Prime Minister KP Sharma Oli draws flak for dissolving the House of Representatives (HoR) during the first meeting of the seventh session of National Assembly on January 1, reports The Himalayan Times. Nepali Congress (NC) lawmaker Jitendra Narayan Dev termed the dissolution of the HoR as an unconstitutional and undemocratic act, while Janata Samajwadi Party-Nepal (JSP-N) lawmaker Pramila Kumari termed it as a repeat of royal coup d’état staged by the then king Mahendra against the constitution. The Election Commission (EC) has amended its rules to formalize the split in the ruling Nepal Communist Party (NCP), reports The Himalayan Times on January 5. Earlier rules didn’t allow the poll panel to recognize a split in a party after announcement of General Elections. After amending its rules, the EC can now decide which faction of the NCP is authentic and which should register with the poll panel under a new name. Spokesperson for the EC Raj Kumar Shrestha said the amendment meant that the EC could hear claims and counter claims of parties’ factions about who should use the original party’s name, flag, and election symbol during the election. According to Shrestha, previous rules prohibited the EC from recognizing a splinter group as a new party even after it submitted signatures of 40 per cent of Central Committee members and the Parliamentary Party.

Four former Chief Justices of the Supreme Court issuing a joint statement on January 8 stated that Prime Minister (PM) KP Sharma Oli’s move of dissolution of House of Representatives (HoR) was an unconstitutional act, reports The Himalayan Times. Former Chief Justices Min Bahadur Rayamajhi, Anup Raj Sharma, Kalyan Shrestha and Sushila Karki concluded that the House was dissolved stepping on articles that are not provisioned by the Constitution. “Other than rights that are clearly authorized by the Constitution, it does not appear that such rights can be created, assumed or can be said to be held to dissolve the House of Representatives,” the justices said in the statement.

Prime Minister KP Sharma Oli on January 9 reiterated that he had to dissolve the House of Representatives (HoR) due to lack of cooperation within the party for Government’s work in favor of the people, reports The Himalayan Times. Addressing a gathering of Nepal Communist Party (NCP) cadres close to his faction, organized by the party’s youth wing Rastriya Yuva Sangh Nepal in the capital Kathmandu city, Oli stated that the other faction was hindering the implementation of constitution and creating obstacles in appointments to the constitutional bodies. “The government was prevented from working, from making laws, and the parliamentary committee created problems for the government by obstructing submission of bill in the parliament. Therefore, I announced the mid-term elections to move forward by taking a fresh mandate as the country could not do so in the expected pace,” said PM Oli.

Thousands of supporters of the Nepali Congress (NC) on January 9 staged demonstrations in all 330 provincial constituencies against dissolution of the House of Representatives (HoR), reports The Himalayan Times. Addressing a mass at Budhanilkanta, Kathmandu, NC President Sher Bahadur Deuba urged all to join hands with the NC as the communist parties had not been able to meet people’s expectations. He, however, also said it was not a democratic practice to exert pressure on the Supreme Court from the streets to give verdict in one’s favour. Deuba said, “Nepali Congress is a party that follows moral values. We believe in rule of law and the court. We shall wait for the SC’s verdict. We will abide by the decision of the court.” He further said that people’s verdict was above the SC’ verdict, so it would be alright to go to elections and seek their mandate. He however, also said that if Oli wouldn’t hold elections on the given date, the NC would throw out the PM through protests.

Chairpersons of Nepal Communist Party (NCP) Pushpa Kamal Dahal and Madhav Kumar Nepal went to the Election Commission (EC) on January 11 and urged the poll panel to stop preparation for mid-term polls, reports The Himalayan Times. NCP leader Krishna Bhakta Pokharel, who accompanied Dahal and Nepal to the EC, said the EC was told that dissolution of the House of Representatives (HoR) was sub judice and the poll panel should stop its ‘meaningless’ preparation for the mid-term polls. NCP Standing Committee member Lilamani Pokharel said his party leaders also asked the EC why it continued to recognize Prime Minister KP Sharma Oli, who had already been removed by his party from the post of co-chair of NCP. Dahal and Nepal also wondered why the EC entertained the document submitted by Oli notifying it that his faction had amended the party statute and added new members to the Central Committee. “Our party statute stipulates that any amendment can be made only by the majority members of the Central Committee. We have the majority. How can Oli, who is in minority, amend the party statute?” Lilamani Pokharel wondered.

The Election Commission (EC) on January 11 refused to stop preparation being made for holding the midterm election scheduled for April 30 and May 10, reports Republica. Puspha Kamal Dahal and Madhav Kumar Nepal led-faction of Nepal communist Party (NCP) had asked the election body to stop the preparations being made for holding the elections arguing that cases against the dissolution of Parliament are still sub-judice at the Supreme Court. The EC has maintained that the election body is obliged to make preparation for the election as the election date has already been announced by the Government. “It is our duty to make necessary preparations and we won’t stop it until the apex court orders us to do so. The EC is acting as per the law,” senior officials at the commission said.

Lawyers representing the petitioners on January 17 said the Prime Minister has no power to dissolve the House of Representatives (HoR), reports The Himalayan Times. Advocate Bhimarjun Acharya said that the Prime Minister has no power to dissolve the HoR and as per the constitutional provision the House could be dissolved only after exhausting all options listed in Article 76 regarding formation of the Government. Acharya said there were only two conditions under which the HoR could be dissolved — on the expiry of the five-year term of the HoR or when a coalition of parties fails to appoint a PM or the PM appointed by them fails to obtain a vote of confidence. “This does not mean that the PM can recommend dissolution of HoR at his will,” he argued. Advocate Sunil Pokharel wondered how the PM, against whom the HoR could not move a no-trust motion for the first two years, dissolved the HoR in 17 minutes. Pokharel said as per the constitution only the PM formed under Article 76 (5) of the constitution could recommend House dissolution under Article 76 (7).

The EC held discussions with 11 political parties represented in the HoR, provincial assemblies and local level and requested them to update the voter list for the election and assist in determining the polling stations. Representatives of both factions of the Nepal Communist Party (NCP) were present at the meeting. The NHRC reiterated that Article 20 of the Universal Declaration of Human Rights-1948, Article 21 of the International Covenant on Civil and Political Rights 1966 and Article 17 of the Constitution of Nepal have ensured the right to freedom of opinion and expression and to assemble peaceably and without arms. “The use of excessive force goes against the national and international laws,” reads the statement. “The commission urges the government to be sensitive in this regard.” The rights body also drew the attention of the Government not to violate, under any pretext, the citizens’ fundamental right to freedom of expression.

Arguing on behalf of the petitioners who have challenged the PM's move to dissolve the House, Shrestha said Article 76 (7) gave the PM the power to dissolve the House when the new government could not be formed but in this case the power was exercised by the PM and hence the dissolution of the HoR was unconstitutional. Similarly, Bidari said that Articles 76 and 100 were incorporated with the main aim of maintaining checks and balance between the legislature and the executive and the PM's move to dissolve the HoR had rendered these articles inactive. The outlawed Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand), the Nepal Communist Party-Revolutionary Maoist (NCP-Revolutionary Maoist) led by Mohan Baidya, Nepal Communist Party led by Rishi Ram Kattel and the Scientific Socialist Communist Party led by Bishwabhakta Dulal formed a front after a joint meeting. The objective of the joint front between the parties is to establish a people’s republic and the scientific socialist system by ending the ‘reactionary parliamentary system’ and state power, they said in a joint statement. The names of 12 people including CP Gajurel, Rishi Ram Kattel, Jagrat Rayamajhi, and Dhan Kumari Sunar have been made public in the Central Committee. The parties have also decided the programs of the first phase of the struggle. They have stated in a statement that they will hold rallies in Butwal on February 18, Dhangadhi on February 26, and Itahari on March 2 and will make public the programs of the second phase of the struggle after the first phase.

Senior Advocate Geeta Pathak Sangroula, who appeared before the constitutional bench of the Supreme Court as an amicus curia on February 19, argued that the Prime Minister did not have prerogative to dissolve the House of Representatives (HoR), reports The Himalayan Times. She said the Prime Minister did not fulfil the preconditions stated in Article 76 (7) before dissolving the HoR.Article 76 (7) stipulates: In cases where the Prime Minister appointed under clause (5) fails to obtain a vote of confidence or the prime minister cannot be appointed, the president shall on recommendation of the Prime Minister, dissolve the HoR and fix a date of election so that the election to another HoR is completed within six months. Poudel also accused Oli of harbouring arrogant ideas and policies. "People had handed majority vote to the Nepal Communist Party (NCP). Oli squandered that mandate and dashed people's hopes and aspirations," Paudel added. He charged that the PM and President Bidya Devi Bhandari's unconstitutional and undemocratic move had put the constitution into jeopardy. This way, the money reaches Kashmir Valley without leaving any electronic trail and thus agencies fail to track the transaction”.The security agencies found an empirical evidence of the ISI’s nefarious design when Bihar Anti-Terror Squad (ATS) arrested a local youth on the basis of input provided by J&K Police, who was alleged to have carried cash and at least seven pistols and handed them over of a Kashmir-based youth, who he had befriended during his stay in Aligarh District of Uttar Pradesh.The youth from Kashmir was earlier arrested after it emerged that he had given guns to Hidayatullah Malik, who was arrested on February 6 by Anantnag Police from Kunjwani area of Jammu.The intelligence report, contended that local youths from Nepal’s border Districts with Uttar Pradesh and Bihar are at times unknowingly get into the trap of militants, aided and supported by ISI, and become “cash couriers”.According to rough estimates in each of such transactions an average of INR 300,000 to INR 350,000 is transferred to over ground workers of terror outfits in Kashmir by these unsuspecting youths, who, in most cases, are not aware that they become part of a terror network, the report said.

Communist Party of Nepal-Unified Marxist–Leninist (CPN-UML) has passed the amended statute of its Parliamentary Party, on March 20, reports The Himalayan Times. The amendment was passed by the CPN-UML's Parliamentary Party meeting held at the official residence of Prime Minister KP Sharma Oli in Baluwatar, Kathmandu. The Parliamentary Party, on March 18, had formed a three-member taskforce to amend the party's statute. The task force - coordinated by CPN-UML Chief Whip Bishal Bhattarai and comprising lawmakers Sher Bahadur Tamang and Bimala Rai Paudel as its members - presented a proposal for the statute amendment. The meeting approved the proposal, giving a green signal for the statute amendment. According to Chief Whip Bhattarai, the statute which was formed in 2072 BS, five years ago, required amendment as it had become outdated. He added that as per the amended statute, any lawmaker belonging to the party who works against party decisions and welfare can be suspended for a maximum period of six months, among other provisions.

Netra Bikram Chand, General Secretary of Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) on March 22 urged the Government to expedite the release of their party leaders and cadres currently serving jail terms, reports Republica. During his meeting with Prime Minister K P Sharma Oli at the latter’s office in Baluwatar, Chand complained that the process to release his party cadres and leaders was slow even as there was an agreement reached between the Government and his party to release all the party leaders and cadres at the earliest. The Government and the CPN-Maoist-Chand on March 5 had signed a three-point agreement with the Government, renouncing violence as a means to achieve its goals. The Government had expressed a commitment to release all its political leaders and cadres unconditionally as a part of the agreement. During the one-hour-long meeting, Prime Minister Oli had said that the Government had already initiated the process to release their arrested leaders and cadres. Chairman Chand had said that there were a total of 148 party leaders and cadres still serving time in various jails across the country.

She has been waiting for impartial investigation and prosecution of the perpetrators for the past 16 years. Arjun was abducted by cadres of the then Communist Party of Nepal-Maoist (CPN-Maoist) on April 29, 2005. Although the Maoist party initially denied it had any role in the abduction, it reported that he died in an aerial attack of the Nepali Army while he was held captive by the Maoists. However, there is evidence to show that he was tortured to death by Maoist cadres. "Maoist cadres Agni Prasad Sapkota, Suryaman Dong, Yadav Poudel, Bhola Aryal, Karnakhar Gautam, and Norbu Moktan were allegedly involved in Arjun's killing," said Advocacy Forum-Nepal in a press release. Despite the Supreme Court order requiring impartial and prompt investigation, no investigation has been carried out in the case. On the contrary, despite the pending Police arrest warrant, Sapkota was promoted. Now he serves as the speaker of the House of Representatives. Despite an outstanding warrant for his arrest in relation to the abduction and murder, Constitutional Assembly Member Dong was appointed as the Minister of Energy in 2011. Advocacy Forum-Nepal has called upon the Government to Implement the Supreme Court's order to investigate and prosecute the perpetrators, enact laws that prevent those alleged perpetrators of human rights violations from serving in public posts, immediately amend the TRC Act and make it functional and establish the special court.

Addressing a virtual even organized to mark the 30th establishment day of Nepal Press Union in Kathmandu, he alleged that both Bhandari and Oli had grossly violated the constitution. "We approached the president with the signature of majority of lawmakers after she called on political parties representing the HoR to stake their claim on the prime ministerial post in accordance with Sub-article (5) of Article 76 of the constitution. But the president did not appoint the person, who commanded majority, as prime minister. Instead, she dissolved the HoR overnight in collusion with Oli. Had she doubted the signature of majority lawmakers, she should have asked the signatories to present themselves physically. The Constitutional Bench headed by Chief Justice Cholendra Shumsher Rana has asked the defendants to furnish in writing the reason behind dissolving the House on May 21. The bench issued the show cause notice after hearing opening arguments from the petitioners and defendants. The final hearing process will begin from June 23. We wish we could revise the transitional justice Act as directed by the Supreme Court, but the government alone cannot do it,” the Minister said. On February 26, 2015, the Supreme Court had directed the Government to amend around half a dozen provisions in the Enforced Disappearances Enquiry, Truth and Reconciliation Act, 2014 - the provisions that allowed amnesty even in cases of serious human rights violation. Amending the Act is a must to prosecute the incidents of serious crimes and human rights violations that were perpetrated by the Maoist rebels and the state security forces during the decade-long Maoist insurgency.

Earlier, 136 political parties were registered at the EC. The EC dismissed 41 political parties after they failed to submit audit reports for three consecutive years. The EC has maintained that Names, Flags and Symbols used by these parties cannot be used by any other political parties for one year. According to EC Spokesperson Raj Kumar Shrestha, the EC has scrapped these political parties and office bearers of their working committee have also faced action. These parties will now need to file Rs 50,000 each. "In order to prevent the central office bearers and members of the dismissed parties from becoming office bearers of other parties for a period until the fine is collected, it has been decided to proceed with the proceedings in accordance with the law only after registering a new party and updating the existing parties," said Shrestha. The EC had earlier sought clarification from 86 political parties failing to submit audit reports for three consecutive years.

The Election Commission (EC) on August 9 updated the record of 35-member executive committee of the Janata Samajbadi Party-Nepal (JSP-N) recognising Upendra Yadav as the only party chair, reports The Himalayan Times. Spokesperson for the EC Raj Kumar Shrestha said Mahantha Thakur was not listed as the party's co-chair among its 35 executive members. JSP-N leader Ram Sahay Yadav said the party had demoted Thakur to a general member after he went against the party's decisions. The EC updated the party's record after the JSP-N made changes to the 51-member executive committee removing supporters of Mahanatha Thakur and Rajendra Mahato. On July 27, the EC gave authenticity to Upendra Yadav-Baburam Bhattarai faction of the party after 34 members of the party's 51-member executive committee supported the faction during the support verification process. Only 16 members of the executive committee had supported the Thakur-Mahato faction.

Referring to the remarks of Minister of Foreign Affairs during the 76th session of the United Nations General Assembly (UNGA) on September 27 in New York, the organisations said, "We hold that successive governments of Nepal have long continued to merely pay lip service and make false commitments to the transitional justice process at international forums including that of the UN. And it is our belief that Minister Khadka's recent remark at the UNGS is just a continuation of those empty promises." In the UNGA, Minister Khadka had said that Nepal was committed to conclude the transitional justice process through the Truth and Reconciliation Commission and the Commission of Investigation on Enforced Disappeared Persons and that there would be no blanket amnesty in cases of serious violation of human rights.

Speaker of the House of Representatives (HoR) Agni Sapkota on October 13 urged the main opposition party, Communist Party of Nepal-Unified Marxist-Leninist (CPN-UML), to come to the negotiation table to resolve the deadlock seen in Parliament, reports Republica. Arguing that there is no alternative to negotiation to ensure smooth functioning of the Parliament, Speaker Sapkota maintained that all parties represented in the Parliament have equal responsibility to enhance dignity of the Parliament. The next meeting will be held at 1 pm on November 15. As soon as the meeting of the HoR commenced today, CPN-UML lawmakers obstructed the meeting by chanting slogans against Speaker Agni Sapkota. The CPN-UML lawmakers picketed the well of the lower house shortly after Speaker Sapkota commenced the meeting proceedings. Minister Khand reiterated that the Government was committed to ensuring durable peace in the country by concluding the peace process through continuous dialogue and discussion with all political parties. It was informed at the press meet that homework was under way to withdraw the cases filed against leaders/ cadres of the CPN-Maoist-Chand and release them in a lawful manner. The homework is being done jointly by the Office of Attorney General, Home Ministry and Law Ministry to identify the cases and condition of the detainees, Minister Khand said, adding, "There has been agreement to discuss in a focused way to carry forward the talks."

He said that system of governance should be decided by the people through a referendum — whether they want scientific socialism or a system ruled by the bourgeoisie. “If the Nepali Congress and the other parties in the government are democrats, that’s fine. We want to face the elections once,” he said. Biplav also said that the country should go for a referendum so that people would be able to decide their own fate. They have demanded that no amnesty be granted for serious offences committed during the decade-long Maoist insurgency. Devi Sunuwar, mother of Maina Sunuwar who was killed by security personnel in Kavre during the Maoist insurgency, said Kavre District Court had awarded life term to the members of the Nepali Army who were found guilty, but ironically, she was dragged into a case by the Nepali Army for seeking justice. "We have lost everything in our long battle for justice. We have lost our loved ones and family members in the course of seeking justice, but we have not got justice," she lamented at a stakeholders' consultation meeting on Universal Periodic Review (UPR) organised by Forum for Women, Law and Development. She said none of the political parties had shown sympathy and seriousness towards the plight of conflict victims. Chair of Conflict Victims Common Platform (CVCP) Gopal Bahadur Shah said the UPR had been expressing serious concern about Nepal's failure to ensure justice for conflict victims, but the government was doing nothing to address the concerns of conflict victims. Similarly, Executive Director of Forum for Women, Law and Development Sabin Shrestha said UPR participants had shown serious concern about Nepal's failure to ensure justice for conflict victims.
