On January 19, the Supreme Court stayed the execution of Shaukat Hussain Guru, an accused in the "December 13, 2001 Parliament attack case." A Bench, consisting of Justice S.N. Variava and Justice H.K. Sema, suspended the operation of the sentence on a special leave petition filed by him challenging the October 29, 2003 judgment of the Delhi High Court. Though another accused, Mohd. Afzal has not filed any appeal in the apex court, in view of the suspension of the High Court order, in effect the execution of his death sentence has also been stayed. The Bench also issued notice to the Delhi University lecturer, S.A.R. Geelani, and Afsan Guru, wife of Shaukat Hussain Guru, on two special leave petitions filed by the Delhi Police challenging the High Court order acquitting them of all charges.

A special Anti-Terrorism Court in Rawalpindi, on January 22, awarded death sentence to three men, on four counts, convicted of carrying out a terrorist attack on the Taxila Church in August 9, 2002 killing four nurses and injuring 20 others. Judge Manzoor Ahmad Mirza awarded the capital punishment to Saifur Rehman, Abu Bakar and Ayaz for attacking the church with grenades. The court also imposed a Rupees 100,000 fine on each of the convicts. The court also awarded life sentence to the three convicts, on eight counts each, for injuring the 20 people and fined them Rupees 50,000 each. Three other convicts, Ayaz, Sabir Hussain and Taufeeq were awarded imprisonment for assisting in the crime.

According to media reports, on January 31, the state appealed before the Delhi High Court for enhanced punishment in a case, wherein death sentence had already been awarded. The appeal was filed by the Delhi Police on behalf of the state against the four Parliament Attack convicts, who have filed appeals before the court against the December 18 verdict handed by a special court. As reported earlier, in the Parliament attack case verdict, out of the four convicts, three have been awarded death sentence and the lone woman convict, Afsan Guru, was awarded five years rigorous imprisonment.

According to media reports, on January 31, the three suspected Student Islamic Movement of India (SIMI) activists- Mohammed Abdul Matin Abdul Basit, Sheikh Mohammed Muzzamil Jamil Ahmed and Zahir Ahmed Bashir Ahmed Shaikh, arrested under the Prevention of Terrorism Act (POTA), in the December 2 bomb blast case were remanded to further judicial custody till February 14. They were arrested on December 27 in Mumbai, Maharashtra, for their alleged involvement in the blast that occurred in a bus at Ghatkopar in which two persons were killed and 31 more injured.

The Portugal High court has reportedly ordered the deportation of underworld don Abu Salem, a key accused in the 1993-Mumbai serial bomb blasts, to India. Official sources said that the Portuguese High Court had pronounced the order on February 3 and it had since been conveyed to the Central Bureau of Investigation (CBI) in India. Salem and his accomplice, Monica Bedi, have already been handed jail terms by Portuguese courts for entering the country on forged documents. Salem was sentenced to four-and-a-half years’ imprisonment on three counts—entering Portugal on forged documents, causing injury to a policeman performing his duty and perjury. The two were arrested in capital Lisbon on September 18, 2002.

Earlier reports had indicated that an unspecified number of Islami Chhatra Shibir (ICS) cadres were also among the accused. Gopal Krishna Muhuri, Principal of Nazirhat Degree College, was shot dead on November 16, 2001, at his residence in Chittagong city.

The Supreme Court on February 20 stayed the execution of Jaish-e-Mohammed (JeM) terrorist Mohammad Afzal, who was awarded the death sentence by the trial court in the December 13-Parliament attack case. The sentence was later confirmed by the Delhi High Court. The Supreme Court suspended the operation of the sentence while issuing notice to the Delhi Government on Afzal's appeal challenging the judgment of the Delhi High Court. It also directed the tagging of his petition with that of another accused, Shaukat Hussain Guru, whose death sentence was also stayed by the Supreme Court in January 2004.

The Supreme Court said some of the lower court's decisions "were based on insufficient proof", and there was a real danger of Salem losing his life if he was extradited to India. The case will now return to the lower court for a review of its earlier decision, based on the Supreme Court's ruling. A media report indicated that on July 14 the High Court (HC) of Lisbon, Portugal, has ordered the extradition of Monica Bedi, associate of Indian mafia don Abu Salem, an accused in the 1993 serial bomb blasts in Mumbai. The Indian Central Bureau of Investigation’s (CBI) petition seeking directions to keep Bedi in custody till her extradition trial was also accepted by the HC. The order was communicated to the CBI officially on July 16 by authorities in Lisbon. The HC had ordered her extradition in November 2003, which was, however, challenged by Bedi in the Supreme Court, which sent the case back to the former asking it to give a reasoned order as to why she should be extradited. She is currently serving a two-year jail term awarded by a lower Portuguese court on charges of entering the country on a forged document and continuing to use the same for stay in that country. Monica Bedi and Abu Salem were arrested by the Lisbon police on September 18, 2002.

After eight months of court proceedings which concluded on September 3, a hundred and eleven people, including seven women, were reportedly sentenced to prison terms ranging from four years to life imprisonment in connection with aiding and abetting the United Liberation Front of Asom (ULFA), National Democratic Front of Bodoland (NDFB) and Kamtapur Liberation Organisation (KLO), terrorist groups active in India’s northeast, when they were illegally camped in Bhutan. Two people received life sentence (above 20 years), five people were sentenced from 15 to 18 years, 14 people from 10 to 15 years and rest from four years to 10 years in accordance with the provisions of the National Security Act of Bhutan, 1992. One person is still under trial at the Samdrup Jongkhar court. The convicted persons reportedly include civil servants, road workers from the national work force, private workers, business people, drivers and farmers.

Police had arrested 18 Maoist guerrillas in Kalimela and Badigeta villages in the southern district of Malkangiri while they were returning from a public meeting. "We cannot go for peace when our own people are behind bars," a leader of the People's War Group (PWG) was quoted as saying in a local newspaper. "We will kidnap 18 government employees if all the arrested people are not released," he added. The outfit is also upset after a fast track court on September 24 convicted 11 people, including a woman, in Mayurbhanj district. Jaya Kumar Dash, the additional district and session judge at Baripada, held the PWG cadres guilty under multiple sections of the Indian Penal Code and said he would announce the sentence on September 27.
