A Mumbai court on January 1 extended till January 15 the judicial remand of Mohammed Afroz Razak, a suspected member of the Al Qaeda, who had planned to blow up targets in Britain and Australia. The accused did not plead for bail and also preferred not to engage any lawyer. Hence, no bail petition was moved on his behalf. Earlier, on December 18, 2001, Afroz had made a statement purported to be a confession about his links with the Al Qaeda and its plans to hit targets in foreign countries. However, the contents of his statement are not known, as it was recorded in-camera.

Justice Karamat Nazir Bhandari of the Lahore High Court allowed, on January 1, a petitioner-lawyer to amend his petition against the ban on the Lashkar-e-Toiba (LeT) and Jaish-e-Mohammed (JeM) to confine it to the detention of their chiefs. Advocate M D Tahir pointed the importance of Jehad in Islam in his arguments against the ban. The Judge observed that he had disjoined a number of aspects and had sought a variety of relief measures, which could only be considered separately. While demanding withdrawal of the ban imposed on the two Pakistan-based terrorist outfits, the petitioner had sought disbandment of India's Rashtriya Swayamsevak Sangh (RSS) and the Shiv Sena and the trial of their leaders.

Police in the Punjab arrested over 80 activists of the different jihadi outfits and militant groups, reports from Pakistan said, on January 4. A majority of them belonged to the Lashkar-e-Toiba LeT), Jaish-e-Mohammad (JeM), Tehrik-i-Jaferia Pakistan and Sipah-i-Sahaba Pakistan (SSP). Reports also said an anti-terrorism court (ATC) in Lahore, on January 4, sent 17 activists of militant groups on judicial remand. Of the over-80 arrested, 18 were taken into custody from Lahore and the suburbs. 20 more were held from Faisalabad and the remaining from other places in the province.

The tribal administration in Khar Bajaur sent to prison, on January 9, for a term of three years, 10 suspected Al Qaeda terrorists and 52 officials of the erstwhile Taliban regime who had illegally crossed over into Pakistan. The 62 persons, comprising Arabs and Afghans, had entered the tribal agency at different points of time through varied routes and were arrested. Media reports indicate that they have been sent to the Central Prison in Haripur and the district prison in Kohat. Official sources have indicated that the Afghan prisoners belonged to Kandahar, Qunduz, Kabul and Nangarhar provinces. The Arabs, belonging to the Al Qaeda, hailed from Syria, Egypt, Jordan, Iraq and Saudi Arabia. Official sources added, after their transfer to Haripur and Kohat, Pakistani intelligence agencies as well as the Unite States’ Federal Bureau of investigation (FBI) would interrogate them.

Maulana Masood Azhar, Chief of the Jaish-e-Mohammed (JeM) and Hafiz Muhammad Saeed, the former Chief of the Lashkar-e-Toiba (LeT) have been detained for three months under the provisions of the Maintenance of Public Order (MPO) Ordinance for making provocative speeches against government policies. Assistant Advocate General Amin Lone disclosed this while making a statement in Lahore before Justice Karamat Nazir Bhandari, on January 10. The order issued on December 25, 2001 seeking the arrest of Maulana Azhar was also presented to the Court. The order Maulana Azhar with instigating the general masses to rise against the government. The order declared that his speeches, presence, or other activities promote feelings of hatred and ill-will among various sects and thus constitutes a serious threat to national security and the solidarity of Pakistan.

The Lahore High Court (LHC), on January 11, upheld the three-month detention of Maulana Masood Azhar, Chief of the Jaish-e-Mohammed (JeM), and Hafiz Mohammad Saeed, ex-Chief of the Lashkar-e-Toiba (LeT). The LHC rejected a petition that contended that the detentions were illegal. Azhar has been detained since December 25, 2001 under the Maintenance of Public Order law, and since early January 2001 has been held in the Mianwali district jail, about 250 km south west of Lahore. Saeed was being detained in the Sihala rest house within a Punjab police training camp, about 40 km east of Rawalpindi.

A court in Mumbai on January 15 extended till January 29, the judicial custody of Mohammed Afroz Abdul Razak, suspected member of Osama bin Laden's Al Qaeda terrorist network. Mohammed Razak is accused of having planned to blow up targets in UK and Australia. According to media reports, the accused did not plead for bail and also preferred not to engage any lawyer. As reported earlier, Afroz, on December 18, 2001, had reportedly made a confessional statement about his links with the Al Qaeda and its plans to air-dash targets in foreign countries. However, the contents of his statement before the court are not known, as it was recorded in-camera. Afroz was arrested from Mumbai on December 3, 2001 and had confessed to police that he frequently visited Australia, USA, UK, Hong Kong and China between 1997 and 2001. He had also disclosed that suicide squads had been formed by the Al Qaeda to carry out terrorist attacks on World Trade Centre, New York, British Parliament, London, Romal Tower, Australia and Parliament House, New Delhi.

The order was passed when amicus curiae Harish Salve drew Court's attention to DFO Sanjay Singh's abduction and killing allegedly by left wing extremists, Naxalites of the Maoist Communist Centre (MCC) on February 15. "We are not sure whether perpetrators of the crime are only MCC or someone else, perhaps those indulging in illegal mining activities," the Court said directing the Chief Secretary to investigate into the case. The Court said the Secretary will file "his own affidavit within eight weeks" and directed the Director General of Police in the State to provide all assistance and cooperation to the Secretary in the conduct of the probe. Meanwhile, the Bihar government on February 18 ordered a Central Bureau of Investigation (CBI) inquiry into the killing of the DFO. The three suspects, including Jaish-e-Mohammed terrorist Omar Sheikh, have reportedly complained that they were being pressured to admit to the crime. Meanwhile, the police have launched a country-wide search for seven persons suspected of carrying out the killing. They included an Arab man with possible links to Osama bin Laden. Police sources have indicated that there was enough evidence that certain foreign nationals probably connected to the Al Qaeda terrorist network of bin Laden were part of the abductors' gang or at least were involved in its planning.

Granting transit remand of the four terrorists, arrested by Delhi Police on January 31 and February 6, the court asked the West Bengal police to produce them before the Sub-Divisional Judicial Magistrtae, 24 Pargana (south), in Kolkata before March 15, 2002. Earlier, the court had issued the production warrant for three Pakistani nationals and a Bangladeshi who were arrested for illegally entering the country to carry out subversive activities. The four terrorists were booked by the Delhi police under the Prevention of Terrorism Ordinance (POTO) and had confessed that they had entered India to carry out subversive activities.

The CBI informed that the warrant issued in 1994 against Abu Salem had already been forwarded to their counterparts in the United Arab Emirates (UAE) but it had not been returned. India had released him along with Jash-e-Mohammed (JeM) chief Maulana Masood Azhar and two others in exchange for passengers of an Indian Airlines aircraft IC-814 that was hijacked to Kandahar, Afghanistan, from Kathmandu in Nepal in December 1999. "America will suffer if I am killed in a false police encounter at its behest," stated Omar in the court. Meanwhile, the court extended their remand till March 22. "Get your dollars exchanged with rupees because destruction of the USA is imminent," Omar told people outside the court after the proceedings. According to media reports, Omar informed the court that nobody had interrogated him during the last 10 days and yet police were seeking extension in remand.

The State counsel said whatever Omar had stated before the court would be held against him despite the fact that he did not say anything on oath. As reported earlier, on his first production before the ATC, Omar had admitted having masterminded the abduction of Pearl. Sindh Advocate General (AG) Raja Qureshi made this statement after attending the pre-trial proceedings. The police submitted an interim charge sheet of the case and produced principal accused Omar Sheikh and his accomplice Adil Sheikh before the judge. On the AG’s request, the court allowed the police time till March 29 to file the final charge sheet and remanded both the accused to judicial custody till that date. Meanwhile, Raja Qureshi was quoted as saying that Omar cannot be extradited to the US in the near future as he has been charged with the abduction and murder of Daniel Pearl. "Once a trial commences, then the person cannot be extradited unless the trial has been concluded and, if convicted, he has served out the sentence," he said.

Earlier, Afroz had been booked under POTO. But on March 26, the prosecution had sought the court’s permission to drop the POTO case against Afroze. Special public prosecutor Ujjwal Nigam told the court that the government had taken the decision since it did not have sufficient evidence to book Afroze under the Ordinance ‘at this stage’. Regular trial of the four accused persons in the abduction cum murder case of US journalist Daniel Pearl would commence inside the Central Prison in Karachi from April 5. A notification to this effect was submitted by Advocate-General of Sindh, Raja Qureshi, to the Anti-Terrorism Court before whom the police presented a final charge sheet of the case against Jaish-e-Mohammed (JeM) terrorist Omar Sheikh and three others on March 29. The police have admitted in the final charge sheet that thus far neither Pearl’s body nor the crime weapon have been recovered. The final charge sheet also shows recovery of two e-mails dated January 27 and January 30 - one in Urdu written by accused Sheikh Adil and one in English written by Omar Sheikh.

Reports said that the hearing lasted for about an hour and was adjourned till April 12 for framing charge on accused. The prosecution on March 29 submitted final charge sheet against 11 accused including seven absconders before Administrative Judge. The charge sheet contained charges of murder, kidnapping for ransom and terrorism. The court observed, "The case is closed against Mann because this court feels that the prosecution is not interested in arresting him and sending him to face trial in the court". The court said despite warrants issued against Mann and another Akali leader Talib Singh Sandhu 11 years ago, the same had not been executed and these persons were ‘roaming freely’. A TADA case against Mann was filed in 1991 for alleged activities of sedition and delivering inflammatory speech at a Gurudwara in the capital where he had spoken about formation of Khalistan.

Afroz has been charged with section 120 b (conspiracy), section 121 A (waging war against nation), section 126 (acts of depredation against countries friendly with India), section 420 (cheating) and section 467 (forgery) of the Indian Penal Code (IPC). Soon after his release, Afroze appeared before the designated Judge, who accepted the chargesheet and adjourned the case upto April 24. Afroze was released from the jail on the orders of the court, which granted him bail on April 5 as the police failed to file chargesheet within the stipulated 90 days after the arrest. The court allowed the police to investigate further but did not fix any time frame.

While, defending himself on April 12, before Arshad Noor Khan, the Judge of the Anti-Terrorism Court in Karachi adjudicating the matter, he also reportedly said that he does not respect the British Laws. The court of Chief Judicial Magistrate, Dhanbad took cognizance of the chargesheet and sent it for trial. The second case against Khalil and Mufiti Shahid pertained to the killing of a doctor in Karachi on May 31, 2001. In which judge condemned Khalil to death and sentenced Mufti Shahid to life term for the murder of the doctor. In the third case, Talha, Khalil and Mufti Shahid were convicted for killing Syed Zafar Hussain, Director, Research & Technology Centre, ministry of defence, on July 7, 2001. The judge sentenced Talha and Khalil to death and Mufti Shahid to a life term in this case. In the fourth case, Khalil was condemned to death and Mufti was sentenced to suffer life term for killing Syed Ali Hasnain Naqvi on September 4, 2001. The fifth case against Talha, Mufti Shahid and Haider pertained to the killing of Dr. Ishrat Hussain near his clinic in North Nazimabad within the limits of Shahrah-i-Noor Jahan police. The judge awarded capital punishment to Mohammad Talha and life term to Mufti Shahid and Haider. After the judgement, the convicts reportedly raised slogans against the rival sect. However, later, they claimed before the reporters that they were innocent and judicial confessions were extracted of them under duress. They also expressed hope of 'getting justice' at appellate level.

A Delhi court on April 18 discharged four out of six terrorists of the Jammu-Kashmir Islamic Front (JKIF) chargesheeted by the city police for allegedly waging war against the Government of India. The court acquitted the four for want of sanction from the Union government to prosecute them for waging war against the government of India as also for lack of evidence. However, the court framed charges against two other JKIF terrorists Feroze Ahmad Mir and Mohammad Sayed Tantrik alias Yusuf under section 121 (Waging or attempting to wage war or abetting waging of war against government of India), section 121-A (conspiracy to commit offences punishable by section 121) and section 120-B (criminal conspiracy) of the Indian Penal Code (IPC). The police had arrested Feroze Ahmad Mir and Tantrik on June 20, 2001 from a guest house in Delhi and seized Rs 15 lakh from them. According to the media reports, Ahmed Saeed Omar Sheikh, the prime accused in the Daniel Pearl abduction and murder case, and three other accused have pleaded not guilty before the Anti-Terrorism Court (ATC) II inside the Karachi Central Prison on April 22. The court earlier formally indicted them under the sections 356-A, 302, 109 and 120-B of the PPC (Pakistani Penal Code). They have also been charged under sections 7, 8 and 11 of the Anti-terrorism Act, which deal with creating harassment and terror in society. No one was allowed to attend the proceedings except for the three defence counsels and court staff. The court would hear a separate case relating to the other six accused who have been declared absconders.

According to media reports, the prosecution expressed lack of confidence in Abdul Ghafoor Memon, the trial judge in the Daniel Pearl murder case, on April 25 and has moved the Sindh High Court (SHC) for transferring the case to some other Anti-terrorism Court in Karachi. "The court proceedings are not being regulated in a manner that justice should not only be done but should be seen to have been done," said Advocate General (AG) of Sindh, Raja Qureshi, while advocating the cause of prosecution before an SHC division bench. The AG Sindh submitted that although the prosecution had succeeded in examining six prosecution witnesses between April 22 and 24, the prosecution side was not satisfied with the conduct of the judge during the hearing. The accused persons, according to him, had adopted threatening and intimidating behaviour.

Geelani admitted to owning the laptop recovered from his Khirkee Extension home in South Delhi and to having filed the documents stored in it. According to the prosecution, the police station received a packet addressed to P. Muthuraj, inspector, from Thrissur by courier on August 5, 2000. The ‘from address’ read as ‘Sakthivel Cottage Industries’', Vadakkancherry, Thrissur, and was booked at Thrissur on August 3, 2000. The inspector grew suspicious on seeing a cream biscuit packet and two packets of dates in a tampered condition. The packet was sent to Chennai for chemical examination. The city police were put on alert apprehending a bid by the Al-Umma militants to kill policemen. Special teams fanned out to Thrissur and the courier firm employee was interrogated. He said Akbar alias ‘Poison’ Akbar of GM Nagar in Ukkadam had booked the consignment. Akbar was arrested and a case of attempt to murder was registered against him.

The Magistrate rejected the prosecution plea for further interrogation in police custody and sent them to judicial custody till July 10. The Naxalites were arrested on June 23. The government counsel accused them of "waging war against the state" as well as "hatching criminal conspiracy and fanning hatred against the elected government." The police report also held the group responsible for conniving with the Naxalites of Andhra Pradesh, Bihar and Maoist insurgents in Nepal. This is first major case against the PWG after Chief Minister Buddhadeb Bhattacharjee spurned the possibility of dialogue with Naxalites and declared his intention to deal with them sternly.

Official sources said there was apprehension of untoward incidents on July 15, today, when the court is likely to announce its verdict. An Anti-Terrorism Court in Hyderabad, on July 15, awarded death sentence to Ahmed Omar Saeed Sheikh and life term to co-accused––Syed Salman Saqib, Fahad Naseem and Sheikh Adil––in the Daniel Pearl abduction-cum-murder case. Omar Sheikh, a front ranking terrorist of the proscribed Jaish-e-Mohammed (JeM) was prime the accused in the Pearl case. The court found Omar Sheikh guilty of committing offences under sections 7-A of the Anti-Terrorism Act, 365-A (kidnapping for ransom), 302 (murder) and section 120-A of the Pakistan Penal Code (conspiracy), after a trial inside the central prison. The judge sentenced the three co-accused to life imprisonment and a fine of Rs 500,000 each. The court also ordered that all the four accused to jointly pay an amount of Rs 2 million, which would be paid to Pearl's widow Mariane Pearl and their recently born son. The court held that Omar Sheikh was responsible for creating a sense of fear nationally and internationally and ruled that he had hatched a conspiracy and was the principal offender. He associated the co-accused with himself in order to accomplish his task of creating fear nationally and internationally. The verdict said, Daniel Pearl being a captive of the accused stood proved and the non-fulfillment of their demands has presumably resulted in the murder of Pearl at the hands of the accused.

Omar Sheikh, the prime accused, was sentenced to death on July 16 by an anti-terrorism court in Hyderabad for the murder, while three accomplices were given life terms. Chief prosecutor Raja Qureshi said an appeal had been filed at the Sindh High Court on the instructions of the government "for the enhancement of punishment" of the three co-accused, Fahad Naseem, Salman Saqib and Sheikh Adil. "The appeal was filed because if the guilt is established then the normal punishment prescribed by law is to be awarded and not lesser than that," said Qureshi.

Muhammad Imran and Muhammad Hanif, chief and deputy chief of HuMA respectively, reportedly confessed that they had planned and had given clearance to their other accomplices to kill President Musharraf in a car bomb attack on April 26 when the President came to Karachi during the referendum campaign. As reported earlier, Waseem Akhter, an Inspector with the Rangers was also involved in this conspiracy. He had reportedly informed the terrorists about the programme of the passage of the President's cavalcade. According to media reports, the terrorists had packed 500-kilograms explosive with a remote control in a vehicle, which was parked on the roadside in front of Falak Naz Arcade at Sharea Faisal. Later, they came to know that their plan had failed, as the remote control device could not ignite the explosive-laden car.

A consistent supporter of the proscribed Liberation Tigers of Tamil Eelam (LTTE), Nedumaran was picked up from his Mylapore residence and remanded to judicial custody till August 28 by a designated judge for POTA cases. Police sources said Nedumaran had been arrested for the pro-LTTE speeches he had made in the past few months and especially during a conference he organised in Chennai on April 13, 2002. Immediately after his remand, Nedumaran told media persons that he would continue to support the LTTE, as it was the only organisation that fought for the cause of Eelam Tamils. "I will not be cowed down by the repressive measures of the police,'' he said. With his arrest, a total of 11 LTTE supporters have been arrested under the POTA in Tamil Nadu.

His lawyer Nazeer Ahmad Ghazi filed another application demanding "that stern action be taken against all those who are responsible for the illegal, unlawful and unjust arrest and detention of the husband of the petitioner at a secret place." Saeed was first detained in December 2001 but subsequently released in April 2002 after the LHC refused a government request to extend his detention. As reported earlier, officials of the Federal and Punjab governments have informed the LHC on July 31 that Saeed was not in their custody.

Reports said the police officials who had recorded the statements of both the accused failed to appear even at one sitting during the trial and, hence, the cases were struck down. In the first, Mylvaganam Ravi, resident of Anpuvallipuram, Trincomalee, was accused of aiding and abetting the Liberation Tigers of Tamil Eelam (LTTE) between 1996 December and 1997 February by way of supplying information. In the second, Visuvanathan Ravichandran, resident of Kanniya, had been accused of training with the LTTE between December 1998 and October 1989. The prosecution reportedly had no other evidence against the accused other than the confessions made by them.

He said the fingerprints of the accused, Jagtar Singh Hawara, Balwant Singh and Lakhwinder Singh, matched the ones found on the rear view mirror. Azhar had moved the bail application through his counsel stating that he had been arrested illegally. The judge reportedly said records revealed there was no law and order situation created as a result of the alleged speech delivered Azhar nor any segment of the public had been put on the alarm or fear. The police have sought the remand of Singh to interrogate him for his alleged involvement in the killings of 58 persons at Lakshmanpur-Bathe on December 1, 1997 as well as the killing of 25 persons at Shankarbigha village on January 25, 1999 in the district. In two cases, two persons were charged with possessing hand grenades. One of them was also accused of raising funds for the Liberation Tigers of Tamil Eelam (LTTE). In another, the accused was charged with possessing a video film depicting LTTE military operations. In three more cases, three persons were accused of training in arms with the LTTE. In yet two more cases, two persons were charged with aiding and abetting LTTE cadres, while in another the accused was charged with knowingly withholding information on LTTE movements in his village.
