A Delhi court on January 2 convicted five Jaish-e-Mohammed (JeM) militants, for waging war against the country and being involved in spreading terror, according to Daily Excelsior. Additional Sessions Judge R K Gauba held Noor Mohammad Tantre, Pervaiz Ahmed Mir, Faroz Ahmed Bhat, Atiq-uz-Zama and Raees-uz-Zama, guilty under the stringent anti-terror law Prevention of Terrorism Act (POTA).They were also pronounced guilty under various Sections of Indian Penal Code (IPC) relating to waging war against the country and under the Explosives Substance Act. All these five convicts were arrested by the Delhi Police on August 30-31, 2003 following an encounter.

Colombo Magistrate Court on January 2, ordered to further remand 55 former Liberation Tigers of Tamil Eelam (LTTE) cadres suspected of committing serious crimes against the State during the war with the Government, reports Colombo Page. The hardcore LTTE cadres have been in detention since their arrests in 2009 while hiding with the displaced civilians in welfare camps of Vavuniya. An anti-terrorism court judge on January 3 started the trial of Tehreek-e-Nafaz-e-Shariat-e-Mohammadi (TNSM) ‘chief’ Maulana Sufi Muhammad amid tight security in the Central Prison of Peshawar, the Provincial Capital of Khyber Pakhtunkhwa. Sufi Muhammad is facing charges of sedition, conspiring against the State and encouraging terrorism. Public Prosecutor Khurshid said that there were also a host of other charges against him, including those under Section 302 and 324 of the Pakistan Penal Code (PPC). He said Swat Anti-Terrorism Court Judge Asim Imam started the trial of TNSM ‘chief’ Maulana Sufi Muhammad by establishing a camp court in the prison. The proceedings lasted for five hours.

On January 6, five Jaish-e-Mohammed (JeM) militants were sentenced to life imprisonment by a trial court in New Delhi connection with Millenium Park encounter case (August 30, 2003), reports Times of India. While sentencing the convicts, identified as Noor Mohammad Tantre, Pervaiz Ahmed Mir, Faroz Ahmed Bhat and brothers Atiq-uz-Zama and Raees-uz-Zama, arrested by Delhi Police, Additional Session Judge R K Gauba also imposed a fine of INR 50,000 on each of them. Within hours of the declaration, Bodoland Territorial Council (BTC) chief Hagrama Mohilary sought suspension of operations against NDFB-ATF. Talking to reporters when he was brought to the court in Guwahati, Daimary said that in the intervening period they would not indulge in any act of violence and cease hostilities. He said their decision to declare a unilateral ceasefire had been conveyed to the Union Government. “Now it is the responsibility of the Government to take the peace initiative forward. The ball is in their court now,” Daimary added. Sources said the outfit had recently sent a letter declaring unilateral ceasefire to the Centre through Bodoland National Conference (BNC), adding that Daimary’s sister Anjali Daimary, a member of the BNC’s convening committee, was playing a key role in this process.

The case against the accused, including Pakistani national Wali Abdul Rahiman, was that they had conspired with the Lashkar-e-Toiba (LeT) and recruited several youths from Kerala to carry out anti-national activities in Jammu and Kashmir. The youths, recruited in 2006, were given armed training in terrorist modules to wage war against India, the charge sheet said. Wali, the main link between the LeT and the Keralites, has been absconding while four youths recruited from northern districts of Kerala, died in encounters with security forces in 2008. So far 10 persons had been arrested in the case while the absconding included the first accused Abdul Jaleel from Kerala. The accused included four youths killed in encounters with the Security Force personnel in October 2008 and T. Nazir, who is now in jail in connection with the Bangalore bomb blasts case.

It also upheld the acquittal of co-accused Fahim Ansari and Sabahuddin Ahmed for want of corroborative evidence. Among the several charges against Kasab, the most serious was his waging a war against the Indian government, the Bombay High Court said. One Kashmiri accused is under arrest, another died in an encounter a few years ago. Siddiqui was around 15 when he committed the crime. He has been on the run since then. There was an award of Rs. 15,000 declared on him. The court granted his transit custody till March 2,” said an Uttar Pradesh ATS official. The judge set March 29 as the next date for recording deposition by the prosecution witnesses (PWs) in the case, court sources said. Mufti Abdul Hannan of the Harkat-ul-Jihad-al-Islami (HuJI) is the prime accused along with his brother Muhibullah alias Muhibur Rahman and Mufti Mainuddin alias Masum Billah. Two cases, one for murder and the other for explosive substances, were filed in connection with the grenade attack on the then Chowdhury, after Jum'a prayers on May 21, 2004 in front of the shrine of Hazrat Shahjalal (RA) in Sylhet. Three people were killed while over 50 others including the District Bar president Abdul Hai Khan sustained injuries in the incident. The Divisional Speedy trial tribunal of Sylhet on December 23, 2008 awarded death to Mufti Hannan, Shahedul Alam Bipul and Delwar Hossain Ripon while Mufti Muhibur Rahman and Mufti Main Uddin were sentenced for life and fined Tk 10,000 each, in default, to suffer two years more in jail. The same group of accused are facing trial in the case for explosive substances.

The Special Court-1 also fined the convicts Taka (Bangladesh Currency) 100 each. Six other accused were acquitted of the case as allegations brought against them were not proved. On completion of arguments on February 9, the court fixed the date for pronouncing the verdict. The convicts had looted arms and ammunition from armoury and brought out a procession at the battalion headquarters, chanting slogans in favour of the mutineers of BGB headquarters in the capital where 74 people, including 57 army officials, were killed during the mutiny. Of the accused, 25 confessed to their involvement in the mutiny and begged for mercy while the remaining 80 claimed innocence. Earlier, on March 1, 13 personnel of Dinajpur Sector of BGB were sentenced to jail terms ranging from four months to four years for their involvement in the mutiny at the sector headquarters on February 26 in 2009. The Special Court-13 also fined the convicts Tk 100 each. During hearing of the case, all the 13 confessed to their involvement in the mutiny and begged for mercy. The trial of the mutiny case started on November 27, 2010. Also, on completion of arguments between the mutineers of 11 Battalion under BGB Khagrachhari Sector and the prosecution witnesses, the Special Court-15 adjourned the trial proceedings till march 2 (today).

Advocate Nazrul Islam, counsel for the appellants, pleaded against the High Court (HC) verdict and told the SC that fatwa has been a "part and parcel of Islam’” adding, “If fatwa is banned, Islam will be struck at the root.” Earlier, on January 1, 2001, the HC declared illegal all punishments in the name of fatwa. The verdict came following a hearing on a suo moto (own initiative, without external prompting) HC ruling after a report on Hilla marriage (marriage with a third person).

The Colombo Magistrate's Court has refused bail to the suspects and ordered them to be further remanded until March 17. The Sri Lanka Navy arrested the 17 suspected cadres on February 19 when they were heading toward Australia onboard a multi-day fishing trawler in the sea 20 nautical miles off Hambantota. The counsels for the suspects have asked the court to release them on bail when they were produced before the Magistrate but the Criminal Investigations Department conducting the investigations had told the court that they have yet to complete the investigation.

Das, of the Odisha High Court has granted conditional bail to four Maoist cadres, identified as Roza Mandangi, Gokul Kuldipia, A.Iswari and Kendula Sirisha alias Padma, whose release had been demanded by the Maoists for the release of Malkangiri District Collector R Vineel Krishna from their captivity, reports Orissadiary.com. The Judge has granted bail against deposit of INR 20,000. Roza and Gokul will report to the Investigating Officer (IO) in every 15 days. Further, with the condition that they cannot go outside of the District without the permission from the Police. The court also directed the Odisha Police to hand over Iswari and Padma to Andhra Pradesh Police within two days. The two were asked not to enter the State until summoned by the SDJM’s court in Jeypore, Koraput District. In addition, Maoist leader Ganti Prasadam, who is currently lodged in the Koraput District jail, is likely to be out on bail, with his lawyer trying to get people who would stand surety for him, reports Indian Express.

Besides Malik, Mushtaq Ahmed Dar and Shamima alias Shazia alias Bitti, also appeared before the Court. Kud Police (Udhampur District) had intercepted a vehicle on March 23, 2002 and recovered USD 70,000 from Shamima and USD 30,000 along with INR 19,000 from Mushtaq Ahmed Dar. During questioning, both the passengers disclosed that they had received this money from Altaf Qadri, Executive Member of All Party Hurriyat Conference (APHC) presently in Pakistan and was at Kathmandu (Nepal), at the instance of JKLF chief Mohd Yaseen Malik. Being a close associate of Malik, Mushtaq Ahmed Dar was allegedly directed by Malik to proceed to Nepal to collect USD 100,000 from Altaf Qadri. Accused Mushtaq Ahmed Dar along with Shamima went to Kathmandu in the month of March 2002 and allegedly collected USD 100,000 which was to be distributed among the militants’ ranks and organisation including Hizb-ul-Mujahideen (HM) and Lashkar-e-Toiba (LeT). After completion of the investigation, Crime Branch presented charge-sheet in POTA Court, which issued general arrest warrants against Altaf Hussain Qadri on the request of Police to initiate proceedings under Section 512 Code of Criminal Procedure (Cr. Daily Star reports that Rajshahi Investigators of International Crimes Tribunal have gathered evidence and statements of witnesses who were forced to convert to Islam at gunpoint in Rajshahi District following directives of former Jamaat-e Islami Ameer (leader) Ghulam Azam during the Liberation War in 1971. They also collected fortnightly secret reports of Special Branch of the then Police Department that were sent to Police stations across the country from Police headquarters in Dhaka in 1971. However, all the families converted to Hindus again after the liberation, said the investigators. Azam and other collaborators held meetings with Tikka Khan in early April of 1971 and genocide took place across the country following the meetings. Further, the investigators recorded statements of around 100 survivors who witnessed genocide in Charghat Upazila (Sub-Division) of Rajshahi District. The evidence shows that genocide took place in Padma Char, some 900 feet away from Thanapara village and Sardah Police Academy of Rajshahi District on April 13, 1971. Around 150 persons were killed in a firing squad and their bodies were set ablaze.

The Supreme Court on March 7 directed the Jharkhand and Tripura Governments to ensure that all schools and hostels of educational institutions are free from the occupation of Security Forces (SFs) within two months, reports Times of India. The apex court also expressed its displeasure against the Assam Government for not furnishing details about the number of schools occupied by the SFs and threatened that non-compliance of its orders would compel it to summon the Chief Secretary. A Bench comprising Justices BS Sudershan Reddy and SS Nijjar refused to give longer breathing period to the State Governments for implementing its direction. The Jharkhand Government counsel said 26 of the 47 school buildings have been freed from the presence of the para-military and State Police and sought another six months to fulfil the apex court order. Declining the plea, the Bench said, "the Jharkhand Government is directed to free the schools from the occupation of security forces within two months". The identical direction came for the Tripura Government which said only 16 schools out of 4000 are under the occupation of the central forces and due to insurgency reason it would take another six months for its removal. Further, the bench, which had asked the Ministry of Development of North Eastern Region (DONER) to hold meetings with seven North Eastern States on various aspects of development, made it party to the petition. The court during the earlier hearings had expressed its displeasure that Government did not respond to its order on the "serious" issue of ensuring that all schools and hostels of educational institutions should be kept away from the occupation of SFs.

A Sri Lankan court on March 7 ordered to send over 100 former Liberation Tigers of Tamil Eelam (LTTTE) cadres for rehabilitation, reports Colombo Page. Colombo Additional Magistrate Aruni Attygalle has ruled that 118 former LTTE cadres should be sent for rehabilitation at the Poonthottam Rehabilitation Center. The Magistrate said that the former cadres should be rehabilitated for a period of one year at the rehabilitation center. 23 female activists are also among the 118 former cadres. The Magistrate's order was delivered following a recommendation made by the committee appointed by the Attorney General to investigate into their condition.

The team visited Karamja village in Santhia Sub-Division of Pabna District on March 9 and took statements of the witnesses. Team leader Mohammad Abdur Razzak quoted witnesses as saying that the occupation troops with the help of Peace Committee Chairman Khoda Bux lined up eight male members of Megha Thakur's family in front of their house in May 1971 and shot them dead. They also raped Megha's daughter Parbati. A mass grave of the eight male members of Megha's family was discovered at his house in 2000 and Santhia Police took eight skeletons into custody. The investigation team collected the skeletons from the police station as evidence of the massacre of the eight. Further, the team members also visited Koroi-Kadipur massacre place in Joypurhat Sadar Sub-Division, Joypurhat Government College and Pagla-Dewan massacre place. It has been reported that at least 10,000 people were killed at Pagla-Dewan by the local collaborators of Pakistani occupation forces during the Liberation War. The team collected evidence and recorded statements of the witnesses to the massacre and also visited the Peace Committee Office in Joypurhat town.

According to India Express, Security Forces (SFs) during October 2008 operations in Jammu and Kashmir found that four Lashkar-e-Toiba (LeT) militants killed in a series of encounters were from Kerala. Subsequently, they learnt that the group had a fifth member, who managed to escape. The revelation set the Police and later the National Investigation Agency (NIA) on a trail that showed how the LeT was recruiting youths from Kerala, training them in Kerala and in Hyderabad of Andhra Pradesh, and then using them for operations in Jammu and Kashmir. Three years on, the NIA has retraced much of the trail with information from two suspected LeT militants from Jammu and Kashmir. Unnamed except as A and B, they have disclosed the identity of the LeT leader who allegedly supervised the recruitment. A and B are mentioned as witnesses in the NIA charge sheet submitted recently in a Special Court in Kochi in Kerala. They were examined under Section 164 of the Criminal Procedure Code (Cr. PC). According to the charge sheet, they have named Wali alias Rashid Abdullah, Baitullah Mujahideen of LeT training camp in Muzaffarabad of Pakistan occupied Kashmir (PoK), as having supervised the recruitments. The tribunal headed by Justice Nizamul Huq directed the prosecution to submit the progress reports on the investigation into the War Crimes allegations against the five leaders by April 20. The tribunal also directed the jail authorities to provide necessary treatment to Delwar Hossain Sayedee and arrange medical test for him at Bangabandhu Sheikh Mujib Medical University (BSMMU), if necessary. According to his lawyer, Srinivas who was arrested in 2007 from Bariguda forest in Kalimela area of the District had been tried in six cases since then and he was acquitted in all six cases, including three murder charges. "First Srinivas was tried in four cases in which he was acquitted. But the Police again implicated him in two more cases in which he was acquitted," his counsel said. Prior to his arrest Srinivas was carrying a cash prize of INR 1.2 million in Andhra Pradesh.

The Supreme Court (SC) has made it clear that the CA’s term will not end until it completes the task of constitution writing, said PM Khanal on April 7. Khanal further said, the CA’s main task is to make a constitution and it can’t shy away from its responsibility. Considering the remaining processes in constitution making it is almost impossible to promulgate a new constitution within the stipulated date of May 28. Since the outline of the constitution has not been determined yet The SC had issued a verdict few months ago upholding the CA decision to extend its term in 2010 saying the CA term cannot end until a new constitution is promulgated. According to existing provisions, the CA needs to amend the clause related to the CA term in the interim constitution. The interim constitution can be amended with a two-third majority. As reported earlier, the Army had submitted a proposal to Prime Minister Jhala Nath Khanal suggesting that a separate directorate be constituted within the Army comprising 50 percent former Maoist combatants and fifty percent personnel of the three security agencies

One of the trial remains stuck as the Supreme Court registrar is yet to give his opinion on whether the trials of both cases could be held in the same court. Ironically, the case filed under Explosive Substances Act (ESA) is pending with the Speedy Trial Tribunal-1 Dhaka. Seven and a half years after the incident, during the immediate past caretaker rule, the investigators found Harkat-ul-Jihad-al-Islami Bangladesh (HuJI-B) links to the blast. Criminal Investigation Department pressed charges against 14 members of banned militant outfit HuJI-B on December 30, 2008. The charge-sheeted accused are top leaders of HuJI-B including top leaders Mufti Abdul Hannan, Mufti Shafiqur Rahman, Moulana Yahiya, Mufti Abdul Hye, Moulana Shawkat Osman alias Sheikh Farid, Moulana Abu Bakar alias Selim Hawlader, Moulana Mohammad Tajuddin, Moulana Abdul Hannan Sabbir, Arif Hasan Suman, Moulana Akbar Hossain alias Helaluddin, Moulana Abu Taher, Moulana Abdur Rouf, Hafez Jahangir Alam Badar and Shahadat Ullah alias Jewel. A Bench of Justices H.S. Bedi and C.K. Prasad, after hearing senior counsel Ram Jethmalani for the petitioner and senior counsel U.U. Lalit for the State, granted bail to Sen. Justice Prasad told Lalit that “We are a democratic country. He may be a sympathiser. That does not make him guilty of sedition.” Drawing an analogy, he asked Lalit that “if Mahatma Gandhi's autobiography is found in somebody's place, is he a Gandhian? No case of sedition is made out on the basis of materials in possession unless you show that he was actively helping or harbouring them [Maoists].” Jethmalani advocating for Sen said: “I have never seen such oppression from the State Government. This literature, what they call sedition is available in the market. ” Quoting various Supreme Court and other judgments, he argued that mere possession of some materials would not amount to the imperialistic concept of sedition, as the law relating to sedition had undergone a sea change. Not a single material was produced against Sen to show that he was involved in preaching or propagating Maoist ideology. Reacting on the Apex court’s decision, Chief Minister Raman Singh said his Government respects the Apex court’s order, reports Deccan Chronicle. “Supreme Court has only granted him the bail. The pending legal process will continue in high court at Bilaspur,” Singh said.

A Dhaka court on April 28 placed Rahmatullah alias Sheikh Farid, a leader of Harkat-ul-Jihad-al Islami Bangladesh (HuJI-B), on a seven-day remand for interrogation in connection with the August 21 grenade attack on an Awami League rally in 2004, reports Daily Star. Meanwhile, HuJI-B Chief Mufti Abdul Hannan and one of his accomplices Abu Zandal were sent to jail after CID produced them before the court of Metropolitan Magistrate Mohammad Ismail Hossain on completion of their one-day remand in Azizur Rahma abduction case. Alim, a member of late President Ziaur Rahman's cabinet, appeared before the tribunal in compliance with his bail conditions. IBNLive reports that a 50-year-old Communist Party of India-Maoist (CPI-Maoist) leader was remanded to Police custody for a day by a local court in Karimnagar District on April 29. Pramod Mishra alias Janardhan alias Ban Bihari, a Maoist ‘Central Committee’ member was produced by the Karimnagar rural Police before the Magistrate court following which he was remanded to judicial custody till May 9. Later Police filed a plea seeking his custody for interrogation. Allowing the petition, the Magistrate directed the Police to take the Maoist leader into their custody and present him before the court today [April 30]. The court further directed the Police not to use third degree methods, while questioning.

In addition, another Maoist cadre identified as Siddharth Bhosale alias Jeeva (24), aide of Sonule was arrested from Chandawa area in Nashik District in the night of April 28, ATS Chief Rakesh Maria said. All the four were produced before a local court on April 29 and were remanded to Police custody till May 3. INR 190, 000 cash, Maoist literature, five mobile phone handsets and SIM cards were recovered from the rented houses of Bhagat and Chorghe, Maria said. "Their bank accounts were also freezed," he added. Sonule, a native of Rajura in Chandrapur, was the sister of Manoj Sonule, adds Times of India. Chandrapur Police had arrested Manoj in 2008 after neutralised a Maoist hideout meant to stock arms and ammunition. Bhagat and Chorghe were from Pune.
