CPN-Maoist Centre leaders during the headquarters meeting of the party Centre on January 2 urged the party leadership to ensure that Pushpa Kamal Dahal becomes a powerful chief of the unified party if CPN-UML Chairman KP Sharma Oli is appointed the Prime Minister, reports Kathmandu Post. With a section of CPN-UML leaders advocating joint-leadership, Maoist members are vocal about Dahal’s full-fledged command after the parties unite. Maoist leaders argue that as the larger party in the alliance the CPN-UML should get to choose whether it wants the PM’s post or the unified party’s chair. Maoist leader Devendra Poudel said after the meeting that his party wants full-fledged leadership of the unified force if the CPN-UML goes for the PM’s post and vice-versa.

Reiterating its position, the Election Commission (EC) on January 3 said that it cannot announce the results of the House of Representatives elections under the Proportional Representation (PR) category before the National Assembly (NA) elections, reports Kathmandu Post. Amid criticisms from leaders of the left alliance and street protests from their sister organizations, the EC clarified its stance through a statement, saying that constitutional and legal hurdles prevent it from announcing the Lower House election results under the PR category despite its wish to do so at the earliest. “As per the Article 84 (8) of the constitution and Clause 60 (4) of the Act on Elections to House of Representatives, the EC is unable to announce the seats obtained by the political parties under PR category and write to the political parties to recommend candidates to be elected before the elections to the Upper House are held,” the EC said in the statement.

Truth and Reconciliation Commission (TRC)’s office in Province-1 has failed to meet its target in investigating the complaints related to the serious human rights violation during the Maoist insurgency, reports The Himalayan Times on January 5. The provincial office of the commission set up seven months ago was supposed to probe over 1,000 complaints. Investigation expert Mina Sedain at the office, however, attributed the below-expectation progress to the two elections. “The Commission had been entrusted with the investigation of 1,207 cases in the first phase but as there were elections one after another, we have so far investigated only 285 cases and sent them back to the commission’s central office,” she said, adding that they had, however, completed primary investigation of all conflict-era human rights violation cases.

As such, the leaders of both the Madhes-based parties are nudging the CPN-UML through both formal and informal channels to soften its stance toward their demands. While FSF-N Chairman Upendra Yadav has had several rounds of meetings with CPN-UML Chairman K P Sharma Oli, RJP-N senior leader Rajendra Mahato is also in informal negotiations with CPN-UML leaders Agni Kharel and others, according to sources.

The two Madhes-centric parties, the Federal Socialist Forum Nepal (FSF-N) and Rastriya Janata Party Nepal (RJP-N), are mulling over supporting the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), which is to form new Government as the largest party in the recently held parliamentary polls, reports My Republica on January 8. Senior leaders of the FSF-N and RJP-N said they are in informal negotiations with top leaders of CPN-UML for the formation of new Government. "We will support any party that assures us constitutional amendment. Parliamentary arithmetic after the election is such that bringing any amendment to the constitution is not possible without CPN-UML support," said RJP-N General Secretary Keshav Jha. The leaders of the two parties have assured the CPN-UML that they would support the CPN-UML to form Government if the party softened its stance on Constitution Amendment. They have demanded a clear assurance from the CPN-UML on amending Article 274 of the Constitution to pave the way for the formation of a new province and change the boundaries of provinces.

The conflict victims, on January 9, said members of Truth and Reconciliation Commission (TRC) should resign and join their movement if they could not do their job of investigating war-era human rights violations, reports The Himalayan Times. Stating that TRC was getting more perpetrator-centric rather than victim-centric, they said the members should come clean as to why they could not even investigate a single complaint in the past three years. “You give various reasons such as earthquakes, political situation in the country and internal feuds for your failure to investigate our complaints, but we are not here to listen to your complaints,” said Anita Gyawali of Arghakhanchi who lost her father during the Maoist insurgency. In a meeting between TRC officials and conflict victims in Kathmandu on January 9, she said, “If you can’t do your job, you do not have the right to continue holding the position.” The victims also said they felt that the TRC members were more concerned about their jobs rather than convincing the victims that they would get justice one day. “I have lost faith in TRC,” said Chandra Kala Adhikari of Gorkha whose husband was murdered during the armed conflict. “We’ve already faced a lot of trouble. And, it’s frustrating to know that you [TRC members] are enjoying your jobs selling our names.”

The Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre), have decided to begin formal negotiations to reach a deal on power-sharing for provincial Governments and other constitutional positions in a meeting between CPN-UML’s KP Sharma Oli and CPN-Maoist Center’s Chairman Pushpa Kamal Dahal held at the former's residence in Balkot, Bhaktapur on January 10, reports My Republica. The meeting ended with an understanding to pick Chief Ministers (CMs) for six provinces and select candidates for the upper house based on consensus. A joint taskforce comprised of leaders from both the parties has been directed to submit a detailed report on power-sharing based on the consensus reached between the two parties. Leaders said that the 60:40 percent divisions in organization will make it much easier to find a settlement on organization. But they pointed at a possible challenge in resolving the number of office bearers and other key positions due to a large number of aspirants. Though, the exact model of power-sharing remains unclear, the cross-party leaders said that there would be 60/40 division in leadership, party organization and other key positions. Both parties will have to select a handful of leaders from among multiple candidates for key positions. Powerful leaders from both the parties have been pressing their chairmen to secure them appropriate positions in the unified party.

International human rights bodies have said that mere extension of the terms of the Truth and Reconciliation Commission (TRC) and the CIEDP by one year without necessary legal and institutional reforms was likely to prolong the justice process, reports The Himalayan Times on February 13. Amnesty International’s South Asia Director Biraj Patnaik said “The net worth of these two bodies has now been tested by the victims who are deeply dismayed at not having been served truth and justice.” “Families and victims of Nepal’s decade-long civil war have waited far too long for answers, and cynical government attempts such as extending the mandate without broader reform as directed by the highest court is a further slap in the face. The two commissions have gathered a lot of documentation, but authorities seem more committed to protecting perpetrators than ensuring justice,” said Meenakshi Ganguly, South Asia Director at Human Rights Watch (HRW). “Now a member of the UN Human Rights Council, the international community has high expectations of the government of Nepal. It needs to commit to ensure that these institutions function independently and free from political interference,” said Frederick Rawski, Asia Director of the International Commission of Jurists.

Though both party chairpersons expressed their commitment to party unity, the leaders of CPN-Maoist Centre believe that the unity may take more time to materialize as the CPN-UML has been reluctant to allocate a respectable share to them.

Ministry of Law, Justice and Parliamentary Affairs Sher Bahadur Tamang at a press conference on June 26 said the Parliament would endorse all the 110 new laws to be enacted to ensure constitution implementation by September, reports The Himalayan Times. He said “There are 110 laws that need to be enacted to ensure constitution implementation. Of them, 37 are yet to be drafted. Some of the issues will also be addressed by the Civil and Criminal Code that comes into force on August 17. We have already issued theoretical approval to draft the laws to ministries, and the law ministry is continuously following up the issue with other ministries.”Meanwhile, Conflict victims and Human Rights defenders at an event organized by the Conflict Victims Common Platform (CVCP) in collaboration with the International Center for Transitional Justice (ICTJ) and Justice and Rights Institute Nepal in the Capital Kathmandu on June 26 raised serious objections to the proposed amendments to existing Transitional Justice law, mainly over concessions in penalties to convicted perpetrators of war era crimes, reports Kathmandu Post. CVCP Chairperson Bhagi Ram Chaudhary said the punishment recommended is unacceptable since it is just ‘symbolic’. He said “Though the draft lacks word amnesty, the proposed provisions ultimately are guided towards providing the amnesty. We want full revision in the draft after meaningful consultations with the victims.” Similarly, ICTJ Reparative Justice Programme Director Ruben Carranza said the draft has many conflicting and ambiguous provisions that need corrections. He pointed out that there are several flaws in the draft bill though it has some good provisions as well.

The main opposition Nepali Congress (NC) on July 5 accused the Government of running the state affairs in an arbitrary way, reports Republica. The party said the Government’s recent moves such as revocation of several appointments and other decisions of the erstwhile Government headed by NC’s Sher Bahadur Deuba were aimed at weakening the democratic system. NC Spokesman Bishwa Prakash Sharma said “The decisions taken by the previous government were taken by a government elected by parliament. Also, those decisions taken during the time when the election code of conduct was in effect were taken only after taking permission from the Election Commission. This is not a matter of any individual or an appointment. This is an issue of an established legal process. In this case, the government has breached the law, which is serious.”

Six top leaders of Nepal Communist Party (NCP) have accused the party Chairmen KP Sharma Oli and Pushpa Kamal Dahal, and General Secretary Bishnu Poudel of undermining the role of the party secretariat, reports The Himalayan Times on August 4. According to party sources, the six disgruntled leaders — Madhav Kumar Nepal, Jhalanath Khanal, Narayan Kaji Shrestha, Bamdev Gautam, Ishwar Pokharel and Ram Bahadur Thapa — said that Oli, Dahal and Poudel had ‘hijacked’ the role of the party’s secretariat. The newly enacted statute of the party states that crucial decisions should be taken formally by the party’s secretariat, but these three leaders have been flaunting this rule, said party sources, adding that most of these decisions were taken at the prime minister’s official residence in Baluwatar. They also claimed that sometimes Deputy Parliamentary Party leader Subas Chandra Nembang was consulted. “We need to discuss some serious national issues and chart our future course accordingly. However, we have not been able to do that,” said a confidant of one of the six disgruntled leaders requesting anonymity.
