ATS told the court on January 1, that the conspiracy to cause serial bomb blasts on Jangli Maharaj Road was hatched by the seven arrested suspects in Saudi Arabia, reports The Times of India. The ATS said the custodial interrogation of the suspects, revealed that they were constantly in touch with the absconding suspects, Fayyaz Kagzi, Riyaz Bhatkal and three others involved in a string of terror attacks in India so far. Investigations also revealed that one of the absconding suspects is a militant of the terror outfit Lashkar-e-Toiba (LeT) and he is involved in inciting youths from Aurangabad, Beed and Ahmednagar (three District of Maharashtra) to indulge in terror activities. LeT had trained the absconders to assemble bombs.

The court of Judicial Magistrate (First Class) S.S. Bose on January 1, extended Police custody of suspected Indian Mujahideen (IM) militants and seven accused arrested in the Jangli Maharaj Road blasts case in Pune of Maharashtra (August 1, 2012), till January 8, 2013, according to Pune Mirror. Five suspects are still at large. Ten teams, set up by the state Anti- Terrorism Squad (ATS), claimed to have recovered 18 different articles from the suspects’ custody, including four CPUs, Indian passports, a chit with a secret email ID on it, four live cartridges, an electronic detonator, a battery, an alarm clock and two gelatin sticks among others. Earlier on December 20, 2012 ATS obtained the custody of four suspects Asad Khan Jamshed Ali Khan, Imran Khan Wajid Khan Pathan, Feroz alias Hamza Abdul Hamid Syed and Irfan Mustapha Landge. Later on December 27, ATS obtained custody of three more suspects, including Munib Iqbal Memon, Faruk Shaukat Bagwan and Sayyed Arif alias Kashif Sayyed Zafaruddin Biyabani.

A US court on January 2 rescheduled the sentencing of Pakistani-American Lashkar-e-Toiba (LeT) operative David Colaman Headley, accused of involvement in November 26, 2008 (26/11) Mumbai (Maharashtra) attacks, from January 17 to January 24, 2013 while that of his accomplice Tahawwur Rana has been rescheduled for a second time to January 17, 2013, according to Zee News. Headley had entered a plea bargain with the Federal Bureau of Investigation (FBI), saving him from a possible death penalty or extradition to India or Denmark. Rana, on the other hand, was acquitted of involvement in the Mumbai attacks but was held guilty on June 10, 2011 of conspiracy to attack Denmark newspaper Jyllands-Posten that had published controversial cartoons of Prophet Mohammed, and of aiding LeT.

A single-member Peshawar High Court bench directed the Provincial Government to raise money from philanthropists for safe release of eight Water and Power Development Authority workers abducted over four months back. The WAPDA workers were abducted by militants on August 15 when they were on the way to Tank District from the dam site in South Waziristan Agency of FATA. The abductors have demanded PKR 150 million ransom. At the same time, the court asked the families of the abductees not to protest, observing that the act may threaten the life of their members. While issuing these directions, Chief Justice Dost Mohammad Khan gave another week to the Government for the safe recovery of the WAPDA workers associated with Gomal Zam dam project, and adjourned hearing to January 10.

A Pakistani national, identified as Mohammed Hussain alias Julfikar Ali, who was on death row since 2006 until the Supreme Court set aside his conviction and ordered his retrial in August, 2012, was acquitted by a Sessions Court in New Delhi on January 4, reports The Hindu. The court noted “substantial lapses” in the Delhi Police investigation into the 1997 blast in a Blueline bus near Punjabi Bagh in West Delhi killing four persons and injuring 24. Among the lapses, Additional Sessions Judge Pawan Kumar Jain found that the Delhi Police did not prepare a site plan, did not consider taking photographs of the inner portion of the bus, exhibits lifted from the spot were not sealed and no effort was made to prepare the sketch of the suspect. “The prosecution has failed to bring home the guilt of the accused beyond the shadow of reasonable doubt,” the Judge said.

Hearing a petition by Senator Haji Adeel for reviewing the progress on the judgement on Karachi (Sindh) law and order passed by the Supreme Court in October 2011, the court on January 7 directed the Sindh Chief Secretary and Advocate General to submit a comprehensive reply by January 22 with regard to implementation of its orders. The court expressed its dissatisfaction with non-implementation of the judgement even after more than a year and directed Advocate General Fateh Malik to present a comprehensive report with detailed progress against each point of the judgement at the next hearing. The bench warned that contempt of court proceedings would be started against the authorities concerned if they fail to provide details of steps that have been taken in this regard. During the hearing, the court expressed its concern to know that Karachi Police is controlled and run by a gambler, Wasim Beater, and postings and promotions of Police Officers are made on his recommendations. Sindh Police Inspector General (IGP) Fayyaz Leghari, Chief Secretary Raja Muhammad Abbas and Additional Chief Secretary Wasim Ahmed expressed their ignorance on the issue. Mumbai Police arrested two persons, identified as Farooq Naiku and Mohammed Talukdar, suspected to be linked with Hizb-ul-Mujahideen (HM) from a guest house at Masjid Bunder in Mumbai (Greater Bombay District) along with Fake Indian Currency Note (FICN) worth INR 27, 200 on January 16, reports Indian Express. They were produced before a local court the next day and remanded in Police custody till January 23, 2013. During interrogation of the accused, it was revealed that Farooq was an active HM militant and he along with Mohammed were actively involved in FICN circulation, narcotics trade, hawala (illegal money transfer) and terror activities. They had also carried out recce of various vital installations across the country. Farooq has been to Pakistan and Pakistan occupied Kashmir (PoK) via Wagah border in Amritsar (Punjab) on several occasions since 2001 form training. Officially, he has crossed the Indo-Pak border three times. Farooq had been reporting to a HM "commander" in Jammu and Kashmir (J&K) and also took part in the agitation over the Amarnath land transfer controversy in the state in the year 2008, Police added. Joint Commissioner of Police (Crime) Himanshu Roy said, "We have evidence that he has photographed Uri Dam, Uri power project, Baramulla Bridge and graves of terrorists killed during operations by security forces… He had even attempted to infiltrate into the Indian Army”. Farooq has been tasked with gathering information related to Indian troops' movements in J&K, public protests and other developments. He passed on the information either through telephonic conversations, mails or by crossing the border, to his Pakistani handlers and intelligence agencies. The second accused Talukdar, who hails from Assam, is also suspected to be an active member of the terror outfit and had been helping Farooq in FICN operations. "We are ascertaining Talukdar role in detail," Roy said, adding Police were trying to find out if the accused had played any role in violence in Azad Maidan (Mumbai) on August 11, 2012.

Later, they were taken to a house where Raj Begum, wife of Manzoor and some other persons assaulted them seriously and took away their cell phones forcibly. Proceeding with the trial, the Court observed, "Prosecution has withheld the main and star witness of the case Mohammad Ayoob and his father Gul Mohammad besides the non-examination of doctor and Investigating Officers who had completed the investigation". These forces were formed to collaborate with the Pakistani military in identifying and eliminating all those who sympathized with the liberation of Bangladesh, individuals belonging to minority religious groups, especially the Hindus, political groups belonging to the Awami League (AL) and other pro-liberation political parties, Bengali intellectuals and innocent civilians. People of the then East Pakistan wholeheartedly supported the war and participated in the call to free Bangladesh. But a small number of Bengalis, Biharis, other pro-Pakistanis, as well as members of a number of different religion-based political parties, particularly JeI and its student wing Islami Chhatra Sangha (ICS) joined and collaborated with the Pakistan military to actively oppose the creation of independent Bangladesh. The 65-year-old fugitive, also known as Bachchu Razakar, was found guilty of killing 14 Hindus, raping two women, torturing two other persons and setting homes ablaze in Faridpur District, his birthplace. The judges said in the verdict “In dealing with the charges we have found that the accused Abul Kalam Azad alias Bachchu Razakar himself had physically participated being accompanied by his armed accomplices to the commission of crimes and as such he held criminally responsible for the direct commission of crimes proved.” Azad was sentenced to death for four of the charges, although found "guilty beyond doubt" in seven.

Headley was ordered to serve 35 years, followed by five years of supervised release by US District Judge Harry Leinenweber. "Mr Headley is a terrorist," the judge said while imposing the sentence in the court. Leinenweber also said, "He commits crime, cooperates and then gets rewarded for the cooperation. No matter what I do, it is not going to deter terrorists. Unfortunately, terrorists do not care for it. I do not have any faith in Mr Headley when he says that he is a changed person now. The Attorney General (AG) Irfan Qadir informed the Supreme Court on January 24 that around 700 persons were in the custody of the security agencies and those people were arrested in connection with the ‘war on terror’, reports The News. He said this while appearing before a three-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhary, which took up the case of prisoners of Adiala Jail. During the hearing, the Chief Justice observed that the Government should find a solution to the issue on its own and if the court gave its judgment, all had to face the consequences. Irfan Qadir said that the suspects were arrested in the Federally Administered Tribal Areas (FATA), where the Army had been fighting militants for around a decade. He said none of the suspects could be freed until the operations in the tribal belt was ended and declined to say how long they had been in the custody. He further submitted that the prisoners of Adiala Jail (Rawalpindi) would be tried under Frontier Crime regulation (FCR). The Attorney General further informed that the evidence against the prisoners had been collected and their trial would be completed within a month.

The three-member tribunal, led by Justice Obaidul Hasan, pronounced the sentence after reading out a 132-page verdict. A total of 18 witnesses, 12 from the prosecution and 6 from the defence, testified in the case. In May 28, 2012, the tribunal indicted Quader Mollah for six offences of crimes against humanity, including killing, mass murder, conspiracy and instigation during the 1971 Liberation War. This is the second verdict of the ICT in connection with the crimes against humanity cases. On January 21, 2013, the same tribunal delivered its maiden verdict sentencing JeI leader Abul Kalam Azad alias Bachchu Razakar to death, in absentia.

President Pranab Mukherjee had rejected Afzal Guru’s mercy petition recently. Guru was sentenced to death by the Prevention of Terrorism Act, 2002 (POTA) court on December 18, 2002, and this sentence was upheld through appeals in the Delhi High Court and the Supreme Court (August 4, 2005). On December 13, 2001, five heavily-armed gunmen stormed the Parliament complex and opened indiscriminate fire, killing nine persons. They included five Delhi Police personnel, a woman Central Reserve Police Force (CRPF) official, two Parliament’s watch and ward staff and a gardener. A journalist, who was injured, died later. All five terrorists were shot dead. Union Home Secretary R K Singh told reporters that the family of Afzal Guru has been informed about his hanging by the Tihar authorities through speed post and the Jammu and Kashmir government was taken into confidence before his execution, adds The Times of India. "They (Tihar jail authorities) intimated the family through speed post, registered post and the DG (Director General of Jammu and Kashmir Police) has been told to check with the family whether they got it or not," Singh said. "We are not having any apprehension anywhere in the country. In Jammu and Kashmir, the state government is taking steps. We are in touch with them," the Union Home Secretary said. Without giving details, Singh said security has been intensified in some areas.

The legislative and parliamentary affairs division placed the draft Bill at the weekly meeting of the cabinet with Prime Minister Sheikh Hasina in the chair seeking equal rights for both the prosecution and the defence to appeal against conviction and sentence. The ICT law allows the Government to appeal only against an order of acquittal while a person convicted and sentenced by a tribunal can appeal against such conviction and sentence.

So far, Fasih has been charged under the Indian Penal Code (IPC) for forgery and possessing fake currency, besides the Explosive Substances Act and the Unlawful Activities Prevention Act. "During his interrogation, Fasih disclosed that he was one of the founding members of IM and was involved in its various activities," Police said in the chargesheet filed in the court of Additional Sessions Judge Asha Menon. The chargesheet also names 18 suspects, including brothers Riyaz and Iqbal Bhatkal (IM founders) and Yasin Bhatkal (chief of IM in India). The Indian Express further reported that in the chargesheet Delhi Police Special Cell said Fasih and other founding members of the IM received "generous support from many people in Pakistan who are well placed in the government there". The chargesheet, based on Fasih's confession, describes him as a "motivator" of the IM.

Eleven of the 12 men were among the 15 arrested in late September 2012 for allegedly planning to kill select targets, including prominent personalities. The 12 militants have been charged under Sections 120 B read with 153 A (criminal conspiracy), 399 (preparing to commit dacoity), 18 read with 10, 13, 17 and 38 of the Unlawful Activities Prevention Act (UAPA), 1967, and Section 3 read with 25 of the Arms Act 1959. Those charged are Shoaib Ahmed Mirza, Abdul Hakeem Jamadar, Riyaz Ahmed Byahatti, Mohammad Akram, Ubedullah Bahadur, Wahid Hussain Kanakyanavar, Zafar Iqbal Sholapur, Mohammad Sadiq Lashkar, Mehboob Bagalkote, Zakir alias Ustad, Obaid-UrRehman and Nayeem Siddique. Of the 15, Zakir is absconding. According to Punjab Police, the team, landed in Jalandhar on February 21, following leads on terrorists of banned terrorist group Babbar Khalsa International (BKI) hiding in the District. Sources in Punjab Police said that attempts are being made by Pakistan-based terror outfit Lashkar-e-Toiba (LeT) to reignite terrorism in Punjab and carry out bomb explosions with the help of Sikh militants based abroad. "The Babbar Khalsa top leadership, including ‘chief’ Wadhawa Singh, and its cadres are active in Pakistan and a few European countries. Malik claimed that Shahbaz asked the Tehreek-e-Taliban Pakistan (TTP) to stop terrorism in Punjab as he and the TTP share a ‘common agenda’. He said if the provincial Governments of Sindh and Balochistan have issued arms license to LeJ chief Malik Ishaq, its responsibility does not lie with the Federal Government. The Federal Government didn’t issue any license to the LeJ chief, he added. He claimed that the Punjab Government was backing LeJ. He asked why a case was not registered against Malik Ishaq when he termed Shias of Faisalabad as ‘infidels’. Had the Punjab government taken timely action against LeJ, the terrorism incidents in Karachi (Sindh) and Quetta (Balochistan) could have been avoided, he said. A Bench of Justices, Aftab Alam and Ranjana Desai, was acting on the State Government’s appeal challenging the rationale of the August 8, 2012 High Court verdict. The High Court had declared CPI-ML Spokesman Gour Nararayan Chakraborty, who was facing charges under the Unlawful Activities (Prevention) Act, a “political prisoner” under the West Bengal Correctional Services Act, 1992. Six other Maoists facing similar charges — V. Venketeswara Reddy, Sambhu Soren, Sagan Murmu, Chatradhar Mahato, Sukanti Baskey and Prasun Chatterjee — had also secured similar privileges from the High Court. The State asked whether an active member of a declared terrorist organisation could claim to be a political prisoner. “The judgment has wrongly held that even terrorist activities would amount to a political movement and therefore participants in such terrorist acts would be political prisoners.”

International Crimes Tribunal-2 (ICT-2) on March 10 released JeI leader Selim Uddin upon BTK 100,000 bail and assurances of two of his counsels. Selim, along with two other JeI leaders, including a Member of Parliament, had been summoned by the court to explain their comments about the war crimes trials. The tribunal decided to release Selim Uddin on bail and fixed March 21 for his hearing. Selim Uddin’s physical appearance was also dispensed with. Hearing the suo moto case of the burning of Christian houses at Joseph Colony in Badami Bagh area of Lahore, the court in its interim order ruled that Inspector General Police Punjab had failed in providing security to 220 homes. The court has sought answers to the questions as to what steps have been taken to stop such attacks in the future, why residents were displaced and why they were not provided security. The court observed that unless and until true facts are produced, it would not be possible either for Police and law-enforcing agencies to nab the culprits involved in the incident.

The chargesheet says Dr Sholapur and Jamdar wanted to fight against the US by joining the Afghan army after completing the murderous tasks. According to the chargesheet, "In Pakistan, they met Abdul Rehman alias Farhathullah Ghori, accused in the Akshar Dham attack case. Ghori introduced them to ISI agents and trained the two men to collect intelligence, execute cyber crime and use weapons”. Dr. Nayeem Ahmed Siddiqui, is the second doctor arrested and named an accused in the case. NIA investigation revealed that another accused, Mohammed Akram alias Khalid, too visited Saudi Arabia in the guise of a driver to forge links with the jehadis. Akram also met in Riyadh "Abu Hamza, working for LeT and wanted accused in Sai Baba temple blast case in Hyderabad in the year 2002", the chargesheet says. Among the various people Akram met in Riyadh were three men from Karnataka who the chargesheet identifies as 'Dr Imran alias Immu, learnt to be a native of Karnataka, Motu Doctor, learnt to be a native of Karnataka, Dr Usman Ghani Khan alias Abu Anas, a native of Dharwad...' NIA will once again take the custody of these two who had recceed Dilsukhnagar in Hyderabad (Andhra Pradesh), to confront them with Lashkar-e-Toiba (LeT) operative Obaidur Rehman. The agency took Rehman's custody on March 13, in connection with the Hyderabad blasts. It has already questioned Maqbool and Imran once in connection with the blasts. The accused Khamirul Islam, Anamul Hoque, Sirajul Hoque and Ruhul Amin are from Malda District of West Bengal. However, the roots of the currency racket are not unearthed during the investigation by the CBI. According to the CBI, the accused entered into a criminal conspiracy and brought FICN of INR 500 and INR 1,000 denominations from Malda to Thiruvananthapuram. The Supreme Court (SC) on March 18 ordered Chief Justice (CJ) Khil Raj Regmi to limit his role to chairman of the Interim Election Council for the time being, reports Myrepublica.com. After hearing on a writ petition filed by advocates Chandrakanta Gyawali and Om Prakash Aryal, a single bench of justice Girish Chandra Lal issued an interim order stating that Regmi should work only as the head of the Interim Election Council till the latter enjoys that post so that it will not affect the jurisdiction of the independent judiciary. The SC said Regmi should be identified only as the chairman of the Interim Election Council for the time being as he will not have any role in the capacity of Chief Justice at the same time.

Submitting a progress report regarding the missing persons, Deputy Inspector General (DIG) Criminal Investigation Department (CID) Balochistan on March 20 told the Supreme Court that six Army officers are involved in the abduction of missing persons in Balochistan, reports Daily Times. According to the report submitted by DIG CID Feroze Shah, 10 military personnel are accused of abducting the missing persons. “Some 18 missing persons had returned home safe and sound but 48 people are yet to be traced,” he said. “Following the statements of 12 missing persons after they returned home the Balochistan Police asked the Frontier Corps to trace the whereabouts of the accused Army men including two Lt Colonels, six majors and two subedars”, said the report submitted by the DIG in the SC. The report further states that the FC personnel assured that they would extend full cooperation for the completion of investigation and the recovery of the missing persons. According to FC, some of the officers did not belong to the organisation and others had gone back to Pakistan Army.

The apex court reduced death sentence of 10 others to life imprisonment. Yakub is brother of Ibrahim Mushtaq 'Tiger' Memon, one of the prime accused of the attacks. Yakub Memon was convicted in the 1993 Mumbai blasts case and has been in jail since he returned to India and surrendered in 1994. Supreme Court observes, "Yakub Memon and all absconding accused including Dawood Ibrahim were archers and rest of the accused were arrows in their hands." Supreme Court says, "Police, customs and coastal guards are also to be blamed for 1993 Mumbai blasts." Court further added that the training of convicts materialised in Pakistan. The apex court adds that management and conspiracy of 1993 blasts were done by Dawood Ibrahim and others in Pakistan. Supreme Court says that Pakistan's intelligence agency Inter-Services Intelligence (ISI) was also involved in the 1993 blasts. Supreme Court upheld life terms of 17 convicts in the 1993 Mumbai blasts case and commuted death sentence of 10 convicts to life imprisonment on the ground that the convicts were behind bars for 20 years and their economic condition was weak. Supreme Court asks all accused to surrender within four weeks. Actor Sanjay Dutt is also sentenced for five years in jail by the Court. However, the apex court has reduced his sentence from six years to five. Sanjay has not been granted any probation and will have to spend three years and six months in jail.

Supreme Court on March 21 said "It is devastating to state that Pakistan being a member of the United Nations [UN], whose primary object is to maintain international peace and security, has infringed the recognized principles under international law which obligate all states to prevent terrorist attacks emanating from their territory and inflicting injuries to other states. A host state that has the capability to prevent a terrorist attack but fails to do so will inherently fail in fulfilling its duty under Article 2(4\ since terrorism amounts to force by definition." Delivering judgment on the March 12, 1993 Mumbai (Maharashtra) serial blasts, a bench of Justices P. Sathasivam and B.S. Chauhan said some of the accused, upon arrival in Pakistan for arms training, were received by Inter-Services Intelligence (ISI) operatives who took them out of the airport without observing any immigration formalities. "Pakistan, thus, took precautions not to bring its involvement on record," the bench said. There was no entry in their passports when they left Islamabad for Dubai, "meaning thereby, they (the accused) had a green channel entry and exit in Pakistan", the court said. "The events unveil the tolerance and encouragement shown by Pakistan towards terrorism," the bench said, referring to confessional statements admitting that some of the accused received training directly from ISI officials on occasion. In addition, Supreme Court said, terrorism and heinous crimes cannot be fastened only on adults, while upholding the conviction of Muhammad Moin Faridulla Qureshi, who was 17 years and 3 months old when he loaded vehicles with explosives and fitted them with timers to devastating effect on March 12, 1993 in Mumbai. "There is no justification whatsoever to restrict the meaning of 'any person' and 'whoever' only to a major or non-juvenile as such an interpretation would have a potentiality to defeat the object of Terrorist and Disruptive Activities (Prevention) Act," the bench said.

Pakistani prosecutors on March 22 approached a court seeking voice samples of seven men, including Lashkar-e-Toiba (LeT) commander Zakiur Rehman Lakhvi, charged with involvement in the 2008 Mumbai attacks, reports The Indian Express. Special prosecutor, Chaudhry Zulfiqar Ali of the Federal Investigation Agency (FIA) filed an application that was admitted for regular hearing by the Islamabad High Court on March 21. Prosecutors also filed a separate application that asked the court to declare Indian terror suspect Fahim Ansari a "proclaimed offender" or fugitive. A two-judge bench issued notices to the seven suspects, asking them to respond to the FIA's application seeking their voice samples. Ali contended that the voice samples would help prosecute the seven suspects, on trial since 2009. "The Indian government had sent the alleged voice samples of the seven accused facing trial here. If the court allows us to obtain their voice samples, the truth will be before everyone," he added. The FIA has for long been seeking voice samples of the seven accused so that they can be compared with recordings provided by Indian authorities. The recordings include intercepts of communications between the attackers in Mumbai and their handlers in a control room in Karachi.

Of the remaining missing persons, 148 are from Punjab, while 100 are from Sindh, 48 from Balochistan, 26 from FATA, 20 from Islamabad Capital Territory, 11 from Azad Kashmir and one from Gilgit Baltistan. The updated report on the status of missing persons was submitted by the Commission of Inquiry on Enforced Disappearances to a two-judge bench, headed by Justice Jawad S Khawaja. The commission also reported that it was handed over 138 cases of missing persons in December 2010 and, so far, it has received 873 new cases of missing persons from all over the country. The total number of cases they have handled thus far is 1,011. Out of these, the commission has traced 316 persons and deleted 47 names from the list, due to lack of details. Another 15 names were omitted because of other reasons.

Delhi Police had claimed that he was planning to carry out terror attacks in the national capital. Chief Metropolitan Magistrate (CMM) Manoj Kumar sent 45-year-old Shah, a resident of Jammu and Kashmir, to Tihar jail till April 12 after he was produced in the court before the expiry of his 15-day Police remand. Sangma challenging his detention under the Meghalaya Preventive Detention Act (MPDA). Sangma, who is in the Shillong jail, was booked under MPDA for waging war against India’s sovereignty. Under the MPDA, a person is detained for a maximum of three years and the accused can get bail only after an Advisory Board chaired by a retired Judge gives a decision on the matter. “The Court has directed the Meghalaya government to file an affidavit against the petition filed by Sangma for booking him under MPDA,” Sangma’s legal Counsel Sujit Dey said.A four weeks time has been given to the government to counter Sangma’s petition, he said. Besides the minor identified as Mohd Azad Khan, a three-person investigation panel blamed security forces for the death of Khumbongmayum Orsonjit Singh, Nameirakpam Gobind Metei, Nameirakpam Nobo Meitei, Elangbam Kiranjit Singh, Chongthan Umakanta and Akoijam Priyobrata. Judge Chaudhry Habib-ur-Rehman, who is conducting the trial behind closed doors at Adiala Jail in Rawalpindi of Punjab province for security reasons, issued the summons for Altaf Hussain, a Karachi-based Additional Director of the Federal Investigation Agency. Prosecutors described Hussain as an "important witness" in the case against the seven accused, including Lashkar-e-Toiba (LeT) commander Zakiur Rehman Lakhvi. He was directed to appear in court at the next hearing on April 13, 2013. At the last hearing on March 30 2013, the court had issued summons to the six private witnesses for selling a boat, an engine and other related equipment to the accused. The Pakistani judicial commission's visit to India has already been delayed by several weeks over the issue of Islamabad (Federal Capital of Pakistan) seeking an assurance that members of the panel will be allowed to cross-examine witnesses. The commission is set to make a second visit to Mumbai to record the statements of the witnesses because the anti-terrorism court had rejected a report submitted after its first visit on the ground that the panel was not allowed to conduct cross-examination.

Additional Sessions Judge Neeraj Dhote fixed April 18 for pronouncing the punishment, after hearing the prosecution and defence on the point of sentence.Maharashtra Anti-Terrorism Squad (ATS) said that German Bakery blast was the first act of terror in which the Pakistan-based Lashkar-e-Toiba (LeT) coordinated with IM. "We proved in court that the LeT and IM joined hands for the first time to create terror in India," said ATS chief Rakesh Maria. LeT operatives gave Baig INR 1.25 milion for the Pune operations. He added, "Baig was the connecting link between the LeT and IM. He did not plant the bomb but took active part in the conspiracy, assembling the explosives and transporting them to the spot. Tiger Hanif was arrested in March 2010, after he was traced to a grocery store in Bolton, Greater Manchester.As reported earlier, Westminster Magistrates' Court in London had ordered on May 2, 2012 to be extradited to India. Savaikar as the special judge to conduct the trial into the Margao (South Goa District) blast (October 16, 2009) case, which will now be heard at the South Goa sessions court at Margao. The case was being heard at the North Goa sessions court for around a year-and-a-half after the central government had notified the North Goa sessions judge as the special judge to conduct the trial. While the Special Investigation Team (SIT) was initially investigating the case, the central government ordered that the probe be handed over to the National Investigation Agency (NIA), a federal agency formed after the 26/11 Mumbai attacks to probe terror-related cases. In 2011, the NIA filed a chargesheet against 11 accused. So far nearly 100 witnesses have been examined in the court, including Police officers, explosives' experts and handwriting analysts.

A two-member bench of the PHC headed by Chief Justice Dost Muhammad heard the case against the CIA-led drone strikes in Pakistan. Justice Dost Muhammad said drone attacks should be declared a war crime and issued wide-ranging directives to the Federal Government and Security Forces to ensure halt to such attacks and that included the raising of the issue at the UN Security Council and the General Assembly. “The drone strikes carried out in the tribal areas (FATA), particularly North and South Waziristan, by CIA and the US authorities, are blatant violation of basic human rights and are against the UN Charter, the UN General Assembly resolution adopted unanimously, the provision of Geneva Conventions and thus, it is held to be a war crime cognizable by the International Court of Justice or Special Tribunal for War Crimes constituted or to be constituted by the UNO for this purpose,” the court ruled.

Skeletal remains of 154 people were found during excavations carried out from November 26, 2012 until March 12, 2013. The Magistrate, after studying 13 affidavits filed by the relatives of missing in the area, ordered the CID to record statements from the petitioners, who appealed the authorities to conduct DNA tests on the human skeletal remains recovered from the grave. It is believed that the skeletal remains unearthed from the Matale mass grave were of insurgents from the Marxist party Janatha Vimukthi Peramuna (JVP) killed during the 1988-89 violence.

The National Investigation Agency (NIA) on May 15 opposed the bail plea of suspected Hizb-ul-Mujahideen (HM) militant Liyaqat Shah in a Delhi court which allowed it to take his DNA samples on May 16 (today), reports Daily Excelsior. During the hearing, the court also reserved its order for May 17 on the bail plea of Liyaqat. The NIA opposed his plea saying that he has been booked under the provisions of Unlawful Activities (Prevention) Act (UAPA) and for offences under various Sections, including waging war against the country, of the Indian Penal Code (IPC). Liyaqat is presently lodged in Tihar jail in Delhi and is in judicial custody till May 18. Liyaqat was arrested by the personnel of the Special Cell of Delhi Police on March 20, 2013, while crossing the Indo-Nepal border in Gorakhpur in Uttar Pradesh with his family. The special cell of Delhi Police later said that Liyaqat, a resident of Jammu and Kashmir (J&K), had told his interrogators that he is a trained militant of HM and was settled in Muzaffarabad in Pakistan occupied Kashmir (PoK). Police had said that Liyaqat and his associate Manzoor, a resident of J&K, were directed by top ranks of HM to carry out terror attacks in Delhi, especially a suicide attack at the time of Holi. It had said that based on inputs given by Liyaqat, a huge consignment of arms, hand grenades and explosive material were recovered from a guest house in Jama Masjid area in Delhi. It had said that his associates, including Manzoor, are absconding. J&K Police, however, had supported the claims of the family of Liyaqat that he was a former militant who had surrendered before Sashastra Seema Bal (SSB) on the Nepal border and was in a group returning from PoK under the rehabilitation policy.

A man detained by intelligence agencies since 2011 told the Islamabad High Court (IHC) on May 15 that over 500 terror suspects had been kept in an internment centre in Lakki Marwat town of same District in Khyber Pakhtunkhwa (KP), reports Dawn. Rana Amir, who went missing in 2011, also was detained at the centre. This was confirmed by a Defence Ministry Official who told the court on May 2 to ask the KP Government to produce him before it. On the directive of Justice Shaukat Aziz Siddiqui, the Interior Ministry and the KP Government produced Amir during the hearing of a petition filed by his wife Rashida Amir. Responding to the court’s questions, Amir said that intelligence personnel had picked him up from his dairy farm in Rahim Yar Khan on February 10, 2011. According to him, the agencies initially kept him in solitary confinement for five months somewhere in Bahawalpur. From there he was taken to Lahore and Peshawar and subsequently to Lakki Marwat. He told the court that the Lakki Marwat centre housed more than 500 suspects in about 20 barracks.

"No substantial evidence has come up against the present petitioner till date and the prosecution/NIA has failed to make out a prima facie case against the present petitioner/ accused till date," District Judge I S Mehta said while granting bail to Shah, despite NIA's opposition. "Further, the NIA investigation also confirms the same that there is no substantial linking against the petitioner/ accused being involved in conspiracy to commit terrorist attack on vital installations in Delhi till date," the court added. Completing the investigation in a case, registered in 2011, related to smuggling of FICN, the NIA filed a final supplementary chargesheet in a Jammu court in April 2013. The chargesheet states that "Fake Indian currency is being used being used by terrorist organisations to damage the economy of India and finance terrorist activities of their cadre operating in India". Further, an officer from NIA said, "Through the Bangladesh border, it (fake Indian currency) was being pumped into India from West Bengal. It was being funnelled via Delhi to terror groups like Hizbul Mujahideen."
