associated with the Islamic State/Islamic State of Iraq and Levant/Daish (ISIS), to death in a case pertaining to the 2017 suicide blast at the shrine of Lal Shahbaz Qalandar in Sehwan that killed around 70 people and wounded dozens of others, reports Dawn. The judge of the Anti-Terrorism Court-XVI found Nadir Ali and Furqan guilty of facilitating suicide bomber Barar Brohi who on February 16, 2017 blew himself up at the packed-to-capacity courtyard of the shrine of the Sufi saint. The court handed them capital punishment on 70 counts (for killing of 70 victims, including women and children) and ordered to pay a collective fine of PKR 14 million each (PKR 200,000 for each killing) to the state. It also ordered the convicts to pay a collective fine of PKR 14 million (PKR 200,000 each), as compensation to the legal heirs of victims. The judge also awarded 10-year imprisonment to each convict for wounding each of 65 people. They were ordered to pay a fine of PKR 100,000 for causing injuries to each victim. Additionally, the convicts were awarded a collective sentence of 24-years each for their involvement in the bomb blast and ordered to pay PKR 100,000 fine each. Nadir Ali was further given life imprisonment for possessing explosives in addition to seven-year imprisonment for possessing illicit weapon and PKR 50,000 fine. However, their death sentences are subject to confirmation by the Sindh High Court. Other sentences of imprisonment would run concurrently.

The Justice Anup J. Bhambhani has directed the NIA to respond to the bail plea by the next date of hearing, which has been set as 27 May. Navlakha is one of the 11 prominent activists, academics, and lawyers who have been accused of Naxal [Left Wing Extremism, LWE] links, and instigating the violence that took place in Bhima-Koregaon on January 1, 2018. They were booked by the Pune Police under the Unlawful Activities (Prevention) Act (UAPA) 1967, which imposes extremely strict conditions for grant of bail. The Supreme Court (SC) on June 1 dismissed eight Fundamental Rights (FR) petitions filed challenging the dissolution of Parliament and holding the General Election on June 20, reports Daily News. Five Judge Bench comprising Chief Justice Jayantha Jayasuriya, Justice Buwaneka Aluwihare, Justice Sisira de Abrew, Justice Priyantha Jayawardena and Justice Vijith Malalgoda unanimously refused to grant Leave to Proceed with eight FR petitions. An Anti-Terrorism Court (ATC) in Lahore on June 18, convicted four militants of the proscribed Lashkar-e-Taiba (LeT) in a terror financing case, reports Samaa TV. The court has awarded imprisonment for five years each to Zafar Iqbal and Yahya Mujahid. Two others, Hafiz Abdul Salam and Abdul Rehman Makki, the brother-in-law of LeT ‘chief’ Hafiz Saeed, have been given imprisonment for one year each. The accused were convicted under the Anti-Terrorism Act, 1997. The verdict said that the accused “arranged, managed, solicited, supported and obtained property in the name of AL-Anfaal Trust” which is a subsidiary organisation of LeT. The court in its judgment further stated, “the prosecution has proved its case against accused persons Malik Zafar Iqbal s/o Sardar Ali and Muhammad Yayha Aziz s/o Ham Din to the extent of use and possession of the property which has reasonable cause to suspect that it has been used for the purpose of terror financing or terrorism”. The court has also ordered the authorities to confiscate Jamia Madrasa Sattaria and its building.

The Special Court of the National Investigation Agency (NIA) at Mohali in Sahibzada Ajit Singh Nagar District of Punjab dismissed the bail application of a UK citizen identified as Jagtar Singh alias Jaggi Johal, accused in targeted killing cases in the State, reports Indian Express on June 25. The bail plea of the accused was dismissed on the ground that he was part of a “larger conspiracy to destabilise the security of Punjab”. The case was initially registered on February 4, 2016, under section 307 of the Indian Penal Code (IPC) and Section 25 of Arms Act at Basti Jodhewal Police Station in Ludhiana, on the complaint lodged by Amit Arora. Thereafter, investigation of the case was handed over to NIA on December 8, 2017. During the investigation, the NIA found that Hardeep Singh alias Shera and Ramandeep Singh alias Bagga tried to murder Arora on February 3, 2016, at Basti Jodhewal. It was also found that an attempt made to kill Arora was part of a larger conspiracy hatched by the terrorist organisation Khalistan Liberation Force (KLF), which involved eight incidents of targeted killings/attempted killings and objective of this conspiracy was to destabilise the law and order in the State. It has also come on record that funds facilitated by Johal were handed over to accused Hardeep Singh, who along with Ramandeep Singh used them to carry out the incidents of targeted killings.

The Gujranwala Anti-Terrorism Court (ATC) of Punjab on June 25, handed down 16 years imprisonment each to five Al Qaeda in the Indian Subcontinent (AQIS) militants for terror financing and keeping explosives, reports Dawn. Convicted terrorists were running a media cell of the AQIS in Gujranwala. They were arrested in a joint operation by the Counter Terrorism Department (CTD) of Punjab and an intelligence agency in December 2019. The punishment was handed down after trial in a case registered and investigated by the CTD. The court found Abdullah Umair, Ahmadur Rehman, Asim Akbar Saeed, Muhammad Yaqoob and Muhammad Yousaf guilty of the offences. Each convict was handed down five years in prison for terrorism financing, seven years for keeping explosives, three years for supporting proscribed AQIS and one-year imprisonment for keeping literature of AQIS. The personal properties of convicts were confiscated and fines were also imposed on them.

The court scheduled his next day of bail hearing on August 21, 2020. In his extradition case held before Magistrate Judge Jacqueline Chooljian, the US District Court of Los Angeles ordered that Tahawwur Hussain Rana be "temporarily detained" till his next hearing on August 21. "Court orders defendant temporarily detained pending further briefing and issuance of decision on detention motion," it said. Describing Rana a flight risk, the US has opposed his release on bail, arguing that if he were to flee to Canada, he may escape the possibility of a death sentence in India.

Laamu Atoll's Magistrate Court, on July 6, sentenced Abdul Latheef, also a 2007 Sultan Park bombing suspect, for one year and 12 days of imprisonment over obstruction of justice linked to the averted Maafushi Prison attack case, reports Edition. According to local media Mihaaru, Abdul Latheef destroyed his mobile phone after it was summoned, as part of an investigative operation conducted by the Maldives Police Service on Gan in Laamu Atoll. This was part of an investigation launched over reports that detainees in Maafushi Prison were plotting to carry out terrorist activities. Police further noted having received information that indicated the prisoners had colluded with Foreign Terrorist Organisations. Sources also noted that Abdul Latheef was arrested during the month of April 2020.

The National Investigation Agency (NIA) on July 21, claimed that the four accused in Kerala gold smuggling case were part of a larger conspiracy and the gold they were smuggling was supposed to be used to finance terror activities in the country, reports Times Now. According to the NIA's remand note, main accused Swapna Suresh and Sandeep Nair conspired to damage monetary stability and destabilise the Indian economy by smuggling a large quantity of gold from abroad. The gold was supposed to be used to finance terrorism in the country through various means, further stated the NIA note. The investigative agency has also mentioned KT Rameez as the lynchpin of the operation and he was pulling the strings for a diabolical terror plot in the country. The development has come hours after a special court in Kochi, Kerala extended NIA custody of Swapna Suresh and Sandeep Nair till July 24, 2020. Swapna Suresh and Sandeep Nair were arrested by the NIA from Bengaluru (Karnataka) on July 11. Central agencies have arrested 15 people in connection with the seizure of gold worth nearly Rs 15 crore from a "diplomatic baggage" at the Thiruvananthapuram International airport on July 5, 2020.

US District Court Judge in Los Angeles Jacqueline Chooljian, in her 24-page order dated July 21, denied bail to Rana arguing that he is a flight risk. Describing Rana as a flight risk, the US government opposed his release on bail, arguing that if he were to flee to Canada, he may escape the possibility of a death sentence in India. "Given the stakes, an allowance of bail in any amount would not guarantee Rana's presence in court. Granting bail would invite the possibility of embarrassing the United States in the conduct of its foreign affairs, straining its relationship with India," Assistant US Attorney John J Lulejian had told the court.

The Supreme Court (SC) on July 21, suspended the Peshawar High Court’s (PHC’s) order to release 196 military court convicts, and sought details of cases against them, reports The Express Tribune. A three-member bench of the SC, headed by Justice Mushir Alam, heard a petition against the PHC’s verdict given on June 17. The apex court inquired whether the convicts were released from jail following the PHC’s decision. The Additional Attorney General (AAG) informed the SC that convicts had not been released as of yet. The AAG then requested the decision of the Peshawar High Court to be suspended. Justice Qazi Amin remarked that the convicts were convicted after a trial by military courts, he added that each case will have its own particular evidence and facts. Suspending PHC’s order, SC adjourned the hearing till July 24. On July 11, a two-member bench, comprising of PHC Chief Justice Waqar Ahmed Seth and Justice Muhammad Naeem Anwar, issued a 426-page detailed judgment on the appeals of the convicts. The court allowed their release if they were not involved in any other case.

Revoking the verdicts of lower courts, the Supreme Court has given a clean chit to Govinda Bahadur Batala, a ‘brigade commander’ of then Maoist People’s Liberation Army who allegedly masterminded the murder of Ram Hari Shrestha, a restaurateur in Koteshwor in 2008, reports Kathmandu Post. Shrestha was abducted from Kathmandu on April 27, 2008 and his body was found on the bank of Trishuli River in Chitwan district a month later on May 25. In his Police statement, Batala confessed to have taken Shrestha, along with Keshav Adhikari and Gangaram Thapa to Chitwan, for an investigation into their alleged involvement in the robbery of Rs 1.7 million and a pistol. On May 31, 2011, a single bench of Chitwan District Court judge Bhojraj Pokharel ordered three months of imprisonment to Batala arguing even though he wasn’t directly involved in the killing, he was present at the scene. The Hetauda Appellate Court upheld the decision on January 19, 2014. Batala challenged the decision in the Supreme Court. The division bench of Justices Tej Bahadur KC and Tanka Bahadur Moktan on March 1 issued a verdict, giving clean chit to Batala arguing that he had no involvement in the entire crime. KC and Moktan, in their verdict, say the decisions of Chitwan District and Hetauda Appellate courts were wrong.

The two militants identified as Wangfai Wangsa, a Myanmar national and Kekho Homkhu, a resident of Lazu village in Tirap District had been arrested in a search operation at Kamka village under Pongchau Circle of Longding District bordering Myanmar on May 5, 2020. A 9 mm and a 7.65 mm pistol with a magazine and three live rounds each besides seven extortion receipts and other incriminating material had been recovered from the duo arrestee. Wangsa, one of the arrestees found guilty of illegally entering India under Section 14 of the Foreigners’ Act, was ordered to be deported following the completion of his prison term.

In mid-June, a special Anti-Terrorism Court (ATC) in Lahore had convicted four top leaders of JuD — Zafar Iqbal, Yahya Aziz, Abdul Rehman Makki and Abdus Salam, for collecting funds and unlawfully financing activities of their parental militant outfit Lashkar-e-Taiba (LeT). Iqbal and Aziz were each sentenced to five years in prison while Makki and Salam had been given one-year jail terms each. Makki and Salam had challenged their conviction in the Lahore Hight Court. During hearing, a two-member bench of the Lahore Hight Court comprising Justice Asjad Javed Gural and Justice Waheed Khan, after hearing arguments from the defence and prosecution, accepted the plea of Makki and Salam and ordered the suspension of their one-year sentence by the ATC. The Court also ordered their release on bail. Both militant leaders were serving their sentences in Lahore’s Kot Lakhpat jail.

Accused Abu Anas and Najmul Huda made the submission before the court, which was scheduled to hear arguments on the quantum of punishment for six other accused who had earlier pleaded guilty in the case, their advocate Qausar Khan said. Special Judge Parveen Singh, meanwhile, deferred for August 24, 2020 the hearing on the quantum of sentence for the six accused — Mudabbir Mushtaq Sheikh, Mohammad Shareef Moinudeen Khan, Asif Ali, Mohammad Hussain Khan, Syed Mujahid and Mohammad Azhar Khan — who pleaded guilty earlier. While pleading guilty, the accused told the court that they were “remorseful for the acts alleged against them”, and undertook not to indulge in similar acts and activities in future. The case, registered by the National Investigation Agency (NIA) on December 9, 2015 under relevant sections of the IPC and the UA(P) Act, pertains to the larger criminal conspiracy hatched by the IS to establish its base in India by recruiting Muslim youths for the proscribed terror group through different social media platforms, the probe agency said. The accused had formed Junood-ul-Khilafa-Fil-Hind organisation, seeking to establish a caliphate in India and pledging allegiance to IS, to recruit Muslim youths to work for the ISIS and commit acts of terrorism in India at the behest of Syria-based Yusuf-Al-Hindi who is purportedly the media chief of IS, it said. Brief facts of the case are that on March 16, 2013, Pappu and the other two were picked up by police from their hideout in Defence Housing Authority and later handed over to the Amn Committee which killed them. Pappu himself was allegedly involved in several cases of murders, kidnappings and drug peddling but was never convicted. A year before his death, he was acquitted from the murder of Faiz Muhammad, alias Mama Faizu, the father of Uzair. Uzair faces over five dozen cases related to terrorism. After his arrest, the army had taken him into custody in April 2017 on the charges of espionage and leak of sensitive security information to foreign intelligence agencies. He was handed back to the home authorities recently. During the hearing, he claimed that he never made any confessional statement in court. He asked the ATC to summon the judicial magistrate who presided over the recording of his so-called confessional statement under the Section 164 of the Code of Criminal Procedure.

The Anti-Terrorism Court (ATC) of Lahore on August 28, convicted three leaders of Jamaat-ud-Dawa (JuD) in a new case of terror financing registered by the Counter Terrorism Department (CTD), reports Dawn. ATC-III Presiding Judge Ejaz Ahmad Buttar, announced the verdict against Malik Zafar Iqbal, Hafiz Abdul Salam and Hafiz Abdul Rehman Makki in FIR No 91/2019. They were charged under sections 11-F (2)(5)(6), 11-H (2), 11-H (3)(a)(b), 11-J (2), 11-N of Anti-Terrorism Act 1997. The court awarded a collective imprisonment of 16-and-a-half years to Iqbal and Salam while one-and-a-half-year jail term to Makki. As per the breakup of the sentence, Iqbal and Salam have been given one-and-a-half years imprisonment under section 11-F (6) and five years each under sections 11-N read with sections 11-I (2)(b), 11-H and 11-J of the ATA, 1997 along with a fine Rs170,000 on each while Makki has been punished under section 11-F (6) only with a fine of Rs 20,000.

On September 8, National Investigation Agency (NIA) Court in Kolkata (West Bengal), convicted and sentenced four accused persons, belonging to Jama’atul Mujahideen Bangladesh (JMB) to imprisonment for seven years in Burdwan Blast case of October 2, 2014, according to nia.gov.in. Four accused are: Ziaul Hoque, Motiur Rahaman alias Bhasa, Mohammad Yusuf alias Bakkar alias Yusuf Sheikh, Jahirul Sheikh. Investigation by NIA revealed a conspiracy by JMB to radicalise, recruit and provide training in arms and explosives to its members in India as well as to commit terrorist acts and wage war against the democratically established Governments of India and Bangladesh. A large number of Improvised Explosive Devices (IEDs), explosives, hand grenades, training videos were recovered during the investigation of the case. A total of 33 accused were charge sheeted for commission of various offences in this case, out of which 31 could be arrested. Earlier, on August 8, 2019, 19 accused persons, and on November 15, 2019, five accused persons were convicted and sentenced, for various terms, by the NIA Special Court. The trial against the remaining three arrested and two absconding charge sheeted accused persons shall however continue.

Asif Pervaiz (37), has been in custody since 2013 fighting blasphemy charges that were levelled against him by the supervisor of the garment factory he once worked at. The supervisor had accused him of sending derogatory remarks about Prophet Muhammad to him in a text message. The court order issued by Additional Sessions Judge Mansoor Ahmad Qureshi, said Pervaiz would first serve a three-year prison term for “misusing” his phone to send the derogatory text message. Then “he shall be hanged by his neck till his death.” He was also fined PKR 50,000, the order said. Pervaiz's lawyer Saiful Malook said that Pervaiz has denied all charges against him and had merely forwarded the text messages in question.

Earlier on August 6, 2020, six accused persons were held guilty and convicted in this case. This case was registered on 09.12.2015 under section 125 of IPC and sections 18, 18B, 38 & 39 of UAPA, and pertains to larger criminal conspiracy hatched by the IS to establish its base in India by recruiting Muslim youth for IS, through different social media platforms. An Anti-Terrorism Court (ATC) on September 22, pronounced death sentence to Abdul Rehman alias Bhola and Zubair Charya, who were affiliated with Muttahida Qaumi Movement (MQM), reports The Express Tribune. At least 260 people were killed in the fire at Ali Enterprises garments factory in Baldia Town on September 11, 2012. The incident was initially deemed as an accident but was later termed an arson attack over non-payment of extortion. The court found that the men set the building ablaze because of a non-payment of extortion money by the garment factory owners. The two-prime accused, MQM's former provincial minister for commerce and industries Rauf Siddiqui and others were presented in court for hearing. Rauf Siddiqui, however, was acquitted by the court. The verdict was earlier due on September 17, but the court had adjourned the hearing of the case to September 22 without giving a verdict in the case. Abdul Rehman was arrested from Thailand through the Interpol. He was brought back to the country by the Federal Investigation Agency (FIA) and later handed over to the Police for further legal proceedings. In July, the Baldia factory inferno joint investigation team's (JIT) 27-page report stated that factory incident was an act of organised terrorism. The report said that the factory was set on fire for not paying extortion money of up to PKR 250 million and leaders of MQM – Hammad Siddiqui and Rehman Bhola – were involved in the act. It had further stated that the Baldia factory case was handled in a non-professional manner and from the day it was dealt with in such a way that the group involved in the act of terrorism benefitted.

The petitions point out that Sections 14, 16, 6, 5, 91 (1), 32, 33, 34, 35, 36, 37, 38 and 40 of the draft Bill are unconstitutional. According to Article 14 in the Bill, the President can dissolve Parliament at any time. The petitions allege that it is detrimental to the stability of Parliament. Also, according to Article 16, the President has the power to refer bills not passed by Parliament to a referendum. The petitioners point out that it is an undermining of the power of Parliament. Article 6 also provides for the President to appoint the Chief Justice and Justices of the Supreme Court. According to Article 25, the President also has the power to appoint members of the Judicial Service Commission. The petitioners point out that Article 5 of the Bill deprives them of the right and ability to file fundamental rights petitions against the President.

Earlier, on September 25, 2020, the Court had convicted the accused u/s 120B and 125 of Indian Penal Code (IPC) and sections 20, 38 and 39 of the UA (P) Act. this case was registered by NIA on October 1, 2016, based on credible information that certain youth had entered into a conspiracy and were making preparations to carry out terrorist attacks in India to further the objectives of IS. Investigation also revealed that Moideen had exited India from Chennai and reached Turkey on April 8, 2015. He had then illegally crossed over to Iraq through land border and joined the Islamic State using kunya name Abu Jasmine Al-Hindi. After undergoing religious and arms training with IS in Iraq, he was deployed with IS’ military formation Umar Ibnu Khatab Khatiba, headed by the French national Abu Suleiman Al-Francisi, who was later killed. Moideen was also associated with Pakistani national Mohammed Usman Ghani, while being in the Islamic State. Ghani was subsequently arrested and is now incarcerated in France, for his involvement in 13/11 Paris attacks of 2015.

On September 29, Special National Investigation Agency (NIA) Court at Kolkata convicted two (Bangladeshi citizens) accused persons, Sahadat Hussain and Umar Farooque after they pleaded guilty and sentenced them to rigorous imprisonment of seven years and fine in Ansarullah Bangla Team (ABT) case of 2018 (RC11/2018/NIA/DLI), according to nia.gov.in. Hussain, 26 years is a resident of Jessore District and Farooque is a resident of Dhaka District, Bangladesh. Investigation by NIA revealed that Bangladeshi members of ABT entered India in 2016 in pursuance of the conspiracy to commit terrorist acts in India. The accused persons travelled and stayed at Hyderabad, Pune and Mumbai in the guise of laborers. Investigation also revealed that the accused persons tried to procure chemicals from a shop in Patna and tried to establish hide-outs in Ranchi. The accused persons also tried to procure arms and ammunition in Kolkata. Addressing a five-judge bench of the Supreme Court, Attorney-at-Law Iraj de Silva, appearing for the United National party (UNP) Deputy Leader Ruwan Wijewardene, said “Articles from clause 3 to 57 of this Bill are completely unconstitutional. In this situation the sovereignty of the people is being violated. This Bill is completely contrary to the basic framework of the Constitution. The provisions of the Bill will consolidate the full powers of the President. The provisions of the Bill also upset the balance of the three main branches of law, accountability and governance. It also contradicts the principle of devolution. It is also a violation of the principle of public trust. Also, the power to govern will be transferred to a dual citizen through this amendment bill.” By the end of today, consideration of 32 out of 39 petitions has been completed.

On April 2, the Sindh High Court overturned the death sentence for British-born militant Ahmed Omar Saeed Sheikh, who had been convicted in the case in 2002. His sentence was commuted to seven years and a fine of PKR 2,000,000 was imposed on him. Other three accused, Adil Sheikh, Salman Saqib and Fahad Nasim, were acquitted. They had previously been sentenced to life imprisonment. However, Pearl’s parents and the Sindh Government on May 2 had filed appeals in the Supreme Court against the Sindh High Court’s order. The Sindh Government decided on July 15 to extend detention of the four men.

Speaker Mahinda Yapa Abeywardena announcing the determination of the Supreme Court on the Bill entitled Twentieth Amendment to the Constitution said the Apex Court has determined that the Bill was consistent with the Provisions of Article 82(1) of the Constitution and requires a special majority to be passed as specified in Article 82(5) of the Constitution. The Supreme Court had however ruled that Clauses 3,5,14 and 22 in the amendment in their present form are inconsistent with Article 3 read with Article 4 of the Constitution and require a public referendum.

The ATC awarded a one-year imprisonment with PKR 20,000 fine to Hafiz Abdul Rehman Makki in the same case. The ATC also handed down 16-and-a-half-year imprisonment to Malik Zafar Iqbal with PKR 170,000 fine in FIR No 90, registered and investigated by CTD, Multan in 2019. ATC-III Judge Ejaz Ahmad Buttar conducted the case proceedings and handed down imprisonment on proving charges. The CTD Multan had registered the cases against the convicts under section 11-N of Anti-Terrorism Act 1997. It was alleged that the convicts committed terror financing by managing assets of a proscribed organisation, and helped in raising funds.

The US Government on November 30, has moved a motion in a federal court in California opposing the release of Pakistani-origin Canadian businessman Tahawwur Rana, who has been declared a fugitive by India for his involvement in the 2008 (26/11) Mumbai terror attack case, describing him a flight risk, reports Daily Excelsior.Rana, 59, was re-arrested on June 10, 2020 in Los Angeles on an extradition request by India for his involvement in Mumbai terror strike.His extradition hearing is scheduled for February 12, 2021. In a motion filed before the US District Court Judge in Los Angeles Jacqueline Chelonian, US Attorney Nicola T Hanna urged the court to deny Rana’s motion for release for failure to prove that he is not a flight risk or that special circumstances exist and continue to detain him pending resolution of this extradition proceeding. Hanna’s motion comes in opposition to the latest effort of Rana to avoid detention pending extradition, by capitalising on the developments of the COVID-19 pandemic. Rana’s attorney has argued that pandemic warrants his release from custody. In denying Rana’s initial motion for release in July,2020, the court had said he constituted a flight risk given his significant foreign contacts and the possibility he could face a death sentence in India.

On August 17, 2005, as part of the countrywide series bomb blasts by JMB, bombs went off in 13 places of Sylhet District including the bus terminal, Sylhet court and other important places. A special Prevention of Money Laundering Act (PMLA) court in Mumbai has issued notices to three family members of Dawood Ibrahim’s associate late Iqbal Mirchi under the fugitive economic offenders law, the Enforcement Directorate said on December 17, reports outlookindia.com. The notice has been issued against Junaid Iqbal Memon, Asif Iqbal Memon (sons of Mirchi) and Hajra Memon (wife) under section 10(4) of the Fugitive Economic Offenders (FEO) Act of 2018, the central agency said in a statement. The Enforcement Directorate (ED) had moved the court early this month (December 3) to get the three family members of Mirchi declared as violators of this law. The Mumbai court, said, "also directed to issue the notices to the interested parties and fixed the date of appearance of the accused persons till February 16 next year and adjourned the matter". An open ended non-bailable warrant has also been issued by a special PMLA court in Mumbai against the three family members of Mirchi after a charge sheet was filed against them by the ED.

Tariq Qazmi, convicted for his involvement in the 2007 serial terror blasts in Gorakhpur (May 22, 2007), was on December 21, sentenced to life imprisonment by a local court in Gorakhpur, reports news18.com. Special Judge Narendra Kumar Singh also imposed a fine of INR 2,15,000 on convict Tariq Qazmi, a resident of Shambhupur village under the Rani Ki Sarai Police Station of Azamgarh District (Uttar Pradesh), said prosecution counsel Yashpal Singh. Singh said that Qazmi was sentenced following his conviction in various offences, including section 307 (attempt to murder) of the Indian Penal Code (IPC), sections 16, 18 and 23 of the anti-terror law Unlawful Activities (Prevention) Act (UAPA) and sections 3, 4 and 5 of the Explosive Substances Act. Singh said Qazmi was sentenced to life term under sections 3 and 4 of the Explosive Substances Act, 1908, pertaining to the offence of causing or trying to cause an explosion, endangering life and property. Following his conviction under section 5 of the Explosive Substances Act for being in unauthorised possession of an explosive substance, he was sentenced to ten years in jail, said Singh.

The SHC declared the notification regarding the detention of Umer Shaikh and four others illegal and ordered their immediate release. The court also directed officials to place the accused on the Exit Control List. The court said the accused have been in jail for the last 18 years without committing any crime. It added that their imprisonment was illegal and ordered them to appear before the court when they are summoned. Following, the SHC verdict, the Sindh Government filed an appeal in the Supreme Court over the ruling in which three of the four accused were acquitted and a death sentence of the prime accused was commuted.

An Anti-terrorism Court on December 28, sentenced Ghulam Rasool Rabbani, the prayer leader of a mosque located on Superhighway in Karachi (Sindh) to over 25 years in prison for raising funds for the outlawed Jamaat-ud-Dawa (JuD), reports Dawn. The court also ordered the provincial education department to take over and forfeit the mosque/seminary in Malir used by JuD for generating money to fund terrorist activities across the country. The court also imposed a fine of PKR 2.2 million on him. According to the prosecution, the Counter-Terrorism Department on November 11, initiated investigation against Rabbani, who belonged to the JuD and was involved in collecting funds for Madrasa/Masjid HarmainShareefain located in Jamali Goth along the Superhighway in Malir. The prosecution alleged that such money was used for terrorist activities all over the country, financial assistance was provided to terrorists and such act fell within the ambit of the Anti-Terrorism Act, 1997.

Three lawyers filed a writ petition at the Supreme Court on December 28 demanding that the reshuffle of KP Sharma Oli Cabinet be scrapped because Oli has been reduced to a caretaker prime minister after he dissolved the House of Representatives on December 20, reports Kathmandu Post. Advocates Lokendra Oli, Keshar Jung KC and Dinesh Lamichhane have jointly registered the writ petition as the Article 77(1) of the Constitution states that a person who is not a member of Parliament cannot be a Prime Minister and a Minister. “Our writ petition was just registered. Discussions on it will be held on Wednesday. We have demanded that the caretaker government cannot reshuffle the Cabinet and therefore the move should be scrapped,” said advocate Oli. In the writ, the petitioners have also demanded that the Supreme Court issue an interim order not to implement the decision of December 25 of Cabinet reshuffle. The Office of the President and the Office of the Prime Minister and Council of Ministers have been made defendants.
