Addressing an event organised by Mahotari Pariwar Kathmandu on January 3,to felicitate chief justice Ram Kumar Prasad Shah, Prime Minister Sushil Koirala said he believed that the new constitution would be out on its January 22 schedule as a consensus between the main parties will be reached in the next three days, reports Nepal News. “After the Speaker put his hand up, all the parties have felt that it is us who should show some initiative. On January 5, speaking at an interaction program in Kathmandu, Nepali Congress (NC) leader Dip Kumar Upadhyay said that a draft constitution has to be readied by January 22, 2015 and a full-fledged constitution has to be issued by May 29, 2015, reports Nepal News. Upadhyay said, “It is not possible to issue a constitution on January 22. Therefore, we have to make adjustments. Parties are narrowing differences on forms of governance, electoral system and judiciary. Disputes are there only about the delineation of provincial borders. We will soon reach an understanding in this regard.”

The Communist Party of India-Maoist (CPI-Maoist) on January 5 called out to people to "condemn and boycott" the visit of US President Barack Obama to India to be the chief guest at the 65th Republic Day celebrations on January 26, 2015, reports The Times of India. "In protest of calling him to be the chief guest at the at the Republic Day celebrations, we call upon people to observe 26th January as a day of protest and to boycott all the meetings," a written statement issued by the Dandakaranya Special Zonal Committee of the CPI-Maoist, dated January 5, said. Statement issued by the Maoist spokesperson Gudsa Usendi said rallies will be organized across the country with the slogan "Obama go back." Calling President Obama "the gang leader of American imperialism" the Maoist statement says "American imperialism is the number one enemy of the oppressed masses and nationalities of the world. It is the biggest terrorist and its gang leader. Obama has no moral right to touch down on our mother land," Usendi stated on behalf of his party. The Maoists also plan to distribute pamphlets, put up posters, banners, hold meetings and demonstrations and burn effigies of President Obama and Prime Minister Narendra Modi to register their protest and in an effort to reach out to the masses in cities as well as in villages.

In a meeting of the 30-party alliance on January 5, that he leads, Dahal said Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Chairman KP Oli in particular wanted to promulgate the constitution by January 22 in his rush to "ascend to power". In what could be a positive step for promulgating a constitution within the deadline, Pushpa Kamal Dahal aka Prachanda, Chairperson of the Unified Communist Party of Nepal-Maoist (UCPN-M), has said that he would not be a hurdle for issuing a constitution on the stipulated date of January 22, 2015, reports Nepal News. “On moral grounds, I can’t stop a constitution on Magh 8 (January 22),” Dahal said, while talking with the Lawmakers’ Pressure Group for a Timely Constitution on January 7. “I have been playing an active role for a constitution in time. Rumours that I am obstructing the process are baseless,” Dahal said, adding that at least a draft constitution has to be released on January 22 after forging consensus of major political parties on key issues.

The Madhesi Janadhikar Forum-Nepal (MJF-N) decided to put forth the common proposal of 30 political parties as its precondition for consensus, reports Ekantipur.com. A meeting of the party’s political committee on January 7, decided to seek assurance on the implementation of the past pacts signed with the Madhesi parties and the provisions pertaining to federal set-up mentioned in the interim constitution. “The MJF-N has taken the 22-point agreement signed between Nepal government and Madhesi Janadhikar Forum-Nepal and the eight-point pact signed with the alliance of Madhes-centric parties and the report of state restructuring commission, along with the provisions of federalism mentioned in the interim constitution, as the bottom line,” read a statement issued by MJF-N Chairman Upendra Yadav. Expressing solidarity with the concept of federalism based on ethic-identity, Madhes province with right to self-determination, proportional inclusiveness, the MJF-N has decided to take ahead the talks regarding the constitution drafting process on the basis of common proposal of 30 political parties.

On January 08, Madhesi parties snubbed cross-party meeting seeking apology from CPN-UML Chairman KP Sharma Oli saying that his remarks on federalism had hurt their sentiment, reports Ekantipur.com. “We boycotted the meeting as Oli has not furnished his apology,” said Sadbhawana Party Chairman Rajendra Mahato, who had a heated exchange with Oli when the latter remarked that every plain land cannot be part of Madhes. Madhesi leaders had walked out of the meeting after Oli opposed their call to split Jhapa, Morang, Sunsari, Kailali and Kanchanpur Districts while federating the country. A meeting of the Madhesi Morcha had decided not to sit with CPN-UML for talks until it apologised for Oli’s “humiliating” remarks. Oli, however, said he would not apologise at any cost. “I was presenting my views decently but they abruptly walked out of the meeting,” Oli said after a three-party meeting in Baluwatar, Kathmandu on January 8. “Convey my message that KP Oli won’t apologise as long as he’s alive.”

Senior Unified Communist Party of Nepal-Maoist (UCPN-M) leader Baburam Bhattarai has apologised to the people for failing to deliver the new constitution on time as promised, reports Ekantipur.com. “As per the commitment to promulgate the new constitution, I take the responsibility on my part and apologise from my heart,” he said in a statement on January 22. "We were near consensus on key intricacies of the constitution but it's sad to say that we could not conclude them on time. There are still chances of consensus and only a constitution drafted in accord will ensure lasting peace in the country," he said. He added that the constitution could be promulgated in consensus in a short-cut way and there should be no division between the forces who fought together for the latest political gains.

Koirala urged all the parties to make the constitution writing process a success through the Constituent Assembly (CA). “I want to urge all the political parties to come together for the promulgation of a democratic republic constitution with national unity and reconciliation,” Koirala said. He said timely promulgation of the constitution is necessary to end the prolonged stalemate. After having deferred the CA meeting for more than two months, Nembang made it clear at the CA meeting on April 23 that he would move ahead as per the report submitted by Questionnaire Committee. However, again the CA meeting scheduled to be convened on April 23 has been put off for the next seven days, and the next meeting is slated for April 30 for the last time to forge consensus on the disputed issues of constitution writing as the CA’s priority is still agreement. Addressing the CA meeting, Nembang said the CA is still in favour of consensus but there will be no other option but move ahead as per the established norms, law and tradition if the parties failed to solve the disputes through consensus. The three major parties— Nepali Congress (NC), Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and Unified Communist Party of Nepal-Maoist (UCPN-M)—had agreed on April 20 to initiate drafting process on already agreed upon issues and continue discussions on the disputed issues. Committee member Ram Narayan Bidari said it has been difficult to expedite the task of writing the preliminary draft to the desired extent as the draft of the constitution has to be written in simple language keeping the views and aspirations of all in mind. The members of the taskforce said there were no differences as such in the taskforce, in course of drafting, regarding the topics on which consensus has been built, and that intensive and wide-ranging discussions have been held on the topics to be incorporated and how this is to be done in the Preamble, Section, Articles and Sub-articles of the constitution and these topics were being finalised. The taskforce has been taking the formal and informal views and suggestions from the constitutional experts and lawyers as well in the course of giving final shape to the draft of the constitution. In the interim, Committee secretary Rabi Aryal said the taskforce would prepare the draft even late tonight (June 22) so that it could be presented in the committee’s meeting scheduled for June 24.

The CA chairman, during his meeting with the President at the President office in Shital Niwas, Kathmandu, briefed the Head of State that the work related to the constitution writing was going ahead in an expeditious manner and has reached the draft writing stage, and the committee was working day and night to take it to a conclusion at the earliest. On the occasion, President Yadav reiterated on moving ahead maintaining balance of power and cordiality among the Executive, the Legislature and the Judiciary, not to escalate dispute and to keep patience. CA chairman Nembang told media persons that during the meeting, the President pointed out the discord seen between the court and the parties, the Executive and the court and the CA and the Judiciary as of late, urging that it should not happen. Speaking at the inaugural ceremony of BP Highway at Dhulikhel in Kavrepalanchowk District on July 3, PM Koirala said the new constitution would be promulgated at any cost. Stating that establishment of federal republicanism in the country was not a minor issue; and the time has come to institutionalise the achievements gained from the people's movement. PM Koirala further said that there would be drastic change in the country within the next 10 years if there would be good governance, transparency, accountability and corruption-free in the country. He urged the Madhesi Alliance not to doubt the issue of federalism, saying the development and construction works could not gain momentum in the country due to lack of constitution. When four Madhes-based parties are boycotting discussions in the CA, the Unified Communist Party of Nepal-Maoist (UCPN-M) said that the delineation of federal units should be decided before constitution promulgation, reports Ekantipur.com. The main opposition party has presented its position in informal meetings with the Nepali Congress (NC) and the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML). Citing the changed circumstances, the party argues that it is better to settle the demarcation as the constitution draft undergoes modifications over the next few weeks. The UCPN-M believes that state demarcation could be decided within a month if the two ruling parties take it seriously. Maoist Vice-chairman Narayan Kaji Shrestha said it was improper to decide the numbers before laying out other details. “The demarcation should be guided by some principles, which in turn decide the number,” said Shrestha. There are growing voices in the NC and the CPN-UML as well that delineation should be decided before the new charter gets its final shape.

Defending the draft constitution and spirit of 16-point agreement, Oli said the draft charter was a progressive document and he will do his best to improve by taking other parties into confidence. “Otherwise we have to compromise on it as the constitution drafting will become a number game this time too. We need a two-third majority to promulgate the new constitution while our party commands just a one-third votes,” said Oli. Besides, disgruntled Madhes-based parties have been pressing for demarcation of federal states before statute promulgation. Further, The UCPN-M demanded revision to the preliminary draft of the new constitution, claiming that the Constitution Drafting Committee (CDC) made a number of mistakes while putting the issues together. In a letter submitted to the CA chairman, the main opposition party said the committee overstepped its jurisdictions and violated the directives issued by the CA. In a letter submitted to top leaders of four major parties, NC leader Nidhi, who is also the minister for Physical Infrastructures and Transport, said the provisions in the preliminary draft Constitution are not appropriate as they fail to take into account the practical difficulties of cross-border marriage common in Tarai Districts. "Women, in our culture, live in their husband's houses after marriage. This should not be overlooked. The proposed provision on citizenship is unscientific, humiliating and discriminatory to women," said Nidhi. "The proposed draft constitution says only those Nepali citizens who have acquired citizenship by decent would be eligible for the posts of president, vice president, prime minister, speaker, deputy speaker, chief minister and chiefs of security agencies. This is not appropriate," he said. Nidhi has urged top leaders of major political parties to retain the provision in the Interim Constitution with regards to delineation of electoral constituencies.

Suspending the Constitution-making process or adopting a go-slow policy could be the initial steps towards preventing the country from a disaster. Withdrawal of Nepali Army mobilized in the riot-hit areas and release of arrested protesters would help create an environment to bring the agitating parties to the negotiation table, he said. “Agitating communities, mainly Madhesis, Magars and Tharus, are not demanding separate provinces. They want their issues of identity to be addressed. It can be ensured by creating clusters of dominant communities and terming them special protected zones,” Koirala said, adding that he had reached this conclusion after holding discussions with the Madhesi, Tharu and indigenous Constituent Assembly (CA) members of NC. “Newar, Rai, Limbu, Tamang, and other castes have not demanded separate provinces as their clusters are addressed in the seven-province model. The commission claimed that its investigations found the involvement of ex-Maoist combatants in the crowds of protesters who came to Tikapur from Joshipur village on the day of the carnage. NHRC has also said that most of the protesters were of a young age. Minister Pandey said although a few Madhes-based parties have taken to the streets there has been adequate representation from the region in the CA. "Out of 240 directly elected members, 122 represent the people of 20 districts in Tarai-Madhes. Of them, 110 members are participating in the process. Only 12 elected members have chosen to be out of the process," he said while informing diplomatic community that there has been adequate representation in the statute making process. Of the total 601 members in the Constituent Assembly, 240 members are elected under the First Past the Post electoral system while 335 are elected on the basis of proportional representation. Likewise, there is a provision to nominate 26 members from the cabinet. "As regards to the members elected on the basis of proportional representation, more than 80 members representing the Tarai-Madhes based ethnic communities are actively participating in the process," the minister said.

Issuing a press release in Kathmandu on September 17, UDMF said the new Constitution would not bring an end to inequality and discrimination against the marginalised community and the front would organise silent walk with black flags across Madhes to protest the promulgation of new Constitution on September 20. UDMF stated it would also impose a blackout from 7:00- 8:00pm on September 20, the day the constitution would be promulgated to counter major parties, who have announced that they would celebrate the promulgation of new Constitution with Deepawali. The front also decided to form a working alliance with forces that disagreed with the constitution-making process and those who quit the constitution-making process. It also decided to torch the copies of the new constitution on September 21. Around 110 federal laws, 22 provincial laws and six laws related to local bodies will have to be enacted and around 315 existing laws will have to be amended to make them compatible with the new constitution, said Minister for Law, Justice and Parliamentary Affairs Agni Prasad Kharel at a press meet organized by the Ministry. “As it is not possible to draft all the laws simultaneously, the ministry will prioritise them and the most essential laws will be drafted first. Since, the process of making provinces will take time, the related laws will be drafted later,” Kharel said. It will take minimum three years to draft and review all laws if there are no technical difficulties, said Bhesh Raj Sharma, secretary at the Ministry.

Four parties under the UDMF alliance met on December 22, to discuss the three-point proposal forwarded by the government after a consensus between major parties. "The proposal is unclear, vague and visionless as it fails to address the 11-point demand forwarded by the UDMF as well as raised by Madhesi, Muslims, dalits indigenous communities like janajati, Tharu and women," stated the UDMF issuing a press release after the meeting. The UDMF argued that the proposal has envisaged that the constitution amendment bill could address its demands of proportionate representation and delimitation of electoral constituencies on the basis of population but the bill itself is unclear, vague and incomplete. "The front has already rejected the proposal during the talks in the initial period stating that the proposal creates confusions among the people and mislead them," stated the UDMF. "The ongoing protests will continue until the demands on citizenship provisions, delimitation of electoral constituencies and proportionate inclusions are met, and the provincial boundaries are changed," the press release read further. The UDMF also urged the government to be serious about the 11-point demand. NC negotiator Mahesh Acharya said the CPN-UML should play a proactive role to end the Tarai unrest, but Prime Minister KP Sharma Oli was not doing the same. “Talks are not happening due to UML’s indifference,” he said and added that NC top leaders were touring districts to celebrate National Reconciliation Day but would intensify their efforts for talks after Friday when leaders return to the capital. Acharya said his party took the initiative to hold talks with the United Democratic Madhesi Front (UDMF) and narrowed down differences. “I think an agreement is possible on the constitution amendment bill and even on provincial boundaries; UDMF is ready to wait but they want a guarantee that provincial boundaries will be changed,” Acharya said. Meanwhile, Minister for Home Affairs Shakti Bahadur Basnet on December 31 said that the problem of Tarai unrest will be resolved with the Constitution Amendment proceedings in Parliament and that will pave the way for import management at the border points, reports The Himalayan Times. He said “The provincial boundary can be changed as per the all-party consensus within three months. There is no option but cooperation and mutual understanding among parties to deal with the existing problems the country is facing.”

Prime Minister KP Sharma Oli addressing a meeting organized by the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Mechi Zonal Committee in Jhapa District on December 31 has said that allocating the electoral constituencies on the basis of population is inappropriate, reports The Himalayan Times. He added that the premise itself was wrong as the constituencies could not be determined only on the basis of population and the geography of Nepal does not assure it. He further said that ongoing identity-based protests and movements were trying to disintegrate national unity.
