An anti-terrorism court in Lahore granted bail, on January 1, 2003, to Al Qaeda suspect and medical practitioner Ahmad Javed Khawaja, and his brother Ahmad Naveed Khawaja. However, the accused could not be released as they have been booked for 90 days in another case registered against them under section 3 of the Security of Pakistan Act, 1952. As reported earlier, Ahmad Khwaja and nine of his family members were arrested on December 19, 2002, from their Manawan residence for alleged links with Al Qaeda and Taliban.

The sessions court in Gangtok remanded National Democratic Front of Bodoland (NDFB) 'vice president' Dhiren Boro to a 12-day police custody, on January 2. Police had arrested him along with his wife, two children and two associates identified as Prabin Basumatary and Babloo Swargiary the previous day. Sikkinm police said Dhiren Boro, his wife and associates have been booked under the Prevention of Terrorism Act (POTA). The NDFB leader reportedly told police during interrogation that no other NDFB cadre was in Sikkim. He also said he had been staying in Tadung locality, from where he was arrested, in a rented house for the past one year.

It directed police to present the accused on January 13. A case was registered against him and five others on July 31, 2000 at Jampur police station, under section 295A and 16 of the Maintenance of Public Order Ordinance.

A division Bench of the Andhra Pradesh High Court, on January 7, directed a group of experts to conduct postmortem on the bodies of six left-wing extremists—Naxalites—of the People’s War Group (PWG) killed in two encounters on January 5 and 6, in Guntur district. Responding to a petition filed by Andhra Pradesh Civil Liberties Committee general secretary B Seshaiah, complaining that post-mortem was not conducted on the bodies of the slain Naxalites, the Bench made it clear that the said order would be operative, if the bodies have not been already disposed. The court also instructed that the autopsy be conducted only by a team of doctors. The two encounters followed the killing of three constables in a landmine blast on January 5.

Ayub, a resident of Parbhani in Marathwada region, was arrested on December 26 in Washim under the Prevention of Terrorism Act (POTA). Two persons were killed and 34 more injured in the blast.

The court said, since the government has rejected the opinion of the Military Intelligence on the sensitivity of documents seized from Iftikar, the hearing was adjourned to await the outcome of the lower court. The lower court has summoned Director-General Military Intelligence (DGMI) Lt. Gen O. S. Lochab and Joint Commissioner of Police Neeraj Kumar. On December 23, 2002, Lochab appeared before the Chief Metropolitan Magistrate and said documents recovered from Iftikar did not contain any classified information. Iftikar Geelani, a journalist and son-in-law of All Parties Hurriyat Conference (APHC) leader S A S Geelaniu, was arrested on June 9, 2002 under the Official Secrets Act for allegedly possessing documents compromising national security.

Hearing has begun on January 8 at the Speedy Trial Tribunal in Chattagong in the sensational murder case of Gopal Krishna Muhuri. 12 persons, including eight local-level leaders and activists of the Islami Chhatra Shibir have been indicted for gunning down Muhuri, principal of Nazirhat College, on November 16, 2001. Among the petitions filed was one by Marumalarchi Dravida Munnettra Kazhagam (MDMK) leader Vaiko, detained under POTA in Tamil Nadu since July 11, 2002, for allegedly making statements in support of the proscribed Liberation of Tamil Tigers Elam (LTTE). While admitting the petitions and fixing the matter for final disposal in March, the Bench said it was an important issue and needed to be heard in detail. "It was revealed through investigation that the al-Qaeda's most wanted terrorists were being harboured and facilitated at Manawan Compound owned by Dr Ahmed Javed Khawaja and his family," said an Interior Ministry statement presented to the court. The statement responded to a petition by Khawaja's wife challenging the legality of his detention, and that of his brother Naveed, sons Umar Karar and Khizar Ali and nephew Muhammad Usman. The Interior Ministry statement said terrorists allegedly harboured by the family were Abu Yasir Al Jazairi, identified as an Algerian or Moroccan, Assadullah and Sheikh Said Al-Misri, both listed as Egyptians and Abu Faraj, listed as North African. Al Jazairi was "responsible for the business of al-Qaeda," Al-Misri was a financial chief of the network, and Faraj was the head of Al Qaeda's North Africa network, according to the statement. Faraj was also a deputy of Khalid Sheikh Mohammad, a key Al Qaeda figure on the BI list, who escaped a raid on his hideout in Karachi in September 2002, the statement added.

According to media reports, on January 17, the police remand of four suspected terrorists, arrested under Prevention of Terrorism Act (POTA) in the case relating to a blast inside a bus in Ghatkopar, Mumbai, on December 2, 2002, has been extended. The remand of prime accused Imran Rehman Khan has been extended till January 31. Co-accused-Mohammed Abdul Mattin Abdul Basit, Shaikh Mohammed Muzamil Jamil Ahmed and Zaheer Ahmed Bashir Ahmed Shaikh, were remanded to police custody till January 22. The prosecution requested the Court for the extension of their custody on the grounds that their links with other accused abroad had to be investigated. Another accused, Sayyed Khawaja Yunus Khwaja Ayub, had escaped from the police on January 7, and is yet to be traced.

According to media reports, United Liberation Front of Asom (ULFA) terrorists had abducted Doley too, along with Ghosh. Lahore Police registered a case against Azhar in August 2001 for delivering speeches against India. Altaf Shah, counsel for the Punjab government, told the Court that the Jaish chief made "provocative and sensational speeches which instigated students and youths to create a law and order situation." However, the Judge did not agree with this deposition and added, "Indian leaders always make anti-Pakistan and prejudicial speeches and they always attempt to create troubles for Pakistan."

Basha is also the prime accused in the 1998-Coimbatore serial bomb blast case. The Court also convicted 22 others, including two women- Arifa Begum and Ayesha alias Sangeetha, in the case relating to the seizure of arms and explosives from various parts in Chennai in 1998, after the Coimbatore blasts, sources said. The Judge has fixed January 27 for awarding sentences to the convicted persons, after hearing representations from them. Except for Basha, the other accused are charged with criminal conspiracy, violating the Explosives Substances Act (ESA) and Criminal Law (Amendment) Act by supporting the Al-Umma, causing riot with deadly weapons and preventing officers from performing their duty. Basha had been arrested in Chennai on the day of the Coimbatore blasts and the others some time later.

The reports also said that the HC has allowed Afzal to argue his defence against the award. In its order the HC also directed the Tihar jail authorities to produce Afzal before it on February 3, when the reference for confirming the death sentences imposed on three convicts would be heard. The appeal of other convicts in the case–– another JeM terrorist Shaukat Hussain Guru, his wife Navjot Sandhu alias Afsan Guru and S A R Geelani have already been admitted by the Court on January 15, 16 and 22 respectively. While the first and the last were awarded death sentence Navjot Sandhu was awarded five-year rigorous imprisonment.

Further, the other leaders include Kari Mohammad Obaidullah, Kaji Shahidullah and Anwar Sadat and have gone into hiding, reports claimed. He said that confession was not what he made, on February 17. Subsequently, a Magistrate had, on February 18, recorded his confession. Altaf confirmed its contents before the POTA Court and said it was voluntary. He said in his confession before the Magistrate, "Myself, Abdul Mattin, Yunus Khwaja, Muzzamil Ahmed and Zahir Shaikh are innocent and not involved in Ghatkopar bomb blast or in the conspiracy to trigger the explosion… We do not believe in jihad. Jihad is not wanted in India. It may be relevant in Palestine, but not in India. We also do not believe in fundamentalist activities," he added. The POTA Court remanded Altaf and the other accused to further custody till February 28. Altaf was deported from Dubai on January 26, 2003 and arrested under POTA.

The Central Bureau of Investigation (CBI) received Letters Rogatory (LR) from Portugal asking for details about some of the documents procured by Salem from India, which facilitated him in obtaining a fake passport on forged documents in Portugal, report said. As reported earlier, the CBI had put up a request for his extradition and forwarded certain documents to support their claim that Salem is wanted in India for serious offences. Salem was arrested in Lisbon on September 18, 2002, on forgery charges.

The CBI alleged that Pathan had sent co-accused Manoj Kumar Bhanwarilal Gupta alias Munna, Ethesham, Shahnawaz Khan, Akbar Abu Sama Khan and Karimulla to help Tiger Memon in landing arms and ammunition at the nearby Raigar coast. The new affidavit said the "Government … fully supports the constitutionality [the] of Prevention of Terrorism Act (POTA). It is, however, "of the view that the speech delivered by Vaiko on June 29, 2001, if properly interpreted and read in the entire context of the speech and the surrounding circumstances, does not attract the provisions of POTA." The original affidavit said Vaiko’s speech was supportive of the proscribed Sri Lanka-based Liberation Tigers of Tamil Eelam (LTTE) and was "an act of terrorism." Vaiko and other Marumalarchi Dravida Munnettra Kazhagam (MDMK) leaders were arrested under POTA on July 11, 2002. This will endanger state-security and national unity, the petition added. The petitioner's counsel submitted that the state's decision to freeze the accounts of SSP had brought its social and humanitarian work to a halt. Besides, the closure of the party's regional offices at Lahore, Karachi, Rawalpindi, Jehlum, Multan, Bahawalpur, Faisalabad, DG Khan, Peshawar and Quetta had also affected the social functioning of the party, he argued. The counsel also claimed that the proscription had adversely affected its religious functions since hundreds of mosques, including the Farooq Azam Masjid and Jinnah Masjid in Karachi, drew funds for maintenance from the party's coffers. Delhi police, on May 23, charge-sheeted two leaders of the All Parties Hurriyat Conference (APHC), including its Delhi-based spokesman Shabir Dar while naming former Deputy High Commissioner of Pakistan to India Jaleel Abbas Gilani and Hurriyat Chairman Abdul Gani Bhat as accused who could not be sent for trial. They have been charge-sheeted under Prevention of Terrorism Act (POTA) for allegedly funding terrorist activities in the country. Police sources said Gilani and Bhat had been kept in column number two of the charge-sheet meant for persons not sent for trial. While Gilani enjoys diplomatic immunity, there was not enough evidence against Bhat who was questioned by the Delhi Police in March 2003. Dar was arrested on February 6, 2003 in Delhi for allegedly receiving funds from Pakistan High Commission for passing them on to terrorist groups in Jammu and Kashmir.

An Anti-Terrorism court in Karachi sentenced on June 30 three terrorists of the proscribed Harkat-ul-Mujahideen (HuM) to death on each of three counts for killing 11 French naval engineers and two others in a suicide car bomb attack near the Sheraton Hotel on May 8, 2002. While Asif Zaheer and Rizwanullah faced trial, Muhammad Sohail alias Akram, the third accused, was convicted and sentenced in absentia. Another absconding accused, Adnan Qamar alias Nooni, was acquitted of all charges for lack of evidence. The court further ordered that movable and immovable properties of the convicts be forfeited in favour of the state. The court also ordered the convicts to pay a total compensation of Rupees 0.6 million. Meanwhile, the convicts, while talking to the media, claimed that the court had convicted them under pressure from higher authorities. The court, in its 125-page judgment, held arrested accused Asif and Rizwanullah guilty of manufacturing and using the bomb. It also observed that absconding accused Sohail who had reportedly been using a fake name of Khalid Mehmood was the mastermind of the attack and hence deserved similar punishment.
