The Constitutional Committee under the Constituent Assembly, scheduled to complete its first preliminary draft of the constitution January 3, failed to do so after leaders, including those from big three parties, declined to sign the draft, reports Nepal News. The draft was prepared after finalising the contentious issues through voting some days back. Leaders say alternative views were not incorporated into the draft. However, committee chairman Nilambar Acharya informed the members during its meeting that since the issues were finalised through voting, alternative views cannot be included.

Kantipuronline reports that speaking at the ongoing central committee (CC) meeting at the party headquarters in Koteshwor on January 4, the Unified Communist Party of Nepal-Maoist (Unified CPN-Maoist) CC members said that federalism should be discussed in detail as it is a very sensitive subject. Maoist spokesperson Dinanath Sharma said that the party could rethink its earlier decision to announce the autonomous states by holding discussion with other political parties. “Our party is ready to reconsider about the autonomous states being based on ethnicity, sex, region and geograpghy,” said Sharma.

The Unified Communist Party of Nepal-Maoist (Unified CPN-Maoist) agreed in principle to integrate PLA combatants with Nepal Army within four months as per the action plan proposed by Prime Minister (PM) Madhav Kumar Nepal. The Maoist leadership agreed on the proposal submitted by committee coordinator and PM Nepal at the meeting of the Special Committee on the Supervision, Integration and Rehabilitation of former Maoist combatants held in Singhadurbar. The prime minister had presented an action plan to settle the protracted issue of army integration on January 5. According to the committee spokesperson, Madhav Ghimire, the meeting discussed integration of PLA combatants within the time frame of 112 days.

Nepal News reports that the big three parties - Unified CPN-Maoist, CPN-UML and Nepali Congress (NC) - have announced the formation of High Level Political Mechanism (HLPM) in the morning of January 8 (today). NC parliamentary party leader Ram Chandra Poudel told reporters after the meeting of the top leaders that the mechanism at its preliminary phase includes NC president Girija Prasad Koirala, Unified CPN-Maoist chairman Pushpa Kamal Dahal and CPN-UML chairman Jhala Nath Khanal. The top leaders from the three parties concluded to form the mechanism during a meeting held at Koirala’s residence in Maharajgunj. Poudel said formation of mechanism has opened the doors for peace process, constitution writing and ending the months-long political uncertainties.

Hours after agreeing to join a high-level political mechanism, which is widely seen as a breakthrough in the efforts to find an outlet to the protracted political impasse, Unified Communist Party of Nepal-Maoist (Unified CPN-Maoist) chairman Pushpa Kamal Dahal aka Prachanda warned that his party would launch 'people's revolt' if the country does not get a new constitution on time and the peace process gets derailed, reports Nepal News. Addressing a programme organised by the local civil society in Biratnagar in the afternoon of January 8, Prachanda said Nepali people would take to the streets if a scenario, which might derail the peace process and scuttle the constitutional-making drive, is created in the country. He added that the parties should be careful not to invite such a scenario. Prachanda also raised objection to Prime Minister Madhav Kumar Nepal's statement on January 7 that the Maoists would face the fate of the Tamil Tigers of Sri Lanka if they continued to engage on violence and intimation. Speaking at the same programme, Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) chairman Jhala Nath Khanal stressed the need for consensus among the parties to write new constitution and conclude the peace process. Likewise, Nepali Congress vice-president and parliamentary leader Ram Chandra Poudel said peace process should be the main priority at the moment. Alluding to the recent statements of the Maoist leaders, Poudel maintained that the threat of power capturing and ethnicity-based federalism will not help the peace process.

The breakaway faction of the Unified CPN-Maoist made such claims amid a function in Dhankuta District, a day after the discharge of disqualified Maoist combatants began. CPN-Maoist District secretary Sudarshan said that there has been an increasing trend among the former rebel fighters to walk out of the cantonments and join the party. The Matrika-led Maoist had postponed its plan to make public its "people’s army" as announced earlier. Sudarshan said the army publicising programme would be held on February 7. Chhetri said that 30 trucks loaded with INSAS Rifles and bullets, 50 trucks and eight Jeeps with green (allocated for tourism related industry) unmarked number plates, four Mahindra Jeeps, two ambulances, one fire brigade and one crane have entered Nepal through Sunauli border in the night and are kept at the no. 22 Brigade of Nepal Army in Butwal. Peace Minister Rakam Chemjong on February 22 declared that the Government would determine the number of Maoist combatants to be integrated into the national army taking into account the number of weapons verified by the United Nations Mission in Nepal (UNMIN). As per the UNMIN records, the number of weapons with the Maoists is 3400. Though the Maoists are demanding integration of UNMIN-verified 19,602 combatants, the Government is reluctant to take up all of them in the Nepal Army. "Since UNMIN has verified only 3400 weapons of the Maoists, the same number could only be integrated,” the peace minister said. He said that the political parties agreed on a two year time period for constitution drafting after reaching a political consensus and that it was not a mandate from the people. "If the interim constitution doesn't get amended by May 28, only Constituent Assembly [CA] will be rendered inactive but the legislature-parliament will continue to function," he said, adding, "And when the interim constitution gets amended with a 2/3rd endorsement from the Parliament, the Constituent Assembly will automatically become active again." Himalayan Times quoted him as saying that the new constitution will be promulgated from the CA, not from the streets, adding, “Consensus can be forged through collaboration, agreement and talks, not by street movements.” He stressed, “It won't be a stateless situation after May 28.” The Interim Constitution provision that the new constitution shall be drafted by May 28 was incorporated on the basis of consensus and thus the CA tenure can be extended through consensus, he added. Expressing hope that the CA term will be extended, Pokharel said the Government is holding talks with political parties for the same. "It's not a question you have so many qualified people. There are so many armed groups. What happens if all of them demand integration of their combatants into the army," said Nepal. "If we accept the Maoist demand for bulk integration, one phase of conflict will end, but another conflict (with other armed groups) will begin," he added. PM Nepal also claimed, the issue of fixing the number of combatants to be integrated is the only major hindrance to a consensus. Progress towards consensus is stranded on the issue of army integration, he explained. Quoting the insiders of the Unified Communist party of Nepal-Maoist (UCPN-M), Kantipuronline reports that the two groups led by Pushpa Kamal Dahal aka Prachanda and Baburam Bhattarai will spur heated discussions in the upcoming Central Committee of the party. The Central Committee (CC) meeting scheduled for August 10 has been postponed to August 11 on the ground that more time is needed for completing preparations for the event. Both factions of the leaders supporting Chairman Prachanda and Vice Chairman Baburam Bhattarai are impatient to “vent their ire” against each other. “The meeting is likely witness heated discussions and is also expected to thrash out several crucial issues,” said a Maoist leader. Both Dahal and Bhattarai have serious disagreements over several crucial issues pertaining to internal party politics, Government formation and the peace process.
