National Investigation Agency (NIA) has charge sheeted the ‘military chief’ and ‘deputy chief’ of NDFB-S G Bidai alias Bishnu and M Batha alias Binod, in connection to the killing of five Adivasi (migrants from Central India) villagers at Pakriguri in Kokrajhar District in December 2014, reports Times of India on February 5. The NIA had earlier filed charge sheets against a total of 14 persons in the case. According to the investigation, at least 14 heavily armed NDFB-S militants of 'Serfanguri platoon' attacked Pakriguri village in Kokrajhar District on December 23, 2014, following orders issued by Bidai and Batha. On December 23, 2014, NDFB-S killed over 70 people in several areas of the State in a series of attacks upon the Adivasi community.

Communist Party of India-Maoist (CPI-Maoist) 'Central Committee (CC) member', Vijay Arya, allegedly involved in nearly two dozen cases of Naxalite violence in different states including Bihar, Jharkhand and undivided Andhra Pradesh will be soon presented in a Sub-Divisional Court in Punjab in connection with a case registered against him, reports The Times of India on February 6. The case against Arya was registered in Kharar Sub-Divisional town of Punjab. Arya is currently lodged in Gaya Central jail. Jail authorities have already received the production warrant from the Punjab court. He has also been granted bail in all the three cases registered against him in Gaya District. The other ongoing cases are in various stages of trial. Being a high security prisoner, Arya needs proper and well-trained escort. "I have requested the Senior Superintendent of Police (SSP) to depute Police personnel for taking Arya to the Punjab court," said Jail Superintendent, Rajiv Kumar.

Maharashtra Anti-Terrorism Squad (ATS) arrested Saidul Singapanga (36), for ‘Maoist links’ and produced in a sessions court of Mumbai on February 5, reports The Indian Express. Chief Public Prosecutor Lata Chheda told the court that the interrogation of the seven others arrested earlier had led them to Singapanga. “The current accused’s name had reflected in the statements of other witnesses. Along with one of the accused, he had gone to collect funds for the party,” Chedda submitted before the court. “At the time of the arrest of the other men, he was not at his house,” the investigating officer of the ATS told the court. Earlier, South Asia Terrorism Portal (SATP) had reported that the seven other persons, identified as Ajay Dosri alias Krishna Lingaya alias Venugopal (40), Shankarayya, Babushankar Banguri, Narsayya, Ravi Marpalli, Ramesh Golala and Satyanarayan alias Sataya, were arrested from various places in Thane District on January 12. The Police claimed that the arrested persons working as labourers and members of trade unions, were looking to recruit members for the Maoist organisation. The court sent Singapanga to Police custody till February 12.

Police on February 5 filed a charge sheet against four militants of Lashkar-e-Toiba (LeT) for the killing of Station House Officer (SHO) Achhabal and his five security guards in June 16, 2017, reports Daily Excelsior. The Special Investigation Team (SIT) headed by Tahir Ashraf Bhatti, Superintendent of Police (SP), carried investigation and during the course of investigation it was established that LeT headed by Bashir Lashkari were involved in the attack. On the basis of evidences collected during the course of investigation involvement of eight persons was established, of which two have been arrested. The arrested include Sandeep Kumar son of Ramesh Kumar of Muzaffar Nagar (UP) and Mohammad Ashraf Wani alias Molvi son of Ghulam Nabi Wani of Branti Anantnag. The two main accused Bashir Ahmad Wani alias Bashir Lashkari son of Ghulam Ahmad of Soaf Shali Kokernag and Abu Maz of Pakistan were killed. The four others involved in the killings Khurshid Ahmad Ganie of Branti Dialgam, Mehraj- ud-din Bangroo of Narparistan Feteh Kadal Srinagar, Sahir Ahmad Makroo of Arwani Bijbehara and Zeenatull Islam Shah of Malnard Sugan Shopian are absconding.

The Delhi Court on February 6 has framed terror charges including conspiracy against Indian Mujahideen (IM) operative Yasin Bhatkal and other eight associates in a case of allegedly establishing an ‘illicit’ arms factory, reports The Tribune. The Additional Sessions Judge (ASJ) Sidharth Sharma framed the charges under Section 18, 20 of the Unlawful Activities (Prevention) Act [UA(P)A], 1967. Along with Yasin Bhatkal, other IM members including Zia-Ur- Rehman, Tehsin Akhtar, Mohd Waqar Azhar, Mohd Maroof, Mohd Saquib Ansari, Imteyaz Alam and Aijaz Shaikh, were also charged. The next hearing is schedule on March 7.

The National Investigation Agency (NIA) team arrested a hawala (illegal money transfers) operative named Abdul Samad in connection to the Lashkar-e-Taiba (LeT) activities in India from Haridwar in Haridwar District of Uttarakhand on February 6, reports Hindustan Times. Abdul Samad was produced before the designated court. The court sends him to the NIA custody of six days, said an unnamed NIA official. Allegedly, Abdul Samad is a prominent hawala operative whose activities area included Muzaffarnagar, Deoband, in Uttar Pradesh and Roorkee in Uttarakhand. He also acted as a channel for a LeT financer based in Saudi Arabia, said an unnamed NIA Spokesperson. In November 2017, Abdul Samad collected INR 5.50 Lakh from hawala operators in Muzaffarnagar (Uttar Pradesh) to deliver it to Shaikh/Sheikh Abdul Naeem/Nayeem, an active LeT member. Shaikh visited and established bases in Bihar, Odisha, Uttar Pradesh and Jammu and Kashmir (J&K) on the directions of his handler Abdul alias Rehan based in Pakistan, said an unnamed NIA official.

Another accused of the same case—Asrar Tailor alias Sagari received the similar punishment. Whereas the NIA court acquitted Azhar ul-Islam Siddiqui alias Munna of all charges imposed on him in the same case. In 2011, the Maharashtra Anti-Terrorism Squad (ATS) raided a guest house in Wadala in Mumbai city District, Maharashtra and arrested Haroon Naik with Indian currency notes in denomination of INR 1,000 and INR 500 worth INR 9.75 Lakh.

A terrorist of Lashkar-e-Toiba (LeT) has been sentenced to seven years rigorous imprisonment by a local court of Bangalore (Karnataka) in a terror financing and money laundering case, on February 8, reports news18.com. Bilal Ahmed Quta alias Imran Jalal, who operated from Karnataka, has also been fined INR 50,000 by the court, they said. A special PMLA court of Judge Shivshankar Amarannavar pronounced the verdict. The case dates back to January, 2007 when the man was arrested with an AK series assault rifle, 200 bullets, five hand grenades and a satellite phone by the Karnataka Police while he was getting down from a bus in Bangalore. He was charged with "waging war" against Government of India, possession of arms and explosives and other sections of the Indian Penal Code (IPC). Quta was involved in these activities since 2001 and was a member of the LeT, they said. The Enforcement Directorate (ED) later booked Quta under the criminal provisions of the Prevention of Money Laundering Act (PMLA) in 2009, taking cognisance of the police charges and subsequent conviction by a local court.

Areeb Majeed is under judicial trial facing the various charges of the Unlawful Activities (Prevention) Act [UA (P) A] 1967 and Section 125 of the Indian Penal Code (IPC) for joining the banned terrorist organisation—IS. He had been appointed former Chief Public Prosecutor and NIA’s Special Public Prosecutor Rohini Salian to defend his case in the court of law. On February 8, the Prosecution was schedule to start the proceedings of the case but, Majeed forwarded his application before the designated Court. The court has adjourned the case for hearing on the application and Majeed have to obtain a ‘No Objection Certificate’ or NOC from his lawyer as per the legal procedure.

It said the four, who were hanged at a prison in Khyber Pakhtunkhwa, belonged to the Tehrik-i-Taliban Pakistan (TTP). Those executed were identified as Rehmanuddin, Mushtaq Khan, Zafar Iqbal and Obaidur Rehman. According to the Inter-Services Public Relations (ISPR) all the TTP militants had confessed to their involvement in murdering innocent persons and carrying out attacks on armed forces and law enforcement agencies. The Army Chief Qamar Javed Bajwa had confirmed death sentences passed by military courts on 30 militants, some of whom were involved in the country’s worst-ever extremist attack. The military courts – in which the army can try civilians on terror charges in secret, despite strong criticism from rights groups – were established in the wake of the 2014 attack, which traumatised the country. They were seen as an “exceptional” short-term measure to give the government time to reform the criminal justice system, as the military targeted militants in the tribal areas of the northwest. The law expired in January 2017, but was shortly extended for another two years.

To that end Pakistan has been making constructive contributions,” FO spokesman Aizaz Chaudhry said. During a meeting with Afghan Ambassador to Pakistan Umer Daudzai Foreign Affairs and National Security Adviser Sartaj Aziz had proposed a power-sharing formula involving the Taliban and other stakeholders in Afghanistan for ending the war there. Mohamed Rahman had fought in Pakistan’s Waziristan for almost ten years. He could not be charged under the terrorism because the prosecutors failed to prove that he had taken part in conflicts as a terrorist, after the Maldives’ Anti-Terrorism Act came into force in 2015, said Judge Ahmed Hailam. Rahman returned to the Maldives in April 2016 and was arrested in June of the same year. He has remained in police custody since then and was charged under the Anti-Terror law in January 2017.

The five, who were members of notorious Razakar force, were given the punishment for participating and assisting the Pakistan army in the killing of 17 people, rape of 15 women and torture of several others in Itbaria village of Patuakhali Sadar upazila in May of 1971. The convicts are Esahaq Shikder (83), Abdul Goni Hawlader (72), Mohamad Awal (69), Abdus Sattar Pyada (65) and Solaiman Mridha (86). All of them are behind bars. All the convicts were involved with the Muslim League (ML), an anti-liberation political party, and joined locally formed Razakar Bahini, an auxiliary force of the Pakistan army, to commit the crimes.

The accused persons named Asad Katlang, Sabir Mayar, Arif Khan and Izharullah alias Johny, who had been absconding after the occurrence and were subsequently arrested, pleaded not guilty to the charge and decided to stand trial. The court fixed September 13 for next hearing and summoned some of the prosecution witnesses for that date. Mashal Khan, a 23-year-old student of department of mass communication at Abdul Wali Khan University was lynched by a mob over the allegation of blasphemy. The Supreme Court of Pakistan on September 12 rejected the Federal Government’s application against a Lahore High Court (LHC) interim order allowing Jamaat-ud-Dawa (JuD) and its affiliate Falah-e-Insaniat Foundation (FIF) to continue their ‘welfare activities’, reports Daily Times. The apex court’s two-judge bench, comprising Justice Manzoor Ahmad Malik and Justice Sardar Tariq Masood, took up the Interior Ministry’s plea. In it, the ministry sought the cancellation of the order passed by the LHC, allowing the JuD to proceed with its ‘welfare activities’ until a decision was reached in its petition challenging a Federal Government ban against the organisation. The Interior Ministry had contended that the interim order was creating a hindrance for Pakistan in complying with international and local legal requirements concerning terror financing. The SC bench observed that the LHC was still hearing the case, and dismissed the Government’s plea to set aside the interim order.

Earlier in the day Islamabad High Court suspended the 10-year jail term of Nawaz Sharif. The court also freed Sharif’s daughter and political heir Maryam, who was jailed for seven years on corruption charges relating to the family’s acquisition of the London flats. “The prosecution has failed to show the properties belong to Nawaz Sharif,” Justice Athar Minallah told the court. A court in Dumka District of Jharkhand, on September 26, sentenced two Communist Party of India-Maoist (CPI-Maoist) cadres to death for killing a Superintendent of Police (SP) and five other Policemen in Dumka District five years ago, reports Oneindia.com. Additional session judge, Mohd Taufiqul Hassan had on September 6, convicted the two Maoists, identified as, Sanatan Baski and Sukhlal Murmu alias Pravir Da and acquitted five others due to lack of evidence. These two convicts were awarded capital punishment. Pravir Da is a resident of Badwadih village in Giridih District, while Sanatan Baski is a resident of Chirudih village in Dumka District. Additional Public Prosecutor, Surendra Prasad Sinha, said that Pravir Da, a member of the outfit’s Special Area Committee (Bihar and Jharkhand), is serving life term since August 9, 2016, in connection with another murder case. The SC ruled the accused will remain in house arrest for four more weeks during which they are at liberty to avail legal remedies in appropriate court which can consider the case on merits. Chief Justice Dipak Misra and Justice AM Khanwilkar said in their majority verdict, “We are of considered opinion that it is not a case of arrest because of mere dissenting views expressed or difference in the political ideology of the named accused, but concerning their link with the members of the banned organisation and its activities.” Refusing to appoint an SIT to probe the arrests, the SC held that the “accused cannot ask for changing the investigating agency or to do investigation in a particular manner including for court-monitored probe.”

Abdul Hameed who was awarded death sentence belongs to Uttar Pradesh along with two other accused, the rest four belong to Jammu & Kashmir. Another accused was acquitted in the absence of solid evidences. On May 22, 1996, passengers travelling in a bus from Bikaner to Soron near Aligarh in Uttar Pradesh via Jaipur and Dausa were blown up while the bus was passing through Samleti village near Dausa District of Rajasthan. At least 14 persons were killed in the blast including some from Jaipur; a few from Bharatpur and some from Uttar Pradesh while 37 were left injured in the timer blast. Later, the conductor of the bus, who was injured, lodged an FIR at a Police Station in Mahwa in Dausa District. Thereafter, a caller who introduced himself from Jammu Kashmir Liberation Front (JKLF) called up and took the responsibility of the blast in Samleti. After considering the statements of nearly 100 witnesses including the bus passengers and scientific evidences, the Court pronounced the judgment.

The incident primarily targeted at the then leader of opposition Sheikh Hasina Wajed resulted in the death of 24 people, several others were injured. Those found to be guilty include former State Minister for Home Lutfozzaman Babar, Bangladesh National Party (BNP) Senior Vice Chairman Tarique Rahman and handed down various punishments for the bombing. Former Deputy Minister for Education Abdus Salam Pintu, former Director of the Directorate General of Forces Intelligence (DGFI) Brigadier General (retd) Rezzaqul Haider, former Director General of National Security Intelligence (NSI) Brigadier General (retd) Abdur Rahim were also found guilty in the case. All of these 38 accused were also sentenced to life term imprisonment for causing grievous injuries to the survivors. In the murder case, Tarique and 18 others were sentenced to life in prison while former State Minister for Home Lutfozzaman Babar and 18 others were given death penalty on charges of killing through criminal conspiracy. The Special Court also found Tarique, Babar and 36 others guilty in the case filed under the explosives substance act and handed down punishments ranging from death sentence to 20 years in prison. Judge Shahed Nuruddin of Speedy Trial Tribunal-1 observed, “The specialised deadly Arges grenades that are used in wars were blasted at the Awami League's Central Office on 23 Bangabandhu Avenue in broad daylight with the help of the then state machinery ". Judge Shahed Nuruddin further clarified, "The prosecution has been able to prove that the accused held meetings to conspire in different places before the incident and blasted grenades in a planned manner”.

Reportedly, all four men were charged of committing a terrorist act— “damaging the monetary stability of India through smuggling and circulation of the high quality FICNs under Sections 120-B, 489-B of the Indian Penal Code (IPC) and Sections 16, 18 & 20 of the Unlawful Activities (Prevention) Act [UA(P)A] 1967. The conviction is a result of NIA’s determination which has managed to get a life sentence for the four accused in a span of two years. Nasheed lives in self-imposed exile most recently in Sri Lanka after he was allowed to leave to the United Kingdom (UK) on medical leave in an internationally brokered deal following his imprisonment on terrorism charges. He was sentenced to 13 years in prison over the arbitrary arrest and subsequent detention of a sitting judge while he [Nasheed] was President. Nasheed's return on November 1 was announced days after the opposition alliance secured a surprise victory in September 2018 Presidential elections. The Supreme Court on October 31 overturned the conviction of Asia Bibi, a Christian facing execution for blasphemy, reports Daily Times.A three-judge bench headed by Chief Justice Mian Saqib Nisar, with Justice Asif Saeed Khosa and Justice Mazhar Alam Khan Miankhel its members, had reserved its ruling on Asia Bibi’s final legal appeal against execution on October 8.“The appeal is allowed. She has been acquitted. The judgement of the high court as well as the trial court is reversed. Her conviction is set aside,” the Chief Justice said while announcing the verdict to a packed courtroom. “She is to be released forthwith if not required in any other case,” he added. The 56-page detailed judgement was authored by Chief Justice Mian Saqib Nisar, with a separate concurrent opinion note from Justice Khosa.“It is a well settled principle of law that one who makes an assertion has to prove it. Thus, the onus rests on the prosecution to prove guilt of the accused beyond reasonable doubt throughout the trial,” the order noted. “Presumption of innocence remains throughout the case until such time the prosecution on the evidence satisfies the court beyond reasonable doubt that the accused is guilty of the offence alleged against him,” it added.“Keeping in mind the evidence produced by the prosecution against the alleged blasphemy committed by the appellant, the prosecution has categorically failed to prove its case beyond reasonable doubt,” the verdict concluded. “It is not for the individuals, or a gathering (mob), to decide as to whether any act falling within the purview of Section 295-C has been committed or not, because as stated earlier, it is the mandate of the court to make such decision after conducting a fully qualified trial and on the basis of credible evidence brought before it,” it maintained.“Blasphemy is a serious offence but the insult of the appellant’s religion and religious sensibilities by the complainant party and then mixing truth with falsehood in the name of the Holy Prophet Muhammad (Peace Be Upon Him) was also not short of being blasphemous,” Justice Khosa said in his note.

It is pertinent to note that the Peshawar High Courthas suspended the convictions awarded by military courts in various cases. The Chief of Army Staff had confirmed the death sentence of the convicts; however, the families of the convicts had challenged the order in the court and it had stayed their execution.

The Criminal Court Judge Adam Arif granted a conditional release based upon their treatment during the detention and the government’s failure to respond to it. Both were arrested in September 2017 and were charged in November 2017. The pre-trial hearings began in early January 2018 where the Court ordered their detention for the duration of the trial.

The convicts were awarded the punishment for their direct involvement in genocide and crimes against humanity perpetrated in three upazilas -Lakhai of Habiganj, Nasirnagar of Brahmanbaria and Astogram of Kishoreganj. Liakat Ali, 63, former president of Lakhai upazila AL, and Aminul Islam alias Rajab Ali, 62, of Astogram upazila, are now on the run. Liakat was a commander of local “Razakar Bahini” and Aminul a commander of local “Al-Badr Bahini”. They, however, used to move together in the localities and had a nexus with the Pakistan army stationed in Astogram. Both Razakar and Al-Badr Bahini were auxiliary forces of the Pakistan army in 1971.

Counter Terrorism and Transnational Crime (CTTC) unit arrested these individuals on the charge of spreading terror propaganda among Rohingya refugees in Cox's Bazar in the guise of a Non Governmental Organisation (NGO) named Small Kindness Bangladesh (SKB). CTTC officials said the NGO, which was spreading terror propaganda in the name of humanitarian activities in the Rohingya camps, was banned by the NGO Affairs Bureau for its alleged involvement in militancy financing as well as conducting anti-state activities in August. Despite the ban, the NGO was operating its activities. Pakistan-based Al-Khidmat Foundation, an organisation that has connections with terror outfits Al-Qaeda and Lashkar-e-Taiba (LeT), was operating militant activities in Rohingya camps through the NGO, the investigating officials claimed.

The Apex court issued an interim order staying operation of the Gazette proclamation issued by the President dissolving the Parliament until December 7, 2018. The court granted leave to proceed for all the Fundamental Rights petitions heard and the case has been fixed for argument on the on December 5, 6 and 7 of 2018. The court also ordered the independent Elections Commission to halt preparations for the snap election scheduled for January 5 next year. The Supreme Court ruling means the Parliament can be convened and a floor test can be taken to determine whether the President appointed Prime Minister Mahinda Rajapaksa has a majority in the 225-member Parliament.

According to the Police case, these militants identified as Jameel Ahmed alias Abu Chargam, son of Mohd Sadiq of Abatabad and Abdul Majid alias Abu Tala, son of Mohd Ahmed of Sind Pakistan were arrested in Manjakote area of Rajouri District on March 10, 2007 along with two local guides. During the course of investigation, it came to the fore that Abdul Majid and Jameel Ahmed joined the militant organization LeT and took training in the camps in Pakistan. They entered Indian territory through Mumbai from where with the help of local guides reached Chandigarh where accused were given forged election cards to dodge the Security Forces (SFs). The photographs of Lashkar-e-Toiba (LeT) training camps in Sindh and motorboats used by the 10 terrorists who attacked Mumbai are among evidence presented to an anti-terrorism court on December 8 conducting the trial of seven Pakistanis charged with involvement in the 2008 strikes, reports The Hindu. Officials of the Federal Investigation Agency (FIA) presented the evidence to anti-terrorism court Judge Chaudhary Habib-ur-Rehman during a hearing conducted behind closed doors in Adiala Jail in Rawalpindi. The motorboats and other items, currently in the custody of the FIA custody, were recovered in January 2009. The articles presented by the FIA officials were made part of the judicial record after an initial examination by the judge. The FIA officials told the court that the terrorists involved in the attacks trained in the Arabian Sea on boats named Al-Hussaini, Al-Atta and Al-fouz. They also trained in LeT camps in Mirpur Sakro area of Thatta District in Sindh and Yousaf Goth and Landhi areas of Karachi, the officials said. These training camps covered an area ranging between 25 acres and 48 acres, the officials said. One of the seven suspects currently on trial, Hammad Amin Sadiq, had confessed that the 10 attackers had been kept in the training camps before being sent to Mumbai, the officials said. Sadiq acted as a facilitator for the attackers while they were in Sindh, the officials said. Among the seven Pakistani suspects is also Zakiur Rehman Lakhvi, the LeT's ‘operations commander’. Special Prosecutor Chaudhary Zulifqar Ali had told PTI that the FIA officials recorded their statements and provided details of 350 articles found in the LeT training camps, including life jackets and a "pink foam" or pink colored packaging material. The "pink foam" has emerged as a crucial piece of evidence in investigations of the Mumbai attacks on both sides of the border. Indian investigators found samples of the material at three sites where attackers planted bombs in Mumbai in November 2008.

The Bongaon Court of 24 North Parganas in West Bengal, on December 15 has announced capital punishment for a Lashkar-e-Taiba (LeT) operative--Sheikh Sameer, for his terrorist activities termed as ‘waging war against India’, reports The Asian Age. After the announcement of his death penalty, Sheikh Sameer claimed himself as an innocent. On April 3, 2007, Sameer and other two LeT operatives--Mohammad Yunuis, and Sheikh Abdullah (both Pakistan nationals) were arrested by the Border Security Force (BSF) officials after they crossed the India-Bangladesh Border. The BSF officials recovered fake Voter ID cards of India, fake Driving License, fake Passports and Visa, Indian and United State (US) currencies from them. The BSF handed-over their custody to the Police and further they were charged with the Sections 121 and 121A of the Indian Penal Code [IPC], with possession of arms, ammunitions and huge quantities of explosives. In 2014, Sameer managed to escape while taking over to Maharashtra for the investigation of another case. In 2017, the National Investigation Agency (NIA) officials arrested Sameer in Patiala in Punjab in a case (undisclosed).

The Special Court allowed 12 days of remand of the accused to the NIA. The interrogation will focus on the details of how the group was formed nearly four months ago, the background of the arrested individuals who do not seem to have previous criminal antecedents, the possible source of procurement of weapons and explosive substances, and the specifics of the vital installations and persons they were planning to launch fidayeen attacks against. The Chief of Army Staff (CoAS) General Qamar Javed Bajwa on December 28 ratified the death sentences awarded to 22 hardcore terrorists, reports Dawn. The Inter-Services Public Relations (ISPR) said in a statement that the convicts were reportedly involved in heinous terrorist offences, including attacks on armed forces, law enforcement agencies, explosions of vehicle-borne improvised explosive devices (IED) to carry out sectarian killings, destruction of communication infrastructure, police check posts, educational institutions, and killing of innocent civilians. The convicted terrorists were responsible for the deaths of a total of 176 people, including 19 armed forces personnel, 41 police and Levies officials and 116 civilians, and causing injuries to 217 others. Arms and explosives had also been recovered from their possession. Special military courts had awarded death sentences to these convicts. The courts also handed down imprisonments to 15 convicts and acquitted two accused after finding them not guilty. All 22 of the terrorists were found to be members of banned organisations. They confessed to their offences before a judicial magistrate and in their statements during their respective trials, according to the ISPR.
