Shrestha said no general or blanket amnesty will be offered to those who had committed crimes of rights violation during the decade-long insurgency. The general convention of the newly formed CPN-Maoist-Baidya party kicked off in the Kathmandu on January 9, reports Myrepublica.com. This is the party´s first general convention following its split from the UCPN-M in June 2012, the 7th in the history of the party and its mother party, and the first in 21 years. Altogether 1,200 representatives, 400 observers, 300 volunteers and 100 cultural artists are participating in the convention. The five-day convention will conclude on January 13. Representatives of fraternal communist parties from 11 countries including USA, India, Turkey and Canada, who were also present, expressed their good wishes and solidarity. Addressing the opening session of the 7th General Convention at Khula Manch, Chairman Mohan Baidya declared that fresh constituent assembly (CA) elections were not possible in the present context and blamed the major parties for the existing political scenario.

Nine parties in opposition, including the Nepali Congress (NC) and Communist Party of Nepal - Unified Marxist Leninist (CPN-UML), on January 15, made public their 21-day protest programmes beginning from January 19, reports The Himalayan Times. The opposition parties blamed the Government for repeatedly violating law of the land, misusing state coffers, abusing power and blocking the process to form consensus Government. They said they would continue holding talks with the ruling alliance on the sidelines of their protests in a bid to form a consensus Government. The opposition parties, which had launched their protests against the Government two months ago, had put off their agitation programmes after President Yadav made a formal call to the parties to form a national consensus government under Article 38 (1). “If the government does not step down during our first phase of agitation, we will announce stronger protests,” said NC Vice-president Ramchandra Paudel.

The opposition parties declared protest programme to topple the Bhattarai-led Government through street protests as he has been refusing to put in his papers. They have even formed the Protest Coordination Committee comprising District chiefs of all the nine parties. According to the protest programme schedule, they will stage joint protest rally and meet in Biratnagar’s Janaandolan Chowk on January 25. A motorcycle rally would be staged in front of stadium at 1 pm on January 29. Similarly, the political parties would organise horn rally on January 31 and February 1. Leaders of four major political parties have claimed that formal agreement on Chief Justice Khil Raj Regmi-led Election Government is around the corner, reports Nepal News. Emerging from a meeting of four parties in the evening of March 7, the leaders said they had resolved all sticking points except for the ranks to be given to the former Peoples Liberation Army (PLA) combatants to be integrated into the Nepal Army. In the meeting, the parties resolved the differences on formation of the Truth and Reconciliation Commission (TRC) and updating of voter list. As per the understanding, the TRC ordinance won't have provision for amnesty to those involved in serious human rights violations during the Maoist insurgency while the voter list used in the elections in 2008 will be updated. They said a package agreement is going to be signed between the four parties "in a day or two". "There will be formal agreement on ways to remove the constitutional hurdles on Friday or Saturday and the new Prime Minister will be sworn in -- possibly on Friday [March 8] itself," said Unified Communist Party of Nepal-Maoist (UCPN-M) vice chairman and Deputy Prime Minister Narayan Kaji Shrestha.

The petition filed by Advocate Subhas Acharya was first scheduled for hearing on March 18. Legal experts have termed as ‘unusual’ the deferring time and again of hearings at the SC. Stating that there is a provision in the SC regulations for priority hearings in cases of constitutional import, former justice Balram KC said that such cases should have given priority for hearings. Senior Advocate Harihar Dahal sees two possible reasons behind the deferral of hearings on the writ petition. “First, there might be the influence of the executive [which is currently led by the chief justice] on the judiciary,” said Dahal. “Secondly, the apex court might be thinking that it is better not to enter into a political issue.”

This is not the time to be looking for an alternative to the Regmi-led government, but a time to cooperate among each other for fixing the date for fresh elections, he added. Dahal claimed that a date for the Constituent Assembly (CA) election would be announced on May 29 (today) so that the poll could be held in the third week of November. While the Government brought to an end the dispute over contentious provisions in a poll ordinance, it also formed a Constituency Delimitation Commission (CDC). The ordinance formulated to amend the Constituent Assembly Member Act-2008, has been forwarded to the President for promulgation after the threshold for securing seats under the proportional representation system was removed. The major parties were at loggerheads over the one percent threshold that the Election Commission (EC) had set. According to the provision, parties failing to secure one percent of the total votes would be ineligible for seats under the proportional representation system. The Government said that the threshold was removed to ensure participation of all political parties in the constitution-making process.

According to EC officials, the constitutional body has already set out work procedures to check the authenticity of voter signatures submitted by the new political parties which were not represented in the former CA. Political parties that had sent elected representatives to the then CA must submit their respective manifestos, statutes, regulations, flags and election symbols, among other things, while each of the new political parties must also submit the signatures of 10,000 voters in order to be registered at the EC. Likewise, political parties represented in the former CA should submit a letter from the Parliament Secretariat as evidence of their representation. As per the work procedures, the EC will check the authenticity of 200 voter signatures selected randomly. The EC will match the signatures against signatures in the new electoral rolls it has prepared. Similarly, the constitutional body will verify the citizenship certificate numbers.

Chief Election Commissioner Neel Kantha Uprety on September 18 said “We will try to manage a few more days for candidacy nominations if it is technically possible. We will most probably make our views public by tomorrow.” The EC has set aside September 23 and 26 for political parties to nominate their candidates contesting the election under the first-past-the-post and proportional electoral systems respectively.

Mohan Baidya-led Communist Party Nepal-Maoist (CPN-Maoist-Baidya), the only major force opposing the November election, has launched a massive nationwide campaign to collect funds to finance its anti-election activities, reports Kantipuronline.com on September 25 (today). The party has sent electronic messages, letters and made threatening phone calls, demanding donation from individuals, state-owned institutions and private companies, including schools, banks, manpower agencies and industries. CPN-Maoist-Baidya leader Haribhakta Kandel admitted collecting ‘monetary assistance’ from the business community. Though he said the way they are collecting funds does not amount to extortion, those who received the letters and the phone calls said it was clear extortion. An official of a leading commercial firm in Narayanghat District said “We have received some emails from CPN-Maoist cadres, demanding money and they have also made follow-up calls which sounded very threatening. They have also said that the staff will have to raise the money themselves if the firm fails to pay the party.”

President Yadav invoked Article 158 of the Interim Constitution to remove the constitutional difficulties for the army mobilization, in line with the Government recommendation that was made on September 23.
