The Special Court, constituted to try former President General (retired) Pervez Musharraf for treason, on January 1 ordered him to appear for the hearing of the case on January 3, 2013, reports Dawn. The bench initiated January 1 hearing without Musharraf’s presence and while ordering for his production in court also warned of issuing a ruling in case he failed to appear in the court for the next hearing. Musharraf’s counsel, Ahmed Raza Kasuri, said that the judiciary would be responsible if any untoward incident took place, adding that if a bombing occurred, everyone, including the judges of the Special Court, would be killed as a result. Responding to which, Justice Faisal Arab, who is heading the Special Court, cautioned Kasuri to not threaten the court, adding that the counsel's point had been noted.

The Supreme Court (SC) on January 2 has decreed against any bid to offer blanket amnesty to those alleged of serious human rights violation during the armed conflict (1996-2006), reports Nepal News. Delivering order in regard to a writ petition filed against the Ordinance on forming Truth and Reconciliation Commission (TRC), the apex court said that the offer of amnesty will be against the spirit of justice. The apex court further said that the Ordinance contradicts with the citizens' right to life, right to seek justice, right to information, right against torture and other principles of justice.

Lashkar-e-Toiba (LeT) operative Abdul Karim Tunda, on January 3 withdrew his bail petition filed before a Delhi court, reports Zee News. Tunda, who is in judicial custody in connection with various terror attack cases, withdrew his plea after Chief Metropolitan Magistrate (CMM) Amit Bansal transferred his case to a sessions court. As the case was sent to a sessions court, advocate M S Khan, who appeared for Tunda, withdrew his bail plea with a liberty to file it before the sessions judge. He was chargesheeted for offences under sections 324 (voluntarily causing hurt by dangerous weapon), 307 (attempt to murder) and 120-B (criminal conspiracy) of Indian Penal Code (IPC) and the Police had claimed he was part of the conspiracy which led to two bomb blasts, one in Sadar Bazar and other in Qutab Road here, on October 1, 1997 in which several people were injured.

Islamabad High Court on January 3 directed the Government to provide a bulletproof car to former Supreme Court (SC) Chief Justice (CJ) Iftikhar Chaudhry, saying even those who violated the Constitution were being given foolproof security, reports The Hindu. Justice Shoukat Siddiqui of the Islamabad High Court issued the directive while hearing a plea filed by former Rawalpindi High Court Bar Association president Sheikh Ahsanuddin for providing security to justice Chaudhry. During the hearing, Cabinet Division Joint Secretary Zia-ul-Haq told the judge that a bulletproof vehicle was given to justice Chaudhry but it was not functioning properly. There is no other vehicle, which can be provided to him, he said. The judge expressed his displeasure at the non-provision of proper security to justice Chaudhry and ordered the city police chief to provide “proper security” to him and adjourned the matter till January 9. The bulletproof vehicle has to be provided to justice Chaudhry within three days, the judge said.

A special court of National Investigation Agency (NIA) in Patna on January 4 issued an arrest warrant against Muzibullah Ansari, an important part in the Patna blasts, from whose hostel room in Ranchi a sizeable haul of live explosives was recovered on November 4, 2013 but Ansari has escaped to Nepal, reports The Telegraph. The whereabouts of Muzibullah were last traced via his cellphone near the Bihar-Nepal border in the first week of November, 2013. After that, the intelligence teams lost the trail. His involvement in the blasts came to light with the interrogation of another suspect, Imtiyaz Ansari.

New Delhi: A Delhi court on January 6 issued fresh non-bailable warrants against Pakistani-American Lashkar-e-Toiba (LeT) operative David Coleman Headley Headley, his accomplice Tahawwur Rana, LeT ‘founder’ Hafiz Saeed and November 26, 2008 (26/11) Mumbai (Maharashtra) attack mastermind Zaki-ur-Rehman Lakhvi, who are accused of carrying out terror attacks, reports Zee News. According to the court sources, District Judge I S Mehta issued non-bailable warrants (NBWs) against nine persons after National Investigation Agency (NIA) informed the court that they were still absconding and warrants issued against them earlier have not been executed yet. The court issued NBWs against them for April 14, 2014 the next date of hearing. On January 6 the Special Court trying the Pervez Musharraf again exempted him from personal appearance for a day and summoned a medical certificate from the Armed Forces Institute of Cardiology (AFIC). Pervez Musharraf failed to appear before the special court for the fourth time in a row. Special Prosecutor Muhammad Akram Sheikh, stressing the court to issue non-bailable arrest warrants, said the accused was flouting the orders of the august court. “A person cannot hide in the Armed Forces Institute of Cardiology (AFIC) avoiding appearance before the court,” Sheikh contended. Earlier on January 5 a lawyer representing Musharraf said that he would not make a scheduled appearance at his treason trial because of an ongoing illness, reports Daily Times. Musharraf was rushed to a military hospital on January 2, 2014, after developing what a Police official called a “heart problem” while being taken to hear treason charges against him at a special tribunal in Islamabad. A week ago, it had asked the Khil Raj Regmi interim council as to why President Ram Baran Yadav cannot convene the meeting. This dispute is likely to further delay the convening of the first meeting of the new CA-cum-Parliament. Both President Yadav and the head of the interim council of minister, Mr. Regmi are adamant on calling the first meeting. While Mr. Yadav cites parliamentary traditions, Mr. Regmi has pointed to the Interim Constitution. Even the political parties are divided over who should call the meeting. The court issued this order while responding to a writ petition filed by advocate Biswas Acharya. Acharya has claimed that President Ram Baran Yadav has the constitutional authority to convene the first CA meeting. An earlier writ petition filed by advocate Mukunda Adhikari has claimed that IEC Chairmain Khil Raj Regmi has the authority to summon the first CA meeting. The apex court has already sought the help of ‘amicus curie’ (friends of court) to hold debate on the matter, concurrently initiating the process to seek clarification from IEC Chair and President as to why they think that they have the authority to convene the CA meeting.

His name surfaced after police interrogated Mohammad Shahid, another LeT suspect arrested by the special cell of the Delhi Police December 7 from Choti Mewli village in the same District. "It is submitted that further examination of accused Rashid is required for confronting him with the call details/conversations and the facts that have emerged after the examination of witnesses," the police told the court. During investigation, it was revealed the duo was in touch with Pakistan-based LeT ‘commander’ Javed Baluchi over mobile phones. The applicability of CrPC will allow the court to issue an arrest warrant against the accused (Musharraf) over his non-appearance before it. The bench, headed by Justice Faisal Arab, also rejected Musharraf’s plea to suspend its January 9, 2014 order regarding his personal appearance on January 16, 2014. The court said that it cannot revisit its orders and Musharraf will have to appear before it on the next hearing of the case. One member of the defence team said that Musharraf would not appear before the court on January 16, 2014 and another medical report might be furnished regarding his inability to appear before the court. Musharraf’s counsel Anwar Mansoor moved a written application against the court’s January 9, 2014 order regarding the appearance of his client in the next hearing. The counsel said they believed that the notification issued by the Federal Government for the constitution of the Special Court was illegal, and the Prime Minister did not follow the lawful and constitutional procedure in the process of formulation of the court, which was required under Article 90 of the Constitution. On the other hand, special prosecutor Akram Sheikh pointed out that as per Article 90 (2) of the Constitution, the Prime Minister could act directly.

The Government’s non-compliance of its December 10, 2013 order to produce 35 missing persons, led the Supreme Court to order the Secretary to the Prime Minister Javed Aslam on January 10 to bring the matter into the notice of Prime Minister Nawaz Sharif, reports Dawn. A two-judge bench headed by Justice Jawwad S. Khawaja issued the order during the hearing of a case about a missing man named Yasin Shah which was initiated on an application of his elder brother Muhabbat Shah. The Court also directed Khyber Pakhtunkhwa Chief Secretary Mohammad Shahzad Arbab to inform Chief Minister Pervez Khattak about non-compliance of the order. In its December 10 order, the apex court said the army authorities had taken away 35 internees from the Malakand internment centre, but only seven of them were produced before the court. It ordered action against the authorities concerned in the case involving non-compliance of the verdict. The court directed the Prime Minister and the Chief Minister to submit by January 17, 2014 their replies explaining reasons why the December 10, 2013 judgment had not been complied with. Notice has also been issued to Law Secretary Barrister Zafarullah Khan. “We have repeatedly, at least since July last year, been emphasising to the Government that in view of these constitutional provisions, no person could be detained or incarcerated without the backing of a valid law,” the order said, adding that it had also been emphasised by the court from time to time that deviation from the Constitution and the law by the Government would constitute violation of Article 5 of the Constitution, quite apart from undermining the authority of the Government. Article 5 asks for showing loyalty to the state and obedience to the constitution.

A sessions court at Khamgaon in Buldhana District (Maharashtra) on January 17 upheld conviction by a lower court of a Students Islamic Movement of India (SIMI) leader, Sayyad Wasimoddin, and sentenced him to one-month imprisonment for possessing literature and other items pertaining to SIMI, reports The Times of India. The court imposed a fine of INR 200 on Wasimoddin and also upheld acquittal of eight other accused in the 2001 case. A case was registered against nine suspected SIMI members on September 27, 2001, after Khamgaon Police raided a residence of Wasimoddin and seized various items like literature related to SIMI banners, pamphlets and some magazines with radical content. In its judgement delivered on January 31, 2008, the lower court had held Wasimoddin guilty but acquitted others for want of evidence.

Another 1,086 have been identified at notified internment centres in Khyber Pakhtunkhwa (KP) and the Federally Administered Tribal Areas (FATA). Some 3,033 people have been traced to various locations in the region. Justice Khan said that the Human Rights Directorate set up by him for those who cannot afford to hire a lawyer, has received more than 9,000 cases so far. Of these 7,000 were decided instantly, with the aggrieved getting justice in less than 72 hours.

While 22 cases have been registered in the national capital, there are 11 cases against Tunda in Punjab, Haryana, Uttar Pradesh and Rajasthan including one being probed by CBI. The National Investigation Agency (NIA) Special Court on January 22 dismissed the anticipatory bail petition of an accused in the Kasargod Fake Indian Currency Note (FICN) case, reports New Indian Express. K M Balachandran, NIA Special Court judge, ordered that accused Mammunhi alias Muhamad Kunji cannot be granted anticipatory bail as there were serious offenses charged against him. “A very serious investigation has to be conducted with respect of the offences alleged. The investigation definitely would be hampered in case he is let free,” the court observed. Mammunhi is currently working in the UAE and is alleged to have involved in hawala (illegal money transfer) transactions. He is an accused in four cases registered for obtaining FICNs from various parts of Kasargod. In his petition, Mammunhi stated that an Investigation Officer had visited his house and intimidated his wife and family members. The NIA objected to the petition and submitted that he is operating from Dubai as a hawala agent and he was part of the conspiracy in distribution of FICNs. The case against him is charged under 489B, 489C, 420, 201, 120 B, 109 r/w 34 of the Indian Penal Code (IPC).

Khawaja on January 23 suggested setting up of a fund for assisting the needy whose near and dear ones have gone missing and they appear in courts regularly to pursue their cases, reports Dawn. The bench floated the idea of creating the fund in a way of an endowment which should be kept with the office of the Attorney General of Pakistan. When needed, the court said, the fund should be used for subsistence of those who could not afford boarding and lodging in Islamabad. The suggestion came during the proceedings of a missing person’s case instituted on the application of one Saadia Bibi whose husband Khawar Mehmood went missing from Fort Abbas in Bahawalnagar District of Punjab on June 26, 2013. Ms Saadia, 21, pleaded that her husband was picked up by security personnel six or seven months after their marriage. Since then she is running from pillar to post to find the whereabouts of her spouse.

Islamabad Anti-Terrorism Court (ATC), hearing the case of seven men, including Lashkar-e-Toiba (LeT) ‘commander’ Zakiur Rehman Lakhvi, charged with involvement in the Mumbai attacks has adjourned the hearing till January 29, Times of India reported on January 24. According to court sources, a banker of Muslim Commercial Bank Gujranwala District, some 80 km from Lahore, testified in the Islamabad anti-terrorism court on January 22 declaring that one of the accused had made transactions. The defence lawyers questioned how could it be established that a certain amount of money transacted by the alleged accused was used for terror activities. The court adjourned the hearing till January 29 and issued summons for more private witnesses. Seven accused are facing trial in connection with the Mumbai attacks case. LeT ‘operations commander’ Zakiur Lakhvi, Abdul Wajid, Mazhar Iqbal, Sadiq, Shahid Jameel Riaz, Jamil Ahmed and Younas Anjum were arrested in 2009 for their alleged role in the attacks in which 166 people were killed and over 300 injured. They have been charged with planning, financing and executing the attacks.

It said the Special Court had directed the constitution of a medical board comprising senior doctors of the AFIC to verify Musharraf’s state of health in light of his continuous non-appearance before this Special court. “The instant medical report, with respect to any outcomes, is virtually a duplication of the previous medical report dated January 7, 2014. The findings of the medical report are inconclusive and deliberately vague,” it said. It further said that the court did not gain anything from this second medical report. “Rather the time of the court had recklessly been wasted at the cost of the reputation of a premier institution of cardiac disease,” it added. “Even if the accused needs medical supervision that does not render him unable to make attendance before this Special Court and it is now manifest that the accused is prolonging stay in hospital in order to evade the judicial process,” it added.

It is also the first FICN case to be registered under Unlawful Activities Prevention Act (UAPA) making such printing and distribution a terror activity. NIA had produced evidence to show that FICNs’ features, paper quality and printing quality matches exactly to Pakistan currency and thus could only have been printed by Pakistan Government press. Police officials in the Federal Capital Islamabad confirmed on February 1 to have received a bailable arrest warrant for former President General (retired) Pervez Musharraf and said the warrant might be served on February 3 (today), reports The Express Tribune. A Special Court constituted to try Musharraf for high treason had issued a warrant on January 31, 2014. The court had also ordered the Islamabad Police to submit a compliance report on February 7, 2014. Since the start of the trial, Musharraf has not appeared before the court. The proceedings against him started in December 2013.

Former President General (retired) Pervez Musharraf was served with an arrest warrant at the Armed Forces Institute of Cardiology (AFIC) in Rawalpindi District of Punjab on February 3, two days after they were issued by a Special Court, formed for his trial, reported The Express Tribune. A Special Court constituted to try Musharraf for high treason had issued a warrant, carrying a bail bond of PKR 2.5 million. The court had also ordered the Islamabad Police to submit a compliance report to the court on February 7, 2014. Inspector General of Islamabad Police Sikandar Hayat said, “He [Musharraf] will be given two options: either to be arrested or to submit a surety bond for his bail”. Meanwhile, The Express Tribune reported that the expenditure on his security has crossed the PKR100 million threshold in just nine months. Over 400 Police and Rangers personnel are guarding him. Police sources say that the extraordinary security given to a single person has taken a heavy toll on the overall performance of the Islamabad Police, which is facing an acute shortage of security staff. According to the sources, every month around PKR10 million is being spent to secure him. The sources said that every Police Station in the Federal Capital area of Islamabad has 50 to 60 staff, but Musharraf has been given a security detail that could populate eight Police Stations.

A city court in Chennai (Tamil Nadu) acquitted 13 people accused of involvement with the banned terror group Liberation Tigers of Tamil Eelam (LTTE), The Times of India reported on February 8. The case relates to the arrest of some Sri Lankan Tamils in Chennai and seizure of communication devices, including satellite phones, from them in April 2009, during the last phase of the Civil War in Sri Lanka that led to the decimation of the LTTE. Delivering the verdict, the judge said he had doubts about the confession statements allegedly made by the accused. Further, the investigating officers gave contradictory statements on the movement of the special team, seizure of devices and the time of examination of witnesses. The judge also pointed out that forensic experts, who examined the seized items, had said the telescope could also be used sighting animals. The prosecution also failed to reveal the messages exchanged through satellite phones, the judge said.

Ahmed is facing charges of hoarding arms and explosives in huge quantity, along with 21 other accused, including Lashkar-e-Toiba (LeT) operative Abu Jundal. Ahmed was granted bail on a bond of INR 50,000 or property worth the same amount with one surety. He has been asked to attend all court proceedings of his case and not to tamper with evidence or meet any of the prosecution witnesses. Ahmed is the third person to get bail in this case. Javed Abdul Majeed Ansari was the first person to secure bail from the High Court in this case in October, 2013. Riyaz Ahmed was granted bail by MCOCA court in December, 2013.

The Special Court trying former President General (retired) Pervez Musharraf for treason has given him until February 18, 2014 to appear before the court or a non-bailable arrest warrant could be issued against him, reports The Express Tribune. On January 31, 2014 the three-judge court headed by Justice Faisal Arab had issued a bailable warrant for Musharraf’s arrest due to his persistent reluctance to face the treason charges and ordered him to appear on February 7, 2014. However, Musharraf as well as his guarantor, Major General (retired) Rashid Quraishi, did not show up. “It was also pointed out that even the surety, who undertook to ensure the presence of the accused in [the] court, has not appeared which by itself calls for forfeiture of the surety amount and issuance of non-bailable warrant of arrest of the accused,” the court said in its written order. However, Justice Faisal granted Musharraf 10 more days on the personal assurance of Anwar Mansoor, one of the members of the defence team, who assured the bench that his client would appear on February 18. “At this juncture Anwar Mansoor made a statement at the bar that he personally undertakes that the accused will appear before this court along with surety in the week after next as the accused has no hesitation for his appearance except that he feels that this court has no jurisdiction in the matter,” the order said.

Chhattisgarh Government has decided to setup a ‘district’ and an ‘additional district’ court in Narayanpur and Dantewada Districts respectively, reports The Times of India on February 10. The move to set up the District Court at Narayanpur is primarily to speed up trials in cases related to Maoist violence. However, it would in general provide relief to other litigants too, as presently they have to travel to Kondagaon District, which is 56 km away, for court hearings. Confirming the move, Chhattisgarh Principal Secretary, Law and Legislative Affairs, Samanta Ray, said a provision has been made in the budget (2014-15) for setting up these Courts. He admitted that the move was primarily aimed at speeding Maoist-related trials, particularly in Narayanpur area.

Indicting Lashkar-e-Toiba (LeT) operative Abdul Karim Tunda for the terror strikes in Indian cities between 1994 and 1998, the Delhi Police blamed Pakistan's Inter-Services Intelligence (ISI) for masterminding the attacks, The Times of India reported on February 17. The chargesheet, filed on February 11, 2014 says, "Abdul Karim Tunda along with Pakistan's spy agency ISI and LeT prepared a team of Pakistani, Bangladeshi and Indian Jehadi Muslims and prepared a blueprint of carrying out attacks in India”. It further says that "on the anniversary of demolition of Babri Masjid in 1993, Tunda, on the directions of ISI and LeT chief Hafiz Sayeed, made a plan to carry out serial blasts on trains in Mumbai". Tunda has been named in the chargesheet under provisions of Terrorist and Disruptive Activities (Prevention) Act (TADA) and the Explosive Substances Act. Tunda was arrested by the Special Cell on August 16, 2013 from the Indo-Nepal border. It also gives a detailed list of LeT's hierarchy apart from details of ISI officers and Dawood Ibrahim with whom Tunda had close relations. The chargesheet also gives details of other terror outfits like Jaish-e-Mohammed (JeM), Indian Mujahideen (IM) and Babbar Khalsa International (BKI). It says that in 2010, Colonel Imtiaz of ISI and Iqbal Kana had assigned Tunda the task of sending RDX to India via Bangladesh, to be used by BKI terrorists to target the Commonwealth Games in Delhi. The chargesheet gives details some senior ISI functionaries, whose phone numbers were found in Tunda's phone, as evidence of Pakistan's active involvement in terror activities in India. Tunda was in regular touch with several ISI officials and LeT operatives including Zaki-Ur-Rehman Lakhvi (LeT operational chief), Azam Cheema (operational head of infiltration), Haaji Ashraf (LeT finance head), Saifullah Mansoor (head of LeT's Punjab division in Pakistan), Hafiz Abdul Salam Bhutavi (director of LeT terror training), Abu Dujana (chief of security guards of LeT), Abdul Rehman Aabid (Mufti) and Amir Hamza Rana Iftekar (key Lakhvi aide). In addition, Tunda was also in regular touch with Brigadier Hameed Gul, Colonel Usman and Colonel Abdulla of ISI and BKI's Wadhwa Singh, Ratandeep Singh and Lakhbir Singh. The chargesheet says Tunda was in regular touch with Dawood Ibrahim. It says he was taken to Dawood's house at Clifton in Karachi (provincial capital of Sindh) by BKI's Lakhbir Singh in 2002. "Dawood offered Tunda all kinds of help for future terror operations. After 6-7 months, Tunda met Dawood again," says the chargesheet. Tunda had also met IM founder Amir Reza Khan in Pakistan in 2005 through an ISI agent. The chargesheet also states that Tunda collaborated with Iqbal Kana, the counterfeit mastermind, to smuggle Fake Indian Currency Note (FICN) into India.

The National Investigation Agency (NIA) has filed a chargesheet at the NIA Special Court against two accused, Abdul Kalam alias Azad and Abdul Majeed in the Nedumbassery (Ernakulam District, Kerala) Fake Indian Currency Note (FICN) case of March, 2010, New Indian Express reported on February 18. The NIA charged 489 (B), 489 (C) r/w 34 of the Indian Penal Code (IPC) against the accused. Sanal Kumar, Abdulla Haji and Mohammad Rafi are the other accused. These persons were not chargesheeted as they are yet to be arrested. Abdul Kalam was arrested from Kondotty while Abdul Majeed was deported from Dubai last year. According to the NIA, Muhammed Rafi has been raising funds from Gulf countries and smuggling FICN into India to destabilise the Indian economy since 2007. Abdul Kalam had received FICNs from Abdulla Haji and handed them over to Muhammad Rafi.

The supplementary chargesheet was filed before the court of District Judge I S Mehta who posted the matter for February 24 for taking cognisance on the final report. The other two arrested accused Manzar Imam and Ujjair Ahmed, both hailing from Ranchi (Jharkhand) have been charged for their role in the conspiracy to commit terrorist acts, for harbouring IM terrorists, membership of the terrorist organization and for giving support and raising funds for it, adds The Times of India. According to court sources, Bhatkal and Akhtar have been listed in the chargesheet under various sections of the India Penal Code (IPC), including 120-B (criminal conspiracy), 121 (waging war against the country), 121-A (conspiracy to wage war) and under various sections of the Unlawful Activities (Prevention) Act (UAPA).The sources also said NIA has defined the roles of Bhatkal and Akhtar in the entire conspiracy of the IM to carry out the terror activities. According to a Punjab Police investigation report, Mehmood was allegedly picked up by the personnel of Intelligence Agencies on June 26, 2013 from a distribution company in Fortabbas area of Bahawalnagar District. The Inter-Services Intelligence (ISI) and the Military Intelligence (MI) had rejected the allegation and said he had never been in their custody. The court also rejected the plea regarding jurisdiction of the Special Court, saying that it had complete authority to try Musharraf for high treason. The three-member bench, headed by Justice Faisal Arab, resumed hearing of the case and remarked that only the Special Court was entitled to hear the treason case, on the grounds that Musharraf retired in 2007 and he is not part of the army now so the case could not be proceeded under the Army Act. The court also observed that the Army Act of 1977 was declared null and void in 1981 by the courts; therefore, under the law only the Special Court is subjected to hear the case of high treason against Musharraf, under Article 6.

In addition, Delhi's Akshardham temple and Pune's cantonment area were on top of IM’s list of places to be targeted, the NIA has said in its charge-sheet against IM's India operations ‘chief’ Yasin Bhatkal and his three aides, reports The Times of India on February 25. According to data retrieved from the laptops recovered from Bhatkal and his aide Asadullah Akhtar, IM members were carrying out reconnaissance of these places, the charge-sheet said. "The files named as... are the photographs of Khirkee area in Pune (Army cantonment) which was sent by Riyaz Bhatkal to accused Asadullah Akhtar through internet in order to carry out a reconnaissance during the month of January/February 2012 while Waqas and he were staying in the hideout located at Loni, near Loni Medical college in Ahmednagar district in Maharashtra," the NIA said. It further said, "Files named as... are the photographs of Akshardham temple in Delhi. Investigation revealed that accused Md Ahmed Siddibapa (Yasin Bhatkal) went there for the purpose of recce. This established the design of the accused persons for conducting future attacks." Further, NIA has found forensic evidence that IM operatives received instructions on terror attacks from the mentors from across the border. With help from the Netherlands' instant messaging service provider Nimbuzz, the NIA has traced the chat ID of IM founder Riyaz Bhatkal, through which he passed on instructions to Yasin Bhatkal, to Pakistan Telecommunication Company Ltd (PTCL). The chargesheet notes: "The login details from Nimbuzz, in respect of menothing1 and davidthapa77, were received from the providers. From the received details, the creation of IP of the account menothing1 was found to be 221.120.246.6, which belongs to Pakistan Telecommunication Company Limited." The chargesheet directly accuses the Pakistan government of providing shelter to the absconding accused. It says, "The organisation is receiving financial and material assistance from the ISI backed by the Government of Pakistan which has sheltered several absconding operatives." The chat exchanges between IM operatives in India and Pakistan also reveal a sinister plan of IM to expand its footprints across the middle-east and Afghanistan and the outfit's growing ties with Taliban and al-Qaeda. In addition, Yasin Bhatkal was inspired by al Qaeda ‘chief’ Osama Bin Laden and used to motivate youngsters for sacrificing their lives in the name of 'jihad' through the videos of the slain terrorist, NIA has also said in its charge sheet. "He (Bhatkal) used to quote selected phrases from Islamic religious books in support of 'jihad'. He had downloaded from internet a number of documents which portrayed Jihad as an obligatory act of every Muslim. He had also downloaded lectures of Muslim leaders and fighters like Osama Bin laden, Al Yazeed, Al Zarkawi, C Khateeb, Awlaqi from internet. He made young Muslim boys watch these videos and read out these documents to them, so as to motivate them to sacrifice their lives in the name of jihad," NIA said, NIA also stated on February 24, that, Yasin Bhatkal was earlier arrested for theft in Kolkata (West Bengal) in 2009 but Kolkata Police did not know he was the terror mastermind. "Accused Md Ahmed Siddibapa (Bhatkal) visited Kolkata in 2009 along with one Qateel Siddiqui and stayed at the residence of one Humayun for the furtherance of the activities of the IM. He tried to build his network with the help of some Bangladeshi terror links and was arrested on suspicion in a case of theft by Kolkata Police," the NIA has said. NIA has said that “one IM operative Bada Sajid is fighting in Afghanistan-Pakistan border region” and “was also wounded in one of the skirmishes”. According to the chargesheet, the IM is now an al-Qaeda affiliate whose members are trained by the global terror network, and who have been instructed to focus on Myanmar and to “kidnap Jews in India”.The chargesheet says that at a meeting in Dubai five years ago, the IM leadership decided to cut ties with Pakistan’s Inter-Services Intelligence (ISI), and join the al-Qaeda. “Investigations revealed that during the stay of the accused (Akhtar) in Dubai (in 2008-09), Iqbal Bhatkal was elected as the leader of Indian Mujahideen and it was decided to sever the association with ISI as soon as possible, and shift towards the Al Qaida, since everyone unanimously felt that the ISI was against the true Jihadi ideology,” says the chargesheet. The Times of India, added that IM terrorists had on their target some tourist spots, a royal train and some other places in the state, especially in western Rajasthan including Jodhpur, Barmer and Jaisalmer, sources said. The chargesheet reveals that the IM shifted the base from Bihar and other nearby states to Rajasthan after an intense crackdown on its Bihar unit by the cops probing the low intensity blasts that occurred during Narendra Modi's rally in Patna in October, 2013 and Bodh Gaya in July, 2013. The group allegedly plans to target foreign tourists and has conducted a recce in several places in Rajasthan apart from other places including Delhi, Mumbai and Maharashtra. In his confession to NIA, IM operative Asadullah Akhtar alias Haddi said that the American Center attack and the kidnapping of Khadim's boss in Kolkata (both in 2002) were part of a bigger plan. Haddi admitted before a magistrate in Miyapur, Andhra Pradesh, that in 1999-2000, Aftab Ansari started the IM (called Asif's Commando Force then) with Asif Rezza Khan, a resident of Kolkata, who died in an encounter in 2002. Haddi also said that his people attacked the American Center in Kolkata. Haddi added that he got arms training and learnt how to make explosives at a training camp conducted by Pakistan's Inter Services Intelligence (ISI). "Haddi and Bhatkal had revealed that the 'Bihar module' was the first thing to come up under the leadership of Yasin Bhatkal and Mohammad Tariq Anjum Hasan. Kolkata acted as a base for this module. However, since this module was more ideologically inclined, other modules in Pune, Beed in Maharashtra and Azamgarh in UP, were in charge of executing terror attacks across the country till 2008. It was only when these modules were either eliminated or busted, that the IM fell back on its recruits from Samitipur-Darbhanga and Nalanda,'' according to sources. According to the Mumbai Anti Terrorism Squad (ATS), Bhatkal played a very important role in procuring explosives and making Improvised Explosive Device (IED) used in 2011 Mumbai terror attack. IM was keen on 26/11 suicide attack, targeting Police and politicians, instead of planting bombs and running away, The Times of India reports on February 28. IM operative Mirza Shadab Baig and Asadullah Akhtar had discussed that bomb explosions killing common people had little impact as the government moved on after paying compensation to victims. According to the chargesheet filed by NIA, Riyaz Bhatkal and Yasin Bhatkal were particularly impressed with what Maoists had achieved in Darbha, Chhattisgarh where a Congress cavalcade was ambushed killing 27 people, including the party's top leaders. They had discussed that IM, too, should do something similar that would shake the government. With such a plan in mind, Yasin's associate Asadullah Akhtar was trying to procure explosives and guns. He believed that it was time for the outfit to move towards suicide attack. Further, the chargesheet stated that every article needed to make a bomb is easily available in Delhi. "Irshad Khan (Yasin's father-in-law) pointed out the chemical shops, scientific store, buffing shop, tool shop, metal shop, welding workshop and dye shop from where he and Yasin Bhatkal procured chemicals/tools/metal/instruments/dyes etc," it states. All the shops are located in central Delhi's wholesale hubs, such as Esplanade Road, Pai Walan, Jama Masjid, Tilak Bazar, Hauz Qazi, Ajmeri Gate, Sitaram Bazar, Anand Parbat and Lajpat Rai Market. According to NIA, IM's Darbhanga module came into existence after some key IM members, including Yasin and Fasih Mahmood, developed close links in 2001 at the perfume and naturopathy medicines shop in Bhatkal in Udupi District of Karnataka. The charge-sheet said that "investigation has established that in pursuance of the conspiracy, the operatives of IM have been making attempts to foment communal tension in different parts of India". Investigation by NIA found that during the June 2012 conflict in Assam, IM contributed to the flare-up by spreading text messages and online posts falsely claiming atrocities against Muslims. The outfit also spread text messages of hatred against the northeast community in Bangalore (Karnataka) which resulted in several students from the region being attacked. This operation was led by a new head of the outfit suspected to be in Pakistan. The charge-sheet details a chat between Bhatkal and his associate Afeef Mota (in Pakistan) on July 12, 2013 which talks about a certain member of the outfit having participated in spreading fake news about atrocities against Muslims at the hands of northeastern people. The charge-sheet said, "Yasin asked whether their new head had participated in any jihadi operation in India. It was revealed that he had sent SMSs to create panic in northeast region, people staying in Bangalore and other southern states and planned to create violence between groups in India by fake SMSs to avenge the assassination of some Rohingya Muslims."

Additional Sessions Judge, Daya Prakash rejected the bail plea of Shahid, saying the provision of statutory bail lies only after expiry of 180 days, after the arrest, during which the prosecution has to file the charge sheet. "Under section 167 (2) CrPC, the period of 90 days has been extended to 180 days. The statutory bail lies only on 180 days or after," the court said, adding that the bail plea is dismissed.

The Supreme Court directed the Balochistan Government on March 7 to submit a reply with explanation about prosecution and trial of arrested Frontier Corps (FC) officials in a civil or a military court, reports Dawn. The two-member bench comprising Justice Amir Hani Muslim and Justice Athar Saeed resumed hearing of the case about law and order situation in the province and mass graves found in Khuzdar Disrict. During the course of proceedings, the court was informed that Shahid Hamid, the counsel for the Balochistan Government, could not appear because of illness. Additional Attorney General Shah Khawar informed the court that cases had been registered against FC officials and the army had formally contacted the Balochistan Government for their trial under the Army Act, but the provincial Government had not yet responded to the request. The Supreme Court ordered officials concerned of the court to include the list in the court’s record and directed Mr Nasarullah Baloch to contact the Balochistan High Court's Commission for the exact number of bodies found in mass graves in Khuzdar. The court also directed the home secretary of Balochistan to provide security to Mr Nasarullah Baloch.

IM’s cadre Mohammad Tehseen Akhtar alias Monu had visited Jaipur and Jodhpur in June 2013 and had procured SIM cards on fake documents. The NIA chargesheet hinted that IM was planning to expand its base in Rajasthan. “There are vital clues that efforts were made to set up a module in Jodhpur and its surroundings areas. Akhtar alias Monu was assigned this job along with Waqas a native of Pakistan,” an unnamed Anti-Terrorism squad (ATS) official said. “Akhtar visited Jodhpur and Jaipur but there is no confirmation about formation of such module. It may be because efforts could not materialise after Bhatkal’s arrest”, said a senior official of Rajasthan ATS seeking anonymity. According to ATS sources, Akhtar and Waqas were close confidants of Bhatkal and were trained in Pakistan to carry out terror activities. After Bhatkal’s arrest the NIA alerted the ATS following which posters of Akhtar, Waqas, and Haidar Ali alias Abdullah were pasted at all public places across the State.

The bench remarked that Justice Arab had witnessed some documents which stated that not only the accused but the courtroom and the lawyers were also under threat of an attack. He said that some documents were presented to him in which the Interior Ministry was the complainant. This was disclosed by NIA officials in the chargesheet filed by them in the Dilsukhnagar blasts case, in which 18 persons died and 130 persons injured, in the Nampally court on March 14. Dawood had assured Tunda that he would help him in future terrorist activities in India. After 6-7 months, Tunda had again met Dawood Ibrahim who had provided money to Tunda to preach ‘jihad’ in madrasas in Pakistan,” it said. The Supreme Court on March 18 gave the deadline until today (March 19) to the Federal and Khyber Pakhtunkhwa (KP) Governments for the recovery of missing persons, failing which notices will be issued to the Prime Minister, KP Governor and Chief Minister for the recovery of 35 missing persons, reports The News. A three-member bench of the apex court, headed by Justice Jawwad S Khawaja, heard the case of 35 missing persons of the Malakand Interment Centre. During the hearing, the court observed that 34 hearings had been conducted in the case but the authorities concerned had made no progress. Attorney General Salman Butt sought an adjournment in the case, saying that they would show some progress in the matter. Meanwhile, the court adjourned the hearing till today (March 19). The Attorney General informed the court the Government had constituted a one-man commission, headed by Justice (retired) Mian Muhammad Ajmal, to trace out the missing persons. He appraised the court that the inquiry would be completed within a month, while funds would be provided to the families of missing persons.

When a three-judge bench headed by Justice Jawwad S Khawaja resumed the hearing, Attorney General of Pakistan (AGP) Salman Aslam Butt came to the rostrum and said that he wanted to make one submission. “It was the KP Government’s responsibility to lodge an FIR – but since it hasn’t done that, the Federal Government has decided to register the FIR today (March 19) in view of the Supreme Court’s judgment,” AGP Butt submitted. “This is a significant development. Now, there will be no immunity for anyone,” Justice Khawaja said in his remarks. The registrar office held that since the Special Court, seized with his high treason trial, has rejected the identical petition for transferring the high treason case to the military court therefore being the appellate forum such petition could only be filed in the Supreme Court. The three member bench of the Special Court headed by Justice Faisal Arab of Sindh High Court (SHC) had rejected the plea for transferring the high treason case to the military court on February 21, 2014. In its ruling, the Special Court said: “the offences under the High Treason (Punishment) Act, 1973 are exclusively triable by the Special Court established under the Criminal Law Amendment (Special Court) Act, 1976 as its Section 3 (2) ousts the jurisdiction of all other courts.”

A Lahore High Court (LHC) division bench headed by Justice Shahid Hameed Dar on March 20 granted bail to Malik Ishaq, the leader of Lashkar-e-Jhangvi (LeJ) and Ahl-e-Sunnat-Wal Jama’at (ASWJ), in two cases where he is accused of delivering provocative speeches, reports The Express Tribune. The division bench granted the bail subject to furnishing two bail bonds of PKR 200,000 each. Ishaq’s counsel said such First Information Reports (FIRs) were registered on applications of aggrieved parties, but in this case the Police registered FIRs on its own to victimise him over his religious views. He said Ishaq was detained in April 2013 under the Maintenance of Public Order and arrested in June under these FIRs. He asked the court to grant him bail. Investigation Police Officer said that they had lodged two cases against Ishaq, who was accused on August 8, 2012 and February 2, 2013 for making provocative speeches at public gatherings. He added the petitioner had tried to spread hatred and to create unrest in the area.

The convicts, Ghulam Ahmed Khan and Farooque Ahmed Batloo, however, have already spent more than five yearsin imprisonment and are expected to be set free. The two, both from Jammu and Kashmir, were suspected to be associates of a Lashkar-e-Toiba (LeT) militant. They had pleaded guilty to the charges and sought leniency from the court. Additional Sessions Judge Daya Prakash held the two guilty under Sections 17 (raising funds for terror strikes) and 18 (conspiracy) of Unlawful Activities (Prevention) Act (UAPA). A third accused, Tariq Ahmed Dar, a suspected LeT militant, refused to plead guilty and preferred to face trial in the case. According to Delhi Police, Khan and Batloo had supplied around INR 30,00,000 to Dar through hawala (illegal money transaction) channels, knowing well that the money would be used for the blasts. According to the prosecution, Dar with suspected LeT operatives Abu Ozefa, Abu Al Kama, Rashid, Sazid Ali and Zahid, had allegedly had planned the serial blasts. Ozefa, Abu Al Kama, Rashid, Sajid Ali and Zahid are still at large and are suspected to be in Pakistan occupied Kashmir (PoK).

During the hearing of the case, Advocate General Khyber Pakhtunkhwa, Abdul Latif Yousufzai submitted a copy of the First Information Report (FIR) registered against Naib Subedar Amanullah in the Supreme Court. The bench was due to rule on the case concerning the unaccounted persons from the list of 35 missing men on March 21 but it postponed the order to March 22, 2014 (today) following a disclosure by the KP Government that no formal FIR had been registered. The court had then directed the Provincial Government to ascertain the situation on the ground and inform the court. Lawyers for former President General (retired) Pervez Musharraf called on March 21 for his treason trial to be suspended because they claim the Government is colluding with elements of the judiciary to “fix and manipulate” the proceedings, reports Dawn. The legal team said it based its claim on “leaked secret communication” from an unnamed source in the office of Prime Minister Nawaz Sharif. In a statement issued in London, the lawyers called for an “immediate and unconditional suspension of the Special Court and a comprehensive investigation” into their claims. The lawyers said that Prime Minister Nawaz Sharif has “manipulated the Pakistani legal process and used unlawful influence on the... judiciary to bring a barrage of unsubstantiated charges” against Musharraf, his long-time political rival. They gave no specific details of their new claims, but said they had submitted them to the office of United Nations (UN) Human Rights Chief Navi Pillay. Police said the Central Forensic Science Laboratory report has confirmed that voice sample of Akhtar has matched with the intercepted voice calls that were exchanged between Akhtar and Ameen. Akhtar called Ameen for planning through his associate Mohammad Hakim the capital's serial blasts that were to use cycle ball bearings. Hakim is facing trial in that serial blasts case, police said. Police made the submissions to Additional Sessions Judge Daya Prakash while seeking more days to conclude the probe in the 2008 Karol Bagh blasts case. The court accepted the plea after it was told that questioning of Akhtar in the case has revealed vital informations about one more accused in this case named Ariz Khan alias Junaid. The Special Court, headed by Justice Faisal Arab of the Sindh High Court, had dismissed Musharraf’s application seeking trial by a military court under the Pakistan Army Act (PAA) 1952. The petition in the Supreme Court was filed by Musharraf’s lawyers Sharifuddin Pirzada, Dr Khalid Ranjha, Anwar Mansoor Khan and Barrister Mohammad Ali Saif. The court has been asked to accept the plea and declare the February 21 judgment of the Special Court constituted under the Criminal Law Amendment (Special Courts) Act, 1976 as illegal and unlawful. The Special Court should be directed not to proceed with the trial, it said. “Applying the rule of consistency and taking protection under Article 25 read with Article 4 of the Constitution, the petitioner’s case should have been sent to the military court,” the petition argued. In his petition, Musharraf contended that at the time of proclaiming the emergency on November 3, 2007, he was serving as a regular member of the armed forces and that the alleged offense of high treason attributed to him was to be tried only under the PAA 1952, a law also framed by Parliament as much as the High Treason Punishment Act 1973 and the Special Courts Act 1976.

Justice Riaz Ahmed Khan directed the ISI chief to appear before the court next week in response to a petition filed by Parveen Bibi, the spouse of Mohammad Arif, who went missing in February 2014. According to details, Arif, who owned two branches of ‘Dar-i-Arqam’ School in Iqbal Town and Dhamial Camp of Rawalpindi, was a resident of Peshawar Road in Rawalpindi Cantonment, and went to Khushab District (in Punjab) along with three others, Ishtiaq Ahmed Aasi, the Secretary General of the Pakistan Railways Mazdoor Union, Dr Uzair and Hafiz Rauf to condole the death of a friend. However, the four people were allegedly picked by ISI in Khushab. After a couple of weeks, Aasi and Uzair returned to their homes. A Lahore High Court (LHC) division bench on March 26 adjourned the hearing of an appeal moved by a Christian woman, Asia Bibi (45), against her death sentence on blasphemy charges till April 14, 2014, due to unavailability of complainant Mullah Qari Muhammad Salam’s counsel, reports Dawn. According to details, Salam accused Bibi of speaking against Prophet Muhammmad on June 14, 2009 and subsequently the Nankana Police registered a blasphemy case against her. A two-member bench of the Supreme Court (SC), comprising Justice Amir Hani Muslim and Justice Mushir Alam, while hearing the cases on the law and order situation in Balochistan, missing persons and the Khuzdar mass grave case on March 26 observed that Balochistan Chief Secretary was visiting the United States (US) while people in the province were dying, reports The News. The Supreme Court gave these remarks after being informed that the meeting of the Balochistan Chief Secretary, the counsel for the Frontier Corps (FC) Irfan Qadir, the Crime Investigation Department (CID) and Balochistan Advocate General Nizamuddin could not be held as the Chief Secretary had proceeded on a visit to the US. The court asked the Balochistan Government to give a solution to the missing persons issue and directed the Chief Secretary to submit a detailed report in this regard in the first week of April, 2014. Justice Justice Arab remarked, “If someone thinks that we are demonstrating partiality then we too are not interested in hearing of the case,” adding, “I did not say that Pervez Musharraf does not intend to come to court. I had said Musharraf could not appear in the court due to security concerns. The court also accepted security threats being faced by the accused. He was granted exemption after his plea for security threats was accepted. On the prosecution’s request, the special Maharashtra Control of Organised Crime Act (MCOCA) court on April 1, issued production warrants against two Indian Mujahideen (IM) operatives, Tahseen Akhtar and Waqas in connection with the July 13, 2011 Mumbai (Maharashtra) serial blasts, reports Asian Age. According to special public prosecutor Ujjwal Nikam, the court issued production warrants against the duo after they made an application, and they will be brought to Mumbai once they are sent to judicial custody in Delhi. The investigating agency has already arrested seven accused in this case identified as Naquee Ahmed, Nadeem Shaikh, Kanwar Pathrija, Haroon Naik, Mohammed Qafeel Ansari, Yasin Bhatkal and Asadullah Akhtar. They are facing trial under the stringent MCOCA, Indian Penal Code (IPC), and other laws. The IHC, however, disposed off the matter after the spy agency denied the custody of the missing man. Justice Riaz Ahmed Khan of the IHC on March 24, 2014 had directed the DG ISI, Zaheerul Islam, to personally appear before the court in a petition filed by Parveen Bibi, the spouse of Mohammad Arif, who was picked up from December 17, 2013 from Khushab District in Punjab Province. Before being picked up, Mohammad Arif, a former activist of Jama’at-e-Islami (JeI), was running a printing press and private schools in Rawalpindi District. However, DG ISI, in an affidavit submitted to the IHC, denied the custody of the missing men. Additional Attorney General (AAG) Tariq Mehmood Khokar submitted an application on behalf of the ISI seeking exemption of the DG from appearance. In the application the spy agency contended: “For operational security and secrecy reasons his (DG ISI) whereabouts are kept classified.” The application also stated that the “DG ISI is not in Islamabad on the date fixed for the hearing of the matter. It further said that the DG of the spy agency was not “the relevant officer in the matter in question”. Justice Khan expressed annoyance over the lethargy of the spy agency in dealing with the court. He said: “It was not our desire to summon the DG ISI but the conduct of the dealing officials was tantamount to making a mockery of the courts.” “A person files the petition for the recovery of his relative and the dealing official instead of submitting report suggests the court for adjourning the proceedings for 6 weeks” he said. “It was an insult for the judiciary” he added. However, Colonel Fayyaz, Deputy Director Legal of the ISI tendered an apology before the court.

However, there was confusion on the release of the non-combatant TTP prisoners, as the Prime Minister’s (PM) Secretariat initially denied that it ordered the release of any prisoner, apparently due to massive pressure from the military establishment. The PM Secretariat, however, retracted this statement later following a meeting between Prime Minister Nawaz Sharif and Federal Minister of Interior Chaudhry Nisar Ali Khan. It said Sharif had indeed ordered the release of the non-combatant TTP members. The TTP had reportedly handed a list of prisoners to the government demanding their release, during different rounds of the peace talks. On the other hand, the military establishment is opposed to the release of TTP prisoners, both combatants and non-combatants, due to their alleged involvement in terror attacks across the country. The prisoners were released in phases. “Three prisoners were released on March 21, five on March 25 and 11 on March 28,” Federal Interior Ministry sources confided. The Interior Ministry Spokesman confirmed that all the prisoners belonged to the Mehsud tribe. Sources said that in the coming days about another 100 non-combatant detainees would also be released.

The Judicial Tribunal tasked to investigate the discovery of 17 dead bodies from mass graves in Tutak area of Khuzdar District is expected to produce its findings within a month, reports The Express Tribune. The Tribunal, headed by Balochistan High Court (BHC) Judge Justice Noor Mohammed Meskanzai, sought eight more weeks on February 28, 2014, as it wanted to record the statements. “The extension of eight weeks will help the tribunal to record the statements of maximum number of people,” Home Secretary Balochistan Asad Gilani said. Spokesperson of Balochistan Government Jan Mohammed Buleidai said, “High Court judge is investigating this case and we hope that responsible will be brought to justice.” The DNA tests of 13 dead bodies are yet to be submitted to the tribunal. Officials have only identified one body as that of Naseer Ahmed through a piece of paper recovered from the body. All the bodies were decomposed beyond recognition.

The proceeding in the November 26, 2008 Mumbai terror attacks case (26/11) has come to a standstill as the special judge of the Anti-Terrorism Court (ATC), Atiqur Rehman, has expressed his inability to conduct the trial of seven Pakistani suspects in the Adiala Jail of Rawalpindi District of Punjab due to security reasons, Dawn reports on April 4. Sources close to the proceedings revealed that since March 3, 2014, when terrorists attacked the District Courts in Islamabad, there has been no progress on the trial with the ATC unable to complete the cross examination of even a single witness. The ATC judge demanded that the Federal Government should deploy Rangers for his security. However, the Government has not done anything for his security so far. Advocate Raja Rizwan Abbasi, who is representing the accused Zaki-ur-Rehman Lakhvi and other suspects, when contacted, confirmed that there was no progress on the case for about a month. He said the Federal Government was responsible for the delay as the ATC judge had refused to conduct the jail trial of the accused persons because of security reasons. “Had the Federal Government provided the requisite security to the judge, the proceedings would not have been delayed,” he added. However, Advocate Mohammad Azhar Chaudhry, the special prosecutor of the Federal Investigation Agency (FIA) said the prosecution was trying to complete the trial as early as possible.

The chargesheets name LeT 'commander' Abu al-Qama on the list of 29 calling him "mastermind behind creating of IM and responsible for the September 13, 2008 blasts of Delhi". IM operatives includes: Amir Reza Khan, Riyaz Bhatkal, Iqbal Bhatkal, Yasin Bhatkal and Assadullah Akhtar apart from other terrorists. Qama was also the main planner of the October 29, 2005, serial blasts of Delhi, carried out solely by LeT militants. Riyaz Bhatkal, works under Abu al-Qama's command from Pakistan, says the Delhi Police chargesheet. Yasin Bhatkal and Akhtar aka Haddi provided explosives and ball bearings to the Atif Ameen-led module for the serial blasts. The 29 terrorists were chargesheeted for offences punishable under Indian Penal Code (IPC), Explosives Act, Unlawful Activities (Prevention) Act (UAPA) and IT Act. The chargesheets were filed in the court of additional sessions judge Daya Prakash, who fixed them for consideration on April 19, 2014. Of the 29, 16 have been arrested. The notification was published in the Gazette on March 25, 2014. "Since the notification has been published in the Gazette, the order in this regard would come soon,” an NIA official said. Important cases like Vagamon Students Islamic Movement of India (SIMI) camp case, Kalamassery bus burning case and several Fake Indian Currency Note (FICN) cases are pending before the court for trial. The accused persons in the Vagamon SIMI case are believed to be behind the Ahmedabad bomb blast case with some of them having links with top leadership of the Indian Mujahideen (IM). Kalamassery bus burning case is another important case in which Thadiyantavide Nazeer, a suspected south Indian 'commander' of Lashkar-e-Toiba (LeT) and Sufiya Madhani, wife of Abdul Nasser Madhani, are the accused. Former President General (retired) Pervez Musharraf will approach Sindh High Court (SHC) against the Federal Government’s decision to reject his application seeking removal of his name from the Exit Control List, said sources privy to the matter on April 4, reports The Express Tribune. According to sources, Musharraf’s legal team has decided to file a petition in SHC against the Federal Ministry for Interior’s refusal seeking an explanation. The petition in this regard will be moved in the next few days. They further revealed that Musharraf’s legal aides are reluctant to directly approach the Supreme Court and therefore have decided to first submit an application in the High Court. “The (legal) team is still undecided whether to file the petition in Islamabad High Court (IHC) or SHC since most of the members believe that the IHC’s behaviour has been hostile with their client in the past and they should challenge the Federal Government’s decision in SHC,” the sources added. The Interior Ministry, while responding to Musharraf’s request on April 2, 2014, had refused to remove his name from the ECL.

Additional Sessions Judge Daya Prakash allowed the special cell's plea for more time after they told the court that they needed to quiz suspected IM operative Zia-ur-Rehman alias Waqas to establish the missing links in the 2010 Jama Masjid attack case. Earlier, on April 5, Delhi Police Special Cell brought Waqas, and Tehseen Akhtar to ‘When Will You Stay,’ a home-stay facility in Old Munnar (Edukki District) where they had once stayed, to gather evidence, reports The Hindu. They were brought on a Border Security Force (BSF) flight to Kochi (Ernakulam District) and then taken on two helicopters to Anachal. Waqas had stayed there from September to November, 2013. Police team questioned the home-stay owner Muneesh and Muthusami, an autorickshaw driver, who took Waqas to Old Munnar and introduced him to the home-stay. Indian Express reports on April 7 that Tehseen Akhtar and Waqas had visited two places in Kochi in December 2013. The Delhi Police provided the information that Tehseen and Waqas visited Marine Drive and a shopping mall at Edappally during their stay in Munnar. Jahangir Khan, Shabbir Ahmed, Ravinder Kumar, Mohammed Yaseen alias Pappu, Zohra Nishat and Shaik Awadh, all associates of 'self-styled commander' of HM Mujeeb Ahmed, were arrested by the sleuths of Special Investigation Team (SIT) of Hyderabad Police in December 2005 for allegedly conspiring against the state by procuring AK 47 rifles from HM 'chief' Syed Salahuddin of Pakistan. After hearing the argument of public prosecutor and defence counsels, the division bench of Justice L Narsimha Reddy and Justice M S K Jaiswal, while allowing the appeal of six accused, upheld the conviction of life imprisonment of Mujeeb Ahmed. The law permits the Security Forces (SFs) to shoot suspects on sight, detain them at secret locations for up to 90 days and carry out raids without search warrants. The SFs can also carry out secret trials. The opposition termed the Bill as regressive and extra-constitutional. “This law will turn Pakistan into a Police State,” said PTI Vice Chairperson Shah Mehmood Qureshi. “We have decided to take this law to court and challenge its anti-human rights stance.” Qureshi said, adding that his party had the support of the Jama’at-e-Islami (JeI) and the Muttahida Qaumi Movement (MQM). When the hearing started in the court of Justice Ibadur Rahman, petitioner’s counsel Sardar Taufiq Asif expressed dissatisfaction over the failure of the spymasters to appear in person and brought the issue to the court’s notice. “Every time, assurances are given, but no developments have been made for the last year,” he informed the court. Deputy Attorney General Tariq Khokhar replied that a commission is already working on missing persons’ case. The court, however, questioned the status of the commission and asked under which law the commission was set up and to what extent it can implement its decisions. “The commission’s job is to give recommendations,” the court said. The court also asked the Punjab IG about progress made in the investigation. The IG informed the court that a team led by a superintendent and under the supervision of the Rawalpindi city police officer is investigating.

A court in New Delhi allowed the plea of Delhi Police seeking 15 days time to conclude investigation against suspected Lashkar-e-Toiba (LeT) operatives Mohammad Rashid and Mohammad Shahid after the investigators said the efforts to arrest wanted accused Abdul Subhan were still going on, PTI reports on April 11. Rashid and Shahid were arrested from Haryana's Mewat region in December, 2013 in connection with a case of planning to carry out terror attacks in Delhi and adjoining areas. According to Police, "Wanted accused Abdul Subhan is still absconding and non- bailable warrant against him has been issued by the court. With the arrest of this wanted accused, the missing links in the conspiracy are likely to be established which require that period of investigation and judicial custody of these accused (Rashid and Shahid) be extended", reports Business Standard. The court allowed the plea of the Special Cell and granted it time till April 23, 2014 to conclude its investigation.

A 14-member bench of the Supreme Court, headed by Chief Justice of Pakistan Tassaduq Hussain Jillani, also declared that, “Musharraf’s review petition has no merit; therefore, it is rejected on January 30, 2014.” “The Court is seized of a review petition against a judgment wherein neither the question of petitioner’s trial nor the retrospective or prospective effects of Article 6 were moot points. The argument qua this is therefore misplaced and is accordingly repelled,” it observed. Defending its July 31, 2009 ruling, the Chief Justice in his 45 pages judgment said that the July 31, 2009 judgment has narrated with a measure of dismay the frequent constitutional deviations in the country. “The spirit which underpins the judgment is a strong realisation that we should not remain trapped by mistakes in history and turn a new leaf towards constitutionalism and the rule of law.” The court also says that the petitioner’s counsel has not referred to any case in which, after his reinstatement for the second time on March 24, 2009 the then Chief Justice passed any adverse order against Musharraf.

Refusing to accept the petitioners' contention that they were mere cultural activists who took up social causes like poverty, corruption, superstition, gender discrimination, etc, Justice A R Joshi said that there was enough evidence against the trio to curtail their freedom. Sachin Mali, Sagar Gorkhe and Ramesh Gaichor were taken into Police custody along with another member, Mali's wife Sheetal Sathe, after they courted arrest outside the State legislature. Sathe was released in June 2013 on humanitarian grounds as she was pregnant. They had surfaced more than two years after going underground. All four were booked under the stringent provisions of Unlawful Activities Prevention Act (UAPA) and various sections of the Indian Penal Code, including criminal conspiracy.

It asked the Deputy Attorney General (DAG) Sajid Bhatti whether the Army has started any proceedings against the officials allegedly involved in enforced disappearances. Bhatti submitted that they have not received any kind of information from the Defence Ministry in this regard. According to details, the Balochistan Government has agreed to refer 14 ‘missing’ persons’ cases to the Army for the trial of Frontier Corps and Intelligence Agency officials under the Army Act. Advocate General of Balochistan Nazimuddin Baloch submitted a report on behalf of the Chief Secretary of the province Babar Yaqoob Fateh Muhammad regarding the ‘missing’ persons’ issue. In the case of 35 persons, who went missing from Army’s internment centre in Malakand Fort of Khyber Pakhtunkhwa, the Federal Government on April 16 submitted a statement in the Supreme Court suggesting that the main accused, a junior Army officer, identified as Naib Subedar Amanullah Baig, would be court martialed under the Pakistan Army Act (PAA) 1952, reports Dawn. Deputy Attorney General (DAG) Waqas Dar submitted a one-page statement on behalf of the Defence Ministry, informing the court that the main accused was a serving member of the Armed forces and subject to punishment under the PAA. In accordance with the court’s directions, the statement explained, the Malakand District Coordination Officer (DCO) was approached to settle the criminal case against the soldier, registered at the Malakand Levy Post. Jurisdiction over the accused was then shifted to army authorities for investigation and trial under the Army Act. Justice Khawaja observed, “This amounts to closing the case”. “Could Amanullah move the missing persons from the internment centre without approval,” he asked, adding that the court had heard a similar case of one Tasif Ali alias Danish. There, the judge said, it was held that civilian authorities have a right to investigate the matter once an FIR is registered. Justice Khawaja said the court would seek assistance from Attorney General Salman Aslam Butt in deciding the matter and adjourned the case to next week.

He said the matter was investigated and material for prosecution was available only against Musharraf hence the complaint was filed against him. Sheikh said that the FIA “found evidences only against the former President” regarding proclamation of November 2007 emergency. While submitting his written answer to the Special Court, the chief prosecutor said that in accordance with the law “the person signing a document is solely responsible for the act”, and in this matter the FIA found no documentary evidences or summary signed by the then Prime Minister regarding the imposition of emergency in November 2007. He further submitted that “no record of the cabinet’s approval was found” and if Musharraf was advised by someone to impose emergency in 2007, then he should inform the court. Sheikh said it was the responsibility of the accused to provide evidences to verify the claim regarding the involvement of abettors or facilitators during imposition of emergency. The chief prosecutor said that implicating someone without any evidence was unconstitutional and against the fundamental right of a fair trial. The court adjourned the hearing of the treason case to April 24, 2014, and said that the decision regarding the appointment of the prosecutor would be announced on April 18, 2014.

The Telegraph reports on April 17 that the National Investigation Agency (NIA) is hoping to extract information from gunrunner Wuthikorn Naruenartwanich, alias Willy, from Thailand, to effectively nail Nationalist Socialist Council of Nagaland-Isak-Muivah (NSCN-IM) leader Anthony Shimray on procurement of Chinese weapons for the outfit. Shimray, who was arrested by the NIA from Nepal in 2010, is currently lodged in a Delhi jail. A source in the NIA said they are hoping to extract some vital information from Willy on the supply of Chinese weapons not only to the NSCN-IM but also to other Northeast insurgent groups. The move follows a Thai court’s nod to extradite the gunrunner. “Willy’s extradition and arrest will also help us build a watertight case against Shimray who is facing trial in an NIA court in Delhi in a case related to a criminal conspiracy for illegal procurement of a shipload of sophisticated arms and ammunition from China,” the source said. Willy was detained by Police in Bangkok in August, 2013 following a tip-off provided by India. A Thai court recently issued an order for his extradition after hearing a request made by India. A non-bailable warrant and a red-corner notice were issued against Willy in this NIA case in 2011. The Indian government had requested Thailand for Willy’s extradition through a diplomatic channel and Indian officers had testified against him in the Thai court. “The Bangkok court has given Willy a period of 30 days to prefer an appeal against the extradition order if he so desires, which will expire early next month,” the source said. After he is extradited, Willy will have to face trial with Shimray in the NIA case (number RC-01/2010).

Khalid, who committed the crime when he was 15 and has been in custody for three years for his role in the “Jihad Jane” conspiracy, will receive credit for that time and serve an additional two years in prison to finish his sentence, said the sentencing judge, Petrese Tucker, of US District Court in Philadelphia. He was arrested in 2011 on charges that he provided material support to terrorists working with a suburban Philadelphia housewife who went by the nickname Jihad Jane. Her real name is Colleen LaRose. Prosecutors had asked for a stiff sentence for Khalid, arguing that his translations of extremist propaganda helped explain violent ideologies to potential recruits on the Internet. According to details, LaRose admitted to following orders in 2009 from alleged al Qaeda operatives. She travelled to Ireland that fall to meet an Algerian, Ali Damache, who she believed would train her. The plot was not carried out and Damache is fighting extradition from Ireland to the US on terror charges. Prosecutors said Khalid helped Damache recruit others and helped LaRose destroy evidence. Officials said Khalid “worked tirelessly” with two other American men now serving long prison terms on terror charges in other failed plots, Emerson Begolly and Reed Stanley Berry. Prosecutors say he helped them translate violent jihad videos from Urdu to English.

The High Court (HC) on April 17 acquitted four cadres of Islami Chhatra Shibir (ICS), the student wing of Jamaat-e-Islami (JeI) condemned to death by a Chittagong Court for killing eight persons, including six activists of Bangladesh Chhatra League (BCL), the student wing of ruling Awami League (AL) in Chittagong city in July 2000, reports The Daily Star. The HC gave the verdict after hearing appeals by the four accused against the lower court judgment. The charges brought against them were not proved, as none of the witnesses saw them spray bullets at the eight people. On March 27, 2008, Second Additional Metropolitan Sessions Judge Ekramul Haq Chowdhury handed down the capital punishment to the ICS cadres.

The International Crimes Tribunal-1 (ICT-1), after the prosecution and the defense concluded their closing arguments in the war crimes case against absconding Bangladesh Nationalist Party (BNP) leader MA Zahid Hossain Khokon on April 17 kept the case in CAV (Curia Advisari Vult, a Latin legal term meaning the court wishes to consider the matter), reports The Daily Star. During the closing arguments, prosecutor Mokhlesur Rahman Badal claimed that he had proved all the charges against Khokon “beyond any shadow of doubt”. He further said “We are seeking his [accused] capital punishment.” Khokon, believed to be living in Sweden with his son and daughter, is facing 11 charges for his alleged involvement in killings, genocide, torture, abduction and confinement of people during the Liberation War in 1971. At least 24 prosecution witnesses, including the investigation officer, testified in the case. There were no defense witnesses.

The Chitwan District Court on April 17 released two Maoist cadres arrested in connection with 2004 Krishna Prasad Adhikari murder case, on bail, reports Nepal News. After conducting a hearing for two days, District Judge Binod Mohan Acharya delivered the order in the case. As per the court order, Bhimsen Poudel and Chhanilal Poudel have been decreed a bail amount of NPR 27,000 and NPR 20,000, respectively, as the pre-condition for their release from the judicial custody. Among the 13 Maoist cadres alleged of involvement in the Adhikari murder case, 11 are absconding. The court has issued arrest warrant against them.
