The Principal Sessions Judge of Jammu, J. R. Kotwal, convicted and sentenced an Inter-Services Intelligence (ISI) trained militant, Raja Muzaffar Ahmed, to undergo 18 years imprisonment, Daily Excelsior reported. According to the prosecution, on May 1, 2000, one Sanjeev Kumar helped the security forces in arresting two persons, who had come from across the border and enquiring about the road leading to Jammu. The duo disclosed their identity as Raja Muzaffar (code name Rashed) and Bilal Ahmed (code name Siraj Ahmed). From the possession of Raja Muzaffar, maps of Hiranagar sector, railway line and national highway were recovered while a pistol along with loaded magazine was recovered from Bilal Ahmed. On the disclosure of Raja Muzafar Ahmed, two hand grenades, one pistol magazine loaded with seven cartridges, one packet containing five kilograms of RDX, three time pencils, three detonators and a compass were recovered. Further investigation revealed that the duo were active militants and they, at the instance of Pakistan’s ISI, entered India through International Border in Hiranagar sector to carry out disruptive activities in the State. "The offence committed by the accused Raja Muzafar Ahmed is serious as well as heinous. Normally, a person involved in commission of such offence does not deserve leniency and the court can see mitigating circumstances in the case as to how meekly the accused and the co-accused, who is proceeded under Section 512 CrPC, had made their way to police custody", the Court observed.

According to reports, the Maoists were arrested In Tamil Nadu in June 2007 while imparting training to local unemployed youths in a forest range using looted arms of Koraput. The chief, vice chief and finance secretary of the banned Harkat-ul-Mujahideen Al-alami (HuMA) were on January 15 sentenced to life imprisonment – based on their alleged confessions – for conspiring to kill President Pervez Musharraf in 2002, according to Daily Times. Justice Ghulam Ali Samtio of a Karachi anti-terrorism court gave the verdict against Muhammad Imran, Muhammad Haneef and Ashraf Khan. In a judgment announced inside Central Prison, Karachi, co-accused Sharib alias Arsalan Farooqui, Jameel and Inspector Waseem Ahmed of the Rangers, were exonerated of the charges for lack of evidence. According to the prosecution, the accused had parked a vehicle laden with explosives on Shahrah-e-Faisal on April 24, 2002. President Musharraf was scheduled to travel from the Karachi airport to the State Guest House along this route. The plan to kill him, however, failed as the remote-controlled device attached to the explosives apparently failed to detonate. The conspiracy came to light when the men were arrested in a bomb blast case at the US Consulate in Karachi. They confessed to this incident and were charged with attempted murder under Section 324 of the Criminal Procedure Code.

The Hindu reports that Abdus Salam Pintu, former Deputy Minister in the Khaleda Zia Cabinet in Bangladesh, has admitted before a Dhaka court on January 18 that the then Home Minister, Lutfozzaman Babar, and Ms. Zia’s son, Tariq Rahman, had given the nod for the August 21, 2004 grenade attack on the Awami League (AL) rally in capital Dhaka that led to the death of 23 AL activists. Pintu, who is currently under detention, said the plan was to kill AL leader Sheikh Hasina and senior leaders of the party. Pintu is the brother of Maulana Tajul Islam, a militant leader, who reportedly supplied the grenade to Harkat-ul Jihad-al Islami-Bangladesh (HuJI-B) leader Mufti Hannan to conduct the “operation.” Both Babar and Rahman are now facing charges of corruption and misuse of power and are under detention.

On April 15, the Union Government in a statement in the Supreme Court strongly opposed the disbanding of the anti-Maoist Salwa Judum movement in Chhattisgarh. The Additional Solicitor-General Gopal Subramanium told the apex court, “To assume that the Salwa Judum was an army of people with weapons and asking for it to be disbanded will be no more than asking for these people to be pushed out to be killed (by the Naxalites).” "Salwa Judum, activists of which are designated as special police officers, is consciously funded by the Centre to save the tribals, who were displaced from the jungles by Naxalites, and protect people from being killed by Naxalites", Subramaniam added. He further said, “Situation is of considerable concern both to the Centre and state. Policemen are not ready to step into the forests. Though 17,000 posts are sanctioned for anti-naxal force, the state government is finding it very difficult to fill them. That is why the self-defence force was organised to save people from becoming sitting ducks for the Naxals.” He, however, said that the Government has no objection to the National Human Rights Commission examining individual human rights violation cases by the Salwa Judum activists.

The Tehrik-i-Taliban Pakistan has established Sharia courts in the Bajaur Agency of the FATA and a large number of people are using them to get disputes resolved, instead of waiting for action by the tribal administration, Dawn reported. The courts have been functioning in the Sewai area, about 20kms northwest of the agency headquarters of Khar, for a couple of weeks. About two dozen ulema (religious scholars) have been designated as ‘Qazis’. "We have set up the courts in accordance with people’s wishes," said Taliban spokesman Maulvi Umar, adding that people were fed up with the previous legal system. He said that the Qaziswere "competent scholars well versed in Islamic jurisprudence". Umar claimed that people were approaching these courts voluntarily to get their long-standing disputes settled and the Taliban had not forced any litigant to go to the courts.

US authorities have formally acknowledged arresting Aafia Siddiqui, a Pakistani neuroscientist, five years after her mysterious disappearance in Karachi, Dawn reported. Michael J. Garcia, the United States Attorney for the Southern District of New York, Mark J. Mershon, Assistant Director-in-Charge of the New York Office of the Federal Bureau of Investigation, and Raymond W. Kelly, Police Commissioner of the City of New York, announced the arrest of Aafia Siddiqui on charges related to her attempted murder and assault of United States officers and employees in Afghanistan. Siddiqui arrived in New York on August 4-evening and was to be presented before a US Magistrate Judge on August 5 in the District Court for the Southern District of New York. 36-year old Aafia disappeared with her three children while visiting her parents’ home in Karachi in March 2003, around the same time the FBI announced that it wanted to question her over her alleged links to al Qaeda. On August 1, the FBI reportedly informed her brother that she was alive and was in US custody in Afghanistan. Elaine Whitfield Sharp, the lawyer representing Aafia Siddiqui’s family told Dawn that the MIT-trained Aafia was being detained for political reasons. According to the complaint filed in Manhattan federal court on July 17, 2008, police officers of the Ghazni province of Afghanistan observed Aafia Siddiqui outside the Ghazni governor’s compound. Afghan police officers questioned her and allegedly recovered some incriminating documents describing the creation of explosives, descriptions of various landmarks in the United States and substances that were sealed in bottles and glass jars.

A specially-designated tribunal on August 5 lifted the ban imposed by the Union Government on the activities of the Students Islamic Movement of India (SIMI), reports PTI. Justice Geeta Mittal of the Delhi High Court, who headed the tribunal, held that there was no new evidence submitted by the Government against the SIMI to justify the extension of the ban. A senior law officer said that the Government only came out with the evidence of the Malegaon blasts in Maharashtra in 2006 to show the complicity of the organisation in unlawful activities which was not sufficient to come out with the notification to ban it. However, the Union Home Ministry (MHA) said it will challenge the order of the tribunal which lifted the ban. A MHA spokesperson said, "The ministry will examine the order of the specially-designated tribunal in detail and take remedial action on a priority basis."

The Supreme Court on August 6 stayed the order by the Special Tribunal quashing the Union Government’s February 7, 2008 notification declaring the Students Islamic Movement of India (SIMI) an unlawful organisation, reports The Hindu. A Bench of the Supreme Court stayed the order on a mention made by Additional Solicitor-General Gopal Subramaniam about the Union Government filing a special leave petition against the lifting of the ban. The Bench, consisting of Chief Justice K.G. Balakrishnan and Justice A.K. Mathur, ordered notice to the SIMI seeking its response in three weeks. In his petition, Subramaniam said the tribunal, in its 264-page order passed on August 5, did not express anything on the merits of the case though the Government had provided Intelligence Bureau reports pointing to the involvement of SIMI members in terrorist activities. He said the tribunal had done something above the law and if the order was not stayed, it would result in serious consequences.

According to Daily News, a Sri Lankan national was jailed in the United Kingdom for two years and nine months when he confessed that he was blackmailed to work for the LTTE to clone 500 credit cards of British customers for the outfit to steal 175000 British Pounds. Aabid Khan, Sultan Muhammad and Hammad Munshi, all three Britons of Pakistani origin, were sentenced on August 19 by a British court to serve varying prison terms for possessing or preparing documents promoting terrorism, Dawn reported. The Union Government on August 20 filed a fresh affidavit in the Supreme Court, citing the involvement of the Students Islamic Movement of India (SIMI) cadres in the recent bomb blasts in Ahmedabad in Gujarat, reports The Hindu. In its affidavit, the Government said investigations revealed that the accused in the bomb blasts in Ahmedabad and Surat on July 26 were members of the SIMI. Annexing the depositions made by witnesses, the Government further said intelligence sources and secret surveillance by the Police made it clear that the accused had nexus with international terrorist outfits. Further, these persons were persistently involved in more than one offence or other unlawful activities and the nature of activities indulged in by the outfit would show secessionist tendencies and the potential damage to the secular fabric of society. Annexing a list of over 350 terrorist-related cases registered in Maharashtra, Andhra Pradesh, Gujarat, Kerala, Karnataka, Tamil Nadu, Delhi, Madhya Pradesh, Rajasthan, West Bengal since 2001 and the arrest of over 1,400 SIMI cadres, the Centre said that despite the ban, the outfit had continued with its activities and managed to keep its network alive clandestinely. The organisation was revived through the front outfits, Tahreek-e-Ehyaa-e-Ummat, Tehreek-Talaba-e-Arabia, Tehrik Tahaffuz-e-Sha`aire Islam and Wahadat-e-Islami. The Centre said the confessional statements of some of the accused revealed that SIMI cadres had secret meetings to mobilise Muslim youth to spread jihad in the entire Indian subcontinent especially in Gujarat, and that they had planned to wage a war against India by indoctrinating and training Muslim youth in the use of arms and ammunition. The court on August 6 stayed an order passed by the Special Tribunal, set up under the Unlawful Activities (Prevention) Act, quashing the Centre’s February 7 notification banning the SIMI. As the tribunal order has been stayed for three weeks, the matter is listed for further hearing on August 25.

A German man of Pakistani origin suspected of raising money and recruiting fighters for al Qaeda has been charged with membership in the terrorist group, federal prosecutors said in Berlin on September 4, Dawn reported. The suspect, identified as 46-year-old Aleem Nasir, was arrested in February 2008 at his home in the southwestern state of Rheinland-Palatinate and was charged on August 19. According to a statement from German prosecutors, Nasir traveled “regularly” to Pakistan and “by summer 2004 at the latest” he had agreed with al Qaeda leaders in the Pakistani-Afghan border region “to take part in al Qaeda activities.” His attorney, Manfred Gnjidic, said at the time of Nasir’s arrest that his client had not confessed to anything. But prosecutors said that between April 2005 and June 2007 he made at least four trips to Pakistan’s border region with Afghanistan, in one case handing over $21,732 to al Qaeda and on another at least 5,795.20 in cash. He is also alleged to have provided al Qaeda with additional equipment such as binoculars, night-vision goggles, laser range-finders, digital compasses and radios. “His duty is suspected to have been to acquire money and equipment in Germany for military use and recruit further members as well as fighters for the organisation,” prosecutors said in their statement.

The Supreme Court on September 15 affirmed a tribunal order upholding the ban on the Muslim outfit, Deendar Anjuman, for its subversive and anti-national activities, reports The Hindu. Dismissing a special leave petition filed by the outfit, Justice Arijit Pasayat, who, along with Justice Mukundakam Sharma was on a Bench, said, "Your professed activities may be something, but your general activities are different." The judge pointed out that the Special Tribunal, set up under the Unlawful Activities (Prevention) Act, gave findings that the organisation was actively involved in anti-national and anti-religious activities in Goa, Karnataka, Andhra Pradesh and Maharashtra. The tribunal, headed by Justice Mukul Mudgal of the Delhi High Court, had on February 27 upheld the Centre’s fourth notification extending the ban on the outfit, accused of attacking churches to foment Hindu-Christian animosity. It was first banned in 2001 for two years and thereafter after every two years and the last notification was issued in August 2007. The organisation contended that there was no fresh evidence to show that it was still involved in anti-national activities.

On September 19, the Supreme Court asked the Chhattisgarh government to implement some of the recommendations of the National Human Rights Commission (NHRC), which went into the activities of the Salwa Judum (anti-maoist vigilante movement) set up by the State to tackle left-wing extremism, reports The Hindu. The NHRC had been asked by the Supreme Court to probe the allegations that the Salwa Judum was committing atrocities on innocent people. A Bench comprising Chief Justice K.G. Balakrishnan and Justices P. Sathasivam and J.M. Panchal told senior counsel K.K. Venugopal, appearing for Chhattisgarh, that the commission “has done a meticulous work. It has given a series of recommendations. It is very painful to read the report. It says there is arson and looting, people are armed and they [Salwa Judum] are committing serious offences. It says people who are subjected to serious problems are still afraid of coming out.” The Chief Justice observed, “When somebody [Salwa judum] is given arms, he claims to be a pseudo police. Once he is given arms, he will commit an offence though he has no right to do any such act. Some remedial measures have been suggested in the report and the State may consider implementing them. Whatever is urgently required to be done, do it.” Mr. Venugopal assured the court that the government would implement the recommendations “which are of immediate concern.”

The Supreme Court-appointed National Human Rights Commission (NHRC) investigation into Salwa Judum (anti-Maoist civilian vigilante programme) in Chhattisgarh has justified the movement as a "spontaneous revolt of the tribals against years of atrocities and harassment suffered by them at the hands of Naxalites (left-wing extremists)", reports Economic Times. The NHRC report, submitted to the apex court also dismisses most of the allegations of human rights abuses made by the petitioners in the apex court, including widely reported use of minors by Salwa Judum. The report blames the Naxalites for human rights abuses and sees action by Salwa Judum activists from the prism of necessary retaliation. The report further says that 15 years after Jan Jagran Abhiyan, an earlier attempt to deal with Naxalites, "local tribals once again mustered courage to stand up to the Naxalites, which only goes to show their sense of desperation."

The district court in canton Berne handed a sentence of 42 months to one of the three Swiss defendants, and gave suspended sentences of 14 and 24 months to two accomplices. One of the thieves was said to have been inspired by the conflict between the Forces and the Liberation Tigers of Tamil Eelam (LTTE). His Tamil acquaintance apparently had the right connections to smuggle weapons into Sri Lanka. But the Swiss were caught out by an undercover agent and eventually arrested. Most of their booty stolen from a depot in canton Fribourg was recovered. The court ruled in favour of the harsh sentences because, it said, the thieves were unconcerned by the suffering the weapons could cause. The theft provided ammunition of army critics at the time who were calling for a ban on military weapons being stored at home. The Defence Ministry said that more than 4,300 army guns had been lost or stolen over the past 10 years.

According to Daily Times, the government released three Taliban prisoners, including Baitullah Mehsud’s deputy Maulvi Rafiuddin, while the Taliban released 10 soldiers taken hostage in Hangu district of NWFP on November 5, official sources said on November 6. Sources said the exchange, which took place at Thal tehsil (revenue division) of Hangu district, was made possible by the efforts of the Hangu Aman Jirga (council) in facilitating talks between the local administration and the Taliban. The Taliban released seven soldiers, including Hawaldar Tanveer, Ghulam Mustafa, Imran, Rizwan, Imran Ali, Mohammad Nisar and Arshad, and three Kurram Militia personnel, Shahid, Subhan and Dawar. The three Taliban released were among the seven arrested by the Hangu police in Daoba area on July 9. The Taliban had besieged the Daoba Police Station in retaliation and taken 15 security force personnel hostage. The release of the three men had been a key Taliban demand since their arrest in July. Earlier in September, Rafiuddin and the other two Taliban were released on bail by an anti-terrorism court in Kohat but were re-arrested under the Frontier Crimes Regulation for failing to give security for good behaviour. The release was negotiated after tribal elders said Rafiuddin’s release would help restore peace in the troubled region.
