He said, "The CA has gone to the hands of pro-western and pro-status-quo parties. I urge the UCPN-M to stop wrangling for CA posts and join us." Similarly, speaking at a public program, CPN-M general secretary, Dev Gurung claimed that there is no possibility of enacting pro-people constitution through the CA. "There is still time to forge national consensus through a round table conference. For this, larger parties have to take the initiatives," he said.

Two senior leaders of the UCPN-M on January 1 lodged a written complaint against party Chairman Pushpa Kamal Dahal aka Prachanda, asking him to amend the list of PR candidates, reports The Himalayan Times. Former vice-chairmen duo Baburam Bhattarai and Narayankaji Shrestha have been objecting to the PR list that the party submitted to the Election Commission (EC) on December 30. Shrestha said they lodged ‘a disagreement and protest letter’, mentioning that party Chairman Dahal and his team finalised the PR list violating the criteria set by the recently held central committee meeting. The letter has outlined why they are objecting to the PR list approved by Dahal and his team. Bhattarai and Shrestha have also alleged that the party leadership ignored the dissident voices and that their suggestions were ignored when the PR list was being prepared.

The United Nations High Commissioner for Human Rights (UNHCHR) Navi Pillay issuing a statement from the UNHCHR headquarters in Geneva on January 3 welcomed the decision taken by the Supreme Court (SC) on January 2 against blanket amnesties for crimes committed during the 10-year conflict, reports Nepal News. Pillay said “This is a significant development for the thousands of victims of the conflict. The Supreme Court’s decision to block amnesties is the first step towards ensuring that the Truth and Reconciliation Commission (TRC) will not be used to avoid or delay criminal investigations and prosecutions of conflict-related cases. I now call on the Government of Nepal to urgently implement this important decision, in the spirit of working towards genuine and lasting peace, and to respect the demand of the Nepalese people for justice.”

He said the President would call the CA meeting after the recommendation of the HLPC. "The Government despite accomplishing major responsibility of holding CA election, it can't create dispute at the last moment," he said, reminding that the first meeting of the last CA was called by then Prime Minister Girija Prasad Koirala who was also the head of the State at that time. So, it’s the rule that President should call the CA meet, he argued.

The SC on January 5 issued an order, in which it has instructed the concerned Government authorities to arrange people’s right to ‘no vote’ implying that people can cast ‘negative vote’ during election, reports Nepal News. A division bench of justices Kalyan Shrestha and Prakash Wasti delivered the order responding to a writ petition filed by Bikash Khadka on behalf of Campaign against Crime and Terrorism. As per the apex court order, citizens will have the choice to negatively mark any candidate during election and stamp him/her as ‘unwanted’. Negative voting will not allow the particular candidate to get elected. This provision is expected to reduce crime, corruption and terrorism in politics, as the voters can say ‘no’ to those whom they do not like to see as their representatives.

Home Minister Madhav Prasad Ghimire on January 8 called on Nepali Congress (NC) President Sushil Koirala at the latter's residence in Kathmandu saying that his Interim Election Government is eager to hand over power to the political Government, reports Nepal News. During the meeting, Home Minister Ghimire urged Koirala to form a new Government at the earliest and begin preparation for the same. Koirala, in return, congratulated the Home Minister for successfully conducting the CA elections. Being the chairperson of the largest party, Koirala is likely to lead a coalition Government.

The Comprehensive Peace Agreement had envisaged the commissions within six months of its signing in 2006. After two earlier attempts by the Unified Communist Party of Nepal-Maoist (UCPN-M)-led government, the present coalition of the Nepali Congress (NC) and the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) finally drafted the bill that was passed by a majority in Parliament. The bill has now become an Act, but the provisions of amnesty and reconciliation remain controversial. Party chairman Pushpa Kamal Dahal aka Prachanda informed the party Central Committee (CC) meeting that party leaders decided to hold election after efforts to settle the leadership row at the CC meeting failed to make any headway. “We have decided to hold vote for the vital posts as several leaders are contending for the same posts. Party chairman informed the CC meeting that the election to these vital posts would be held on Saturday (May 24),” party leader Lokendra Bista said. The party has not yet finalized the number of office bearers. Party statute will be endorsed by the CC meeting prior to holding the election. Two reports on state restructuring prepared by the Committee to Study and Determine Constitutional Records and the High-level State Restructuring Commission provide agenda for discussion among the CA members. The committee is entrusted to prepare reports on the basis of the progress made by the previous CA while the commission was an experts' panel formed in 2011 to suggest ways to federate the country. Submitting both the documents to the CA, Committee Chairperson Bishnu Poudel requested Assembly members to provide their suggestions and comments on federalism. There are several disputed issues related to federalism such as the number, name and demarcation of provinces which led to the dissolution of the first CA without delivering a constitution. Unified Communist Party of Nepal-Maoist (UCPN-M) Chairman Pushpa Kamal Dahal aka Prachanda claimed that it would be very unfortunate for the country if the Nepali Congress (NC) and other ruling parties insisted on deciding the contentious issues in the new constitution through voting in the Constituent Assembly (CA), reports Republica. Prachanda said that these contentious issues in constitution-making should be settled through consensus among the political forces and the new statute should be produced mainly on the basis of the historic 12-point agreement signed between the then Seven-Party Alliance and the erstwhile Communist Party Nepal-Maoist (CPN-Maoist), the Comprehensive Peace Agreement-2006 and the Interim Constitution-2007. "If the spirit of these historic political accords, including the 12-point agreement, the CPA and the Interim Constitution, is trampled upon and the contentious issues decided through voting on the ground that this is mandated by CA procedures, it will be a biggest blunder for the country," Prachanda said while addressing the CA meeting on May 29. Prachanda said that the NC and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) leaders started insisting on deciding the major disputes through voting only after they emerged as the two largest parties through the second CA election. "I had proposed in the previous CA to decide such disputes through voting. But at the time it was rejected, arguing that there would be blood on the floor if this was done," said Prachanda. "But now the leaders of the same parties have been pushing for voting. Such an approach will push the country into crisis."

Reaching a consensus by the September 6 deadline may appear difficult, but the parties are making progress towards forging consensus, the leaders claimed. A source privy to the development said that all parties seem ready to make compromise, mainly on forms of governance and federalism. According to a leader, Unified Communist Party of Nepal-Maoist (UCPN-M) leaders have hinted that they could accept an eight-province model of federalism from their current position of 10 if the ruling parties agree to address the issue of ethnicity-based federalism. The ruling parties, which are pushing for seven provinces, may ultimately agree on eight provinces, the leaders said. The Madhesi parties have already agreed on two provinces in Madhes.

Singh is on a visit to Kathmandu for South Asian Association for Regional Cooperation (SAARC) summit in Nepal. An official statement released by his office said, "The Indian HM (home minister) expressed his concern on the growth of religious fundamentalism in the border areas." Intelligence agencies have been warning for the past few years that a string of madrasas (Islamic seminary) coupled with large-scale settling of Muslims has been systematically taking place in Nepal along its border with India. These colonies, says security establishment sources, are being tapped by ISI for anti-India activities. Singh also appreciated the efforts of Nepal government in dealing with trans-border crimes and underlined the need for more focused effort to control the activities of criminal elements, terrorists and other Indian insurgent groups along the Indo-Nepal border. "He expressed concern on the smuggling of fake currency notes and human trafficking. Talking at a CPDCC meeting, Dahal said that the NC - CPN-UML joint proposal on the main sticking points for the content of the new constitution could not be presented to the CA. If the coalition wants to go ahead with two-thirds majority and present their proposal to the CA, they would have to replace the CPDCC chair before they could proceed, Dahal warned NC and CPN-UML leaders. While NC and CPN-UML kept the pressure in CPDCC meeting to have their proposal sent to the CA, leaders of UCPN-M and Madhesh-based parties kept challenging them to issue the constitution using their majority if they dared. They said there was no alternative but to promulgate the constitution through consensus and stressed on working towards an agreement. After receiving a memorandum for a timely delivery of the new constitution from the Federation of Nepali Journalists (FNJ) Lalitpur Chapter in Kathmandu at his residence, Bhattarai underlined the problem created by the widening polarization among the parties. He underscored the constitution making as a subject which could not entertain majority and minority voting process while stressing on agreement as the only resolution for the rising dispute. Oli argued that issuance of an updated version of the Interim Constitution-2007 can be better for the country than further prolonging deadlock in the constitution making process. "When it comes to constitution writing, we are not in a void. We have a functioning interim constitution. We can issue new constitution by making necessary updates to the interim statute," CPN-UML leader Shankar Pokharel quoted Oli as saying at the meeting. While briefing the meeting on the progress made in interparty negotiations, Oli said that the party´s first priority is to resolve the key contentious issues in consensus with other major political parties. Union Ministry of Home Affairs (UMHA) is working on a proposal to double the strength of the intelligence wing of Sashastra Seema Bal (SSB) and give it state-of-the-art technical intelligence tools, to effectively counter terror activities mounted by Pakistan from Nepal, The Times of India reports on December 18. SSB, which guards the porous Nepal and Bhutan borders with India, is the only paramilitary unit to have a full fledged intelligence wing. Sources said the idea is to shore up SSB's capabilities to effectively guard entry of Inter-Services Intelligence (ISI) backed terrorists and monitor the activity of ISI in fast mushrooming madrasas (Islamic Seminary) on the border. It would also help the force counter activities of north-east insurgents on the Bhutan border. SSB Director General B D Sharma said, "Intelligence is our biggest weapon when it comes to securing the open and porous borders with Nepal and Bhutan. These are sensitive borders. We have sent to the government a proposal in this regard as we seek to revamp our snooping infrastructure." He added, "We want to excel in intelligence-related works because at these two unfenced frontiers it is only 'good information' that can help secure the area from illegal elements".

Speaking at a human rights program in Bhaktapur on December 20, Bhattarai said it is not important as to whether the constitution would be promulgated on January 22 or February 22, but the main thing is to ensure that the constitution would be good enough. “Until there is an understanding on the issues of federalism, form of governance, electoral system and identity, a constitution cannot be brought into effect,” Bhattarai said. “Nepali Congress and CPN-UML are more concerned about issuing a constitution on January 22, 2015. A meeting of Unified Communist Party of Nepal-Maoist (UCPN-M) and Madhesi Front on December 21, decided to launch protests, alleging Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) of moving ahead ignoring demands of the opposition parties, reports Nepal News. The meeting has formed an 11-member task force under the leadership of UCPN-M leader Krishna Bahadur Mahara. The task force has to finalize protest plans by December 22, and submit it to the joint Front of UCPN-M and Madhesi Front on December 23. “The task force will form common concept on four disputed issues – federalism, form of governance, electoral system and judiciary,” said Rajendra Mahato, chairperson of Sadbhawana Party, after the meeting. “The protest plan will include programs both in and outside the Constituent Assembly.”

While the ruling parties are for promulgating new statute by January 22 even it calls for voting process in the CA, opposition parties have maintained that consensus efforts should be continued until there is consensus among all parties on constitutional issues. Speaking at a debate organized by the Federation of the Nepalese Chamber of Commerce and Industry (FNCCI) in Kathmandu on December 22, the opposition parties even warned that failure to promulgate new statute through consensus will invite fresh conflict in Nepal. “We are ready to move ahead with consensus to bring new statute. But how long should we wait as our efforts in the Constitutional Political Dialogue and Consensus Committee (CPDCC) have so far failed to yield any result?” asked Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Vice Chairman Bhim Rawal. Rawal argued it would be tantamount to undermining the mandate given to the CA by the Nepali people if this CA also failed to produce a new constitution under the pretext of consensus. Nepali Congress (NC) Vice President Ram Chandra Paudel alleged that opposition parties were interpreting consensus to suit their own interests. “Opposition parties have to either be flexible to reach consensus or they should agree on a process [to promulgate new statute]. It is not good to block both consensus and voting processes in the CA,” he said. Paudel said although the Unified Communist Party of Nepal-Maoist (UCPN-M) leaders walked out of the meeting on December 20, the ruling parties will continue negotiations with the opposition parties as last-ditch efforts to bring the new statute in consensus. “We are committed to addressing concerns of all groups. Let´s resolve the dispute related to constitutional issues in a practical manner,” Paudel said.

Inaugurating the 41st general convention of Nepal Jaycees in Banepa of Kavre, Koirala said Nepal cannot afford as many as seven Pradeshes once it adopts the federal structure.
