Speaking at a programme in Kathmnadu, Prachanda said, "The reports appearing in the media that our party has decided to take disciplinary action against Bhattarai are false. We have not taken any decision on this regard yet." There are some issues related to Bhattarai's dissatisfaction in the party, but such issues are always common in any left-wing and the UCPN-M is not an exception to this, he explained.

Chief of foreign department of Unified Communist Party of Nepal-Maoist (UCPN-M) Krishna Bahadur Mahara on January 3 talked about the possibility of country facing a "constitutional crisis" following the departure of the United Nations Mission in Nepal (UNMIN) before the completion of its mandate, reports Nepal News. He said this was so because the UN political mission has become an integral part of the interim constitution. Speaking at a programme organised by Maoist aligned Revolutionary Journalist Association in Dhorahi of Dang, he said "The exit of UNMIN without the completion of the army integration task and successful conclusion of the peace process will leave a void that can possibly create a constitutional crisis in the country."

The chairman of the Unified Communist Party of Nepal-Maoist (UCPN-M) Pushpa Kamal Dahal alias Prachanda said on January 10 that his party is prepared to hand over the command control of cantonments to the Prime Minister-led Special Committee overseeing the Maoist combatants before United Nations Mission in Nepal (UNMIN) scheduled departure on January 15, reports Kantipuronline. He outlined three steps that would ensure a smooth transition before UNMIN wraps up. The steps include organising a special ceremony to formally mark the transfer of the chain of command to the Special Committee, the regrouping of combatants into two different categories (those opting for integration and those opting for rehabilitation), and finalising the norms and modalities for integration. Prachanda said he wanted to send a message to the Nepalese and the international community that the Maoists are committed to the peace process.

A top parliamentary panel in Nepal on January 25 approved key changes in the rules for electing a Prime Minister (PM) that would make it mandatory to vote for a new leader in the House poll, amid a deadlock that has left the country without a Government for nearly seven months, Times of India reports. The five-member parliamentary committee headed by Ek Raj Bhandari recommended making it mandatory to vote in a multi-cornered Prime Ministerial poll in the House. Under the recommendations, lawmakers will not be allowed to abstain, attendance will be mandatory, and the Parliamentary speaker will be able to disqualify candidates after three failed rounds of voting. It has proposed termination of the election process if the House fails to elect a PM in the third round of polls. "We have proposed drastic changes to the laws in practice for electing a prime minister. The new provision suggests compulsory voting in favour of one candidate if there are more than one candidates," said Bhandari.

In a report submitted to Prime Minister Jhala Nath Khanal, Chief of Army Staff (CoAS) Chhatraman Singh Gurung has said, a general directorate with up to 12,000 personnel could be formed and deployed for special tasks like border, industrial or forest security and for rescue works in case of natural disasters. In the model proposed by NA, the general directorate will be led by a Major General and will have about 200 officers. The force will be divided into smaller units of about 250 personnel and will be led by Majors. In the proposal NA has specified the issues in which it can show flexibility and the ones in which it cannot compromise. NA has ruled out the possibility of bulk integration. Likewise it has also ruled out the induction of Maoist combatants accused of serious human rights violations, those who fled security agencies and those in central or regional committees of Unified Communist Party of Nepal-Maoist (UCPN-M). However, NA has said, it can show some flexibility in the criteria on education qualification, physical exercises marital status and age bar. Though the UCPN-Maoist has not responded to the NA proposal, the Maoist combatants have said the proposal could become a basis of discussion for the integration process. The commanding level PLA officers at the seventh division camp in Kailali said the integration issue could be resolved if the NA’s proposal is brought under a positive political discussion and some of its points are revised.

Prime Minister Jhala Nath Khanal reiterated that the seven-point deal between the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and the Unified Communist Party of Nepal-Maoist (UCPN-M) was signed mainly with the aim to accomplish these two main tasks. The Maoist chairman’s decision to back-out from the sub-committee under the Constitutional Committee shows that the Maoists are not serious in making the constitution, he said, adding, the UCPN-M must be further pressured to ensure peace and timely statute. President Ram Baran Yadav opined it is not a good idea to endorse the new constitution by a two-third majority without taking the opposition parties - Nepali Congress and the Madhesh based parties - into confidence. He said a consensus among four power groups in the Constituent Assembly (CA) – UCPN-M, Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), Nepali Congress and the Madhesh based parties – is must for stability and sustainable peace. Pun also said he is consulting various donor agencies for support in developing suitable rehabilitation package for combatants who do not want to join the Security Forces (SFs). Four platoons of Nepal Army (NA) with the help of United Nations Mine Action Team (UNMAT) have cleared 45 of the 53 mine fields and plan to clear the remaining mines by mid-June 2011. Among the places where NA is working to clear the mine fields are Aitabare of Ilam, Liwang of Rolpa, Chawang of Pyuthan and Simkhaka of Salyan. In some places the work is yet to start. These include Sillot of Panchthar, Murtidanda of Ilam, Khara of Rukum and Phulchoki of Lalitpur. UN Resident and Humanitarian Coordinator Robert Piper said that UNMAT and the NA will hold a celebration on June 14 to mark the day. During the conflict, NA had reportedly planted 53 minefields, while more than 300 improvised explosive devices (IED) were planted by NA, Nepal Police and Armed Police Force Combined. The UNMAT in coordination with the Communist Party of Nepal-Maoist (CPN-M) and United Nations Mission in Nepal (UNMIN) counterparts is reported to have carried out the demolition of all items in recorded stockpiles of IEDs — a total of 52617 — and other explosive items at all the seven Maoist cantonments. Around 300 people are said to have lost their lives due to mines and explosive remnants after the signing of the Comprehensive Peace Accord in 2006.

Speaking at a programme, PM Khanal stressed that other parties should also make positive efforts in this regard. Stating that time for drafting the Constitution is less than two months, he also said the peace process and statute drafting would reach a conclusion within 50 days if the ongoing efforts go smoothly. “The ongoing peace process and statute drafting process are equally important although at the moment, we have to give the priority to peace process than statute drafting,” he said. PM Khanal also stressed that past agreements must be implemented properly for the logical conclusion of peace process and statute drafting in time and urged the Maoists to do their bit for the two main tasks. During a meeting convened by Constituent assembly (CA) Chairman Subash Chandra Nembang in the evening of April 29 agreed to intensify bilateral and trilateral discussions to thrash out the debated issues, UCPN-M Chairman Pushpa Kamal Dahal aka Prachanda informed after the meeting. A discussion among the members of sub-committee under the Constitutional Committee has been scheduled for May 1, he added. Dahal is the coordinator of the subcommittee formed to resolve the debated issues relating to constitution drafting. Minister for Education, Gangala Tuladhar, has said that peace and constitution are the top priorities of the Government and support and collaboration from the main opposition party NC is a must to meet such goals, according to Himalayan Times. Party leaders said on May 12 they are ready to demonstrate ‘further flexibility’ on the integration and rehabilitation issue to justify the extension of the Constituent Assembly (CA) tenure. Different parties are likely to agree on integrating 8-10,000 combatants, according to an unnamed Maoist leader. Parties are close to deal on the mixed force. The Maoists have demanded that the PLA should be given the leadership of the mixed force. “We will settle the outstanding issues related to integration before the expiry of the current Constituent Assembly term,” said Maoist Standing Committee member Barsha Man Pun, adding, “We are ready to demonstrate flexibility to forge a new agreement.” Pun said they will settle the norms issue soon in consultation with other parties. Fixation of the norms of integration and rank harmonisation are the contentious issues in the integration process. The Secretary General's report on Children and Armed Conflict presented before the UN Security Council on April 23 has included Maoist in the list of 52 armed forces from Asian and African countries that recruit or use children, kill or maim children or commit sexual violence against children during the armed conflict. This is the sixth annual report that has put the Maoists on a watch list for using minors. The Maoists discharged of 2,973 minors from the cantonments in 2010. The discharge process was carried out as per the tripartite action plan that was signed between the Maoists, the Government of Nepal and the UN in December 2009. 2,394 individuals including 1,843 minors were released from the seven main cantonment sites during the formal ceremonies organised between January 7- February 8, 2010 and the "no-shows" were discharged through the sign off process involving the Maoist leadership a month later. The Maoists, however, insist that they have cut links with the "child soldiers" and that the UN has failed to adequately document the discharge of 4,008 disqualified combatants that included minors. "We handed over the disqualified combatants to the UN and suggested them to accept the rehabilitation packages after signing the action plan. They have cut off the links with the PLA," said Maoist Standing Committee member Barsha Man Pun, adding, "The UN's conclusion has deprived us of justice. We will raise our reservations regarding this issue during the upcoming visits of the senior UN officials."

A group of 60 Unified Communist Party of Nepal-Maoist (UCPN-M) cadres from the Chulachuli-based People's Liberation Army (PLA) first division camp of Ilam attacked local people of Kamal Jhoda, injuring at least 12 people, in the night of May 16, reports Kantipuronline. According to the account of the local people, the Maoists had entered the village at around 11pm and launched the attack in seven houses. The Maoists also ‘captured’ five local youths -- Chabbi Subba, Gyanu Limbu, Birhang Limbu, Dipendra Tumbahamphe and Bishal Sunuwar -- and took them to the camp. They were freed 16 hours after they were captured in the afternoon of May 17. Two others, who had gone missing after the incident, came in contact in the morning. The PLA first division owned up the attack but refuted the local people's claim of abducting the five youths. “They were not kidnapped. They were brought to the camp for treatment, as they were injured in the incident,” said Sangram Thapa, ‘secretary’ of the PLA first division camp. Police also said five youths had sustained minor injuries. It is learned that the attack was instigated as an act of revenge, as six PLA combatants were injured in a clash with the local people of Kali Jhoda recently. Meanwhile, the Nepali Congress (NC) claimed that the people attacked and ‘captured’ by the PLA combatants were the cadres of the party.

According to some senior Home Ministry officials, since taking charge of the Home Ministry, Krishna Bahadur Mahara has been asking them to expedite compilation of a list of cases registered against Maoist cadres from courts across the country. “The number of cases registered against the Maoists could surpass 300, according to our preliminary findings. Most of these cases were registered during the insurgency. We have been asked to find the status of the cases pending in various courts,” an official said. This is not the first time that the Maoist leadership has tried to get their party workers off the book. In October 2008, the Maoist-led Government withdrew 349 criminal cases against its cadres, according to official records. In February 2011, the Attorney General Yub Raj Sangraula went on record saying he would oppose any request from the Government for the withdrawal of court cases.

Earlier, saying the issues of integration and rehabilitation of former Maoist combatants should be addressed politically, the UCPN-M, in its proposal sent to the government and the main opposition Nepali Congress (NC), has sought simultaneous development of national security policy, and restructuring plus esoteric “democratisation” of the security bodies along with the task of integration, adds Himalayan Times. In the eight-point proposal, the Maoists stressed on founding a separate structure for their People’s Liberation Army (PLA). “But taking into account the concerns of all sides a unified new force can also be formed,” it said, pointing out border security and natural disaster management as the dominion of the force-to-be-set-up with a PLA dominance. The proposal has envisioned the PLA leadership of the force that will be formed by incorporating 10,000 former fighters and the same number of personnel combinedly from the existing three forces— Nepal Army, Nepal Police and Armed Police Force. For rehabilitation, the proposal has talked about providing a fat purse to the combatants if they choose not to be the part of army integration but prefer joining politics or social sector-- NR 7 lakh up to the post of ‘platoon commander’ and NR10 lakh above it -- under the scheme of “golden handshake.” The handicapped and injured PLA men will also be entitled to the scheme. He said arms and other objects belonging to combatants would be submitted to the Special Committee along with their integration. "It is meaningless to integrate combatants after they are stripped of arms and belongings. All things stored in cantonments will be handed over along with their integration," he said. He refuted media reports that the Maoists are submitting arms. Stating that the arms used earlier to provide security to party leaders' are being collected, Pun said remaining combatants who are deployed for the security of leaders and their arms would reach camps before the party's central committee meeting this month. Pun briefed the combatants on the proposal about their integration. He said that the combatants want 10,000 of them integrated and another 10,000 rehabilitated.

Defence Minister Bishnu Poudel claimed on June 11 that integration of PLA fighters would take place strictly adhering to the Nepal Army’s (NA) integration criteria, Himalayan Times reports. Poudel said since Unified Communist party of Nepal-Maoist (UCPN-M) have in principle agreed to the NA integration proposal, Army integration would be carried out as per NA’s established criteria. “Maoists have lost moral grounds to dispute over criteria and ranks as they have already agreed to accept NA’s chain of command,” Poudel said. He however said a certain level of flexibility could be considered regarding combatants’ age, marital status, academic qualification and trainings while integrating them in the National Army. Ruling out any prospect of integration of Maoist combatants in bulk, Minister Poudel said, “Bulk integration and setting up a separate unit of the combatants is not possible.” Army integration will take place only by maintaining professionalism in the NA, he added. He also said there is no logic in the argument that the combatants would not hand over their weapons before the new constitution is drafted and called on Maoists to submit their arms to the state before August 31. Minister Poudel further said the Government is committed to make the national Army an inclusive institution but added that the demand put forth by Madhesh parties that bulk recruitment from the Madheshi community is impossible to meet.

The leaders, who until recently were coping with ideological dispute, said in one voice that the party will not split under any circumstances. Chairman Pushpa Kamal Dahal aka Prachanda said that he would make every possible effort in his capacity as the party chairman to keep the party unity intact. He vowed to strengthen the party saying that the weakening of Maoists will weaken the nation. Party Vice Chairman Mohan Baidya also claimed the party would not split even if there are ideological differences within the party and said that they would continue the revolution. Stating that the debates and conflicts in the recent times within the party have raised many concerns and questions, he said that conflicts are needed in any institution to improve it. Another Vice Chairman, Baburam Bhattarai, said that ideological debates are important within the party. His statement came at a time when the non-Maoist parties are expressing doubts that the internal rift of the party could hamper the peace and constitution writing process. In the recent formal and informal meeting with the leaders of Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), Prachanda has stated that he could take any decision from ongoing Central Committee meeting despite the hardliner's pressure not to make further concessions on the issues of peace and constitution. Dahal, who has put off the CC meet at least for three days, has intensified intra-party and inter-party consultation to crave party's latest stance on the twin task of peace and statute.
